THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. 568
AN ORDINANCE APPROVING A CONDITIONAL USE ON PROPERTY
ZONED R.1 LOCATED AT 4101 N. EDGEMOOR, WITHIN THE
CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS.
WHEREAS, Notice of a public hearing to consider a CONDITIONAL USE request was provided
in conformance with Chapter 8, Section 8.04 of the Zoning Regulations of the City of bel Aire,
Kansas.
WHEREAS, A public hearing was convened on April 16, 2015, by the Planning Commission for
the City of Bel Aire, Kansas, to consider the matter of permitting a CONDITIONAL USE upon a
tract of land within the City of Bel Aire, Kansas, more fully described below, in conformance with
the requirements set forth in Chapter 8, Section 8.02, of the Zoning Regulations of the City of Bel
Aire, Kansas:
A 1.00 acre tract, known as 4101 N. Edgemoor, legally described as Lot 9, Block
F, Aurora Park Addition, Bel Aire, Kansas;
WHEREAS, Following the public hearing, the Planning Commission found that the evidence
supported recommending approval of this requested CONDITIONAL USE request based upon
the guidelines set forth in Chapter 8, Section 8.02. of the Zoning Regulations of the City of Bel
Aire, Kansas;
WHEREAS, The Planning Commission for the City of Bel Aire, Kansas recommends approval of
the application by the property owner to allow for the CONDITIONAL USE, such CONDITIONAL
USE fully described to operate a home-based business at 4101 N Edgemoorfrom a detached
mother-in-law addition to the home:A This conditional use would allow for a professional office for meetings with clients
conducted by appointment only, and not allowing retail sales or showrooms;B A city home-based business license is required to be in place prior to beginning any
business related operations upon the property;C An 1 1 .5" x 8.5" sign at the entry of the office is the only approved sign with this application;D Parking approved for clients to park in existing driveway, or other lawfully established
parking area;E The initial city building permit must be obtained within 1 year of the governing body
approval of this Conditional Use, or this conditional use will terminate.F All required city building and occupancy permits will be acquired before the initial or future
alteration of the structure;
WHEREAS, the Governing Body has considered the factors set forth in Chapter 8, Section 8.02
of the Zoning Regulations of the City of Bel Aire, Kansas.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:
SECTION 1. The Governing Body adopts the recommendation of the Bel Aire Planning
Commission and approves the application by the property owner to allow for the CONDITIONAL
USE, such CONDITIONAL USE fully described to operate a home-based business at 4101 N
Edgemoor from a detached mother-in-law addition to the home:A This conditional use would allow for a professional office for meetings with clients
conducted by appointment only, and not allowing retail sales or showrooms;B A city home-based business license is required to be in place prior to beginning any
business related operations upon the property;C An 1 1 .5" x 8.5" sign at the entry of the office is the only approved sign with this application;D Parking approved for clients to park in existing driveway, or other laMully established
parking area;E The initial city building permit must be obtained within 1 year of the governing body
approval of this Conditional Use, or this conditional use will terminate.F All required city building and occupancy permits will be acquired before the initial or future
alteration of the structure;
SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. This Ordinance shall take effect and be in force from and after the publication of its
summary in the official city newspaper.
