HomeMy Public PortalAboutResolution 01:267No. -267 Date of AdoptkmAUGUST 16,2001 APPROVING DRUG TESTING POLICY- POLICE DEPARTMENT WHEREAS, the New Jersey Attorney General's Office ha/ promulgated the Attorney General's Law Enforcement Drug Testing Policy, issued October 1986 and revised August 1990 and September 1998; and WHEREAS, said policy sets l¢orth the guidelines for drug testing of applicants for a position as a law enforcement officer, law enforcement officer trainees, and sworn law enforcement officers at municipal, county and state law enforcement agencies, including the Carteret Police Department; and WHEREAS, the Middlesex County Prosecutor's Office has taken the Attorney General's guidelines and formulated the Middlesex County Law Enforcement Officer Drug Testing Policy and Procedure to be adopted by law enforcement agencies throughout the County seeking to implement a drug testing policy for its applicants, trainees, and sworn law enforcement officers; and WHEREAS, the Mayor and Council recognize the vital role the Borough's police officers perform in maintaining and protecting the health, safety and welfare of the residents of Carteret and the tremendous threat to public safety posed by a police officer acting under the influence of drugs, as well as the compelling interest the Borough has in ensuring that its drug enforcement authorities are themselves drug free; and WHEREAS, in light of the foregoing findings, the Mayor and Council declare that the implementation of a comprehensive law enforcement officer drug testing policy and procedure in accord with the Attorney General's guidelines as set forth in the Middlesex County 'Drug Testing Policy will help to promote and protect the public health, safety and welfare of the community; and WHEREAS, the Attorney General's guidelines require that any random drug testing program or reasonable Suspicion drug testing provision for municipal sworn law enforcement officers be included in the municipal law enforcement agency's rules and regulations as defined in N.J.S.A. 40A: 14-118. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret that 1. The Middlesex County Law Enforcement Officer Drug Testing Policy and Procedure is hereby approved for implementation by the Carteret Police Department. 2. The Police Committee, as the "appropriate authority" pursuant to N.J.S.A. 40A:14-118, is hereby adv{sed to adopt and incorporate the aforementioned drug testing policy and procedure into the "Rules and Regulations for the Police Department of the Borough of Carteret" in accordance with the authority set forth in Section 42-3A of the Carteret Code.
