The following guests attended. the meeting: Councilman Derrick Spicer, Eric Landwehr, Jessica Steinmetz, Mel Steinmetz, Bonnie Steinmetz, and Harry Otto. 1) Introductions No formal introductions were made at this time. 2) Approval of the October 13, 2022 Committee meeting minutes Councilman Spencer requested the minutes be amended by adding "Councilman Spencer requested Committee members to participate in the subject deeper." Councilman Lester moved and Councilman Schreiber seconded to approve the October 13 minutes with Councilman Spencer's amendment, motion carried. Chairman Fitzwater requested to move Item 3.4. to the top of the agenda. Minutes/Jefferson City Public Works and Planning Committee November 10, 2022 3) Business 4. Cole County Roadway Corridor Projects-Militia Drive and Wildwood (Eric Landwehr) 2 Mr. Landwehr gave a presentation on the projects. He stated the Wildwood Drive extension became a City/County Cooperative Project in 2012. There has been recent discussion with affected property owners and they are on board. This project could be ready for construction in 2024. The Militia Drive extension is a possible location for a future Hwy 179 connection to the east or connection to Route M. Recent conversations with city and county leaders and property owners have brought this idea to the forefront. There was discussion among Committee members, staff and those present regarding funding, priorities, and multi-modal transportation projects. 1. Basin 10 Sanitary Sewer Improvements with CCPW in Westview Subdivision (Eric Seaman) Mr. Seaman explained Cole County Public Works will be improving streets and stormwater in the Westview Subdivision in 2023. By bidding the City's sanitary sewer improvements with Cole County's work will be construction cost savings in traffic control and restoration. Staff recommends a design contract with Bartlett and West, Inc. to take advantage of these savings. Councilman Kemna moved and Councilman Schreiber seconded to refer the contract to the City Council with recommendation to approve. 2. Sign C.ode Update (Matt Kreyling) Mr. Kreyling explained staff is wanting specific direction of the requests pertaining to the Advertising and Sign code . •. There was discussion among Committee members and staff regarding temporary sigmige .. .and feather flags. Chairman Fitzwater requested Councilman Spencer coordinatE! with staff on changes to the code. 3. CDBG Policies and Procedures Manual Resolution (Rachel Senzee) Ms. Senzee explained this is the last year for this plan and a new plan will be presented in 2024. Ms. Stratman stated the plan needs approval by the Council effective January 1 , 2023. Councilman Kemna moved and Councilman Lester seconded to refer the resolution to the City Council with recommendation to approve, motion carried. 5. Annexation (Councilman Spencer) Minutes/Jefferson City Public Works and Planning Committee November 10,2022 3 Councilman Spencer requested to discuss any areas for potential growth within the City. There was discussion among Committee members and staff regarding areas of potential growth for the City, properties must be contiguous, the need for an Annexation Committee, concern with fire response times, the annexation plan done in 1996, and property owners are required to sign a voluntary annexation form for sewer outside the city limits. Councilman Spencer moved and Councilman Lester. seconded to recommend the City Council put together an annexation committee to r&Siiew annexation, motion carried. 4) Citizen opportunity to address Council/$taff on Stormwater and Other Public Works Issues) Councilman Fitzwater requested Committ~e members review the parking study for the work session on Monday evening. 5) Reports: Neighborhood Service Grant Update• (~achel Senzee) Ms. Senzee gave an update on the grants. She explained staff is continually looking for opportunities for use of grant funds. She stated this item will be a continual agenda item to update the public about funding opportunities, give .CopQcil the information to provide their respective constituency, and provide information to support,'budgetary decisions. 5 Capital Area Active Transportation Plan Update (Katrina Williams) 0 ~ '' Ms. Williams explained the public meetings for the Transit Fare Increases public hearings, one which was held last evening and another is scheduled for November 17 from 9-11 a.m. She ~~,ated .a public survey will be open through December 9. The results of the public survey and:'apublic meeting will be reviewed by City Council. Ms. Williams then explained the new plan will integrate the existing plan (Capital Area Pedestrian and Bicycle plan from 2016 with the new plan. Staff received over 763 surveys during the first round of engagement. Between December 1 and 2, there will be three opportunities to participate in a Walk-Audit in the Southside/Old Munichburg neighborhood. 6) Adjourn Councilman Kemna moved and Councilman Lester seconded to adjourn the meeting at this time (8:54 a.m.), motion carried. Smith, P.E.~ Parking Division Updates Staff request the committee's concurrence for staff to purse a scope and fee negotiation with Structural Engineering Associates to develop bid specifications for repairs to the Jefferson Street parking deck as well as repairs to Level 4C of the Main Garage. The project is envisioned to include: 1. Precast panel repair; 2 . Waterproof membrane and drainage improvements; 3. Guard cable repair to the lower level; 4. Miscellaneous corrosion and concrete repairs to the stair towers; and 5. Pre-stressed cable repair in the Madison Street Garage . The initial phase will establish the base conditions at the site and explore a number of possible bridge options. These options will include both the bridge structure and possible alternate termination points on the project's eastern end. From these options three w ill be chosen for further exploration which will including roadway geometry, creek impacts and hydraulics , and high-level cost estimates . Input on these options will be sought from stakeholders, the Ste of Missouri , elected officials , and the public. The feedback will be evaluated and will be used to inform the decision as to the preferred concept. Once a concept is chosen typical sections will be developed as will plan and profile drawings of High Street and Missouri Boulevard. Bridge elevation drawings will also be produced as will a cost estimate. As the total funding for this project has not been identified the proposal also contains an allowance of Bartlett & West to help with the application for grants if that were to be part of the funding mechanism . Barring significant changes staff would anticipate bringing this in the form of a design contract to the to the Council for a first reading on December 19, 2022 . SCOPE OF SERVICES GENERAL BACKGROUND The High Street Viaduct bridge in Jefferson City is deteriorating and needs to be replaced. As part of the bridge replacement, additional work at the bridge ends may be included. The initial phase of design is focused on developing a concept for the new bridge. This phase will include investigating multiple options to arrive at a recommended solution that considers feedback from key stakeholders. The solution will define the bridge type, size, typical section and aesthetic treatments, along with associated roadway improvements. The first phase will include a conceptual evaluation of hydraulics along with some key stakeholder meetings as better defined in the detailed scope. This phase also includes some assistance in helping the City apply for grants for the project. Subsequent phases are expected to include preliminary and final design. TASK 1 -INITIAL CONCEPTS ($9,750 Lump Sum) 1.1 Collect data and prepare project base map. 1.2 Site visit to review surrounding infrastructure and potential impacts. 1.3 Develop marker-level sketch of initial concepts. 1.4 Develop initial bridge typical section options that consider bridge width, railing and lighting. 1.5 Meet with the city staff to brainstorm initial concepts and narrow down to three to move forward. TASK 2-REFINED CONCEPTS ($82,750 Lump Sum) 2.1 Refine bridge typical section. 2.2 Develop initial bridge span arrangements and types. 2.3 Develop initial roadway geometry for three chosen options. 2.4 Incorporate affects and potential restoration of Wears Creek and surrounding greenspace. 2.5 Perform high-level hydraulics on initial options to understand conceptual bridge length and impact to water surface profile. 2.6 Evaluate initial retaining wall needs to understand general location and size. 2.7 Develop concept drawing showing the new bridge and roadway construction for three options showing initial plan and profile view. 2.8 Develop order-of-magnitude level estimate for initial concepts. 2.9 Meet with the City staff to discuss three options. 2.10 Incorporate City feedback into initial concept drawings. PN 16197.212 -1-November 2022 TASK 3-STAKEHOLDER ENGAGEMENT ($4,500 Lump Sum) 3.1 Meet with State of Missouri Office of Administration to discuss initial concepts and to better understand the State's plans for changes at the capitol that could relate to traffic movements or parking areas. 3.2 Meet with St. Peters Church to present initial options, any impacts to Mulberry Street and understand concerns. 3.3 Engage the US Army Corps of Engineers to discuss impacts to Wears Creek and better understand any permitting concerns. 3.4 Engage MoDOT to understand impacts to retaining walls behind their building. 3.5 Attend Public Works Committee meeting to discuss initial alternatives and project status. TASK 4-FINAL CONCEPT ($63,500 Lump Sum) 4.1 Refine concepts based on feedback to date to finalize concepts and develop recommendation to City. 4.2 Meet with City staff to discuss recommendations and determine final concept to move forward. 4.3 Develop bridge layout, type and size for chosen concept. 4.4 Develop roadway geometry for chosen concept. 4.5 Review impacts to Wears Creek, hydraulics and restoration options for chosen concept. 4.6 Develop retaining wall sizes and locations for chosen concept. 4.7 Develop drawings to show chosen concept. Anticipated to include: 4.7.1 Overall plan view 4.7.2 Bridge typical section 4.7.3 Roadway typical section 4.7.4 Plan/ profile of High Street 4. 7.5 Plan/ profile of Missouri Boulevard 4.7.6 Bridge elevation views 4.8 Develop cost estimate for chosen concept to be used for budget and grant purposes. 4.9 Meet with City staff to discuss chosen concept drawings and costs and obtain feedback. 4.10 Incorporate final comments from City. 4.11 Attend City Council Meeting to discuss conceptual phase. TASK 5-GRANT FUNDING (Hourly plus Expenses Not to Exceed $30,000) 5.1 Assist with finding and applying for grants as requested by the City. Depending on the chosen grants to pursue, this could include multiple grant applications. However, some more complex grant applications could exceed the funds available with this contract. These funds will not be expended without prior approval from City staff. The hourly rates and reimbursable expenses are shown in the attached fee schedule (Exhibit B). Make available to the Consultant all records, survey plats, warranty deeds, survey, reports, maps, financial information, and other data pertinent to provisions for the services required under this contract. 2. Designate one employee as the City's representative with respect to all services to be rendered under this agreement. This includes both fixed routes and handi-wheels and office support staff (supervisors, dispatchers, etc). Transit did provide service on Black Friday in the early 1990's, but it was suspended for low ridership . The low ridership was likely due to several factors including which we believe are still relevant today; • Medical offices are typically closed; • State Offices are closed; • Baggage is limited to what a rider can carry and stow safely; • Riders may have alternate transportation because a friend or family member may be able to transport them because more of them may also be on a holiday from work; • In present day more shopping can and does occurs on-line . Another factor to consider is being able to staff the system. Transit like many other city departments is often short staffed and is having trouble hiring (down 8 of 32 currently). With our present staffing , we often have difficulty allowing for vacation time, etc. Having staff work on a holiday exacerbates that issue . Because of the facts noted above we would not recommend reinstating the service . Portalld=29&Moduleld=6228&Article=3230 117 1/2 This signing signified the first formal step in the partnership for the Jefferson City FCSA Missouri River Flood Risk and Resiliency Study, which is a spin-off of the Lower Missouri River Basin System Plan, a larger study that involves four states-Nebraska, Iowa, Kansas and Missouri. The System Plan will reassess how USACE operates the lower Missouri River Basin and offer different flood risk and resiliency options for the river as a whole that have the best federal interest. The spin-off study conducted in Jefferson City will offer flood risk and resiliency options specific for the area around river miles 142, an area that has been impacted by flooding multiple times over two decades. "This signing is just the first step in our unified local approach to an extensive look into flood risk reduction, potential environmental impacts, the likely economic benefits and more for Jefferson City. The final year of the five-year contract runs from November 1, 2022 to October 31, 2023 at a cost of $201,600 to the City of jefferson. The current yard waste and compost site is located at 2417 Southridge Drive. Planning and Protective Services staff is currently preparing the request for proposal for the future contract which will begin on November 1, 2023 if funds are allocated for this service. Attached is the request for proposal for yard waste and compost site services for reference. Average usage is approximately 17,500 customers per year, with an average of 24,000 cubic yards of yard waste per year. Highlights of the proposal are: • No charge to city residential users for yard waste drop-off and pick-up of compost; shall charge non-city residents and businesses for use of the facility. • Cost proposal requested for drop off fee for yard waste disposal for non-city residents and all businesses. • Curbside on Demand Yard Waste Pick-Up. Requested cost proposal for customer fee-based curbside on demand pick-up option for residents. Residents can request a special yard waste pick-up from the contractor on a demand basis only for a fee. • No charge to City of jefferson Departments for dropping off of yard waste at the facility. The Department of Parks and Recreation has expressed interest to explore waste options for the disposing of larger wooded material to the yard waste site from their daily operations. Also included in the request for proposal: • A system description of the yard waste facility on set-up and daily operation • Hours of operation of the facility plus a holiday schedule • Advertising methods of the facility to include publications and signage • Reporting methods of volume of yard waste that is being dropped-off and number of customers requesting yard waste pick-up. Additional information will be requested regarding patron usage (resident vs. non-resident/commercial usage). • Plans for disposal of the yard waste and compost This past summer the City of Jefferson Purchasing Department released a Request for Information (RFI) to vendors to explore options for best management practices for yard waste management in the City of Jefferson. The Purchasing Department received one response to the RFI (attached to memorandum for reference). Attached is a 2018 comparison chart of other Missouri municipal yard waste I compost programs for reference. Staff is requesting input from the Public Works and Planning Committee on whether to pursue a new yard waste and compost contract for the next five-year period and for any suggestions or input to the current proposal. REQUEST FOR PROPOSAL YARD WASTE DROP OFF AND COMPOSTING PART I INTRODUCTION AND GENERAL INFORMATION The City of Jefferson, Missouri is requesting proposals from qualified service providers for yard waste drop-off site(s) and composting services. The city wishes to have a yard waste drop-off site and composting systems capable of handling yard waste generated in Jefferson City, Missouri available to its citizens. The yard waste drop off site(s) must be operated in a way that insures a clean and orderly appearance at the location. The public must be accommodated by easy access to . the drop off of yard waste and the pick up of compost and mulch. The City will contract with the successful offeror following negotiations to provide one or more drop off site(s) and a composting site. The fee schedule for all charged users and all increases must be approved by the City of Jefferson. The contract will be for one year from date of award with up to four (4) additional one year renewal periods. The successful bidder shall procure and maintain the insurance as listed in the sample contract for the life of the agreement. · The successful bidder shall be responsible for securing and maintaining all required permits (City, State, and Federal). PART II BACKGROUND The current contract agreement provides for a centrally located site within the C~ty of Jefferson maintained by the contractor, at the contractorrs expe~se. During the past three years the average volume of yard waste has been 29,100 cubic yards'ofprocessed material per year. PART III SCOPE OF WORK The City of Jefferson wishes to explore all possible options for continuing yard waste services by a drop-off site or sites and a composting site. In addition, the City wishes to consider a contractor operated curbside pick-up on demand of yard waste for citizens within the corporate city limits of the city. The City is soliciting proposals, as outlined below. Contractors may respond with one or more options. I OPTIONS AND COSTS A. DROP-OFF SITE, in which the contractor designs, constructs and operates their own drop- off site(s) and compost site. B. Pick up of yard waste curbside on a resident demand basis within the corporate limits of Jefferson City. Contractor must describe method of picking up yard waste curbside on a demand basis. It is. contemplated that costs for such on demand service would be the responsibility of the requesting resident but would be subject to a standard set of rates established in the contract. PARTV PROPOSAL REQUIREMENTS The contractor should address each section on the attached sheet under Part X. Additional description may be added by the offeror. The following categories are areas of concern for the City of Jefferson, and contractors should provide a brief description under each section. A. System Description. 1. In this section, please describe the composting system or option that you propose to utilize. Also describe the procedures for patron residential and commercial identification (Source of Identification) and recording methods of volumes of materials. 2. Volume reports shall be submitted to the City on a monthly basis and must be received before payment will be made. Volume reports shall include the number of patrons each month and the volume of yard waste received. The report shall also include the number of completed requests for pick -up of yard waste curbside for residents. B. Site Considerations 1. Please provide the site location and the size of the site. 2. The site location must be on privately owned property on the south side of the Missouri River on appropriately zoned property within the corporate city limits of the City of Jefferson. 3. The site must provide easy access by the public to the drop off of yard waste and the pick up of compost and mulch. 4. Entrance, Exit and public vehicle access areas must be clearly marked, paved and ·maintained. 5. Contractor shall clearly display at its entrance identifying information and operating hours of the yard waste drop off and compost site. The drop-off area for yard waste must be clearly identified with the type of yard waste to be deposited and location of 2 free mulch and compost must be identified for the residential citizens. Fee schedules shall be posted for those that are non-residents or businesses. C. Zoning Considerations Jefferson City Zoning allows "Yard Waste and Composting Site" as a permitted use in the M-2 General Industrial zoning district, as a Conditional Use in the RU Rural zoning district, and as a Special Exception Use in the M-1 Light Industrial and C-2 General · Commercial districts. Properties zoned M-2 would be approvable as a composting site. Properties zoned M-1, C-2, or RU would require a special permit, with applicable vote by the approving body. Composting sites are subject to Zoning Code Specific Use Standards as follows:· 33. Composting Site A. Location. Composting facilities may be authorized in the districts specified by Exhibit 35-28 Land Use Matrix. · B. Performance Standards (1) No. materials or compost shall be stored within 25 feet of any property line. (2) No excessive dust, noise, vibration, smoke, fumes, odors, or glare shall be detected beyond the property line. (3)· Minimum parcel size of four (4) acres is required. (4) Subject to other applicable local, state, and_ federal permits are required. If the presumptive successful bidder's proposed yard waste location requires a zoning amendment or zoning permit to comply with application ~oning requirements, the award of the bid shall be processed in conjunction with any required zoning approval actions and final bid award shall be subJect to final approval of such zoning amendment or zoning permit. D. Operation ofthe Drop-OffSite(s) 1. Please indicate the number of people that would be available to operate the site(s) and the number of days or hours per week that the site(s) will be open. Both winter and summer schedules shall be included. Below are the current operating hours. It will be the responsibility of the site operator to dispose of the processed material in an appropriate manner. In this section, indicate uses or markets you anticipate for the compost product your process will provide. Assuring a proper disposal for the materials is a minimum requirement for acceptable proposals. Indicate the methods of maintaining an adequate supply of composted material available to the public at no cost. G. Financing and Financial Projections 1. Contractor should provide a financing plan which describes the sources and uses of funds. Please indicate in your proposal the role you propose the city to play in financing any facilities. 2. Estimate the required per ton tipping or service fee to process and market material at your facility. Please include assumptions for other revenue sources such as market sales. Yard waste shall be limited to tree limbs and brush (six inches or less in diameter and a maximum length of 4 feet), garden vegetation, grass clippings and leaves (must be bagged or placed in a disposable container), wood chips, or flocked/unflocked Christmas trees. Residential User: Any person or family unit living in or owning a single family home, duplex, mobile home, or small multi-family residential unit within the City. Residential, One Family or Single Family: A detached single family structure designed or intended for occupancy by one person or by one family. Each mobile home in a non- containerized area shall be deemed a "single family residence", and each pad space shall be deemed a single family structure. Residential, Two-Family or Duplex. A building designed and intended for occupancy by two (2) families in separate living quarters, including housing units described as "attached single family"-and ''townhomes", so long as the structure contains a maximum of two dwelling units only. Yard waste shall be limited to tree limbs (six inches or less in diameter and a maximum length of 4 feet), grass clippings and leaves (must be bagged or placed in a disposable container), wood chips, or flocked/unflocked Christmas trees. 28 YARD WASTE DROP-OFF SITE AND COMPOSTING SERVICE CONTRACT This agreement made and entered into the date last executed by a party as indicated below, by and between the City of Jefferson, a municipal corporation, hereinafter "City", and All Seasons Landscaping and Construction, Inc., hereinafter "Co.ntractor", witnesseth: That for and in consideration of the mutual promises herein contained, the parties hereby agree as follows: 1. Scope of Services. The City agrees to engage the services of the Contractor to perform the services set out in Response to Proposal No. 2978 and incorporated herein as Exhibit A. The Contractor shall operate a drop-off site located at 2417 Southridge Drive, Jefferson City, Missouri, and shall be solely responsible for the operation of said site and the proper disposal of all materials brought to said site. Exhibit A to this Contract and the letter dated July 20, 2018 from David Grellner and agreed upon by Contractor, attached to this contract as Exhibit B, are incorporated in full into this contract. To the extent there is any conflict, the terms of Exhibit B shall control over Exhibit A and this Contract and Exhibit A shall control over this Contract. 2. Additional Services. The City may add to services activities of a similar nature. The Contractor shall undertake such changed activities only upon the direction of the City. All such directives and changes shall be in written form and approved by the Director of Planning and Protective Services and shall be accepted and countersigned by the Contractor or its agreed representatives. 3. Term. This contract shall be for the period of one year beginning on November 1, 2018, and terminating on October 31, 2019, provided that the City shall have the right to cancel at any time upon giving one hundred twenty (120) days' notice. This contract shall automatically renew for up to four (4) additional one year periods, subject to annual appropriation by the City Council. 4. Insurance. Contractor shall procure and maintain at its own expense during the life of this contract: (a) (b) (c) (d) Workmen's Compensation Insurance for all of its employees to be engaged in work under this contract. Contractor's Public Liability Insurance in an amount not less than $3,000,000 for all claims arising out of a single occurrence and $500,000 for anyone person in a single accident or occurrence, except for those claims governed by the provisions of the Missouri Workmen's Compensation Law, Chapter 287, RSMo., and Contractor's Property Damage Insurance in an amount not less than $3,000,000 for all claims arising out of a single accident or occurrence and $500,000 for anyone person in a single accident or occurrence. The City shall be named as an additional insured. Automobile Liability Insurance in an amount not less than $3,000,000 for all claims arising out of a single accident or occurrence and $500,000 for anyone person in a single accident or occurrence. The City shall be named as an additional insured. Subcontracts. In case any or all of this work is sublet, the Contractor shall require thi&J (!_, r Subcontractor to procure and maintain all insurance required in Subparagraphs (a), (b), and (c) hereof and in like amounts. (e) Scope of Insurance and Special Hazard. The insurance required under Sub- -paragraphs (b) and (c) hereof shall provide adequate protection for the Contractor and its subcontractors, respectively, against damage claims which may arise from operations under this contract, whether such operations be by the insured or by anyone directly or indirectly employed by it, and also against any special hazards which may be encountered in the performance of this contract. NOTE: Paragraph (e) is construed to require the procurement of Contractor's protective insurance (or contingent public liability and contingent property damage policies) by a general contractor whose subcontractor has employees working on the project, unless the general public liability and property damage policy (or rider attached thereto) of the general contractor provides adequate protection against claims arising from operations by anyone directly or indirectly employed by the Contractor. (f) The Certificates of Insurance furnished to the City showing proof of compliance with these insurance requirements shall contain a provision that coverage under such policies shall not be canceled or materially changed until at least fifteen days prior written notice has been given to the City. Certifies of Insurance must be on file with the City prior to beginning work. 5. Contractor's Responsibility for Subcontractors. It is further agreed that Contractor shall be as fully responsible to the City for the acts and omissions of its subcontractors, and of persons either directly or indirectly employed by them, as Contractor is for the acts and omissions of persons it directly employs. Contractor shall cause appropriate provisions to be inserted in all subcontracts relating to this work, to bind all subcontractors to Contractor by all the terms herein set forth, insofar as applicable to the work of subcontractors and to give Contractor the same power regarding termination of any subcontract as the City may exercise over Contractor under any provisions of this contract. Nothing contained in this contract shall create any contractual relations between any subcontractor and the City or between any subcontractors. 6. Termination for Cause. The City reserves the right to terminate this contract by giving at least five (5) days prior written notice to the Contractor, without prejudice to any other rights or remedies of the City should the Contractor be adjudged a bankrupt, or if Contractor should make a general assignment for the benefit of its creditors, or if a receiver should be appointed for Contractor or for any of its property, or if Contractor should persistently or repeatedly refuse or fail to supply enough properly skilled workmen or proper material, or if Contractor should refuse or fail to make prompt payment to any person supplying labor or materials for the work under the contract, or persistently disregard instructions of the City or fail to observe or perform any provisions of the contract. 7. , Indemnity. To the fullest extent permitted by law, the Contractor shall indemnity, defend and hold hannless the City , its elected and appointed officials, employees, and agents, from and against all claims, damages, and expenses, including but not limited to attorneys' fees arising out or resulting from the performance of the Work, provided that any such claim, damage, loss or expense attributable to bodily injury, sickness, disease or death or to injury to or destruction of tangible property (other than the Work • 0 itself) including the loss of use resulting therefrom and is caused in whole or in part by any negligent act .;(" . . . . . pC\ or omission of the Contractor, any Subcontractor, anyone directly or indirectly employed by any oftheni or anyone for those acts any of them may be liable, regardless of whether or not it is caused in part by a party indemnified hereunder. Such obligation shall not be construed to negate, abridge, or otherwise reduce any other right or obligation of indemnity which would otherwise exist as to any party or person described in this paragraph. · 8. Compensation. Charges to Users. The City of Jefferson Departments shall be allowed to dispose yard waste without charge. 10. ~ The site is to be located at 2417 Southridge Drive, .Jefferson City, Missouri, which is within the corporate city limits of the City of Jefferson but south of the Missouri River and appropriately zoned. Contractorownsthepropertylocated at2417 Southridge Drive, Jefferson City, Missouri. 11. Waste Guarantee and Acceptable Waste. Contractor shall accept organic material including tree limbs and brush 6" or less· in diameter and smaller cut into four foot lengths, grass clippings, leaves, wood chips, yard and garden vegetation, flocked and unflocked Christmas trees, and similar material. Contractor shall accept processed materials from City departments at no additional charge. 12. Unusual Weather Event. In the event of abnormal or unusual weather which causes a significant increase in the volume of material which would go to Contractor pursuant to this contract, the City shall self-impose a moratorium on the delivery of processed materials by City departments to Contractor for a period of five (5) days from the event. After the five (5) days have expired, the City may resume its delivery of processed material at no additional charge to the City. 13. Marketing Compost. It will be the responsibility of the site operator to dispose of the processed material in an appropriate manner. Part X, Section F of the Contractor's bid proposal indicates uses or markets anticipated for the compost product Contractor will provide. 14. Days and Houts of Operation. The days and hours of operation are as specified in the proposal, but not to be less than the following: · 15. Reports. Summer (March 16 through November 30) 8:00 a.m. to. 7:00 p~m. Monday through Friday 8:00 a.m. to 5:00 p.m. Saturday · Noon to 5:00p.m. on Sunday Winter (December 1 through March 15) 8:00a.m. to 5:00p.m. Monday through Saturday Noon to 5:00p.m. Sunday Vohime reports shall be submitted to the City on a monthly basis and are to be received before payment will he made. The reports shall include the volume ofyard waste received and the number of patrons each month. 16. Performance Bond. The Contractor must furnish a performance bond in the amount of one hundred percent (100%) of the offer. The Contractor must submit the performance bond to the City of Jefferson upon signing this contract. The performance bond .must be issued by a company authorized to do business in Missouri or secured with a certified check, cash, or cashier's check and made payable to the City of Jefferson in the amount specified. The ordinance number and dates of performance must be specified in the performance bond. Per~ona1 or company checks are not acceptable. In the event the City of JefferSon exercises its option to extend this contract for an additional period, th~;: Contractor must maintain the validity and enforcement of the bond purs1jant to the provisioti of this paragraph for the extended period. 17. Nondiscrimination. The Contractor agrees in the performance of this contract not to discriminate on the ground or because ofrace, creed, color; national origin or ancestry, sex; religion, handicap, age, or political opinion or affiliation, against any employee of Contractor or applicant for employment and shall include a similar provision in all subcontracts let or awarded hereunder. The Contractor agrees to comply with all federal, state, and local nondisCrimination laws and orcUnances. 18. Illegallminigration. Prior to commencement of the work: a. Contractor shall, by sworn affidavit and provision of documentation, afflrtn its enrollment and participation in a federal work authorization program with respect to the. employees working in connection with the contracted services. · b. Contractor shall sign an affidavit affirn'iing that it does not knowingly employ any person who is rui unauthorized alien in connection with the contracted services. c. lf Contractor i!> a sole propri.etorship, partnership, or littrited partnership, Contractor shall provide proof of citizenship or lawful presence of the owner prior to iss.uance of the Notice to Proceed. 19. Nonsolicitation. The Contractor warrants that they have not employed or retained any coinpany or person, other than a bona fide employee working solely for the Contractor, to solicit or secure tllis contract, and that they have not paid or agreed to pay any company or person, other than a bona fide employee working jJ& ~< • . ·.')·· solely for the Contractor, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting fi·om the award or making of this contract. For breach or violation of this warranty, the City shall have the right to annul this contract without liability, or, in its discretion, to deduct from the contract price or consideration, or otherwise recover the full amount of such fee, commission, percentage, brokerage fee, gifts, or contingent fee. 20. Compliance With Applicable Law. The Contractor must agree to comply with all federal, state and local laws or ordinances, and all applicable rules, regulations, and standards established by an agency of such govemmental units, which are now or hereafter promulgated insofar as they relate to the Contractor's performance of the provisions of the agreement. It shall be the obligation of the Contractor to apply for, pay for and obtain all permits and/or licenses required by any governmental agency for the provision of those services contemplated herein. 21. Cancellation Due to Unavailability ofFunds In Succeeding Fiscal Perici'ds. When funds are not appropriated by the City Council or otherwise made available to support continuation of performance in a subsequent fiscal period, the contract shall be cancelled. In the event that funds are not appropriated for the contract, the Contractor shall not prohibit or otherwise limit the City of Jefferson to pursue and contract for alternate ·solutiOns_ as deemed necessary for the conduct of City affairs. 22. Independent Contractor Status. In performing the services under this agreement, the Contractor will direct the operation in all respects and will determine the method, means and manner of perfom1ance including, but not limited to, such matters as choice of any lawful routes, points of service, and time of services. The parties intend to create by this agreement the relationship of an independent contractor and not an employee- employer, co-partnership, joint venture, or any other relationship. Neither the Contractor nor any of their employees, agents, or representatives is to be considered employees of the City insofar as the subject matter of this agreement is concerned or in performing services under this agreement. 23. Assignment. The Contractor shall not assign any interest in this contract, and shall not transfer any interest in the same (whether by assignment or novation), without prior written consent of the City thereto. Any such assignment is expressly subject to all rights and remedies of the City under this agreement, including the right to change or delete activities from the contract or to terminate the same as provided herein, and no such assignment shall require the City to give any notice to any such assignee of any actions which the City may take under this agreement, though City will attempt to so notify any such assignee. 24. Jurisdiction. This agreement and every question arising hereunder shall be interpreted according to the laws and statutes of the State of Missouri. 25. Notices. All notices required to be in writing may be given by first class mail addressed to the Director of Planning and Protective Services, City of Jefferson, 320 East McCarty, Jefferson City, Missouri 65101, and All Seasons Landscaping and Construction, Inc., 2417 Southridge Drive, Jefferson City, Missouri, 65109. Mo., which prohibits "yard waste" in solid waste areas or landfills after January 1, 1992, unless otherwise authorized. Section 260.200.1(57), R.S. Mo., defines "yard waste" as "leaves, grass clippings, yard and garden vegetation and Christmas trees. ·.The term does not include stumps, roots or shrubs with intact root balls." 19:, Further, Jefferson City Code prohibits the disposal of yard waste or "compostable materials" into a solid waste landfill. "Disposal shall be in accordance with state and federal law and all applicable ordinances." J.C. Code, Sec. 30-32. See also. It should also be quite clear that yard waste should not be disposed of in solid waste areas or landfills simply because of the tremendous costs that will be passed on to the.solid waste districts and municipalities, like Jefferson City, Missowi (City). Further, the burning of yard waste has both safety and pollution concerns. See, J.C. Code, Sec. 1345, (City ban on open burning). The bottom line is that residents, as well as businesses, and the City itself :peed a place to dispose of yard waste and compostable materials. The City has provided for many years a yard waste and compost site facility, which is a required and necessary service for the economical disposition of yard waste. · Current Site Has Met the Requirements of This RFP The current Site has and will continue to meet all of the City requirements of the Request for Proposals No. 2978, contained in Part V, and specifically,· the Perfonnance Standards set forth on pages 2-3. A. System Description As requested in paragraph 1 in System Description, page 2 of the RFP, the composting system at the current Jefferson City, Missouri Yard Waste and Compost Site facility (Site) utilizes local organic materials primarily from Jefferson City res~dents. As the City's RFP on page 2 recognizes, during the past three (3) years, the current Site has accepted and processed an average of nearly 30,000 cubic yards of materials per year. All of the materials (yard waste .and compostable materials) are separated into two (2) basic types: Brush and Grass/Leaves. Yard waste in the form of brush that is less than six (6) inches in diameter and in a maximum length of four (4) feet is considered acceptable at the Site. The brush is · ground lnto mulch and made available for sale to the public. The revenue generated from this process offsets the costs incurred with labor, equipment and Site operation. . . Yard waSte that is compostable materials is considered acceptable at the Site and ~s processed by placing into windrows with the correct carbon/nitrogen ratios, water added and monitored on a regular basis by Site staff. In addition, staff will turned tl)~ materials a minimum of three (3) times in order to aerated the windrows, which creates a very premium high quality compost . Compost has been and will continue to be provided to City residents FREE of charge. Ifloaded by Site staff, the loading fee is $15.00 per cubic yard. Compost at the Site is provided in a bin that is clearly marked and accessible on two (2) sides for loading purposes. Also, requested in paragraph 1 in System Description, page 2 of the RFP, the current Site accepts residential yard waste generated from City residents. All "City .residents" are permitted to use the current Site, and that yard waste is accepted free of charge. lift. i tel iJ I ~ ·~ . A "City resident" is a person that actually resides at property within the City, and the "residential yard waste" being delivered to the Site by that person is from that property. Further, residential yard .waste from rental property in the City delivered by the te~ant of that property is also accepted free of charge. (See, Definition for "Place of residence" R.S.Mo. Section 1.020(14), "place where the family of any person permantly resides ... and the place where any person ... generally lodges." "Commercial yard waste" is also accepted at the. current Site for a reasonable fee based on ~e cubic yard amount of yard waste delivered to the Site. "Commercial yard waste" is generated from rental property in the City delivered by the owner and not the tenant of that property. In addition, "commercial yard waste" is also generated by individuals, businesses, lawn care, landscaping and tree companies that are hired for, among other things, to cut and/or haul any yard waste from any property. Many times these types of businesses are hauling yard waste from many sources making a determination of the source of yard waste impossible for Site staff. Thus, those businesses will also be charged a reason.able fee based on the ~ubic yard amount of that yard waste. This approach is both the standard and custom throughout the yard waste recycling industry, and it allows for the fair, equal and uniform treatment of all businesses, inch.~.ding the rental business. Favoritism or bias in any form is bad policy, and there is no sound reason to favor any business at the Site. Therefore, Site staff will continue to use this common sense approach in the future for this RFP. Please note: The difference ~ith regard to "residential solid waste" which means "solid waste from a residential user." J.C. City Code, Sec. 30-l.A.23, and clearly not applicable to the City's RFP. A "residential user" may not even be a "City resident" See, RFP, Part XI, pages 27-28. The definitions provided in the RFP refer to the exception to require landlords of rental property in the City to provide trash service to those rental properties unless an assignment is made to the tenant. See, J.C. Code, Sec. 30-1(26). Thus, those definitions provided in the city's RFP, at pages 27-28, are not applicable with regard to "residential yard waste." I I I ~ i I I II I ~ I I i m ~ i I E ~· Staff of the current Site use and will continue in the future to use, a common sense approach to make the .proper determination of the source and type of yard waste ,being delivered.· Simply put, the procedure for patron identification is by Kindly greeting, requesting the name and address of each patron. This information is entered on a daily compost log. Occasionally, additional information or identification is requested from the patron, like a driver's license, mail, voter identification card, midmogis.com (property owner information). Site staff then requests whether the purpose for using the Site is residential or commercial, and the yard waste is inspected to determine whether ~t is acceptable. All yard waste being delivered. to the Site is inspected and a determination as to the cubic yard amount is made prior to unloading same. This information is also entered on the daily compost log. If the pa'tr9n is not a City resident or is delivering acceptable commercial yard waste to the Site, then an appropriate and reasonable fee is charged based on the cubic yard amount of yard waste. All fees are collected prior to unloading acceptable yard waste. At this point, the patron is directed to the designated areas for unloading. This common sense approach has been very successfully used by Site staff for nearly eight (8) years. During the past three (3) years, the average number of patrons to the current Site is over 22,000 per year. Site staff has successfullyperformed this task. Please review the recent City survey, which clearly shows overwhelming support for the current Site and its staff. Further, Site staffbas given comment cards to numerous patrons to be sent to the City. In fact, property owners that reside very near the Site have also submitted comment cards. The Council members and selection committee are invited to review same. Further, as requested in paragraph 2 in System Description, page 2 of the RFP, for almost (5) years, Site staff has prepared and submitted to the City a sufficient monthly. volume report of yard waste accepted at· the current Site, along with the number. of patrons using the Site during that time period. At the time of drop off, Site staff detennines the volume of yard waste being delivered on a uniform standard, i.e., (I) one cubic yard being a level pickup truck load of unprocessed · material. Site staff will continue submitting monthly volume reports to the City in the future. f:ill. Ill B. Site Considerations The City has successfully contracted with All Seasons Landscaping and Construction, Inc. (Contractor) for nearly eight (8) years to provide the current yard waste and compost site (Site) facility. It should be noted that the Contractor is a successful and respected local business operating in the central Missouri area for nearly twenty (20) years. Further, the Contractor has been involved in the successful competition of numerous other past City projects. The current and future Site is located at 2417 Southridge Drive, Jefferson City, Cole County, Missouri; attached hereto is an ·aerial photograph and map of the Site for Council review. The Contractor seeks to continue its contractual relationship with the City and to provide the yard waste and compost site facility in the future, pursuant to this RFP. The current Site is owned by Contractor and consists of approximately six (6) acres. The Site is centrally located on the south side of the Missouri River and within the City boundaries. The Site has clearly marked and paved separate entrance and exit ways. The Site is level making access both convenient and easy for use by the patrons. The Site has a posted speed limit of 5 miles per hour to ensure the safety of both the patrons and pedestrians. Further, yard waste is unloaded and disposed of by patrons on a paved area to keep the accepted yard waste free of debris. This also provides additional safety, along with more convenience to 'the patrons. If the yard waste is contained in a bag or bags, then all bags must be emptied by the patrons. Patrons are encouraged to reuse or recycle these bags. Initially, Site staff accepted yard waste in compostable bags but found that the bags contained a large amount of unacceptable materials( trash). Plus, this caused great confusion among the Site patrons, some believing the Site accepted all bags (including plastic). The Site also offers premium compost to the patrons. In fact, the current compost at the Site is a valuable soil supplement because it contains organic matter which greatly enhances the soil structure. At the Site, compost is located in a bin that is open on two (2) sides for easy access and loading by several City residents, lim i ~ ·I D ~ ~ ~ ~- iJ ~ ~ ~ ~ ~ i ~ ~- ~ ~ In addition, the Site is well maintained, orderly and kept clean by Site staff. The Site is equipped with a complete first aid center and fire extinguishers in case of any . emergency, and the Site has a complete security camera system. The Site also provides a restroom for use by the public, and a large sign at the Site entrance, which displays contact information and hours of operation for the Site. All of the current Site fee schedules are posted on the City's website. Further, the current Site complies with all Missouri Department of Natural Resource (MDNR) requirements. All necessary operating pennits have been .obtained and properly renewed. All appropriate erosion controls are in place, water quality is monitored and water runoff is maintained on-site. In addition, weekly inspections are conducted by staff for the Contractor and in compliance with all record keeping requirements. Further, absolutely no materials, including compost are stored within twenty-five (25) feet of any property line, and there is no excessive dust, noise, vibration, smoke, fumes, odors or glare beyond the Site property. In fact, the Site has an extremely large and dense tree line buffer zone between all adjoining properties. Operation of the Yard Waste and Compost Site Facility For nearly eight (8) years, the current Site has maintained adequate staffing during the hours of operation, and Site staff is under constant supervision by the Contractor. The current Site has processed a sufficient amount of organic and all natural compost to satisfy the needs of the city residents for years into the future. The current. Site has an ongoing system that produces· compost in three (3) phases, and all accepted yard .waste is properly disposed of and meets all the requirements of the City'.s RFP. However, the supply of compost is limited, and therefore, will be provided as it becomes available. Further, Contractor reserves the right to limit the amount of compost made available to. any city resident. The current Site has always provided and will continue to provide compost to city residents free of charge, if loaded by them. If compost is loaded by Site staff, there is a current loading fee of$15.00 per cubic yard. G. Financing and Financial Projections The funding from the City's RFP is for costs and expenses incurred in the ordinary course of operating the future compost Site. These costs and expenses include, but are not limited to, payments associated with the real property, personal prpperty, equipment, maintenance, fu~l, Site improvements, utilities, labor and other unforeseen expenses associated with the future Site. There has been no financing req11ired from the City for the current Site, and none will be in the future. The purpose of the meeting was to discuss the proposal you submitted and to clarify and negotiate items proposed for yard waste and compost services from your company. The following items were discussed and clarified du~ing the meeting: 1. The yard waste and compost facility will be located at 2417 Southridge Drive, Jefferson City, Missouri. The facility i.s located on approximately 6 acres, south of the Missouri River, and is properly zoned M-2 which meets Jefferson City zoning regulations. All Federal, State, and Local Permits required have been obtained by the contractor and a copy of the permits will be provided to the City of Jefferson. 2. Entrance and exit areas are paved and clearly marked~ . Designated locations for yard waste drop off are clearly marked for the customer. An attendant is available to properly identify customers using the facility and to ascertain whether they are using the facility for residential use or commercial use. 3. City residents will be allowed to deposit yard waste at the facility free of charge. Non-resident and all businesses will be charged a fee for use of the facility as listed in the request for proposal. Tenants of rental units are allowed to deposit yard waste free of charge. Landlords using the facility will be classified as business users. 4. Acceptable waste includes tree limbs 6" in diameter and smaller, cut into four foot lengths, grass clippings, leaves, wood chips, and similar material. Also unflocked Christmas Trees will be accepted. Waste not accepted will be root balls, old mulch, dirt, rock, trash, and similar material. THIS IS A REQUEST FOR INFORMATION (RFI) ONLY; THIS IS NOT A FORMAL BID SOLICITATION NO AWARDS WILL RESULT The City of Jefferson, herein referred to as City, is seeking information from the vendor community to better understand the options to manage a yard waste management program for the residents of Jefferson City, MO as well as serve the needs of the Parks, Recreation and Forestry Department (Parks) within the City. Its intended purpose is to provide a facility for the residents of Jefferson City, Parks, and possibly allow commercial users to dispose of yard waste. The current program allows for the following: • Residents within the city limits may take trimmings and yard waste originating from their personal property to a facility at no cost to residents as long as less than 30,000 cubic yards of yard waste is received in a year. • Yard waste provider may charge a fee if an excess of 30,000 cubic yards of yard waste is received. Exceeding 30,000 cubic yards would typically only happen if an unusual weather-related event would take place such as a tornado, ice storm, or other severe weather event. Should this happen, the City can act to divert the yard waste to other facilities. • Yard waste accepted consists of the following: o Tree limbs (6" or less in diameter and a maximum length of 4') o Grass clippings o Leaves o Woodchips o Unflocked Christmas trees • Yard waste not accepted consists of the following: o Rootballs o Oldmulch o Dirt o Rocks o Trash and similar materials • Residents are allowed to pick up compost and mulch as it is available at no cost to residents. A fee is charged if the compost/mulch is loaded by the provider. • Residents may use "on-demand" for curbside pickup of yard waste where yard waste is placed in 30-gallon paper compostable yard waste bags and placed on the curb. The current provider then schedules the pickup for a fee. • Non-residents and commercial users may use the services for a fee. • The City is allowed to dispose of a maximum of 35 tandem axel trucks per year of acceptable yard waste at no charge to the City. The City desires to explore new ideas as to how this program can be managed. The City would like to see how a program could be designed where there is no cost to the City and the following minimum requirements include but not be limited to the following: • The City can drop off as much yard waste as desired to include large limbs and tree balls up to 36 " in diameter. • The contractor will provide to the City at least 100 cubic yards of wood chip compost at no cost to the City. Wood chip compost will be picked up by the City. Wood chip compost in excess of 100 cubic yards may be at a cost to the City as indicated on the pricing form. • Contractor provides a facility for residential yard waste to be dropped off where it will be recycled into other products such as compost or mulch. • Allow compost/mulch to be available to the residents of Jefferson City (this can be at a cost or at no cost). • Allow for commercial yard waste to be dropped off (this can be at a cost or at no cost). • Contractor is allowed to determine rates for residential and commercial users as well as the resulting products produced from the intake of the yard waste. It is desired that residents are allowed to drop off yard-waste at no cost since this is how it has been in the past. In response to this RFI, vendors may provide high level overviews of their solution , however, the City seeks sufficiently detailed information in order to be ab le to understand the full range of services available. The City is not looking for a full proposal at this time or pricing. This information will be used to develop a request for proposal once the City has determined what possibilities are available for the yard waste program. It is the desire that vendors will think outside the box and explore new and innovative ways of managing yard waste for the residents of Jefferson City and provide material back to the Park's Department. If the goal is to save money then the cheapest way to accomplish the elimination of yard waste could be to have the citizens deposit it at the local landfill and then have Republic Services process and dispose of it. This would eliminate the need to check every load to ensure that no trash is included. The City of Columbia has a model similar to this where they grind the up debris, and it is full of trash so that it isn't fit to become clean power plant fuel or mulch and compost. If the goal however is to recycle the material and keep it out of the landfill then people need to inspect every load to keep trash out of the facility so the material can be recycled. 99.9% of the carbon material can be recycled if it can be kept free of trash. This requires that site staff members inspect every load. There are four reasons that this cannot be done at a low cost. The first reason is the fact that there must be a person at the facility to receive the material from the citizens or they will deliver trash along with the brush and clippings and this adds a large labor cost component. Furthermore the compost must be separated from the larger material that becomes mulch or wood chips. Even with Sundays excluded it would take a minimum of two full time and one part time staff member to complete this task, or one who worked 20 hours of overtime and a part time worker. The second reason is that if the lack of a city contract payment is to be made up with per user fees then there will need to be a third well paid and trustworthy person to process the transactions given the volume of traffic that is likely, especially on holiday weekends. This will also greatly slow down the facility on the weekends when the citizens are most likely to use it. Cars are already backed up on the road for a great distance on busy weekends. The third reason is that the mulch buying market in Jefferson City is unlikely to be able to use more than a fraction of the yard waste generated. The rest of the material would make good clean fuel for power plants but it would be worth only $1.25 per cubic yard if sold wholesale. The fourth reason it that a grinder to grind all of this material now costs ~ound $750,000 and they burn a lot of diesel fuel in operation. The above costs lead to the main reason that the site can't be run cheaply and that is the labor cost versus the value of the carbon material the site would generate. At this time all of the carbon fmal products are priced very low compared to labor rates, so the carbon final products produced by the site in an area outside a major metropolitan area likely can't cover the cost of the facility much less turn a profit. The city is supposed to be provided with reports from the existing facility and these should be consulted to get actual numbers. None were provided with this request. The question that needs to be asked is what is the environmental cost of adding this yard waste to the landfill or allowing it to be burnt. That cost could be added to the cost of landfill processing and compared to bids for a yard waste recycling facility. Recycling may be cheaper for the community after all even if it comes with an up front cost. From our perspective the cost of the compost site could be lowered by removing the Sunday hours which greatly add to the labor complexity and cost, and then also including the large woody debris from the City Streets Department and the Parks Department which would simplify movement of that material into a centralized location saving time, wages, and fuel which would offset the cost of the site.
