Priem 771.80 $11,930.00 187 MEDINA CITY COUNCIL MEETING MINUTES OF NOVEMBER 21, 1995 The City Council of Medina, Minnesota met in regular session on November 21, 1995, at 7:30 p.m. in the City Hall Council Chambers. Mayor Anne Theis presided. Members present: John Ferris, Jim Johnson, Ann Thies, Phil Zietlow, and Mayor Anne Theis. Members absent: None. Also present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City Engineer Shawn Gustafson, City Attorney Ron Batty, and Clerk -Treasurer Jeff Karlson. 1. Adoption of the Agenda MOVED BY ZIETLOW, SECONDED BY THIES, TO ADOPT THE WRITTEN AGENDA WITH THE FOLLOWING ADDITIONS: 1. PARK ITEMS 2. EXECUTIVE SESSION TO DISCUSS MCWD V. CITY OF MEDINA MOTION PASSED UNANIMOUSLY. 2. Consent Agenda MOVED BY THIES, SECONDED BY JOHNSON, TO ADOPT THE CONSENT AGENDA, AS FOLLOWS: 1. RESOLUTION NO. 95-56, "RESOLUTION AUTHORIZING PUBLICATION OF ORDINANCE NO. 287 BY TITLE AND SUMMARY" 2. RESOLUTION NO. 95-57, "RESOLUTION CERTIFYING DELINQUENT WATER, SEWER, AND RECYCLING CHARGES TO THE HENNEPIN COUNTY AUDITOR FOR TAX COLLECTION" 3. Mayer Mobil -- Request for Reduction of Letter of Credit Mayer Mobil requested a reduction of their financial guarantee to reflect work completed throughout the middle of November 1995. Shawn Gustafson recommended that the council reduce the financial guarantee from $139,743 to $40,951. MOVED BY FERRIS, SECONDED BY THIES, TO APPROVE THE REDUCTION OF MAYER MOBIL'S FINANCIAL GUARANTEE TO $40,951. MOTION PASSED UNANIMOUSLY. 5. Affirmation that a Variance was Granted to the Hamel Fire Department In a memo to the city council, Planning and Zoning Assistant Sandie Larson noted that a variance was granted to the Hamel Fire Department in 1985, but the resolution was never completed. MOVED BY FERRIS, SECONDED BY ZIETLOW, TO ADOPT RESOLUTION NO 95- 61, "RESOLUTION AFFIRMING THE GRANTING OF VARIANCES TO THE HAMEL FIRE DEPARTMENT," ALONG WITH THE CONDITIONS AS STATED. AYES: FERRIS, JOHNSON, THIES, ZIETLOW, AND MAYOR THEIS. NAYS: NONE. RESOLUTION NO. 95-61 ADOPTED ON A 5-AYE AND 0-NAY VOTE. 6. Discussion of Trunk Highway 12 Corridor Project Ann Thies summarized the project schedule for the Trunk Highway 12 Corridor Study. The decision process included a public open house in each city. Thies said she would contact Valerie Reinaas of MnDOT about having an open house in Medina the first or second council meeting in January 1996. 7. Brush Removal Jim Dillman said that because of a Medina resident's complaint, the DNR was out to inspect the city's open burning site. Dillman disclosed that it was necessary to change the way the city disposed of trees and brush. He mentioned four things that the city should be doing: • Inform residents of alternative methods of disposal such as chipping. • Open burning limited to three two week periods during the year. • Separate logs and large branches and make them available to the public for firewood. • Brush that comes from roadside trimmings should be chipped or burned off -site. Dillman emphasized that he would do everything he could to prevent the burn site from being closed down. 8. Consideration of Trails Along Hamel Road Ann Thies pointed out that Martha McPhee, owner of property at 1982 Hamel Road, wrote a letter to the city which expressed her concerns regarding the construction of the Hennepin County Public Works Facility near her property and the designation of 189 Hamel Road as a county road. Thies mentioned that no one from the city had responded to McPhee's concerns and that someone should contact her. Thies noted that Hamel Road was a popular horse trail and she was not in favor of paving the road if it could not be used as a trail. Thies felt that residents should be given an opportunity to voice their opinions on these matters before the council approved the county's Planned Unit Development (PUD). Mayor Theis asked Ron Batty what the timing was for the county's development agreement. Batty said the PUD agreement would be ready for consideration in early January 1996. The council agreed that everyone along Hamel Road and Pioneer Trail should be notified that the county had agreed to pave Hamel Road and Pioneer Trail. The council also recognized the need to look at the corridors which connected the equestrian routes in Medina with an eye toward preserving off -road trails wherever possible. MOVED BY FERRIS, SECONDED BY MAYOR THEIS, TO TABLE THE DISCUSSION OF HAMEL ROAD UNTIL DECEMBER 19, 1995. MOTION PASSED UNANIMOUSLY. 9. 1996 Assessment Contract MOVED BY JOHNSON, SECONDED BY FERRIS, TO APPROVE THE "CONTRACT FOR ASSESSING SERVICES" WITH THE GREATER NORTHWEST OFFICE OF REAL ESTATE ASSESSMENTS IN THE AMOUNT OF $29,088 FOR THE PERIOD SEPTEMBER 1, 1995 THROUGH AUGUST 31, 1996. MOTION PASSED UNANIMOUSLY. 10. 1996 Budget The council reviewed each line item in the 1996 budget. The taxable tax capacity of Medina increased by 10.6% to 5,862,175. The 1996 preliminary property tax levy was established at $873,434, an increase of 9.9% over the 1995 levy of $794,494. The city's tax rate dropped from 14.55% to 14.51 % under the proposed levy. General Fund revenues were estimated, as follows: General Property Taxes $880,086 Licenses & Permits 113,750 Intergovernmental 287,491 Charges for Services 123,785 Fines & Forfeits 55,000 Transfer from Reserve Funds 260,000 Miscellaneous 186,192 TOTAL $1, 906, 304 190 General Fund expenditures were estimated, as follows: General Government $377,681 Public Safety 697,915 Public Works 297,879 Parks & Recreation 35,588 Capital Outlay 430,400 Miscellaneous 66,841 TOTAL $1,906,304 The council discussed the Hamel Athletic Club's request for a $9,600 contribution to maintain the ball fields at Hamel Legion Park, which was $1,100 over previous years. Phil Zietlow wanted to know why the Athletic Club budgeted an additional $1,750 for salaries, bringing the total to $5,250. Zietlow pointed out that this was more than the city spent for all its parks. The council agreed to table the matter until the next meeting so that an explanation could be provided by the Athletic Club. 11. Park Items In a memo to the City Council, Park Commission Chair Tom Gregor specified that the Hamel Athletic Club wanted to host a winter golf tournament at the Hamel Legion Park to raise money for the new multi -use facility. No alcohol was involved in the fund raising event. MOVED BY FERRIS, SECONDED BY MAYOR THEIS, TO RESERVE THE HAMEL LEGION PARK ON FEBRUARY 24, 1996, SO THAT THE HAMEL ATHLETIC CLUB CAN HOST A WINTER GOLF TOURNAMENT. MOTION PASSED UNANIMOUSLY. Gregor reported that the Northwest Trails Association had asked permission to maintain the snowmobile trail that crossed the old Nyberg property. MOVED BY ZIETLOW, SECONDED BY MAYOR THEIS, TO GRANT THE NORTHWEST TRAILS ASSOCIATION PERMISSION TO CONTINUE USING THE EXISTING SNOWMOBILE TRAIL ACROSS CITY PROPERTY. MOTION PASSED UNANIMOUSLY. 12. Payment of Bills MOVED BY THIES, SECONDED BY FERRIS, TO APPROVE PAYMENT OF ORDER CHECK NUMBERS 15230-15276 FOR $36,538.03 AND PAYROLL CHECK NUMBERS 14587-14599 FOR $11,930.00. MOTION PASSED UNANIMOUSLY. 191 13. Executive Session Ron Batty announced at 9:00 p.m. that the council would be going into executive session on the basis of attorney -client privilege to discuss litigation in the matter of Minnehaha Creek Watershed District v.
