RESOLUTION NO. 94 -3355
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING THE PERSONNEL RULES AND REGULATIONS
FOR FISCAL YEAR 1994 -95.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE,
DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. At -will Provisions
A. Section 6 is hereby added to Rule 15 of the Temple City Personnel Rules and Regulations
as follows:
"SEC. 6 At -will Employees:" "At -will" employment as defined in the Labor Code as
employment, having no specified term, which may be terminated at the will of either party
on ten -day notice to the other. Department managers hired after July 1, 1994, are
considered "at -will" and will not enjoy the benefits of challenging disciplinary actions as
described in Rule 15, Section 5 "Appeal Procedures." For purposes of this section,
department managers include:
Public Services Director
Financial Services Director
Community Development Director
Community Services Director
Assistant to the City Manager
City Clerk
B. Rule 7, Section 2 of the Temple City Personnel Rules and Regulations shall be amended
as follows:
"SEC. 2 Probationary Periods /Appointments to Positions:" All original and
promotional employee appointments shall be subject to a probationary period of not less
than one year actual service, and may be extended an additional 90 days at the discretion
of the City Manager. If a probationary employee's probationary period is extended, the
employee shall be given written notice of the extension prior to the expiration of the
probationary period. An oral or written review of progress shall be conducted by the
supervisor after six months of service. The provisions of this Rule do not apply to "at -will
employees."
SECTION 2. The City Clerk shall certify to the adoption of this resolution.
