HomeMy Public PortalAboutr 06:047 ~£Zúluthm úf t~£ ~úrúug~ úf (1IètrÌ£r£Ì, ~ ~ W + No. 06-47 Date of Adoption .TamJarV 26. 2006 APPROVING THE DESIGNATION OF REDEVELOPMENT AREA BOUNDRlES _ FEDERAL BOULEVARD REDEVELOPMENT AREA WHEREAS, by Resolution #05-243, adopted on Angust II, 2005, the Mayor and Council of the Borough of Carteret ("Borough Council") authorized and directed the Plarming Board of the Borough of Carteret (the "Planning Board") to undertake a preliminary investigation to detennine whether those properties listed on Table 1 Study Area Properties, including the right-of-way of Raskulinecz, as set forth in the Federal Boulevard Redevelopment Area Assessment prepared by Beacon Planning and Consulting Services, LLC, dated October 2005, ("Delineated Area") meet the criteria set fO\1h in the New Jersey Redevelopment and Housing Law, NJ.S.A. 40A: 12A-I et seq. ("Redevelopment Law"), a for being determined to be an "area in need of redevelopment" as therein defined; and WHEREAS, after providing requisite notice, the Planning Board held a hearing on October 26, 2005 to review the results of the preliminary investigation and to solicit public comment on whether the Planning Board should recommend to the Borough Council that the Delineated Area be determined to be an "area in need of redevelopment"; and WHEREAS, at the public hearing, the Planning Board considered the testimony of and exhibits furnished by Andrew ->N. Janiw, a license professional planner with Beacon Planning, the author of the Redevelopment Area Assessment Report for the Delineated Area, and afforded all interested members of the public an opportunity to make inquire into and give testimony concerning the boundaries of the proposed Delineated Area and whether said area should be determined to be a redevelopment area; and WHEREAS, the Planning Board, by a Resolution of Findings and Conclusions, PB-05- 012, has recommended to the Borough Council, pursuant to Section 6 of the Redevelopment Law, that the Delineated Area be determined to be an "area in need of redevelopment", finding that each of the twenty-three lots meet at least two (2) of the statutory criteria, and that many of said lots meet more than two (2) of the statutory criteria, to be an area considered in need of redp.velopment all as set forth in the Assessment Report prepared by Beacon Planning; and WHEREAS, the Borough Council has given due consideration to the recommendation of the Planning Board and further finds that said recommendation is supported by substantial evidence; and WHEREAS, the Borough Council further concludes that there exits within the delineated area sufficient criteria for the designation of a redevdopment area as set forth in NJ.S.A. 40A:12A-5, as more fully described and delineated in the Federal Boulevard Redevelopment Area Assessment Report, as found by the Carteret Planning Board. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey that the Federal Boulevard Redevelopment Area as depicted on Figure 10, Proposed Redevelopment Area, containing those properties listed on Table 1, Study Area Properties, set forth in the above-referenced Beacon Planning AS'sessment report, dated October 2005, a copy of which is attached hereto and made a part hereof, is a redevelopment area as so defined by N.J.S.A.40A:12A-3. NO. 06-47 PAGF 2 BE IT FUTHER RESOLVED, that a duly executed copy of this Resolution shall be transmitted to the Commissioner of the New Jersey Department of Community Affairs: BE IT FUTHER RESOLVED, that a copy of the Redevelopment Area Assessment Report shall be kept on file in the Office ofthe Borough Clerk for public inspection. BE IT FURTHER RESOLVED, that duly executed copies of this Resolution shall be transmitted to the Planning Board and filed in the office of the Borough Clerk.
