This is to confirm that at the meeting held by the Town Commission
on March 8, 2002, a 12 month extension of the approval for certain
improvements to the Gulf Stream School, File #001 -2, was granted.
This approval, with the 12 month extension, shall expire on March
9, 2003 if a Building Permit Application, including the aforementioned
improvements, has not been applied for.

Issues Considered During Review:
1. Developers agreement restrictions

Recommendation:
If the Board finds that the 8 mandatory variance criteria are met and the proposed additions
are approved, the following conditions are recommended for the site plan approval (three
separate motions to recommend approval or denial are required, one for each of the approvals
reauested).
1. The student enrollment shall be permanently capped at 250, as limited by the existing
developers agreement.
2. No additional after -hours functions shall be held at the School other than those allowed
by the existing developers agreement.
3. The private school campus shall not be expanded onto existing single - family lots, as
dictated by RS -C zoning district use regulations.
4. The school shall submit an updated long -range master plan to the Town prior to building
permit.
5. A Construction Traffic Management Plan shall be submitted prior to the issuance of a
building permit application. This plan shall be reviewed and Approved by the Town
Manager and followed during construction.
6. The hedge along Gulf Stream Road shall be supplemented with additional plants to fill in
existing gaps, replace dead or dying materials, and create a denser hedgerow.
7. The drainage plan submitted with the application shall be followed.
8. The School shall reimburse the Town for all advertising and Town legal fees associated
with this application.

9. The school is respectfully requested to dedicate a 9' utility easement across the entire
frontage of A1A, to be used exclusively for future under - grounding of power, phone and
utility lines. (A long -term Town goal)
Background:
A chronology of school construction during the past 50 years and related Town regulations
is attached.
Over the last two decades, the school's facilities and curriculum have evolved to keep pace
with educational standards and parental expectations, while the absolute enrollment has
remained capped at 250 students. Both the school and the Town have put forth great effort
to ensure that the school can maintain high educational standards and respond to student
needs with out inappropriately impacting the surrounding single - family homes.
Particularly with the site improvements conducted in 1997 (drainage, landscaping, sewer
connection, new parking layout, relocated basketball area), the school has endeavored to be
a better neighbor. Additionally, the headmistress and school president have made
themselves available to Town officials and have immediately addressed any request from
the Town. For example, last year the school participated in a 50% cost share drainage
improvement project, when requested by the Town.
The school has made a commitment that additions will not increase enrollment or traffic
impacts. However, the mutual efforts to be compatible neighbors must continue. The
conditions recommended above should assist in this regard.

Amendment to Existing Developers Agreement: Recommend that the Developers
Agreement remain intact, thereby denying the amendment with the understanding that the
only revision to same would be for the specific improvements granted by this variance and
architectural/ site plan review (5 -0).

Gulf Stream School has, for the last 63 years, held true to the mission of its founders — to meet the
intellectual, academic, creative and physical needs of our students. Our 1991 Long Range Plan indicated
that increased emphasis be placed in the areas of computers, creative arts, physical education and
endowment, not a larger enrollment.. Thanks to the Gulf Stream Commissioners, Developer's Agreement
and incredible support by parents, friends, alumni and community, GSS successfully — and conservatively —
raised all of the money needed to construct the Field House and computer facility — and we increased
endowment. We did not increase enrollment, but rather, enhanced the students' offerings.
In a survey conducted in 1996, it became clear that the remaining areas of improvement needed centered
almost unanimously around fine arts - specifically art and music. We believe that in this age of technology
and increasingly more creative avenues in education, the fine arts and media will benefit from a larger area
in which to excel.
Additionally, smaller class sizes were desired by all constituencies, not to allow a larger student body, but
to accommodate smaller sections within specific courses, for example, math and foreign languages.
To accomplish this, a second story plan for the Bernet Library has been proposed, with an adjacent 2 story,
unobtrusive classroom structure, allowing flexibility within its layout for subdivided rooms. We propose to
add a comprehensive space allowing flexible art room space, media, photography, sculpture, drawing,
printing, etc.. We will also renovate the existing Souder Art and Music Building to house an expanded and
enhanced music department.
Gulf Stream School's enrollment will never exceed 250, including seasonal students, we will never go
beyond grade 9, we will never go beyond the existing footprint known as envelope 1, the number of
allowable events will not be exceeded, the style and color of the buildings will always conform to
generally accepted codes as set forth by the Town at the time of the request, and we will maintain a
drainage system whereby at least the first one inch of rainfall will be retained on site.
We are requesting a permanent amendment to the Developer's Agreement, which currently requires the
demolition of covered walkways for each additional square foot over 400. Amending the Developer's
Agreement now will ease the process for generations to come. Again, always keeping in mind our role in
the community and maintaining Planning and Zoning compliance, we request an amendment to the section
which requires equal demolition of square footage for each square foot of new construction. We would like
the ability to build out envelopes 1 and IA, already at approximately 95 % buildout, without removing
equal numbers of square feet of existing classrooms or covered walkways. We are requesting flexibility so
that future building will not require complex variances and future needs can be accommodated
The current plans are totally within the allowances for second story building and are an implementation of
the proposed amendment. We have designed the solution specifically to place the least burden on the
School and on the Town by not tearing the campus apart. We feel strongly that taking down covered
walkways will negatively impact the campus and affect the integrity of the architecture. We feel our plan
represents a positive change to the School and to the community. The neighbors will have no imposing
changes in their views from any direction
We will only make changes to our campus in keeping with the residential atmosphere of our community,
always keeping in mind the needs of the students, our most important constituency. Students who add to the
life of this town, students who increasingly come as residents of Gulf Stream Nearly 50 students of our
current enrollment of 238 live here, 21 %, up from 38 ten years ago, while our Boca enrollment has
decreased to 53 from 67 ten years ago.

Recent Gulf Stream School Construction Chronology
Highlights of recent school building projects and Town ordinance provisions related to
school expansion are provided below.
1952 The following paragraph appeared in the 1952 Zoning Code relative to existing
private schools located in residential zoning districts.
"Any private school now being conducted on lands within the Town of Gulf
Stream, Florida, classified as Residence District "A ", may continue to be used
as such under the provisions of Section VII hereof, provided, however, that any
private school building, or other structure used in connection with and as a part
of, and appurtenant in the operation and maintenance of such private school,
may be altered and repaired from time to time as shall be necessary for the
effective operation and maintenance of such private school."
1952 -81 A brief overview of this period indicated that little action occurred which would
be relevant to the current request.
1981 In 1981, the Town decided to revisit many of the regulations in the Zoning
Code. Among these regulations was the paragraph relating to private schools
in residential districts. A Commission workshop meeting was held on
September 17 at which the following discussion took place.
When the subject paragraph came up for review, the Town attorney suggested
the Town permit the school as a special exception. Instead, the Commission
decided to keep the paragraph with the following amendments:
"Any private school now being conducted on lands within the Town of Gulf
Stream, Florida, classified as +denr�B;�trTet " "RS "— Residential Single-
Family District, may continue to be used as such under the provisions of
Section VII hereof, provided, however, that any private school building, or other
structure used in connection with and as a part of, and appurtenant in the
operation and maintenance of such private school, may be replaced altered

effective operation and maintenance of such private school."
The amendments followed a discussion among the Commission concerning
the future physical expansion of the school. The discussion appears to indicate
that a limit on the number of students already had been agreed upon by both
the School and the Town. However, this discussion directly addressed the
physical expansion of school facilities. Participating in the discussion were one
Commissioner who also was a member of the School's board and another
member of the School's board who was in attendance. These two individuals
indicated that the School had no plans to increase its facilities with the
exception of a future replacement of the auditorium /chapel. Accordingly, the
amendments were made to the paragraph to permit replacements but prohibit
entirely new facilities. The amended paragraph was subsequently adopted in
January 1982.
1982 In May 1982, the school made application to construct a new Montessori
classroom. The new classroom was to be built in place of the existing
Montessori classroom, which was to be demolished. As part of the approval of
the new building, the Commission required the School to demolish the existing
building and to provide the Town with a long - range plan. The school complied
with the requirement and provided their long -range plan to the Town along with
a letter dated May 25, 1982 addressed to the Mayor from the School's
president. The plan included both a text and a site plan drawing. Apparently,
the Mayor sought to clarify the plan and phoned the president. The president
then responded in writing on June 15, 1982 providing specifics concerning the
future growth of the school's population and physical plant.
The June 15 letter from the school's president stated that the school would
serve a maximum of 250 students. Regarding physical facilities, the president
stated, "When the Montessori building ... is constructed and operational... we can
abide by the Gulf Stream town ordinance to demolish ... the particular wooden
structure housing those Montessori children..." The letter further states "There
is only one further new building construction contemplated and that ... will be an
auditorium which will replace the present frame building which is now used for
chapel."
1984 In June 1984, the Commission approved the construction of the new
auditorium /chapel facility at the school. The new building was approved with
the condition that the existing assembly building be removed, among other
requirements.
In July 1984, the Commission approved the expansion of an existing faculty
residence on the school grounds.
1989 In May 1989, the Commission approved the relocation of the "pink house" to
school grounds. At the Commission hearing, considerable discussion was held
regarding the addition of a building to the school without a reciprocal
demolition. Because of the historic nature of the pink house, the Commission
ultimately agreed to permit the relocation subject to several conditions,
including the following:
1) The Commission reiterated the prohibition of additional structures at the
school as stated in the Zoning Code.
2) No additional buildings were to be located south of the pink house along
Al A.
1993 In January 1993, the school submitted an application for a desired 11,468
square foot multi - purpose "field house" building and connecting walkways, east
of the chapel. The application included variances to allow this construction
without the corresponding replacement or substitution of an existing building on
site, as required by code provisions. The application was approved in March
1993 subject to a requirement that the school enter into a developers
agreement that outlined required site improvements (drainage, parking,
landscaping, sewer connection) and clearly defined limits on the number of
students, number of after hours events, and maximum square footage of
buildings.
1994 The developers agreement was adopted in June of 1994.
1995 The Design Manual was adopted in January 1995. The new code provisions
included a revision to the language addressing private schools in single - family
zoning districts. The following language was added:
"and further, any development permits, orders or written agreements
granted or executed by the Town prior to adoption of this chapter shall remain
in full force and effect."
1997 School field house completed and issued a Certificate of Occupancy.
2000 The GS School President spoke at the December 2000 Town Commission
meeting to inform the Commission of desired improvements in the Fine Arts
curriculum, along with an associated two story addition request.
2001 Application submitted for: (a) Variance to expand a school without
corresponding demolition or replacement of existing structures, (b) Amendment
to developers agreement in order to delete the following language: "for each
square foot of Building Area ... that is added, the school removes one square
foot of either building area or covered walkway and covered open structure
area" and (c) Site Plan /Architectural Approval for first and second story
additions totaling 6,236 S.F. (with a net increase of 5,917 S.F.)

Sec. 70 -49. Prohibited uses.
§ 70 -51
(a) To promote the private, peaceful, residential enjoyment of property in the single family zoning
districts in the town, and to protect these districts from the noise, traffic, congestion, crime and tumult
associated with nonresidential uses, �honresidential uses shall be prohibited including, but not limited to,
the following:
(1) The conduct of any professional, business, occupation, or calling.
(2) Home occupations and other home -based businesses.
(3) Transient uses including, but not limited to, time - sharing uses, corporate retreats and property
rentals with lease terms of less than three months.
(4) Other nonresidential uses including temporary uses, whether or not they benefit charitable
organizations, such as:
Auctions and silent auctions
Commercial still photography
Commercial motion pictures /videos
Display of items to be for sale at a later date
Garage /yard sales
Home tours and show houses
Tag /estate sales
Trunk sales and equivalent in -home display sales
(5) Aircraft landing pads and strips, whether temporary or permanent.
(6) Any other use not specifically permitted.
(b) These prohibitions shall not extend to telephonic transactions and communications.
Sec. 70 -50. Private schools.
Any private school conducted in any single family residential zoning district may continue to be used as
such under the provisions of sections 66 -131 et seq. of this Code, provided however, that any private school
building, or other structure used in connection with and as a part of and appurtenant in the operation and
maintenance of such private school, may be replaced, or another building substituted in place thereof;
repaired and maintained from time to time as shall be necessary for the effective operation and
maintenance of such private school; and further, any development permits, orders or written agreements
granted or executed by the town prior to the adoption of this chapter shall remain in full force and effect.
Sec. 70 -51. Minor acces r tructures.
The following structures shall be considered as minor accessory structures in all five single family zoning
districts subject to specific setbacks established in this chapter. Any structure which is larger or more
intensive shall be subject to the same setbacks as the principal structure.

Dear Gulf Stream Neighbors:
As you may have read in the newspaper last month, Gulf Stream
School is considering how best to provide our students with enhanced
space in which to study the Fine Arts. We are planning also for several
classrooms to accommodate smaller sections of certain classes. We
have no plans to increase the student body.
We are designing our plans in accordance with the Developer's
Agreement entered into with the Town of Gulf Stream in 1994. And we
are taking great care to ensure that the understated charm and beauty of
our campus remain to benefit not only those of us working and studying
here, but also those who live in this very special community.
We want to keep you fully informed about our plans, to share
very attractive and appropriate design concepts, and address any
questions and concerns you may have before we begin this undertaking.
To these ends, we hope you will be able to attend one of two community
open houses scheduled for Wednesday evening, January 31, from 5:00
to 7:00 p.m., and Friday morning, February 2, from 9:30 to 11:00 a.m.
Members of our Board of Trustees will be on hand to speak with you
personally, as will our architects, Digby Bridges and Mark Marsh.
We look forward to presenting our plans to you, and I welcome
your calls or visits at any time.

GULF STREAM DESIGN MANUAL § 70 -51
Sec. 70 -49. Prohibited uses.
(a) To promote the private, peaceful, residential enjoyment of property in the single family zoning
districts in the town, and to protect these districts from the noise, traffic, congestion, crime and tumult
associated with nonresidential uses, nonresidential uses shall be prohibited including, but not limited to,
the following:
(1) The conduct of any professional, business, occupation, or calling.
(2) Home occupations and other home -based businesses.
(3) Transient uses including, but not limited to, time - sharing uses, corporate retreats and property
rentals with lease terms of less than three months.
(4) Other nonresidential uses including temporary uses, whether or not they benefit charitable
organizations, such as:
Auctions and silent auctions
Commercial still photography
Commercial motion pictures /videos
Display of items to be for sale at a later date
Garage /yard sales
Home tours and show houses
Tag /estate sales
Trunk sales and equivalent in -home display sales
(5) Aircraft landing pads and strips, whether temporary or permanent.
(6) Any other use not specifically permitted.
(b) These prohibitions shall not extend to telephonic transactions and communications.
Sec. 70 -50. Private schools.
Any private school conducted in any single family residential zoning district may continue to be used as
such under the provisions of sections 66 -131 et seq. of this Code, provided however, that any private school
building, or other structure used in connection with and as a part of and appurtenant in the operation and
maintenance of such private school, may be replaced, or another building substituted in place thereof;
repaired and maintained from time to time as shall be necessary for the effective operation and
maintenance of such private school; and further, any development permits, orders or written agreements
granted or executed by the town prior to the adoption of this chapter shall remain in full force and effect.
Sec. 70 -51. Minor accessory structures.
The following structures shall be considered as minor accessory structures in all five single family zoning
districts subject to specific setbacks established in this chapter. Any structure which is larger or more
intensive shall be subject to the same setbacks as the principal structure.
(1) Detached, one -story structures of 300 square feet or less and 18 feet or less in height, including but
not limited to:

Gazebos
Greenhouses
Guest houses
Pool cabanasibathhouses
Trellises /arbors
(2) Permanent recreation facilities, including but not limited to:
Batting cages/backstops

This is to convirm that at the Regular Meeting and Public Hearing
held by the Town Commission /Board of Adjustment on March 9, 2001,
your Application for Development Approval bearing File #001 -2 and
consisting of a request for a variance, a site plan review and
an amendment to the existing Developer's Agreement, all in
connection with proposed additions to the existing classroom
complex, was heard.
The Variance and the Level 3 Architectural Site Plan Review to
permit two -story additions totaling 6,236 square feet (net increase
of 5,917 square feet) and to expand the School without corresponding
demolition or replacement of existing structures was approved
subject to the following conditions:
1. The student enrollment shall be permanently capped at 250, as
limited by the existing Developer's Agreement.
2. No additional after -hours functions shall be held at the
School other than those allowed by the existing Developer's
Agreement.
3. The private school campus shall not be expanded onto existing
single - family lots, as dictated by RS -C zoning district use
regulations.
4. The School shall submit an updated long -range master plan to
the Town prior to building permit.
5. A Construction Traffic Management Plan shall be submitted prior
to the issuance of a building permit application. This plan
shall be reviewed and approved by the Town Manager and followed
during construction.

6. The hedge along Gulf Stream Road shall be supplemented with
with additional plants to fill in existing gaps, replace dead or
dying materials, and create a denser hedgerow.
7. The drainage plan submitted with the application shall be
followed.
8. The School shall reimburse the Town for all advertising and
Town legal fees associated with this application.
9. The School is respectfully requested to dedicate a 9' utility
easement across the entire frontage of AlA, to be used exclusivel,
for future undergrounding of power, phone and utility lines.
The amendment to the existing Developer's Agreement that was requested
was denied. However, at the Regular Meeting of the Town Commission
held on April 6, 2001, the matter of the amendment was revisited as
had been directed at the March 9th meeting and the Developer's
Agreement was amended as follows:
1. The provision that read "for each square foot of Building Area
in access of 400 square feet that is added, the School removes
one square foot of either Building Area or Covered Walkway
and covered Open Structure Area ",was deleted from the Agreement.
2. A new provision was added to read "The Gulf Stream School, in
recognition of the extraordinary services provided it by the Town
of Gulf Stream, voluntarily agrees to pay to the Town annually
on October lst of each year the sum of Ten Thousand Dollars
($10,000.00) beginning October 1, 2001, as long as said
extraordinary services continue to be provided by the Town.
This contribution shall remain fixed for a period of three years.
Beginning October 1, 2004, this contribution shall be tied to the
Consumer Price Index snd shall be subject to amendment upon
approval of the School and the Town Commission. Increases in the
annual contribution shall be in proportion to yearly increases
in the Consumer Price Index as reported by the U.S. Department of
Labor, Bureau of Labor Statistice, "All Items" for "All Urban
Consumers." The Base CPI shall be the twelve month average for
the calendar year 2004. The Adjusted CPI shall be the twelve
month average for the calendar year preceding each annual adjust-
ment. The annual contribution beginning October 1, 2004, and ever
year thereafter shall be computed under the following formula:
"New Contribution "- $10,000o00xAdjusted CPI
Base CPI"
All other provisions of the Developer's Agreement shall remain
in full force and effect and the parties agree that this
Amendment shall be recorded in the public records of Palm Beach
County, Florida, within fourteen days of execution by all parties.
