Driscoll, Town Manager Date: June 18, 2020 RE: Agenda Item—Transfer of Funds Request As you are aware, an Informational Presentation on the proposed renovations and improvements related to Arsenal Park Phase A was given at the May 12t"Town Council Meeting (see attached May 71"Agenda Item correspondence and related excerpt from the May 12t"Town Council minutes.) As a follow-up, attached please find email correspondence from Glen Howard, CDM Smith regarding the results of yesterday's bidding of the project. As indicated in Mr. Howard's correspondence, seven (7)bids were received and the bids ranged from a low of$1,884,000 to a high of$3,363,275. The intent has been to bring forward a proposed loan order for Arsenal Park Phase A Improvements. At this time,monies totaling$988,233 are available in the Fiscal Year 2020 Debt Retirement Short Term Interest Account to support funding of this project as a result of not borrowing for some planned items in Fiscal Year 2020 (see attached Fiscal Year 2020 Cost Analysis.) j I The utilization of unspent Debt Retirement account monies for the acquisition and payment of capital equipment items is consistent with the Honorable Town Council's Ongoing Budget Policy Guideline to make annual capital expenditures (including debt and exclusive of the school Building for the Future Initiative funding and enterprise funds) equal to at least 7.5 — 8% of the operating budget in order to maintain and improve its infrastructure, facilities, and equipment. i Reducing permanent borrowing amounts is consistent with a"very strong debt profile"which is one of the factors Standard&Poor's Rating Services cited in the affirmation of the Town's AAA Bond Rating. Additionally, as stated at the May 12t" Town Council Meeting and in the attached June 18t" email correspondence from Steven Magoon, Community Development &Planning Director/Assistant Town Manager, $200,000 from the Housing Choice Grant is available to support funding of this project. As indicated in the June 18t"email correspondence,the $500,000 contribution from Boylston Properties will not be available to support funding of Phase A as construction of Building G has not started. Lastly, the remaining balance of$789,967 to fund this project is available in the Town Council Reserve Account. Given all of the above and in order to move forward with Arsenal Park Phase A Improvements, I respectfully request the attached transfer of$1,778,200 (see attached spreadsheet)be placed on the June 23, 2020 Town Council Agenda. The project schedule may need to be adjusted based on current events,but if so,the duration should still be applicable. This is a project that has been through extensive public discussion through the Conservation Commission and staff efforts. The discussion of the entire park project has been on the agenda of the Conservation Commission many times since October of 2017. This includes a March 12, 2018 meeting to review the draft plan, a December 5, 2018 meeting to review and approve a 25%draft Plan, and a March 4,2020 meeting to review and approve the construction drawings, as well as permitting for the first Phase. The matter before the Commission was reduced to Phase A due to a Housing Choice Grant the Town received specific to construction of the first phase. The remainder of the Park has conceptual design, but has not yet been fully designed or permitted. Therefore,I would respectfully request the opportunity to have our consultant, CDM Smith, present the final design of Phase A of Arsenal Park for Town Council consideration. Glen Howard, CDM Smith, stated that Phase A renovations of Arsenal Yard are at the east end of the park,provide a formal gateway to the park, and will be for residents' use as passive open i space. The project was broken into phases in part to use the Housing Choice Grant of$200,000, which must be expended by June 2021, and will take about 3-4 months to complete in the October-November period. He stated that this might also be a good bidding environment as there have been few construction projects open for bid since the COVID-19 crisis. Nicholas Watkins,Lead Landscape Architect at CDM Smith, stated the majority of the park will be for programmed active use;therefore, Phase A will focus on an unprogrammed open space. The park's emphasis is to provide an attractive entry point. There will be an eight foot raised knoll with a seating area to enhance park views and is handicapped accessible by an elliptical pathway. An abutting terraced lawn can be used for general activities. The pavilion will be adjacent to a tree bosque with picnic style seating situated on a stone dust surface. In addition, there will be a gateway sign between Arsenal Yards and Arsenal Park designed to emphasize the industrial past. The plantings will be mostly native species that are excellent pollinators and will provide enhanced coloring in the spring and fall. The trees will be selected for minimal maintenance that can easily grow to mature size i A full irrigation system will allow for minimal maintenance of the area. The runoff from the berm and bosque areas will be collected and sent to two rain garden areas. Overflow will be sent to an underground storage tank and will be treated onsite so that the water will not be sent to the local sewer system. Mr. Howard stated the cost of this portion of the project is estimated to be $1,650,000 including a Pavilion. If the bidding is approved,the bidding period would be from May 28—June 11, 2020. Town Council approvals could be completed on June 23 and July 14, 2020; construction would be completed by mid-November with a goal of having the landscaping and sod completed by the end of October. EXCERPT •• 1 1 TOWN COUNCIL In the discussion that followed,these matters were brought up: TREES — Honey locusts, which have a 4-6 inch caliper, will be used in the tree bosque area because they are good in high traffic areas, can provide a large canopy, and have a shallower root system that will utilize the I moisture in the area — In 5-10 years, the caliper should double and within 20 years,there should be a full canopy with trees touching each other in a 25 foot span — The majority of the trees will have a 2.5—3 inch caliper similar to the ones planted at the entrance of Filippello Park — All trees within the park should mature around the same time TABLES—STONE DUST SURFACE — Wheelchair accessible tables will be available in the bosque;the table seating will vary to accommodate people with needs — The proposed square seating on the tables is uninviting and should be replaced with oval or round seats — The stone dust was designed to minimum grades to provide a positive flow of slope water so as not to create rutting or water concentrating in a location — The catch basins were elevated to the elevation of the stone dust — The stone dust will be placed on a layer of stone to aid the water infiltration — Stone dust stabilizer will be applied to the surface for high traffic areas — There will be some tracking of the stone;the concrete will need sweeping TRASH — Three to four Big Belly trash receptacles that notify when filled and will be placed at main access points — There should be an agreement with Arsenal Yards for daily maintenance of the area I RAIN GARDENS i EXCERPT ' • 2020 TOWN COUNCIL — The rain gardens will capture water prior to draining into the subsurface drainage system — They are needed to meet storm water reductions and will aid the quality of the storm water before it is released to the drainage — The gardens should remove about 90% of the phosphorus suspended solids before being stored in the infiltration chamber PARK USAGE — The Pavilion is planned as an event space — The berm and lawn will provide partial views to the river especially during the spring and fall and is intended to be used for informal activities — The Conservation Commission and Recreation Department would need to determine if the use of some areas need to be reserved or are able for reservation CONSTRUCTION STAGING — Staging will be kept to a minimum; most of the earthwork will be to install the subsurface for drainage — Staged elements will be on the tennis courts PROJECT PROCESS — Town Council will need to permit the Town to bid the project — The Town will create a bid package in May — The project will be bid the first two weeks in June — The First Reading of the Loan Order will be on June 23, 2020 and the Public Hearing and Vote will be on July 14, 2020 — The borrowing will be reduced by $700,000: $500,000 will be from mitigation funds from Arsenal Yards and $200,000 from the Housing Choice Grant Councilor Piccirilli moved to authorize the Arsenal Park Phase A project go out to bid as presented; Councilor Woodland seconded the motion. A copy of the bid comparison is attached.The bid prices for the base bid plus Alternate#1 ranged from a low bid of$1,884,000 to a high bid of $3,363,275. The low bidder was Heimlich Landscaping&Construction Corp of Woburn,Massachusetts. Mrs. Linda Heimlich is the President of the company. The low bid was 14% above CDM Smith's estimate and 19%above our estimate when factoring in a 5% construction contingency of$94,200 which we recommend adding to the award. As we discussed we are in the process of working to identify the discrepancies between our estimate and the bid price.Heimlich Construction Corp.has offered to review our estimate and assist us in this effort. i0 WATER+ENVIRONMENT+TRANSPORTATION+ENERGY+FACILITIES CDM Smith Mr.Michael Driscoll June 18,2020 Page 2 There were no questions during the bid period which is typically an indication that the bid package q g P t3'P Y was clear,concise and met CDM Smith's standard of quality. There were 2 bids in relative proximity to the low bid including R.A.D Corp.at$2,043,611 and Quirk Construction Corp.at$2,241,000.This is another indication that Heimlich's price of$1,884,000 is an accurate estimate of the project cost as bid and a good price in comparison to the other bids. At this time,we believe the discrepancy between our estimate and the bid price is related to the high-quality materials we specified for the project.The design and materials selection for this project included an extensive community process and close coordination with the conservation commission to ensure the Phase A renovation meets a level of quality that Arsenal Park deserves as a"jewel"of Watertown open spaces.We also reviewed and coordinated with the Arsenal Yards developer to ensure that our materials selection provided continuity and connectivity through the entrance into the park. The project includes a significant quantity of Tectura precast wall panels,wall coping,pier caps, stairs and Bomanite premium finish aggregate colored concrete walkways and promenade which we specified as proprietary in order to achieve this high level of quality.The project also includes extensive landscaping and rain gardens to enhance aesthetics to meet stormwater quality standards. We believe these items may be where the pricing discrepancy occurred.Prices quoted from the manufactures may have differed from the pricing provided to contractors. j I We also recommend the inclusion of Alternate#1,the Performance Pavilion.The bid price of $92,000 is excellent and much of the Phase A area was designed to complement a focal point with the Pavilion at the center.It also provides an area for residents to picnic,gather and provides an additional venue in Watertown to hold special events. I We value our relationship with Watertown and if directed we would be happy to evaluate what could be removed from the project and re-bid at no additional cost to the Town.Unfortunately,as indicated,in order to achieve better pricing,we believe we would have to change the materials specifications to standard concrete walkway,standard precast concrete for the walls and reduce the quantity of landscaping.This would reduce the aesthetic appeal of the Phase A area and the difference would be visibly evident.If installed as bid we believe Phase A will be an even more significant compliment to Arsenal Park and the Town of Watertown. A list of completed projects included in Heimlich Landscaping&Construction Corp's reference package indicates that the contractor has completed numerous park improvement projects and athletic field projects in the last several years. The most recent includes Improvements to Wayland High School Athletic Facilities in Wayland,MA with a value of$S,797,000 and Greater Lawrence i CDM- Smith Mr.Michael Driscoll June 18, 2020 Page 3 Regional Vocational Technical School Athletic Campus Improvements, Phase 2 in Andover,MA for $1,577,700. CDM Smith has worked with Heimlich Landscaping&Construction Corp.on numerous projects dating back to 2006. These projects include: Filippello Park Improvements and Dog Park in Watertown,the Ward Park Improvements Project in Marlborough,and the Harry Dello Russo Stadium Improvements in Revere We have always found Heimlich Construction Corp to be a very competent contractor,thorough in their execution,run a very neat job site,have met project deadlines,and are fair with clients in terms of project change orders. Other references contacted indicated Heimlich has been good to work with,their change order requests are reasonable,their quality of work is excellent,they completed their work on schedule,and would gladly work with them again. I spoke with the contractor's bonding agent at Eastern States Insurance Agency,Inc. who indicated that the contractor is in good standing and currently has a$3,500,000 single project limit and an$8,000,000 combined limit. The contractor's bank is Northmark Bank.I spoke with Glenn Johnson,Senior Lending Officer who noted that Heimlich Landscaping and Construction Corporation accounts are in good standing. CDM Smith's review indicates that Heimlich Landscape and Construction Corp.appears to have the capabilities and resources necessary to complete the project.Therefore,we recommend the Town of Watertown award the Arsenal Park Improvements Project Phase A to Heimlich Construction Corporation for both the base bid plus Alternate#1 in the amount of$1,884,000. This was not a specific numerical commitment as there were a number of moving parts at this point. As Boylston Properties moved forward with Site Plan approval for Phase 5 Building G, staff included condition language that provided specificity to this offered mitigation. The Site Plan condition requires a $500,000 contribution to be made prior to occupancy permit approval for Building G for the Arsenal Park Phase A. Building G has not started construction, so this contribution would not be available for construction of Phase A this summer, but will be paid prior to occupancy for Building G. The second outside funding source is a grant for$200,000, which has been approved by the State. This money must be spent and reimbursed prior to next June. i
