Section 11. Amendment. Chapter 55 is hereby at-riended as follows: CJ 55 ANIMAL [)R(_.)TT,(.110N AND CV-)NTROL 55.01 DE11NITIONS. The follown.19 terms are to be added: 9. "(1)II1111LIflity is defined as any 1'ree-n-Aining cat that may be cared for by one or more tvs1dents of an lininediatearea who is/are lu.iown or unknown; a community cat may or may not be feral. 12. "Eartippmig" means the removal of the 1/4 ch tip of the community cat's left ear, performed while the cat is under anesthesia in compliance with any applicable federal or state law, and under the supervision of a licensed veterinarian. Eartipping is the universally accepted method to identify a sterilized and lawfully vaccinated feral or free-roaming cat. 13. "'Trap-Neuter-Return (TNR)" means the non-lethal process of humanely trapping, sterilizing, vaccinating, eartipping, and returning Community Cats to their original location. 55.04 ABANDONMENT OF CATS AND DOGS. A pet-son who has ownership or custody of a cat or dog shah not abandon the cat or dog, except the person may detiver the cat or dog to another person who will accept ownership and custody or the person may deliver the cat or dog to an an -nal shelter orpound. Returned as pertains to the 'INR protocol shall not, constitute abandonment. (Code 71,73.8) 55.06 A'I' IARGE PROHIBITED. This section shall not apply to (1)mmunity Cats. Section I 11. Repealer. All ordinances or parts of ordinances in conflict with the, provisions of this Ordinance are. hereby repealed. Section V. Severability Clause. If any section, provision or pan of this ordinance shall, be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any,section, provision or part thereof not adjudged invalid or unconstitutional. Section V. Wien Effective. Jbis ordinance shall be in effect, after its final passage, approval, and posting as provided by law. On the 7`1 day of May 2019, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2019-456, and moved that it be given its first reading. The motion was seconded by Councilperson Havens. Ayes: Upton, Ryan, Havens, Schnedler, Bartels Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2019-456, was read the first time, discussed, and placed on record. On the 7"' day of May 2019, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilpei-son Bartels introduced Ordinance No. 2019-456, and moved that it be given its first reading. Whereupon the Mayor declared that Ordinance No. 2019-456 be adopted and signified his approval of same by fixing his signature thereto.
