CALL TO ORDER AND ROLL CALL
Mayor Bailey called the special meeting of the McCall City Council to order at 9:07 a.m.
Mayor Bailey, Council Member Aymon, Council Member Delaney, Council Member Scott
and Council Member Witte answered roll call.
City staff present was Lindley Kirkpatrick, City Manager; Bill Nichols, City Attorney (via
phone); Kim Trout, Attorney with Trout Jones; Ben Slaughter, Attorney with Trout Jones; and
Dick Kluckhohn, with Trout Jones.
Also present for portions of the meeting were Duff McKee (the mediator), members of the
Payette Lakes Water and Sewer District Board, and other representatives of the District.
EXECUTIVE SESSION - MEDIATION
At 9:08 a.m. Mayor Bailey moved to go into Executive Session for:
• Litigation — Pursuant to Idaho Code §67-2345(1)(f) To communicate with
legal counsel for the public agency to discuss the legal ramifications of and
legal options for pending litigation, or controversies not yet being litigated
but imminently likely to be litigated.
Council Member Witte seconded the motion. In a roll call vote Mayor Bailey, Council
Member Witte Council Member Aymon, Council Member Delaney, and Council Member
Scott, all voted aye and the motion passed.
Council discussed the Payette Lakes Water and Sewer District litigation and mediation for
possible settlement.
