Be cautious of opening attachments and clicking on links.  Dear Mayor Fine and City Council, I know all of you have been working incredibly hard to make impossible decisions during global crises - all of them are difficult and heartbreaking.      I know cuts to our fire department were one of these decisions - I am writing as a member of the community to express my concern. I am really worried that because of these cuts, if I or one of my neighbors were to need a first responder during the pandemic that delayed response could put someone’s life in danger.      I know the Weekly has published multiple articles in the last years about how a fire similar to Paradise could occur in this area - especially with climate change increasing the risk of megafires. Given the fire season the last few years and the current pandemic I want to know our community is as prepared as possible to face the current health crisis and further emergencies that may arise.      As you all know outside of saving lives our fire department makes a mean pepper sauce, helps deliver letters to Santa in the winter, they host movie nights at the firehouse, fundraise for St. Jude’s, Breast Cancer research, and the Muscular Dystrophy Association, and in the last 8 years their Charitable Fund has raised over $60,000 for community programs including college scholarships for our students. Some of our firefighters live with their families as far away as the Sacramento area and commute every few days to serve our city, they face increased health risks because of their work, they serve 125,000 individuals in our area and respond to over 8,000 calls a year over half of which require medical attention.      It breaks my heart to hear the brave individuals of Palo Alto Fire currently on the frontlines of the pandemic, are breaking physically and mentally.     Please do anything you can to ensure Palo Alto Fire is well funded. If there is anything community members can do to assist please let me know - I know these are trying times and everyone lending a hand is important.    Thank you for your leadership! I would like to tell a story of a time I was arrested and brought to a police station for an overnight stay that describes  unprofessional and unlawful behavior of the police and inhumane treatment of detainees.    We had been celebrating a friend’s birthday at The Patio in downtown Palo Alto. Near the end of the night, I was told  that my friend had been arrested. The bar had refused to let her husband from Botswana back into the bar, and she  had called them racist while arguing with them. The police arrested her on a drunk in public charge. The police  claimed she (a 5 and a half foot girl) had attacked and punched the 250 pound security guards, which seemed an  absurd accusation to me. I asked them where she was being taken, and they told me “to San Jose”. They refused to  say anything more to me about it.     Her husband was distraught, and kept saying this would never happen in his home country of Botswana. After more of  our friends spoke to the police to figure out what to do, 6 or 7 more police cars showed up on the scene and said we  had to get out of there, even though we were standing on a public sidewalk. As we walked down the street, police cars  circled around us. I decided to take a video of the scene, and a person sitting against a street lamp starting pointing a  bright flashlight into my eyes. I told him to stop repeatedly and he refused. He got up off the ground and came toward  me and stuck the flashlight in my face. I slapped the flashlight onto the ground and Officer Nick Enberg immediately  pulled up in his car and arrested me. I never made contact with the person’s body or hand. Officer Enberg made no  attempt to mediate the confrontation between me and the man with the flashlight. In fact I was not asked what  happened at all, during any part of the night, the arrest, or the stay at a San Jose holding cell.     Officer Enberg arrested me for Drunk in Public, but I was neither unable to excercise care for my safety or the safety of  others nor was I interfering with anyone’s ability to use public ways. I was attacked by the man with the flashlight, and  39 I defended myself without hurting anyone.     I asked to be breathalyzed, because I knew I was not drunk, but he refused. Officer Enberg heckeled me in the Palo  Alto police station saying to another officer: “He attacked a homeless man. He probably beats his women.” Officer  Enberg referred to the “homeless man”, but the man on the street wasn’t dressed like he was homeless, was leaning  against an uncomfortably cylindrical pole, and had a bright flashlight. A friend suggested to me later that the person  on the street might have been an undercover cop, which seems quite plausible.     After breathalyzing me at the Palo Alto police station, Officer Nick Enberg told me that I blew a 1.2 BAC. I was not  anywhere near drunk at that time. I had had a total of 4 drinks that night over the course of 7 hours, and hadn’t had a  drink for about 2 hours. So I asked to see the reading but he refused to show me any reading. I am very confident the  officer lied to me about my BAC, as apparently lying is legal for them to do.    In the car ride to San Jose, I told the officer my seatbelt wasn’t on. I had to repeat myself a few more times before he  pulled over to put the seatbelt on. He was also texting on his phone while driving on the freeway, and after I asked  him to please stop texting while driving a number of times, he started reading and typing messages on the laptop in  the car instead. I could read the messages and these didn’t look like official messages either ‐ just banter. We were on  the freeway and I told him typing on the computer was just as bad as texting and I’d like him to stop. He kept doing it  for another few minutes before closing the laptop and continuing the rest of the drive more or less legally.     When we arrived, someone at the San Jose department admitted me, and I was given forms to sign. One of them said  “I acknowledge that I am not receiving any medi‐cal benefits”, which I told the woman at the desk wasn’t the case.  She said she corrected it on the computer and said I should still sign it. I asked her “shouldn’t I sign a corrected form?”  She asked “you want me to print it out again?” She gave me a sour face and took the form from me and signed it  herself, rather than printing out a corrected page for me to sign.     I was then put in a holding cell with about 15 other people in it. There were already 2 or 3 people standing as there  was no more space on the bench. I repeatedly, and quietly, waved out the holding cell window and mouthed that I  wanted to talk to someone. Some officers simply averted their eyes or turned away. Some mocked me. Some just  pointed and laughed. No one came to the holding cell to see what I wanted to say. There was a button labeled “press  for assistence”. I pressed it perhaps a hundred times and no one took notice. The only times the door was opened was  when a new person was put into the cell. Each time I told the officer on the other side that I was wrongfully arrested  wanted to talk to someone. I told this to probably 3 officers. After about 30 or 40 minutes, someone opened the  holding cell door and took me out, saying that I was “annoying the hell out of [him]”. He handcuffed me to a battery of  chairs where 20 or so other people were handcuffed.     To my right was a person who was either having a bad drug reaction or had psychiatric problems. He was constantly  struggling against his handcuffs, making a metal on metal sound. He struggled for a few hours before they took him  and handcuffed him to a wall and hid him behind a curtain. The whole night he periodically made strange noises,  yelled for a nurse, yelled for water, and yelled to be taken to a hospital. Several times he said he needed to take his  medication. He was never given water and a nurse never came to talk to him, though perhaps 5 hours into my stay a  psychiatric evaluator did talk to him. The whole night there was usually two nurses on duty, and at least one at all  times. But the nurses never came to talk to anybody.     I asked for water repeatedly. I told each passing officer I was wrongfully arrested and would like to talk to someone. I  asked repeatedly that I would like to use my cell phone. Various responses I got were:     “Alright, give me a minute.” And the officers that said this never came back to me.     “You can talk to someone in a couple hours.” I was never talked to about my arrest.     “We can’t do that.”   40   “You have to wait for the nurses to come around [for water].” Nurses never came around for anything, much less to  get anyone water.     “We don’t work here. If you want water, don’t get arrested.” And then laughed at me.     “Stop asking questions.”     The nurse told me from behind the desk: “Ask the guys in green for water.” The guys in green were the ones who told  me to wait for the nurse.     About 6 hours into my stay, I asked the nurse, still behind the desk, for water. She told me “You can get water when  you’re released. You’re not dehydrated.” A strange thing to tell someone who came in on a Drunk in Public charge. I  told her “I am dyhydrated.” She didn’t respond, so without yelling, I raised my voice to the entire room “This is  inhumane, I just want a drink of water.” No one did a thing.     Some people got cups of water when they came in, but none of the 4 or 5 people I heard asked for water was given  water. Eventually, after about 7 hours, I was released.     When I spoke to my friend that was arrested, she told me the same thing my sister had, my friend never attacked the  security guards, she just called them racist. The Palo Alto police department should be ashamed to spend its time  harassing people who are having a bad night. The wrongful arrests of my friend and myself show how unjust and  unprofessional the Palo Alto police department is, as well as how awful the conditions are at the San Jose police  station. I witnessed the health and safety of detainees at the SJPD being put in jeopardy.     I sent this letter to 6 members of the Palo Alto government, 2 members of the San Jose government, and 4 San Jose  Council District emails. Not one recipient responded to my letter. What is the Palo Alto council going to do about the unjust and unprofessional Palo Alto police department? I ask for  the following:    * Nick Enberg and should be put up for a review of his conduct by an independent review (independent of the Palo  Alto Police Department).  * The Palo Alto government should put in place a clear mechanism for people arrested by police to be informed of  how to hold the police and jails accountable for inhumane treatment, false arrest, and other unjust behavior. Arrested  individuals should be given information about how to raise a formal complaint and there should be a clear process  published that allows this to happen smoothly.   41 * There should be an easy and obvious way to search records of complaints against police officers without going  through any kind of public information process. The information should be published online for all to see.  * The Palo Alto council should give serious consideration to the call to "Defund the Police", which is a call to transfer  responsibilities from police to other government organizations for types of cases that rarely require arrests and  physical confrontation.   * Prohibit uniformed officers from lying (except in cases where it has a high likelihood of jeopardizing the life of an  undercover officer).   * Give serious consideration to rotating police out into other jobs that don't come along with additional powers that  normal citizens don't have, like being firefighters and EMTs.  * Demand that Santa Clara County treat the people they jail humanely.   * Consider replacing the leadership of the police department with someone from the outside who has a track record  of being able to reform police culture.     There is a reason that people are protesting across the country and across the world. This is not just a problem in  Minnesota, or New York, or Oakland. Its a problem right here in Palo Alto. Our police are out of control, and we need  to build structures that will hold them accountable for their actions. CAUTION: This email originated from outside of the organization. Be cautious of opening attachments and clicking on  links.  ________________________________    Dear City Staff and City Council,    I would like to know if the City still plans to spend around  $400,000 in FY 2021 to replace functioning seats in the Lucie  Stern and/or Children's Theatre while cutting $700,000 from the Children's Theatre budget. This appears at odds with  the City's stated goal of spending money in FY 2021 on "critical infrastructure" while reducing spending on "discretionary  projects." This is a non‐critical, utterly discretionary project, and, if it's still in the budget, makes no sense at a time when  the Children's Theatre and Lucie Stern auditoriums have been closed for months, and the Children's Theatre budget is  being cut by 50%.    I have been told that the Friends of the Palo Alto Children's Theatre proposed providing funds to the City to avoid  cutting programs and laying off Children's Theatre staff if the City could meet them halfway with an additional $100,000  for the Children's Theatre. The City demurred. Yet it appears you are still spending four times that amount on seats  which have essentially not been used since February 2020, and are unlikely to be used before January 2021. In fact, the  newly‐proposed health guidelines for Santa Clara County call for keeping indoor theatres closed indefinitely, so for the  City to spend money on functioning theatre infrastructure while defunding Children's Theatre programs and staff which  can deliver services virtually is hypocritical and indefensible.    This project, "AC‐18000 Performing Arts Venue Seat Replacement" is listed in budget document ID #11330, which was  sent to the City Council for the June 22 meeting, and was the basis for the City Council approving the FY 2021 budget  that night.    Best,    Jeremy Erman  48 Baumb, Nelly From:John Guislin <jguislin@gmail.com> Sent:Thursday, July 2, 2020 3:08 PM To:Council, City; Shikada, Ed; Jonsen, Robert Subject:Fwd: ALL fireworks are ILLEGAL in Redwood City. This included banning no knock warrants. No knock warrants have already been banned in Oregon and Florida. Dear Palo Alto Human Relations Commission, The supreme court found in many cases no knock warrants can violate the 4th amendment. In many cases police also fail to knock and announce with sufficient time for the resident to answer the door resulting in a regular warrant being illegally converted to a no knock warrant. Breonna Taylor, who had never been convicted of a crime was killed by police during a no knock warrant, which did not meet the requirements as stated by the supreme court and was thus illegal. In my neighborhood in Duveneck St. Francis, in 2002, Palo Alto SWAT got the wrong house while serving a warrant in response to a bomb threat against Greene (formally Jordan) Middle School. My neighbor told me how SWAT unexpectedly showed up on his doorstep in full battle gear. Fortunately they knocked but my law abiding neighbor and his family were still shocked. The SWAT team showed the warrant and then entered searched his house and confiscated his computer (which they only reluctantly returned 9 months later). Turns out my neighbor had allowed one of his neighbors to share his internet connection and unfortunately the middle school child of that other neighbor had sent the threatening email to Greene Middle School. Despite good detective work, PAPD SWAT still got the wrong house and had they gone in with a flashbang the family would have been traumatized. What if the father had been holding a black cell phone when SWAT entered the home? I feel this inclusivity and equitable access is particularly important precisely because of Palo Alto’s lack of diversity and the systemic barriers to living here for BIPOC. My understanding is that Palo Alto only has 1.2% Black or African American community members (much lower than national average of 13.4%). It’s important to remember that this low diversity rate was designed/built through historically well documented red-lining practices that excluded BIPOC. This historical systemic exclusion is further perpetuated through other more (subtle?) redlining practices that limit access for BIPOC, such as restricting access to this park.     Surely there's a way to balance understandable concerns about the number of people who enter the park and concerns about  taking care of the preserve with concerns around systemic exclusion and a desire to make the park more accessible to our  neighbors?  I'm aghast every time I have to present ID at the park entrance (ask my kids :). I'm all too aware of how many  cannot afford to have that particular ID. I would love to share this park access at least with EPA. My kids and I have loved the  hikes and fishing there and have been so grateful for this amazing, unique space. Given that it is shared during the week  without monitoring ID and it hasn’t been catastrophic, I think a pilot at the very least could be very effective in reassuring  people in this regard.   I recently helped to organize a hike in another nearby hiking area with local high school seniors from an under-served community. Many told me that it was their FIRST time on a hike. After we hiked, we sat by the stream and drew the water. I hope we can make hiking and awesome experiences like this more widely available in a sustainable way. The new RHND numbers would unfairly and unreasonably impact Palo Alto and the Mid-Peninsula. They are based on an aggressive job growth projection within an already congested Silicon Valley, and focus an increasing share of new jobs in these already jobs-rich areas while the share in the East Bay and San Jose continue to fall dramatically. 6 3. The RHND jobs-based numbers require unattainable housing solution by Palo Alto and the surrounding communities. The new RHND mandate more than DOUBLES the current new housing requirement in Palo Alto and surrounding communities, a demand that cannot be met given that median housing prices are already the highest in the country. 4. The penalties for not meeting the goals associated with the RHND numbers are very destructive of local government … if Palo Alto cannot meet these goals, we would lose control of local zoning to the State and to non-elected bodies like MTC/ABAG. However, the Metropolitan Transit Commission (MTC)/Association of Bay Area Governments (ABAG) and HCD have refused to allow any open and transparent discussion – as required by our laws. We are being asked to bear an extraordinary burden without any representation, without any input. We urge Council to insist on transparency and public participation in Plan Bay Area 2050 and the Final Regional Housing Need Determination.  We didn’t meet our last RHNA goals for affordable and at-market rate housing, and now we are told to build over 4000 new housing units in Palo Alto. We have also been told we have to add even more jobs as we have been targeted as a “high opportunity area.”   Palo Alto is already experiencing an excruciating jobs/housing imbalance which has caused housing costs to skyrocket. Yet commercial building profitability continues to outpace housing profitability, which de-incentivizes private sector investment in housing. We’re being set up for an extraordinary Catch 22. If we race to meet the RHNA numbers, our jobs/housing imbalance will only be exacerbated, which is a great irony, isn’t it?   Please advocate for Palo Alto and in so doing join with other Bay Area cities in questioning the methods as well as the results of this flawed process. Dear Chair Templeton and Commissioners, I am a 50 year resident of Palo Alto with an office in PA since 1969 but today I write in my role with the Center for Continuing Study of the California Economy. In that role I served on the HCD review committee as they were translating state law into the regional housing needs determination process. I have had ongoing conversations and emails with HCD staff in charge of the RHNA. I also was under contract to the Southern California Association of Governments (SCAG) as they developed their RHNA application and in their appeal process. In June 2020 I presented at SCAG's demographic workshop on the potential impact of COVID on their long-term growth forecast. I was a consultant to ABAG through early November 2019 on their Plan Bay Area 2050 growth forecast and understand the methodology and assumptions underlying their forecasts. Four Recommendations for PTC, Council and Staff 1. Invite HCD to come and explain their criteria for reviewing Housing Elements prepared for the new RHNA cycle and their legal authority in reviewing these and project determinations with regard to good faith efforts to meet housing goals. 2. Invite ABAG (and participate in the upcoming public engagement opportunities) to understand the goals and strategies of the Blueprint/Plan Bay Area 2050 with regard to housing and transportation. 3. Invite SV@Home,the Terner Center and nonprofit and private developers to understand how housing projects can pencil out and the role of inclusionary zoning %s in project feasibility. 4. Consider tonights and the above discussions as inputs into the development of the City's updated Housing Element that we will be working to develop in compliance with HCD guidelines. Discussion of the staff memo with regard to the regional and Palo Alto RHNA allocations RHNA Methodology State legislation required HCD to include factors to reduce overcrowding and the number of cost burdened household in their RHNA housing needs determination methodology in addition to moving toward a normal level of vacant housing. These legislatively mandated additions to the RHNA methodology attempt to alleviate the hardship to residents caused by the shortage of housing built and the large job growth that has occurred since the cycle 5 RHNA housing needs determination was made 8 years ago.The staff report includes the HCD determination letter to ABAG elaborating on this process. It is this inclusion of those two state mandated goals that caused the increase in the Bay Area and Southern California RHNA goals. It is NOT because HCD is factoring in higher future growth rates than previously projected. The HCD determination letter sets forth the basis for HCD’s RHNA determination. You can also find memoranda from MTC/ABAG staff on their websites on the determination process. 46 HCD made two choices in developing the Bay Area RHNA that resulted in a LOWER RHNA allocation. The first choice (probably a fair move) was to reverse what they did for SCAG and compare the Bay Area to comparable regions not the nation in the allocation to reduce overcrowding and the number of cost- burdened households. A comparison to national averages would have resulted in higher RHNA allocations. The second choice was to use the Department of Finance (DOF) population projections for 2030 instead of those consistent with the ABAG growth forecast, which were 400,000 higher in 2030. HCD did NOT use the ABAG growth forecast for jobs as part of their determination but there has been regional and local discussion as if that did happen. For your information I have included data about the current ABAG growth forecast though it was not used in the HCD RHNA determination. The high job growth forecast adds 1 million jobs between 2019 and 2050 for average growth of just over 30,000 jobs per year or an annual growth rate of 0.7%. Growth for 2015-2019 by comparison was more than double in numbers and more than three times the annual growth rate. In Plan Bay Area 2040 job growth of 700,000 was forecast for 2015-2040. In Plan Bay Area 2050 700,000 added jobs are projected between 2019 and 2040 based on success in reducing the relative gap in housing prices between the Bay Area and competition regions though housing costs grow over time in all regions and Bay Area housing costs remain higher than elsewhere. For the RHNA end year of 2030 the ABAG population forecast is the same in PBA 2050 as in PBA 2040 despite the higher job forecast. Palo Alto RHNA Allocation As the staff reported the final allocation methodology has not been adopted. I encourage commissioners to listen to the RHNA allocation committee hearings. The staff memo shows a variety of allocation factors considered by the committee some resulting in a 135% increase in the PA allocation over the cycle 5 goal and some resulting in a higher or lower increase. However, the committee discussions are clear that the two criteria that push Palo Alto's allocation upward -- Access to High Opportunity Areas and Jobs-Housing Balance -- will dominate the allocation methodology as shown in the committee charts shown in the staff report. With regard to the impact of COVID the near term future is uncertain and depends on our efforts to control the virus spread. But in all the research I did for SCAG the prevailing opinion is that these severe economic and human challenges could remain as long as 2023, but income, job growth and unemployment levels will be close to the long-term trends after that. The unemployment rate for the 2nd quarter of this year is expected to be 14.6%, and it is expected to decline the balance of 2021. For the entire years 2020, 2021, and 2022 we expect average unemployment rates of 10.5%, 8.2%, and 6.8% respectively. Our forecast for 2020, 2021, and 2022 is for total employment growth rates to be -8.6%, 3.6%, and 3.0%. Non-farm payroll jobs are expected to fall by 9.3% in 2020 and to grow at 0.4% and 6.6% in the following two years. Real personal income growth is 47 forecast to be -0.9%, 1.4%, and 2.2% in 2020, 2021, and 2022. In spite of the recession, the continued demand for a limited housing stock coupled with low-interest rates leads to a forecast of a relatively rapid return of homebuilding.” This is among the most cautious of the forecasts I reviewed for SCAG and even so sometime in 2023 the economic impacts at the macro level are expected to end. Finally, check with HCD but my understanding is that they already made an adjustment (downward) for the short-term impacts of COVID on the RHNA. The project must be completed in  a timely manner.        The pandemic has been going on for only 4 months.         This project should have been finished by now.    Construction sounds, as well as unsightly beams and cranes in the sky need to end.    2. Trooper Werner was assisting Trooper James Harper with a traffic stop for an equipment violation. Unknown to either man, the stopped vehicle contained three members of the Black Liberation Army, a group that had declared war on the United States and killed 13 police officers. All three in the car opened fire on the Troopers, with Shakur firing first. Trooper Harper was wounded. Foerster killed. Shakur escaped but was later caught, tried and convicted of first degree murder, assault and battery of a police officer, assault with a dangerous weapon, assault with intent to kill, illegal possession of a weapon, and armed robbery. The current $5,000 fine means NOTHING to the owner of a multi-million dollar property who just wants the tree gone. (2) Hold BOTH the property owner AND the tree pruning company responsible for damage. For example, fine EACH party $20,000. By holding the pruning company responsible they will become much more reluctant to do pruning that they KNOW is bad for the tree. (3) Ask your staff to create a real-time process for protecting our heritage trees. There needs to be a way to stop in-progress damage (say, within 15 minutes of the call for help). These trees are irreplaceable! It was working as the number of cases leveled off in early April. But then the governor, ignoring warnings from some of those same health officials to take it slow, reversed course and opened up the state much too fast. The result: California is now plagued with a major spike of coronavirus cases. The numbers had been steadily increasing since late April but then started sharply rising in mid-June. Each day now, the state's seven-day trend line reaches record-high levels. The increase in cases is not merely due to more testing; it's also due to a larger percentage of those tested having the virus. The portion of tests that come back positive has increased more than 50% in the past 2½ weeks. Now, about 7% of those tested are infected. Which helps explain why California hospitalizations for COVID-19 have increased 60% since June 13 and have surpassed the statewide peaks seen in April. Once again, some hospitals are preparing to stop doing elective surgeries so they can open up more beds for virus patients. For that testing to be effective in stopping the spread of the virus, it must be accompanied by sufficient tracing of those who were in contact with people who test positive for the virus. They reminded all of their subcontractors about it and emphasize it through their foreman meetings, safety meetings, and project emails. Shortly into the COVID-19 shutdown, the City cancelled our agreement with Caltrain to save the rental cost because the extra parking was not needed. At that time, Swinerton was using the empty Lot C-6 for their parking needs. To prepare for the start of re-opening on June 5th, we directed Swinerton to park on County Lot B (leased by the City) to clear Lot C-6 for public parking. This may have resulted in their workers walking along Birch from that County lot to the jobsite. I suspect that may have been a source of the noise you are referencing. The City just renewed the Caltrain parking agreement, so Swinerton forces will be parking on the Caltrain lot starting on July 1, 2020. In the meantime, I have asked our Public Works team to check on Birch Street in the morning hours to further verify that the street parking is left available for the general public’s use. Our concerns include: 1. These agencies did not allow for appropriate public participation in the process as required by California Government Code. 2. The new RHND numbers would unfairly and unreasonably impact Palo Alto and the Mid- Peninsula. They are based on an aggressive job growth projection within an already congested Silicon Valley, and focus an increasing share of new jobs in these already jobs-rich areas while the share in the East Bay and San Jose continue to fall dramatically. 3. The RHND jobs-based numbers require unattainable housing solution by Palo Alto and the surrounding communities. The new RHND mandate more than DOUBLES the current new housing requirement in Palo Alto and surrounding communities, a demand that cannot be met given that median housing prices are already the highest in the country. 4. The penalties for not meeting the goals associated with the RHND numbers are very destructive of local government … if Palo Alto cannot meet these goals, we would lose control of local zoning to the State and to non-elected bodies like MTC/ABAG. This is clearly overreach by State and Regional government and must be stopped. It is absolutely essential that the Palo Alto City Council demand the right for public participation in Plan Bay Area 2050 and the Final Regional Housing Need Determination. That Determination has been based on aggressive jobs growth targets for the Bay Area Region but has consistently ignored the California Code that demands careful attention to “improving intraregional jobs-housing balance”. The current huge imbalances between jobs and housing in the West Bay have created major problems in such issues as land costs, housing costs, congestion, increasing density, long distance commuting, small business viability, income inequality, infrastructure demands, and local government decision-making. It is imperative that the citizens of the West Bay (through their City Councils) have a chance to explore the beneficial impacts of alternate patterns of sub-regional job growth on the range of problems created. Instead, the California Department of Housing and Community Development (HCD) announced that unless formally appealed, their regional jobs and housing projections will be finalized by July 10, 2020. California Code (Section 65584.01) requires an open discussion of the impacts of alternate jobs growth levels on the costs and distribution of housing throughout the Bay Area. Although specifically citing the California Code, the Metropolitan Transit Commission (MTC) /Association of Bay Area Governments (ABAG) and HCD have refused to explore any such alternatives in public session. In fact, they decided in their own in-house process with no public discussion that it was not worth looking at any alternate patterns of job growth through the Bay Area (“Futures Final Report”, December 2019). Citizens of the West Bay have requested the opportunity to explore the impact of existing jobs-housing imbalances but have been completely ignored as MTC/ABAG’s in-house models and closed technical committee continued to explore a single pattern of job growth based on aggressive job growth in already existing jobs-rich priority development areas. They announced in May 2020 that while the COVID crisis would affect short term patterns in the Bay Area, it would not affect their long-term growth projections (MTC/ABAG Planning Committee, May 8, 2020). This City Council must act now (with the support and advice of the City Attorney) to assure that there is adequate time to hold public hearings that can explore alternate job growth patterns that could have a beneficial impact on a well-balanced jobs-housing growth throughout the Bay Area. The deadline of final approval of the current aggressive jobs-based regional RHND must be extended to include opportunity for the public discussion of intraregional jobs-housing balancing required by the very California Code cited by HCD. We ask that the City Council act now (with the support of the City Attorney) to demand public meetings in front of this Council to assure that the HCD/MTC/ABAG Final Regional Housing Need Determination meet the California Code requirement of “Promoting an improved intraregional relationship between jobs and housing”. Historical data on the huge jobs-housing imbalances and the consequences of those imbalances have been provided to MTC, ABAG, HCD and the DOF over the last year but have never been acknowledged publicly or integrated into their Determination. A copy of one such letter to MTC/ABAG with data and codes cited was sent by the West Bay Citizens Coalition (http://westbaycoalition.org/wp-content/uploads/2020/06/WBCC-MTC-ABAG-letter-final.pdf). The document shows the language of the California Codes and the historic Census Bureau data presented to MTC/ABAG and HCD over the course of the last year. The following is a discussion of the legal issues that point to the Council as the party that must take action within the allowed time frame. Please Act Now! LEGAL ISSUES In the formal letter from the California Department of Housing and Community Development (HCD) to the Association of Bay Area Governments (ABAG) on June 9, 2020, HCD announced a “Final Regional Housing Need Determination” of 441,176 new housing units for the nine county Bay Area. This basically doubles the number of housing units required in the current RHNA cycle. ABAG staff announced at their June 18, 2020 Executive Committee meeting that any objections to the RHND under Code 65584.01 (c) must be done within 30 days or by July 10, 2020. The 441,176 housing unit number was based on the statement that HCD had considered all the information specified under California Government Code 65584.01 (c). But, that section refers to section 65584.01 (b) (1) (G) which clearly states “the council of governments shall provide data assumptions from the council’s projections on …. the relationship between jobs and housing, including any imbalances between jobs and housing”. Section 65584.01 (c) (1) further states “the region’s existing and projected housing need shall reflect the achievement of a feasible balance between jobs and housing within the region”. In an earlier letter from the Palo Alto City Attorney to the City Council (February 11, 2013), it was recommended that appeals on the specific allocations to each city were not likely to be upheld in court. But appeals on the overall regional numbers could be made through the council of governments (ABAG) based on the Council’s judgment of HCD’s methodology, specifically “based on historical data, statistical methods and the intent of the Legislature as set forth in the Government Code”. Aggressive job growth in the West Bay has created a huge jobs-housing imbalance in the West Bay and excessively slow job growth in other parts of the Bay Area, creating gigantic economic and social problems. There has been no opportunity for public input on these issues. Data on existing imbalances and the economic and social impacts of those imbalances have been presented to ABAG and MTC and HCD over the course of the past year and are cited in the WBCC letter. Historical data from the Census Bureau clearly show a pattern of concentrated job growth in West Bay communities and an extremely slow job growth in the East Bay counties and San Jose. Data further show the consequences of these imbalances, including the highest housing prices in the country, congestion, long distance commuting, and growing income inequality especially in areas of concentrated job growth. These factors also make it extremely expensive to build new housing, especially affordable housing, given the resulting high land costs. Further, it should be mentioned that there is a an existing Code (Section 65890.5) that requires HCD to prepare and publicly distribute a Guidebook that would present “methodologies for measuring the balance of jobs and housing” and identifying “incentives which local, regional and state agencies may offer the private sector to encourage developments which will facilitate an improved balance between employment generating land use and residential land use”. No such Guidebook has been made available for public discussion. Be cautious of opening attachments and clicking on links.    Date: July 1, 2020 at 8:11:06 PM PDT  To: Scott McKay <scott.mckay@cityofpaloalto.org>      Subject: ., Garage ADU (Tom and Sue Kramer)  Dear Scott,  I am opposed to the city allowing a window to be built on the upper rear  wall of the Kramer’s  high‐pitched garage ADU conversion, which is about 3’‐4’ from my  property line. You mentioned in your email that’s the loft is “supposed“ to be used for  storage and therefore the window won’t impact me.  But the homeowner told me last  week that she hopes to use the loft for a sleeping area.   Does the building permit specifically state the loft is solely for storage and cannot be  used  as sleeping quarters?    If the owner intends to use the area for storage, why would she need to have a window  there?  Wouldn’t an electrical light be more practical?    A window could also fade  stored items.   Long after you and the building inspector are off the project, it would be  easy for a homeowner or tenant to add a ladder and convert the storage space into  sleeping quarters.  Maybe that is why they want an operable window in the loft.   They  could claim ignorance and say they had no idea sleeping was not permitted in the loft.   The proposed window faces directly into my bathroom and dining room and overlooks  my entire patio and yard. It is very close to my property line. One wall of the garage  conversion is directly on my neighbors property line, too. The wall and window I am  objecting to is only about 3‐4’  from my property line.  (See photos)  I will have no  privacy in my bathroom, dining room and entire yard and patio, if you permit this  window.  Noise is also a concern. The architect told me the window is operable.   If the tenant uses the loft for sleeping quarters and opens the window,   I will hear music and other noise from the unit, not to mention the tenant looking  directly down on me. Surely the homeowner could put in a skylight, dormer or window  on another wall of the garage to respect my privacy and noise concerns. I would think  the city would be sensitive to window placement, especially since the living unit will be  so close to my property. I have nothing against ADUs, but they should be designed to  have minimal impact on the adjacent neighbors. The design of this unit severely impacts  the enjoyment of my property.    I would also like to know why the city allowed the Kramer’s to place the 5 unsightly  pipes protruding from the roof of the garage, so close to the lot lines? (See photo). The  Kramer’s chose to put the pipes on the roof slope closest to my neighbor and me. The  pipes are all between 1’ and 2’ from the property line.  They will create fan noise and  Redacted 89 cooking odors that will impact my property due to their placement.   One pipe fan is for  the stove emissions  and one pipe is for the bathroom fan. Another pipe is for the smelly  sewer gases. Again, all less than 2’ from property lines. Why weren’t they put on the  homeowners side of the property?    I appreciate your emailing me today.  I know you are busy.   Could you please call me so we can discuss the situation further.  (650‐996‐3191) I don’t  want the homeowner to begin cutting a hole for the window before this issue is  resolved.   I’m hoping you can stop by my house to see the proposed window placement  in relationship to my home.   Please keep me apprised so I can proceed accordingly. Thank you      90 91 92 Debbie Nichols    Palo Alto      cc:  Jonathan Lait, Planning Dept Director, Palo Alto Mayor Fine,  Palo Alto City Council  members      Redacted Redacted 93 Baumb, Nelly From:Shikada, Ed Sent:Wednesday, July 1, 2020 5:57 PM To:Stefania Pomponi Cc:Council, City; O'Kane, Kristen; DeMarzo, Elise Subject:RE: The BLM Mural is powerful and beautiful! Your Allies at Midpen Media Center I am frustrated by well-meaning rules and regulations that don't achieve their desired goals. On Middlefield the speed limit is 25 mph. When I drive 35 mph, people pass me as if I were standing still. There are rules against gasoline powered leaf blowers, but I hear them every day. The permit to replace my 40 year old furnace required a HERS test. It cost $900 for a man with a special license to spend 90 minutes measuring leakage in my air ducts. The ducts are no better now than they were before. I had to work a week to pay a man for no benefit to me or the environment. Pressure treated lumber is toxic waste. They won't take it at our hazardous waste drop off or the SMART station. I found a place south of San Jose that was legally empowered to take my few sticks for $75. I dumped where requested and then watched a giant earth mover scrape my sticks into a pile with all the other trash. That did not help the environment. With my latest utility bill, there is a notice about "new deconstruction requirements". It is very hard to understand how this will really reduce environmental impacts. Somethings like iron and copper pipe are easy and profitable to recycle. But who is going to reuse a 2x4 when construction labor is $80/hr and a new 2x4 costs $3? In Seattle where I have family, they have similar rules and they have "reuse" stores with salvaged construction material. Some quirky things in these stores are very nice: e.g. antique marble, stained glass, etc. Mostly they have windows and doors and cabinets; but the windows are not energy efficient, and who wants new construction with a variety of unmatched doors? Reusing old windows and doors and cabinets requires a lot of expensive labor. After some delay and extra handling and extra expense, I suspect that most deconstructed material ends up in landfill. And how is a building department with reduced staffing going to handle the extra responsibility of managing these deconstruction requirements? The building department already has a large backlog. On June 16, 2020, the Palo Alto City Council ("Council") adopted amendments to the City of Palo Alto Tobacco Retail Permit Ordinance ("Ordinance") (Palo Alto Municipal Code 4.64). In reaching the Council's decision: (1) the Council was provided false information from Sally-Ann Rudd, (2) the Council's decision is preempted by Tobacco Control Act (21 U.S.C. §387), (3) the Council's decision exceeded Staffs May 2020 recommendations, and (4) violated the Fourteenth Amendment. I. False Information was Provided by Sally-Ann Rudd On May 16, 2020, Sally-Ann Rudd sent the Council an email accusing Mac's Smoke Shop of selling vaping products to her underaged daughter. This is a false accusation. Security surveillance cameras show store employees checking the customer's identification. It turned out that Ms. Rudd's daughter provided fake identification to store employees. (Please see the enclosed photos.) To accuse Mac's Smoke Shop of not paying attention to who they sell tobacco products to is a false statement. Ms. Rudd's daughter provided an undetectable fake identification. This was an unfortunate situation caused by Ms. Rudd's underaged daughter, not Mac's Smoke Shop. II. The Ordinance is Preempted by the Tobacco Control Act of 2009 The Ordinance bans the sale of flavored tobacco and electronic cigarette products, however the Ordinance is void because it is preempted by The Family Smoking Prevention and Tobacco Control Act of 2009. The Family Smoking Prevention and Tobacco Control Act of 2009 ("Tobacco Control Act," codified at 21 U.S.C. §387) applies to cigarettes, cigarette tobacco, roll-your-own tobacco, (")~ --i -!-< -< n~ r-,..,.., '"T.l ;r;> :;s:r- u)O al> '"Tl!:°:i ::!o n · ,.,, ('"') l> July 6, 2020 Page 2 and smokeless tobacco products, as well as to any other tobacco products that FDA by regulation deems subject to the Tobacco Control Act. 21 U.S.C. § 387a(b). The Tobacco Control Act expressly preempts state or local regulations that set forth requirements "different from, or in addition to," any of the Tobacco Control Act's or FDA's requirements relating to federal "tobacco product standards." 21 U.S.C. § 387p(a)(2)(A) ("Tobacco Preemption Clause"). In this case, the Ordinance's blanket prohibition of flavored tobacco products and electronic cigarette products is an attempt to regulate tobacco product standards which is prohibited and preempted by the Tobacco Control Act. III. The Ordinance Eliminates the Exemption Proposed by Staff in May 2020 In May 2020 City Staff carved out an exemption for five small business that would suffer severe economic hardship. In June 2020, the Council removed those proposed exemptions without explanation. This is a violation of my client's Due Process rights. IV. The Ordinance Violates the Fourteenth Amendment The Fourteenth Amendment prohibits states or localities from making or enforcing any law that deprives "any person oflife, liberty, or property, without due process oflaw." U.S. Const. Amend. XIV § 1. A law is unconstitutionally vague under the Fourteenth Amendment if it fails to provide a person of ordinary intelligence fair notice of what is prohibited or is so standardless that it authorizes or encourages seriously discriminatory enforcement. In this case, the Ordinance is vague in its definition of characterizing flavor, as any ingredient can be deemed to impart a non-tobacco flavor. Retailers lack the ability to verify all ingredients within a tobacco product and manufacturers may modify product ingredients without informing the retailer of the changes. This type of uncertainly may lead to arbitrary enforcement. For the reasons stated above, my clients request the Council reconsider and rescind the Ordinance. The Friends of Foothills Park, at their September meeting, discussed the issue of public access to the park. We voted unanimously to recommend that the official policy regarding park entry reflect the current practice: that nonresidents are permitted to use the park on weekdays (except holidays) and non-resident volunteers are granted access to the park to assist in projects related to supporting the park. Attached is the declaration of the city council in 1965 at the park's dedication.
