To all‐ I B 30 shares of Pfizer, PFE, yesterday at $34.01. With a $1.52 annual DIV, that will yield 4.47%, and PFE
is a great Co. They too are working on a Covid19 vaccine.

I also B 50 more shares of British Petroleum, BP, at $23.43 per share yesterday. This lowers my avg. price
paid for BP to $29.8604 per share and at that price the $2.52 ann. DIV will produce a yield of 8.44%, or $378 per year on
an investment of $4,479.06.
Anyone buying BP at today's c. price of $23.16 will suffer a yield of 10.9%. Pretty guilt‐producing if easy money
bothers you. Take a look at the five year chart for BP. It has rarely been under $35, so you'd get a rich DIV while you wait
for a big gain‐ a 51% gain when it gets back to $35. It was above $40 for most of 2018 and into 2019, and just under $40
in the last half of 2019. $40 would give you a 73% gain from here, as well as the rich DIV.
Now for some fun gains I've suffered since March, in a span of four months:
1) MGM Resorts: MGM: I B 80 shares of MGM on March 19, 2020 at $7.7738. It c. today, July 8, 2020 at
$16.30, up $.16 today, up 1% today, and more than doubling in four months.
2) Square: SQ: I B SQ at $57.443 on April 8, 2020. It c. today at $133.35, up $7.75 today, up 6.17% today,
WAY more than doubling in exactly three months. Double $57.443 is $114.89, so SQ is just on fire. It seems immoral to
get such easy money, but I guess it's legal.
3) Nvidia: NVDA: I B NVDA for $204.3996 per share on March 18, 2020. It c. today at $408.64, up $13.77
today, up 3.49% today. Another $0.16 per share and my investment in NVDA will have doubled in four months.
4) Sorrento Therapeutics: SRNE: I B 200 shares of SRNE at $6.73 on May 15, 2020. It went as low as$3.86 on
June 4. But now their product, which they claim can stop the virus cold, is in trials, and today, July 8, 2020, SRNE c. at
$7.29, giving me a small gain of 8.32%. Actually, that is a two month gain that I'll take anytime. If what they have really
works, the stock will soar. When CEO Ji said that their drug was a cure, there was speculation as to how many years he'd
get when the SEC charged him with pumping the stock. Nothing happened to him. Co. is in San Diego.
I watched the network news and PBS News Hour tonight. I hope I live to spend the money.
BTW, the professor of Medicine and Engineering at USC who was interviewed by KCBS was on again. He said
"We'll have a vaccine by fall". He said it twice.

Dear City Council Members,
As elected representatives I realize you are trying to facilitate healing and understanding in our
community, and I'm sure that was the intent with the Black Lives Matter mural painted across city
hall. And that's great. But when you find out through the news that one of the persons in the mural is
an escaped convict and convicted murderer of a police officer, and you keep it up on the building for
even a day, it shows that you are out of touch with the community and you are now part of the
problem. The painting of Assata Shakur should be removed from the mural immediately and you
should let the public know why with a positive message. Please take this opportunity to promote
something positive and not sow more distrust between us and the police. We need the police to be
fair and impartial now more than ever, and placing a painting of a cop killer on the front of city hall is
not going to help that happen.

I, along with many others request that the City Council order the City Attorney to make
a formal request to extend the discussion deadline of the appeal of the final regional
housing need determination (RHND) that expires July 10th. They have not followed the
California Code that mandates open discussion on other methodologies to determine the
local jobs-housing imbalances. The unattainable high housing numbers has and will
increase traffic, put more jobs in job rich areas, instead of places that want more jobs,
such as San Jose, and the East Bay, which want jobs, and already have housing.
Consider the increase in pollution, look at the clear sky's we were experiencing, and the
increase loss of livability.

Dear Mayor Fine and Council Members;
I am writing to ask you to have the City Attorney request an extension of the deadline of the appeal of the final Regional
Housing Need Determination which expires on July 10. The Council has been woefully inactive in bringing this issue to
the public’s attention. I know you, Mayor Fine, have stated that you have attended many meetings on this subject. That
may be the case but that does not mean that the Council has been proactive in putting this item on the Council agenda
so that the community has any sense of what lies in store for it if the allocation is enacted. It seems like a misuse of your
office to keep important pending developments from the public view because these are policies you favor. I hope the
Council will make this request so that the jobs growth model, which may no longer be accurate in light of the pandemic,
does not force upon us a reality in terms of excessive development that few have anticipated.

I am reading the comments on Palo Alto Online and urge you to create more effective context for
PTC and Council decision discussions.
Here is my post to PA Online today.
A lot of heat and not enough light are being spread around town.
All of these details and opinions are informative but polarizing. Our city council and staff are avoiding the heat and
light. There is no proactive effort for collaboration and compromise within our local government.
The land use train in Sacramento is leaving the station. Here is some information about the milestones ahead.
#1 I have not been able to get a straight answer when 100+ towns and cities in NorCal will know their RHNA
allocations. It is hard to focus on RHNA urgency without this date.
#2 Very important land use legislation is being finalized in Sacramento. If passed and signed by Gov. Newsom, then
there will be more hard facts to debate.
Here are a few dates to ponder for at least six powerful land use bills in the state senate and assembly. I hope our
two newspapers and council will soon summarize these bills.
State legislature schedule:
Aug 7 last day for policy committee to meet and report bills
Aug 14 last day for fiscal committee to meet and report bills
Aug 17-31 Floor session only. No committee can meet for any purpose except Rules
Committee Aug 21 last day to amend bills on the floor Aug 31 last day for each house to pass bills. Final recess begins upon
adjournment.

You are likely aware that Valley Water is considering placing a measure on the November ballot to replace the current
Safe, Clean Water parcel tax, which is set to expire in 2028.
Before taking a position on the measure, I ask that you to give the environmental and fishing communities some time to
try to work through some issues with Valley Water. Attached is a letter we submitted earlier today. I’m actually fairly
optimistic we can reach some resolutions that will work for all parties involved.

Dear Chair Hsueh and Board Members:
As representatives of environmental and fishing organizations working in Santa Clara County,
we appreciate this opportunity to share some concerns we have with the proposed Safe, Clean
Water (SCW) parcel tax replacement and with Valley Water in general. We seek to work
constructively with you and your staff over the next few weeks to address our issues and
recommendations. Ultimately, we hope we can come to agreements that will earn support for
Valley Water’s parcel tax measure from the environmental and fishing communities.

Our concerns and recommendations are as follows.
I. Valley Water has demonstrated poor follow-through on environmental commitments.
An example of the District’s failure to deliver on promises is the Fisheries and Aquatic Habitat
Collaborative Effort (FAHCE) Settlement Agreement of 2003. Santa Clara Valley Water District,
a number of other agencies, and environmental and fishing groups signed an agreement to
restore the steelhead trout and Chinook salmon fishery on three major streams. Had the
District implemented the FAHCE Agreement, the entire suite of Phase I measures would have
been completed by 2016 or 2017. At a minimum, the steelhead trout population would have
been well on its way to recovery by this time. Instead, a report released in 2019 summarized
that lack of releases from Anderson Dam in late spring from 2015 through 2019 prevented
outmigration of anadromous steelhead trout. This, together with the failure to remove fish
migration barriers at Singleton Road and Ogier Ponds, caused the Coyote Creek population of
steelhead trout to be at a very significant risk of extirpation. We recommend the addition of
KPIs (in a separate document) to fulfill some of the desired outcomes of FAHCE.
Another example is the lack of promised investment in riparian ecosystems and wildlife habitat
that is critical to the survival of most species of plants and animals in our region, and for wildlife
movement through our landscapes. At the end of the previous parcel tax measure, there were
$16M of promised funds for habitat stewardship unspent. In the FY19 report of SCW, $25M of
habitat stewardship funds collected through the parcel tax were unspent. After six years (40%)
of SCW, only 19% of the funds specified for habitat stewardship have been spent. There is a
deficit of habitat funding that we recommend be dedicated to environmental stewardship in
the renewal parcel tax program.
We have compared KPIs in the new 2020 parcel tax resolution with the 2012 resolution that
was approved by the voters as Measure B. The new resolution merges the stream and wetland
habitat restoration grant program (D3), pollution prevention grant program (B3), and volunteer
creek clean-ups (B7) into a general-purpose grant fund (F9) for “safe clean drinking water, flood
protection and environmental stewardship.” We recommend that the environmental
stewardship grant program (F9) be moved back to Priority D. Grants for “drinking water or
flood protection” should be separate. The 2012 SCW required 21 grant cycles. This renewal
proposal has only 9 grant cycles for the same time period.
Recommendations:
1) Valley Water should immediately submit the most recent FAHCE administrative draft EIR
and Fish Habitat Restoration Plan and a request to publicly notice the Change Petition to
the State Water Board for review and preliminary action to enable compliance with the
construction schedules contained in the Districts’ Capital Improvement Plan.
2) The proposed grant program F9 should be moved back to Priority D and specify only
grants for riparian vegetation and wildlife habitat stewardship and clean creeks, not
“drinking water or flood protection” or access to trails, with one grant cycle per year.
3) Restore KPI “Develop 5 Stream Corridor Priority Plans” under Priority D.

II. Lack of adequate accountability and oversight.
The draft measure calls for the parcel tax to last in perpetuity, or until voters elect to change or
eliminate it. The environmental community feels strongly that we cannot support a parcel tax
for Valley Water without a sunset date. Government accountability for Valley Water requires
opportunities for the electorate to assess the effectiveness of an agency or measure, and make
changes when necessary.
We also have concerns about the strength of the Independent Monitoring Committee,
members of whom are appointed by Valley Water Board Members, and their ability to advise.
The current charter allows only assessments of prior year activities. The IMC should function as
a true oversight committee with the ability to advise on all aspects of the program, including
forward-looking recommendations.
Some of us question the appropriateness of Valley Water managing the environmental grants
programs, as it could be perceived as influencing an organization’s ability to speak openly about
concerns with Valley Water.
The District is proposing to issue $310 million in bonds – 35% of the total of $894 million over
the next 15 years – with $295.5 million in debt service carried forward to the 2036-2050 period
– over five times higher than in the existing SCW program. The debt service for the entire 30-
year period needs to be included in the budgets for each program in which bond funds are
used. The cost of debt service should not be shared among all programs.
Recommendations:
1) The 2020 parcel tax should sunset after 15 years, as have previous measures.
2) We request that Valley Water revise the section of the draft resolution on the
Independent Monitoring Committee to improve oversight of the parcel tax.
3) Commit to meeting with environmental groups to explore a new structure for grant
management.
4) Proposed bonding for each Priority (A-F) should be identified, and forecast
interest expenses should be allocated within each category.
III. Valley Water lawsuits threaten to weaken environmental protections.
Valley Water’s high-profile lawsuit over the Bay Delta Water Quality Control Plan has driven a
wedge between the District and the environmental and fishing communities. Of less visibility,
but also of great concern, is Valley Water’s legal challenge to the Regional Water Board’s
authority to require mitigation measures as a permitting condition for the Upper Berryessa
Creek Flood Protection Project.
We also have concerns about the lack of collaboration among parties in Santa Clara Valley
watersheds. We would like to see more inclusive decision-making, and a more visionary
approach to watershed planning and restoration.

On a side note, we have concerns about Valley Water’s role in the San Luis & Delta Mendota
Water Authority. Valley Water has lobbied side-by-side with the Westlands Water District
(arguably the least environmentally-concerned agency in the state) for projects such as the
Shasta Dam raise, which would be illegal, and would have a devastating impact on the
environment.
Recommendations:
1) Drop the two lawsuits, and prioritize alternatives to litigation over environmental
safeguards in the future.
2) Commit to a meeting with the environmental community prior to the filing deadline for
the parcel tax to discuss ways we all could build more trust and collaboration between
Valley Water and the environmental community.
3) Board commitment to environmental stewardship, not only within our county borders,
but for any watershed involved in District operations.
IV. The parcel tax should not be used to fund water supply projects.
We believe water supply and storage projects, such as the proposed expansion of Pacheco
Reservoir, should be funded by the ratepayers who will benefit from the water supply. When
water is subsidized, people use it less efficiently. When the full cost of developing and
delivering water is incorporated into its price structure, a signal is sent to consumers to
conserve water and use it more efficiently.
Demographic projections were changing even before the COVID-19 pandemic, and Santa Clara
County is likely to see less growth than previously forecast, and less demand per capita.
Therefore, Valley Water should be cautious about moving forward with expensive water supply
and storage projects that might prove unnecessary.
Recommendations:
1) Remove water supply projects from the parcel tax, and target flood protection, water
quality and environmental stewardship projects.
2) Valley Water should revise its demand projections and take a fresh look at water supply
planning for the post-pandemic era. Conservation and water reuse should be
prioritized.
3) If mitigation is required for water supply projects, water utility revenues, not parcel tax
funds, should pay for the mitigation.

necessary to address our concerns and recommendations in a timely fashion. Again, we hope
to get to a place where we can support the 2020 parcel tax.

So the SJ Mercury News is at least partially responsible for violating my privacy rights and causing a

residence of a senior citizen who ended up suffering from a stroke after the multi-year campaign was

It was bad enough having the State of California deceptively trick voters into voting for a supposed
recreational pot law that ended up destroying their beloved Proposition 215...Twenty years of enjoyed
deepened state initiative democracy was destroyed by Governor Newscum...Even after promising
backwoods growers they would not be affected -- then turning his backstabbing back on those same
growers and criminalizing them; while wiping old marijuana convictions from people's records in the
process to make himself look merciful...
And the situation as of 3 months ago ~ compared to the current situation we are now in -- are
completely different...Thousands of jobs have been wiped out by Newscum; not only the cool part
time jobs he destroyed before the Covid virus in a seemingly psychopathic attempt to help; but now
almost the entire state has been shut down and left desperate and unemployed...Oh and what about
those $36 million lost lottery dollars?
Meaning that the job-related dollars are simply not there for what has already been
overdeveloped...The massive new development that our neighborhood fought with the help of the City
of Sunnyvale at Lawrence and El Camino Real (for instance) is not near being half full as no one
wants to live right by an often crowded expressway...Imagine opening your curtains and windows in
the morning to exhaust smoke and leering drivers?
Local cities are so desperate to build they are doing it in places no one wants to live...Including in the
City of Santa Clara at Central Expressway and Lawrence Expressway; with large new high density
housing units that are so compacted that some units will have no windows...I can't think of a worse
way to live...No one wants to admit we have reached a critical mass point of development that cannot
be fixed without angering people...
And this new housing needs to be more rent to own than rent to rent so people can save their money
and not be broke when they are old; needing public assistance from government...
And the rest of the new half-built developments here in Sunnyvale and Santa Clara are going to be
the same; largely empty for quite awhile until the economy comes back enough to substantiate the
new development...For instance; The Empire State building was largely empty for about a decade
after first building it due to the glut of high rise buildings that were being constructed at the time in
NY...
So yeah? Let's double our housing goals even though the current housing cannot even be filled?!
I'll say it over and over; Newscum is out of his fucking mind as usual; and the San Jose Mercury
News is of course equally out of their minds as well right there with Newsum ~ since San Jose seems
to have such a penchant for destroying the beautiful Valley of Hearts' Delights' past for the new
Corporate Valley of Nightmarish Heart's Anguish and Traffic mess...I hate San Jose compared to the

This is Donna Wallach again. I have read your original comments at the bottom of this email regarding your disfavor with
the BLM mural in downtown Palo Alto. I must say that I found your comments to be totally insensitive to the situation of
Black, Brown, Indigenous and Asian people living in the U.S.A., and including the plight of poor and LGBTQI of all colors,
but of course the main focus is Black people because they are murdered by the U.S.A. police in every city in the U.S.A.
every single day, meaning that MANY Black people, men, women and children, are murdered by the police every day in
the U.S.A.
The artist told you that the diamond does NOT represent Jewish people in any way shape or form.
It is not surprising that he believes that Jews control the economy, since in many poor Black neighborhoods often the
landlords were Jews and because of discriminatory laws in Europe and here in U.S.A. in years past,, Jewish people were
limited as to what profession they could work.
I am Jewish, I also have Israeli citizenship. I am anti‐zionist because the War Criminal Apartheid Terrorist State of Israel
commits War Crimes, Crimes Against Peace and Crimes Against Humanity on the Palestinian people on a second‐by‐
second basis, much like what the U.S.A. govt and the Europeans did to the Indigenous peoples on this continent, and the
forced enslavement of Africans for hundreds of years and the numerous laws that have been passed over the years
discriminating against Chinese, Japanese and more recently Muslims. I stand with BLM, because Black lives DO MATTER,

other methods must be taken. The young people leading the BLM movement are very dedicated, committed, creative,

Don't read anti‐Jewish into everything. Jewish people have it very good, especially here in the U.S.A. No more quotas,
the discrimination is gone. We can go anywhere and everywhere, we can rent, buy property, work, use our real names,

I suggest you read some alternative history books so you can better understand the real truth of the history of the U.S.A.

Indigenous Peoples' History of the United States", Howard Zinn's book "The Peoples' History of the United States", and

Louis Brandeis ‐first Jew appointed to the Supreme Court ( think he was 28 at the time) also active in
formulating ideas for the creation of a Jewish State‐served on the court from 1916‐1939–( more a
secular Jew in practice).
In any event, Brandeis one of the earliest and deepest thinkers on first amendment jurisprudence, said
something to this effect: the best answer to bad speech ( I might add, an offensive mural as an example
) is not censorship but more speech or good speech. I believe Brandeis would roll over in his grave re
how often the fear of anti‐semitism is raised by some Jews to censor legitimate speech or even
protected hate speech‐ focused on us as Jews, the state of Israel, etc. We are supposed to be people of
the mind.
I suggest the better solution is for you to write a critique of the piece but don’t destroy( amend) some
or part of the artist’s piece. Again think of what brother Brandeis said.
Also see another Jewish star’s thought on the first amendment: Anthony Lewis’s ‐Freedom For the
thought that we hate. Or his seminal first amendment read: Make No Law: The Sullivan Case and the
First Amendment.
Mark, I believe you would be big time dishonoring Justice Brandeis and other 1st amendment scholars‐
by destroying ( amending) some or part of this man’s mural‐ particularly since you have much less
destructive first amendment options.
To me it would be an act of arrogance if you, or me, Adrian Fine, or other Jews declare themselves
censors of other people’s work. Instead this piece should be debated by all who would like to discuss its
legal and moral implications.
As I’ve often said: the 1st amendment was not designed to protect popular speech ‐popular speech
needs no such protection.
Rather the 1st amendment was designed‐ in this country‐ to protect harsh and angry verbal attacks on
political officials, hate speech and other forms of noxious speech. We should talk. Look forward to your

I was awakened wed. morning 7/8 at approx. 7am by construction workers parking on birch st. between Sherman and
grant.
It was my understanding , after talking with city staff, including holly boyd and mr. raschke, that the city would
communicate to the constractor, swinerton inc, that construction workers should not park on birch st. between
Sherman and grant between 630am and 800am mon to Friday. I was also told that public works would have staff
monitoring parking on birch st. between Sherman and grant beginning 7/6 through 7/10 and would indicate to
construction workers that they should not be parking on birch and that they needed to park in areas the city had
designated for them to park at.
I made a reasonable modification/accommodation request to mr. newman on june 21 regarding this ongoing problem
and ccd everyone dealing with this project with the city and the contractor.
If it has not been clear then I want to make sure that the city understands that I am repeating my request to the city of
palo alto for a reasonable modification/accommodation based on disability under title 11 of the ada. that the city take
steps to make sure that construction workers should not be parking on birch st. before 8am m‐f and that they should
park in areas designated by the city.

I sent mr. newman of swinerton inc. an email on june 21 that there was a serious problem with construction workers
parking on birch st between Sherman and grant from 630am to am. I sent that email to yourself, mr. shikada, molly
stump and several other swinerton management staff.
This problem has been going for weeks if not longer and I had hoped that after my email on 6/21 to everyone who
needed to be informed from swinerton and the city staff including yourself that the problem would be addressed and
that it would no longer be an issue.
However, the problem continues and is not a result of workers walking to the site on birch. It is the result of workers
parking on birch between 630 am and 800 am. It happened again this morning and unless swinerton has directed
either their staff or subcontractors to not park on birch between Sherman and grant that this will occur again on tues.

I believe that everyone who needed to be contacted about this issue has had ample time to resolve it and sincerely

City Manager Ed Shikada asked me to respond to your message. Thank you for bringing this issue to our
attention. I can assure you that the garage contractor, Swinerton, started addressing this issue immediately upon
your earlier notice to them. They reminded all of their subcontractors about it and emphasize it through their foreman
meetings, safety meetings, and project emails.
Shortly into the COVID-19 shutdown, the City cancelled our agreement with Caltrain to save the rental cost because
the extra parking was not needed. At that time, Swinerton was using the empty Lot C-6 for their parking needs. To
prepare for the start of re-opening on June 5th, we directed Swinerton to park on County Lot B (leased by the City)
to clear Lot C-6 for public parking. This may have resulted in their workers walking along Birch from that County lot
to the jobsite. I suspect that may have been a source of the noise you are referencing.
The City just renewed the Caltrain parking agreement, so Swinerton forces will be parking on the Caltrain lot starting
on July 1, 2020. In the meantime, I have asked our Public Works team to check on Birch Street in the morning
hours to further verify that the street parking is left available for the general public’s use.

I am sending you this email because the request I have made has been ignored and the problem of construction
workers parking All Day on birch st between jacaranda and grant from very early in the morning, between 630 am to
8am, continues to be a serious disturbance for myself and other residents in bldg. 3, on the corner of birch and
Sherman st. This is especially harmful to residents who are disabled and have serious health challenges. There is
abundant parking in public parking lots on Sherman and at the county courthouse so I do not know why the city and
the contractor seem to think that this is acceptable.
I hope the council will take this matter seriously and provide the residents living adjacent to this construction project
some peace and quiet.
I think I may have the address wrong because I have seen this construction project listed as 350 Sherman and 250
Sherman.

Max Greenberg's Palo Alto Online column, "Senior Focus", gives irresponsible advise, while promoting himself as having
a special interest in helping seniors with their challenges. After speaking with Mr. Greenberg, it is my opinion that
Coldwell Banker realtor Greenberg cares only about rich seniors, who pay him handsomely, to set them up in luxury
retirement living. --From my standpoint, Max Greenberg personifies realtors who say anything to look good to make a
buck.
He is wrong to counsel seniors, with medical emergencies, to rely on their community churches to bail them out. Do you
realize the damage he causes those, who are the most vulnerable and in need, by dispatching his false hope? I took his
column advice, as I have an emergency dental issue needing financial help. I found out that our community Palo Alto
churches insist they have no budget to support seniors needing "medical care". I spent months knocking on neighborhood
church doors, while my open abscess advances to serious bone disease and destroys my sinus cavity.
Realtor Max Greenberg's column allows those that can help seniors, to turn away, under the delusion that there is always a
church readily available to meet emergency needs of elders. ... There is no excuse for irresponsible reporting.

supports the valuable and courageous men and women of law enforcement and hold them in high regard. The radical

Hello Palo Alto,
I'm a 67 year old white cop. I've been driving a scout car and answering calls in the metro Detroit area for 38 years. I've had maybe a
couple dozen life threatening confrontations in my career where both the suspect and I ended up in a hospital. Not a single citizen
complaint in my 38 years on the road.
I find myself at the end of my career with a number of battle scars, rotator cup, hip, hand, elbow and knee injuries. Nothing serious,
but it leaves me vulnerable in a physical confrontation. I've never really worried about my safety as I was comfortable my abilities and
the atmosphere I worked in. I do not feel that way anymore.
In the last year as age & injuries have tempered my abilities, the charged public & political atmosphere has had a dramatic effect on
the way I'm treated upon arriving at a scene. Just fueling my patrol vehicle in the City of Pontiac Michigan last weekend I had a
carload of young men hanging out the window of their vehicle screaming, "F**K The Police", as they drove by. It's very disheartening
to experience this absolute hatred toward me as I wrap up my career. Which brings me to the point of this email.
I just read about the Chesimard/Shakur mural on one of your buildings. I am used to be attacked, punched, kicked, being spat on, hit
with a 2x4, by subjects as the streets contain a lot of people with mental issues. What I'm not use to, and find heartbreaking, is to have
public officials, while sitting quietly in a meeting, as a matter of coarse, make a decision without being coerced to put up a City
sanctioned mural that included a person who has purposely killed a public servant police officer. It's a sad day for this old war horse
and for the profession. Your City is one of many that have this attitude and I pray for the poor officers that serve your community. It
affected me deeply and I live a couple thousand miles away.
Okay, I will wrap this up. I thank God for my ability to serve and for keeping me alive for 38 years. I'm proud of my work, but I feel
extra fortunate that I'm getting out of the police world alive and without getting caught up & crushed by the anti-police movement.
There will be no celebrations, no parties, I will sneak quietly out the back door. My plan is to dispose of all my police gear that I own
so it does not remind me of this sad ending. I'm so weary of trying to explain how the world looks from these old eyes when folks find
out I was/am a cop. As such I will bury all remnants to avoid the look and, "So you are a cop?"

not prove that she killed officer Foerster. In fact, Assata was shot 2 times during her arrest and brutally beaten by the
police who questioned her because they themselves didn’t know who shot the cop. In 1973, Assata was falsely accused
by the media propaganda for murdering a cop and she suffered the consequences unjustly by torture, abuse, trauma,
solitary confinement and 6 years in prison. The only crime she committed was her escape from prison where she
shouldn’t have been to begin with and where her life was in grave danger.
Placing her on the FBI’s most wanted list 40 years after she fled the US, was a bargaining chip that the racist political
right pressed for when Obama lifted sanctions off of Cuba in 2013. The political right media continues to misrepresent
her as a “Cop killer” in order to perpetuate fear among people in the Black Lives Matter movement and to justify the
abuses committed by police to this day.
Assata Shakur represents a voice of freedom, equality, survival and leadership in the black community and artists should
be able to express her heroism and the injustice placed upon her in peaceful protest such as this mural by Cece Carpio.
This is a political art intervention and deserves no censorship.
Given the evil injustice Assata endured, at the very least, we demand that you keep your hands off of symbolic images of
Assata Shakur, the artists who believe her, and work to support the Black Lives Matter movement.
Let's be on the right side of history and keep this mural up.

To all‐ KCBS‐SF carried this story this morning: Santa Clara Co. Public Health official says that letting counties set
their own rules re Covid19 is not working and that State officials will not listen to them on this. He says that in 4 or 5
weeks the virus could be spreading like wildfire and be completely out of control.

It is out of control in Republican‐owned Fresno County. On Thursday, July 9, this county had a cumulative total of
7627 cases of the virus and 87 dead.
On Friday, July 10, 2020, Fresno Co. had 279 more cases in one day, for a cumulative total of 7906 cases and 88
dead, so the number of cases jumped 3.66% in one day. At that rate, the cumulative total number of cases will double
every month in Fresno County.
Newsom is asleep at the switch again, just as he has been on the wildfires. He should adopt a uniform set of rules
for all 58 California counties and use tough enforcement of those rules. That should include the arrest and prosecution
of local officials who listen to the Republican business people who own them and violate the State rules. The business of
granting "variances" to counties should become a rare event.
I won't comment on the stuff coming from Trump. We HAVE to open the schools. Fauci "has made many mistakes"
and he is told not to participate in the Covid19 press conferences. How many recipients of this think that Fauci is a liar

and incompetent on viruses? At first I thought that re the schools re‐opening that Trump is really interested in students'
learning. No, that's not it. Their parents can't go back to work if the kids are at home, and that hurts the businesses they
work for. Money is all that matters.
So Fauci is a liar and a moron re viruses. Is there no end to this? PBS News Hour had a female professor at UC
Berkeley on who said that we cannot re‐open the schools. "Kids like to touch each other and touch their teacher".
Teachers are leaving the profession already because of the virus threat. The news told the % of teachers in California
who are over 50 years of age. Forcing the schools to re‐open will kill a lot of teachers and support staff. The kids taking
the virus home will kill family members. Gov. Newsom has been too soft on the counties. The virus is exploding in
Florida, Texas and Arizona and the H.C. systems there are in danger of being over‐run. California is flirting with the same
thing.
Re‐open the schools, Fauci is a mistake‐prone moron and and we'll ban him from the press conferences. He
became Director of the National Institute of Allergies and Infection Diseases through a series of management blunders
at NIH. Geez, what do we do about our "leadership"? Hope we can vote while we're still alive, I guess.

I’m writing to express my gratitude for Cece Carpio. Her beautiful portrayal of my friend Assata Shakur is heartwarming.
I’m fortunate enough to have spent time with Assata and know first hand what an amazing, warm and loving woman she
is.
For historical context, Assata was a target of the Counter Intelligence Program (CoIntelPro) of J Edgar Hoover’s FBI. She
wasn’t found guilty in any of the six trials she endured prior finally being convicted in a sham trial. The government
recognized her power and was determined to neutralize the threat she posed to the existing power structure.
Assata was doing her part to liberate Black people from the oppressive conditions that plague(d) Black communities in
the US. She is a freedom fighter motivated by her deep love for justice and liberation.
The mural of her should serve as a motivation for folks to inquire about her life‘s story and learn the truth about the
modern day hero that Assata Shakur truly is.

I was born and raised in the South Bay, going to high school at Castilleja. Palo Alto is located in Ramaytush
Ohlone land. I have a great deal of love for that place and hope to see a society of justice and goodness evolve
there and throughout our Bay Area.
I now practice medicine on faculty at UCSF and am an artist highly engaged in the arts scene in the Bay Area
and beyond. I want to ask you to not censor the beautiful art piece by Cece Carpio that was painted in Palo
Alto. I have seen the news articles about the police feeling upset that Assanta Shakur is depicted in the mural.
They are calling her a cop killer. This couldn't be further from the truth.
In the same way that SF police said Mario Woods was a threat before they killed him or the Vallejo police said
Sean Monterrossa was a threat and video footage showed how they executed him, while he was on his knees
and his hands were above his waist, we have every reason to be suspect of police narratives around the
culpability of Black and Brown people.
Assanta was never found guilty of killing a police officer. She was a victim of a racist legal system that tried and
failed to convict her. The medical reports and testimony from physicians at that time countered the narrative
the police were trying to advance. It was anatomically impossible for her to shoot a weapon, as she was
injured from the police shooting her.
It is of utmost importance that we uphold narratives that expose the depth of violence white supremacy in our
country if we are ever going to move beyond them, into a more balanced society where all may thrive. We
must not cave in to requests to silence or rewrite our histories. They must be told, and the beauty and grace
with which Cece Carpio depicts them is powerful.
Please do not change or alter this important work of art you have commissioned. It is powerful and inspiring. I
am excited to come home with my own children to see it.

My name is Zoë Wong‐VanHaren and I am a 17‐year old recent Palo Alto High School graduate. I've lived in Palo Alto for
the majority of my life, and am proud to be a Palo Altan.
I'm writing to you to show my support of the Vote16 Palo Alto movement, a student‐organized campaign to change the
legal voting age for city council elections to 16 years of age.

Research shows that cold cognition — the ability to make informed decisions over long periods of time — is fully
developed at age 16. This means that teens ages 16 and 17 have the same decision‐making capacities as older voters.
Additionally, components of citizenship such as political efficacy and basic civic knowledge are as developed in 16‐year‐
olds as in 18‐year‐olds.
In addition, lowering the voting age to 16 will help increase voter turnout. In the 2018 U.S. midterm elections, 35.6% of
18‐29 year olds voted, and 59.5% of 45‐64 year olds voted. (According to the U.S. Census Bureau; Current Population
Survey's Voting and Registration Supplements: 2018) Low voter turnout among the youngest demographic is one of the
biggest problems facing our democracy today. At 16, students will be able to develop positive voting habits and carry
this experience into adulthood.
That leads us to help shape lifelong voters. Voting is a habitual activity, whether or not someone votes in their first
election dictates their voting habits for years to come. Voting for the first time at age 16 allows young voters to establish
their voting habits in a stable environment with a solid support system, thereby creating lifelong voters and improving
voter turnout and registration.
Lowering the voting age to 16 will encourage schools to adapt and improve their civics education. Covering more
information about local elections will allow students to move forward as more informed and educated voters, as well as
prepare them to vote in their first election.
16‐year‐olds should also have a say in the City Council elections because the City Council takes action on issues that
affect youth in Palo Alto every day, such as transportation infrastructure, the budget of city services (including police
funds), environmental policies, affordable housing, and more. 16‐ and 17‐year‐olds, many of whom pay income taxes,
have driver's licenses, and can be charged as adults in a court of law, deserve to have a say in the elected officials
representing them.
While many of you City Council members praise student activists for coming forward with their opinions, elected officials
still seldom listen to youth voices as they have no power to hold them accountable through a vote. If the voting age is
lowered to 16, City Council members will be pushed to further consider the opinions of all their constituents.

Regarding the mural depicting murderer, Joanne Chesimard, allowing It to remain on publicly owned property (public
roadway), is an affront to common decency. I support the first amendment rights of all people to say and express
whatever they want. However, to allow an image of a woman wanted in the unnecessary murder of a law enforcement
officer in the line of duty, painted on a publicly owned street; appears to be an endorsement by city officials of that
heinous crime. To say that the city supports protester’s rights to free speech is disingenuous. Would the city allow
someone to paint an expression of support of Adolf Hitler? He murdered for what he believed to be a just cause. We all
know that would not be allowed. As such, the mural of Chesimard should not be allowed either. Please take it down!

Public open Letter to City of Palo Alto and City Counsel,
Here is a pdf document from my attorney outlining the illegal yet convenient destruction of “original”
video files evidence in Palo Alto Police Department evidence room. This destruction is a felony and was
deliberate. Through my contacts with the FBI have told me that if they had those “original” video tapes
they would have been able to start a Felony Investigation into the Santa Clara County DA immediately,
as to people involved in the chain of custody cover up at the PAPD, City Attorney, Santa Clara County
DA, illegally editing video tapes missing 7‐8 critical minutes. These videos were destroyed approximately
4 days before Stutchman Forensic Labs were scheduled to make copies of “original” video tapes. The
originals were destroyed. We will never have the originals.
Observation Agent Dan Ryan assaults Mr. Pierce and due to Agent Ryan and his involvement in previous
cases at the PAPD coincidentally those cases also involved altering of AUDIO and VIDEO. (Google: police
department audio video tampering).
So Agent Ryan asks for a “favor” from the dark side inside the Santa Clara County DA to alter videos, as
he has done in two prior cases but was caught editing video, and charges dropped in those cases.
So the DA steps in and takes 8.5 months to turn over the “altered” videos minus the Agent Ryan
assault. Then when Mr. Pierce requests for the Forensic Lab to make copies of “ORIGINALS” at the PAPD
which was advised to do by Joseph Ciampi in his brutal taser incident and videos were 100% altered by
the connection through the PAPD as Agent Dan Ryan was overseeing the Ciampi case. Then Police Chief
who has access and processes ALL information that is removed from the “Safe Evidence Room”, stepped
in and did a favor for the DA to destroy the original videos. The FBI has already indicated that "if the
Police Chief did not destroy those originals with the 7‐8 missing minutes on them then they would start
an immediate criminal investigation into the Santa Clara County DA, PAPD, City Clerk, City Attorney, and
others related to the cover up”, which obviously did not go as planned.

(The 7‐8 minutes of MISSING time is Verified with the PAPD Dispatch Records, Dispatch Audio file, J.
Salkeld under oath, Also Forensic Reports also show Anomalies, missing hash values, time stamps,
overlaps, and many other serious issues with video) The altered video shows only approximately 4
minutes of travel time for Officer Salkeld. Big difference exactly where Agent Dan Ryan assaulted Mr.
Pierce and with many other events during that time missing from the video as Mr. Pierce said from he
beginning. Now we finally have solid PROOF!! Proof that can be admitted in a trial so as Mr. Pierce to
take the witness stand and tell exactly what happened and why the BAC results proved to be a false
positive. Unless you have proof you can’t testify or be telling a story that does not appear on the video
tapes. Thus if done so without positive proof of video being edited would be assuring Mr. Pierce a
conviction based on a fictitious story that does not correlate to the “altered” video. Mr. Pierce begged
both attorneys to take witness stand but due to the complexities and felony conduct carried out by the
DA, Dan Ryan, Dennis Burns and the City Attorney not limited to. Taking the witness stand was not
advised.
Due to the fact that in this Mr. Pierces case prior to the original videos being destroyed, Mr. Pierce
already had a Federal Lawsuit filed against the PAPD, City of Palo Alto, Agent Dan Ryan, and Police Chief
Dennis Burns. The lawsuit points out that video tapes have been altered and missing 7‐8 minutes during
the timeline between J. Salkeld was called for back up and he also testified to the fact under oath that it
took him 13 minutes as he read from his notes on the witness stand.
The forensic lab indicated that the VIDEO that was altered by the Santa Clara County DA only shows
approximately 4 minutes. They also said that I should go to the Clerks office and look up David Mariant
case. The Mariant case has a report from Stutchman Forensic Labs that outline blatant and gross editing
of these video tapes in this other case. Over 200 pages and a lengthly official report showing how the
Santa Clara County DA edited these videos on the Mariant case. The forensic lab was scheduled to
testify against the DA to show the gross and blatant editing that occurred with many screen shots
pointing to all the missing audio and overlap.
The missing 7‐8 minutes would have shown Agent Dan Ryan forcibly assaulting Timothy Pierce for
absolutely no reason as Ryan just snapped and made a solid punch to the chest of Mr. Pierce while
standing in front of him. Other parts of the video sequence has also been altered with voice over and
extraction.
(You can read the details Mr. Pierces assault in the filing, 15cv06117DMR ‐ filed prior to audio video
being destroyed by Dennis Burns, who was responsible for ALL EVIDENCE being removed from the
Evidence Room.
The PAPD Dispatch records clearly show approximately 7‐8 minutes of missing video EXACTLY where
Mr. Pierce said. These events occurred and told to the attorney L. Potter the week after the false arrest
of DUI charges. The PAPD did not follow protocol in the DUI process of collecting samples. Stating Palo

Alto Police Department Policy Manual 2013 & 2019 (514.5.2 Breath Test, 514.5.3 Blood Test and 514.5.4
Urine Tests under Impaired Driving and Evidence Collection ‐ 360)
These PAPD Department procedures were not followed and "should also require the person to submit to
a blood test”, it continues “the handling officer shall advise the person that the breath‐testing
equipment does not retain a sample, and the person may, if desired provide a blood or urine specimen,
which can be retained to facilitate subsequent verification testing" (Vehicle Code / 23614.) None of
these procedures were followed or carried out. IF procedures are not followed innocent people will be
hurt and abused by the system. Because of 2 trials lasting 2 weeks long one hung jury and the other a
false conviction which is in appellate court not having the ability to testify to the truth as Pierces story
will not align up with the Santa Clara County DA altered video (4 minutes travel time should be 13
minutes) being presented in court to point out what actually happened. Pierce was advised not to take
the witness stand due to the unavailable data being presented.
Also the DA refused Mr. Pierce to use the Drager Machine to replicate the event evening and prove his
innocence. Even Felix Li who works for the DA in toxicology indicated Pierce was not showing any signs
of being near or over .08 in the video. Pierces own witness expert testified also to this .12 not aligning
with the behavior in the video.
Also Dan Ryan falsified and wrote in report Mr. Pierce was slurring speech, yet no where in the video
this occurred which was pointed out when asked by Dan Ryan.
Also speeding was not digitally written on video itself but Dan Ryan verbally calling out MPH, but as
anyone can notice that only when Dan Ryan is accelerating from a delayed start at a stop light does he
call out MPH. Proper pacing should have been implemented by the duty officer and clearly was not done
when viewing the “altered” video. Pacing should have been called out when Agent Dan Ryan was
following behind at the same speed to then call out actual MPH. This was clearly not done on the video
as Mr. Pierce was shocked when Ryan was talking about the much higher speeds he was clocking, with
improper techniques similar to entrapment. At no point in that evening Mr. Pierce did not go over the
speed limit. Agent Dan Ryan was only playing catch up deliberately reading out improper MPH. A
technique used to entrap and have excuse to pull driver over.

Mayor Fine and members of the city council,
I am writing to ask that some attention be paid to the astonishingly bad city web site and utilities portal for Palo Alto.
Firstly, since the city is no longer using Google as the default search engine on the city's website, it is almost impossible
to find anything there even close in specificity to the topic in the search box. I understand Google will no longer provide
ad‐free access to its search engine, but whatever we are using in its place is ghastly and does not lead the searcher to
the link he or she needs.
Since at least one of Google's founders actually lives here in Palo Alto, how about a direct appeal from the city
council? Why not bring this issue directly to his attention and ask to work out some sort of solution that will strengthen
not only his town's local government, but all towns' ability to do their jobs better and help their residents? Send him a
letter if you need to! What we have now is inadequate, and at least we could make an effort to improve it.
Truth be told, the entire City of Palo Alto website could, I am confident, be redesigned for easier and quicker links to its
information. Why not hold a contest to get the city's bright minds to improve it? What better place ‐ in the world ‐ is
there to tap into the very best tech talent than by looking to our fellow Palo Altans?
My second beef is with the recently upgraded City of Palo Alto Utilities website and bill paying portal. The old one was a
dinosaur, but this one just doesn't work, period. This week when our utility bills were due, my neighbor couldn't even
get on the system. She had to use the telephone prompt system (so Mid Century! The last Mid Century) to simply pay
her bill. When I went on to do the same, I could not get the system to accept a payment vehicle. I ended up calling the
Utilities Department and paying over the phone. The very helpful and sympathetic employee said the system is riddled
with problems, and she thought it was due to the vendor they had hired.
Whatever the reason, why, oh why, do we have these embarrassing IT issues in our interface with our own city? Who is
choosing these platforms and vendors? How can it be that in the very nexus of Silicon Valley, the very city that is home
to arguably the most brilliant technology minds of all times, do we persist in having such substandard city web
interfaces? In that this is an even more challenging time due to the pandemic, and when city offices are not open as
usual, and we all are depending moe and more on our online access to city services. And the online system is not
working well, and sometimes not at all.
More importantly, who can fix this?
What will it take to do so?
Why do we allow this to go on, to represent our stellar, remarkable, luminous Palo Alto in this shabby, dysfunctional,
and embarrassing way?

I just learned that the PA City Council is considering using the Roth Building for something other than a PA Museum.
This is a crazy idea! It's the perfect building in the perfect place for a PA Museum. We are a city with an incredible
heritage, and it needs to be preserved and made available to local citizens and scholars alike.
Too often PA gets bogged down in studies and consultations and can't decide anything until there is total
consensus. Phooey!!
The City probably doesn't have to even contribute much money for this. There are enough rich people in Palo Alto who
will put up some funds and keep this going. To allow a couple of rich people to get richer by allowing them to develop
this property into housing or commercial space would be a crime.
The only possible excuse to not do this would be to put a 10‐story high‐rise low income housing project on the site, and
you know the neighbors would really have a fit about that.

The mural in Palo Alto that carries the depiction of Assata Shakur either needs to be removed
immediately, or at the very least, the group that made it and put it up needs to be told to modify it to
remove the image of Shakur. Assata is a murderer and is on the FBI's list as a Most Wanted
Terrorist.
Could you imagine what would be happening in your city if the mural was a "Back the Blue" mural that
carried an image of Derek Chauvin? You would for sure have protesting, if not rioting and looting! As
it is, the offended group in this instance -- the law enforcement community of America -- is taking a
very civilize approach of emails and petitions. Though the approach is civilized, it does not absolve
you of the urgent need to see that this is appropriately and immediately addressed. The previously
released statement that this is "art" and will only be up for a limited period of time is completely
unacceptable, and is a veiled attempt to avoid doing what you know needs to be done.
I am a retired 37-year veteran of law enforcement who has lost 6 friends to line-of-duty deaths. Do
the right thing. Make them modify the mural or take it down.

As a retired federal officer who has been to too many police
funerals, I implore the city to remove the mural of of convicted cop
killer Joanne Chesimard. She is still a fugitive from justice.
She was legally charged and convicted and later escaped
prison. Having her on a city mural spits in the face of the
deceased officer's family and mocks our legal system. It may not
be perfect but our system and dialogue can be opened without her
face on a public mural.
Replace it with NYPD Fire Lieutenant Brian Hickey who ran into the
World Trade Center only to die.

I’m appalled that the BLM mural at city hall contains a painting of Assata Shakur.
That person is one of three people responsible for murdering a New Jersey State Trooper in 1973.

My name is Rev. Lorrie Owens and I am the president of the San Mateo County branch of the NAACP.
I am rather new to this discussion about Captain Zack Perron. All I know about this right now is what I have
recently read in the various email threads. My branch will be looking further into this.
Even if Captain Perron had not used the "n" word in promoting a racist stereotype that African‐Americans
cannot swim, the statement alone would warrant termination. The fact that he allegedly used the "n" word
makes the incident even more egregious. At this point, it doesn't matter if he was "joking" or if he made that
statement before he was promoted to captain. No one with that mindset, and especially with the nerve to
verbalize it in front of other police officers, should be entrusted with a badge and a gun.
If it is validated for us that Captain Perron did in fact make this statement, the San Mateo NAACP will formally
be calling for his termination.

It came to my attention that you are considering censorship regarding a temporary mural that depicts a painted image
of a black liberation movement leader, Assata Shakur, currently on the street in front of the Police Station. As a
reminder, Assata was acquitted for the crimes she was charged for 50 years ago and her innocence was proven in a
court of law.
Assata Shakur represents a voice of freedom, equality, survival and leadership in the black community and artists should

To the Palo Alto Planning Enforcement Department,
I hope you are all doing well during the pandemic.
This letter is to ask you, when you can, to please kindly examine the lack of timely construction progress
at 700 Los Trancos Road – a private property being developed above Arastradero Open Space Preserve,
and also the lack of screen planting there, that is supposed to shield the project visually from park users.
The Palo Alto City Council approved construction of this private property (a nearly 10,000 square foot residence)
in April 2017, at 700 Los Trancos Road (formerly 670 Los Trancos), which lies directly above Arastradero Open Space
Preserve (southwest side).
This property is unfortunately highly visible from trails in the upper part of park.
A handful of us who protested this development at city hearings in 2017 pointed out that this project does not
comply with city Open Space Regulations, as outlined in Municipal Code 18.28.070, which states:
1. The development should not be visually intrusive from public roadways and public parklands.
As much as possible, development should be sited so it is hidden from view.
2. Development should be located AWAY from hilltops and designed to not extend above the nearest ridge line.
The 700 Los Trancos development does not seem to conform to any aspect of this good and farsighted municipal code.
The City Council went ahead in 2017 and approved the development anyway. Promises were made by the
owner/developer to screen buildings from public view (from the park) with significant tall plantings.
Construction began in 2017
Let’s fast‐forward now to the present.
Construction has not been performed in a timely or consistent manner.
After over 3 years, the building and project is nowhere near completion.
This slowly‐executed project is imposing an ongoing source of VISUAL UGLINESS (unfinished steel beams, cranes)

and construction NOISE, exacerbating the ill effects of the project on the public trying to enjoy the park.
On Tuesday July 7 the following construction noises were heard by this hiker, as far as half a mile away, for at least 2
hours:
‐ Very loud, deep, grinding or winching sounds, heard as far as half a mile away
‐ on the upper west slopes of the park. This went on for the 2 hours I was there.
‐ Truck back‐up beeping
‐ A truck honk
‐ Clanging and clattering of perhaps steel beams
‐ Workmen talking
‐ A crane hovering very high in the sky. On some days it moves, on others, not.
‐ It has been up there for months, impeding the sky view.
‐ and on other days hammering is heard, and other machine noises.
This is not ok.
If performed in a timely manner, this construction project could have been finished (and landscaped) by 2019.
Furthermore, there are no effective plant screenings in place, to conceal this big project from the park.
Whatever trees may have been planted far downslope from the project are spindly and useless to screen
the building. The owner should not be permitted unhindered panoramic views at the expense of the park.
The mansion being built will be bad enough to look at, impeding once‐natural sky views when looking uphill from trails
below.
At the very least its construction should be completed in a timely manner,
to lessen the ongoing noise, worker movement, and the esthetic burden on park users.
Are you familiar with Arastradero Open Space Preserve ? It is a natural gem hosting an abundance of wildlife,
including deer, coyotes, turkeys, rabbits, voles, snakes, lizards and a great variety of birds large and small.
Wildflowers in spring. The oak woodlands are of unsurpassed beauty and changing color during the year.
If the public is to bear forever this mansion’s permanent impediment to the open sky views we once enjoyed,
at the very least its creation should not also impose excessive years of ugly construction and noise.
Additionally: it is of paramount importance to install effective screen plantings to block views of the building,
especially from downslope and east. These should have been planted by now, to have time to grow.
Other homes in the area are sufficiently nestled among greenery, partially screening them from public view.
This property at 700 Los Trancos Road does not appear to be in compliance with promised plantings and sits
visibly above a mostly bare grassy slope, as seen from trails to the east of it.
I have written to the City Council this past week about the problem, but perhaps should have written directly to you.

Dear City of Palo Alto,
I am writing this email to address your concern with the Assata Shakur mural painted by the artist Cece Carpio. Currently
you are being pressured by the National Police Association to remove it, because they believe she is a 'killer.' The case
against Assata Shakur is based on false evidence, by one witness, who later admits to lying in all three of his testimonies.
Today George Floyd, Breoanna Taylor, Elijah McClain and many more black bodies are dead due to false evidence rooted
in anti‐ Black racism.
First off I want you to understand that painting 'BLACK LIVES MATTER,' is a great artistic gesture that takes up space in
public spaces. But it is just that, a gesture. It does NOT erase the work laid out in front of you in terms of black
reparations. It does not bring back these black bodies that have been murdered by 'policing.' And we still have more
work to do if we truly want black folks to be able to walk freely without having to feel like they have a target on their
back. For you to remove Assata Shakur, a black woman, wrongfully convicted, from the BLACK LIVES MATTER mura;,
means taking back your 'gesture.' It means a step back for the fight for black lives.
Second, the reason we are yelling BLACK LIVES MATTER on the streets, and painting BLACK LIVES MATTER in public
spaces, is to take up space where black lives have not been given space. It is in response to cops who claimed they were
'policing' but at times had the wrong person, the wrong evidence, or just escalated and ended up costing a black life.
George Floyd was WRONGFULLY arrested and later was subjected to brute force. However, I want to remind you even if
a human is guilty, being guilty does not give a cop the right to kill someone. Today we are painting and protesting against
the way this country has policed and harmed black bodies. Today you want to remove Assata Shakur, because history
has false accusations against her, when in fact she was wrongfully accused. Again this is an example of history repeating
itself, where a black body/ black mind is dismissed and not given space. If you look closely at her case you will see that
one of the only surviving witnesses of her case, Trooper Harper, has ADMITTED to lying 3 times under oath for all his
reports, which is the only evidence against Assata Shakur.
Again, this is history repeating itself, where a black body is denied it's liberation, rights, and freedom dude to false
accusations, racism, and white supremacy. Assata Shakur is an example of the cost of police violence and FALSE
accusations. George Floyd, Breonna Taylor, Elijah McClain, and many many more black bodies are TODAY's examples of
the continued violence by the police department on black bodies.
I hope this time around, while you have the opportunity to make a choice and stand with black lives, that you choose to
stand with black lives, and ALL Black Lives, after all the mural does say, "BLACK LIVES MATTER."

I saw news about the National Police Association pressuring the City Council to take down the BLM mural outside of City
Hall. I'm a resident of Palo Alto and it gave me great joy knowing that the city took part in something so beautiful and
bold right in the heart of downtown. Please do not let the NPA pressure you into taking down the mural that says to its
citizens they matter. If the NPA want to cite "freedom of speech" then the mural should stay on the street as a reminder
to them that they should revisit their job requirements.
Please do not take down the mural. It's beautiful. The NPA cannot influence a public service council that represents the
people of the city, not the NPA.

I am writing to support the creation, celebration and preservation of the new Black Lives Matter Mural in your
city, which graces Hamilton Avenue in front of City Hall. In particular, I want to voice my unwavering and ardent
support for Cece Carpio’s contribution of the second letter “E”. Her portrait of such an important Black leader
in the struggle for racial justice is key to the message of the mural, and an educational image for young people
who may not be aware of Assata Shakur’s legacy. And the message of the text could not be more timely or
necessary for healing the wounds of our urban centers: “We must love each other and support each other”.
This also summarizes my plea to you, as public servants.
Shakur’s groundbreaking book, Assata, An Autobiography, should be part of American history reading in Palo
Alto public schools. It is time, as Elizabeth Boubion’s letter eloquently states, to set the record straight on
Assata’s innocence and persecution under the now‐discredited COINTELPRO program of the mid‐twentieth
century. (COINTELPRO (syllabic abbreviation derived from COunter INTELligence PROgram) (1956–
1979, and beyond) is a series of covert and illegal projects conducted by the United States Federal Bureau of
Investigation (FBI) aimed at surveilling, infiltrating, discrediting, and disrupting American political
organizations. Wikipedia) As you are probably aware, this program explicitly targeted Black people struggling
for racial justice, such as Fred Hampton Jr. and the Black Panthers.
Furthermore, it is the responsibility of public officials to investigate the source of the attack on Palo Alto’s new
flagship work of public art: the murkily identified and ethically questionable “National Police Association”. In
their online literature, the National Police Association supports the Broken Windows Policy that racial and
social justice organizations have fought hard to abolish, and the NPA is opposed to Sanctuary Cities, like Palo
Alto. The city council and the arts commission should be the first to defend the preservation of such a piece as
Cece’s and her colleagues', and take pride that your city has had the moral backbone and ethical consciousness
to support such a work of art.
As a muralist who fights for racial justice with my own work, I stand in solidarity with Cece Carpio and the other
muralists of the Black Lives Matter Mural. It is my suggestion to the city that the Black Lives Matter mural be
recreated in a more permanent location in downtown Palo Alto, not as a “temporary” or ephemeral work, but
as an ongoing commitment from the City of Palo Alto to live up to its commitments to equity, sanctuary and
justice for all of its citizens.

2020-0316 on Noise Certification of Supersonic Airplanes
On behalf of thousands of citizens from MidPeninsula cities in the Bay Area, and across the
country, we are alarmed that Congress asked DOT/FAA to take up domestic noise certification
of supersonic transport. Furthermore, this docket is deceptive, asking for input on noise
certification of SST with a stated intent “to make commercial space transportation regulations
more efficient and effective, while maintaining public safety,” Using the term safety is a
known DOT/FAA tactic to evade noise concerns and provide regulatory supports to promote
aviation interests, in this case regulatory supports for a business jet market segment. An
investigation on SST certification would be welcome, similar to the recently published Inspector
General Timeline analysis of the MAX 8 certification.
If the subject was noise and public safety, the docket would more robustly reflect noise
concerns. In the six years of our involvement with all levels of government and FAA about
aviation noise, our observation is that DOT and FAA do not have the capability to consider noise
safety for the American public. Creating the appearance of having processes or appropriate
noise policies with this notice contributes to the confusion.
For the record:
1. Unlike noise standards used by aviation agencies in the rest of the world, the US stands
out with aviation policy that does not attempt to address what metrics and threshold
criteria are consistent with protecting public health with an adequate margin of safety.
DOT/FAA noise policy is litigation risk based and budget based.
2. With the current sole metric DNL and threshold of 65 DNL that the FAA employs to
consider noise, the system is rigged to filter out most of what is experienced on the
ground. Congress has asked the FAA to review these standards, and until this is
adequately addressed, FAA's noise practices and policies are, at best, controversial.
3. The Airport Noise and Capacity Act of 1990 took away local control of aviation noise
(such as the ability for local governments to set night-time flight limits) with provisions to
ensure progressively quieter aircraft. Should SST abuse ANCA, introducing new or

different impacts that the FAA cannot project or mitigate, local noise control should
prevail for SST, including the choice for cities to ban operations.
With lax to non-existent protections, the US embarking on SST is the equivalent of fast-tracking
a vaccine with zero protocols to assess public health safety.
In recent Covid-related communications, the FAA's Administrator suggested that the FAA is not
in the health care business. FAA and DOT are in fact bystanders, evading and avoiding all
responsibility for public health impacts from airspace operations. We suggest that it’s time for
the FAA to relinquish the privilege of setting aviation noise policies and certification of SST.
New protection agencies and methods to address noise impacts are needed.
Please suspend SST plans until the American public can count on responsible agencies to help
DOT and FAA address noise pollution. The costs to citizens, and to vulnerable populations in
particular, from excessive and unacceptable noise far outweigh the potential benefits from a
niche jet market business.

Hello Elise:
Letters of support for Assata have been coming through my inbox and I do hope that these letters can raise awareness
to the Council, the Public Art Program of Palo Alto and the general public of Palo Alto. I know that as a City Agency you
cannot lobby for any side, however, I do feel that the Public Art Program of Palo Alto can release a statement in dealing
with this issue if you all want to counter the stories (lies) that the non‐legitimate NPA have been putting out in the
media. If the "Cop Killer" headlines should be a concern of the City of PA, then it should be corrected. That message will
come powerfully if it comes from you rather than just my statement as an individual artist that participated in this
project that you all produced. The City of Palo Alto sponsored a mural project that says "Black Lives Matter" that on its
own is a statement that says your stance on this subject.
I have gotten cranks calls from New Jersey numbers at least 15 times within a day just last week. I cannot be sure that
this is all connected, but it's definitely a new experience from me. I have been hit up by the media and have strongly
taken my stand and created a public statement on this issue. I have read the articles of the Mayor apologizing to the
cops of Palo Alto, but no acknowledgment of why Assata's image and message are vital and relevant to the stance that
the City has taken in support of Black Lives Matter.
Thank you for choosing me to participate in this project and I am available to offer any support to all of you if you need
additional resources to learn more about the legacy of Assata and what Black Lives Matter movement is about, and why
she is highly celebrated by the masses who support this movement.
In an additional note, I am still waiting for the 2nd payment to be completed of the promised artist fee for this project.

Furthermore, it is the responsibility of public officials to investigate the source of the attack on Palo Alto’s new
flagship work of public art: the murkily identified and ethically questionable “National Police Association”. In
their online literature, the National Police Association supports the Broken Windows Policy that racial and social
justice organizations have fought hard to abolish, and the NPA is opposed to Sanctuary Cities, like Palo Alto. The
city council and the arts commission should be the first to defend the preservation of such a piece as Cece’s and
her colleagues', and take pride that your city has had the moral backbone and ethical consciousness to support
such a work of art.
As a muralist who fights for racial justice with my own work, I stand in solidarity with Cece Carpio and the other
muralists of the Black Lives Matter Mural. It is my suggestion to the city that the Black Lives Matter mural be
recreated in a more permanent location in downtown Palo Alto, not as a “temporary” or ephemeral work, but
as an ongoing commitment from the City of Palo Alto to live up to its commitments to equity, sanctuary and
justice for all of its citizens.

I hope you are all doing well during the pandemic.
This letter is to ask you, when you can, to please kindly examine the lack of timely construction progress
at 700 Los Trancos Road – a private property being developed above Arastradero Open Space Preserve,
and also the lack of screen planting there, that is supposed to shield the project visually from park users.
The Palo Alto City Council approved construction of this private property (a nearly 10,000 foot residence) in April
2017,
at 700 Los Trancos Road (formerly 670 Los Trancos), which lies directly above (southwest of) Arastradero Open Space
Preserve.
This property is, unfortunately, highly visible from trails in the upper part of park.
A handful of us who protested this development at city hearings in 2017 pointed out that this project does not
comply
with city Open Space Regulations, Municipal Code 18.28.070, which states:
1. The development should not be visually intrusive from public roadways and public parklands. As much as
possible,
development should be sited so it is hidden from view.
2. Development should be located AWAY from hilltops and designed to not extend above the nearest ridge line.
The 700 Los Trancos development not seem to comply with any aspect of this good municipal code.
The City Council went ahead in 2017 and approved the development anyway. Promises were made by the
owner/developer to screen
the development from public view (from the park) with significant tall plantings.
Construction began in 2017
Let’s fast‐forward now to the present.
Construction has not been performed in a timely or consistent manner.
After over 3 years, the building is nowhere near completion.
This delayed, slowly performed project is imposing an ongoing source of VISUAL UGLINESS (unfinished steel beams,
cranes)
and construction NOISE, prolonging the ill effects of the project on the public trying to enjoy the park.

On Tuesday July 7 the following construction noises were heard by this hiker, as far as half a mile away, for at least 2
hours:
‐ Very loud, deep, grinding or winching sounds, heard as far as half a mile away
‐ on the upper west slopes of the park. This went on for the 2 hours I was there.
‐ Truck back‐up beeping
‐ A truck honk
‐ Clanging and clattering of perhaps steel beams
‐ Workmen talking
‐ A crane hovering very high in the sky. On some days it moves, on others, not.
‐ It has been up there for months, impeding the sky view.
‐ and on other days hammering is heard, and other machine noises.
This is not ok.
If performed in a timely manner, this construction project could have been finished (and landscaped) by 2019.
Furthermore, there are no effective plant screenings in place, to conceal this big project from the park.
Whatever trees may have been planted far downslope from the project are spindly and useless to screen
the building. The owner should not be permitted to preserve his panoramic views at the expense of the public.
The completed mansion itself will be bad enough, impeding the natural sky views that we used to enjoy:
at the very least its construction should be completed in a timely manner,
to lessen the ongoing noise, worker movement, and the esthetic burden on park users.
Are you familiar with Arastradero Open Space Preserve ? It is a natural gem hosting a plethora of wildlife,
including deer, coyotes, turkeys, rabbits, voles, snakes, lizards and a great variety of birds large and small.
Wildflowers in spring. The oak woodlands are of unsurpassed beauty and changing color during the year.
If the public is to bear, forever, the permanent impediment of the natural sky view we once enjoyed up there,
at the very least, we should not have to bear excessive years of ugly construction and noise.
Additionally: it is of paramount importance to install effective screen plantings to block views of the building,
especially downslope and east. These should have been planted by now, to have time to grow.
Other homes in the area are sufficiently nestled among greenery, partially screening them from public view.
This property at 700 Los Trancos Road does not appear to be in compliance with promised plantings and sits
visibly above a mostly bare grassy slope, as seen from trails to the east of it.
I have written to the City Council this past week about the problem, but perhaps should have written directly to you.
They are cc’d here.
It is understood that during the pandemic you may not be able to visit the site. However, as it sits in open space,
perhaps you can take a look.
In any event, you have on file when you issued building permits for this project, and you know what a reasonable
rate of progress should be under these permits.
To sum, the issues I ask you to please kindly look at are
‐ speed of construction (way too slow) & ongoing park disruption
‐ ‐ ‐ screen plantings (little or none, on an open hilltop site)

I believe there is an immediate censorship issue regarding a temporary mural that depicts a painted image of a black
liberation movement leader, Assata Shakur, currently on the street in front of the Police Station. Assata Shakur was
acquitted for the crimes she was charged for 50 years ago and her innocence was proven in a court of law. SHE WAS
PROVEN NOT GUILTY IN A COURT OF LAW even with a blatantly racist jury and judge. There was no evidence to convict
her of the trumped up charges of killing officer Foerster.
Assata was shot 2 times during her arrest and brutally beaten by the police who questioned her because they
themselves didn’t know who shot the cop. In 1973, Assata was falsely accused by the media propaganda for murdering
a cop and she suffered the consequences unjustly by torture, abuse, trauma, solitary confinement and 6 years in prison.
The only crime she committed was her escape from prison where she shouldn’t have been to begin with and where
her life was in grave danger.
She was placed on the FBI’s most wanted list 40 years after she fled the US as a bargaining chip that the racist political
right pressed for when Obama lifted sanctions off of Cuba in 2013. The political right media continues to misrepresent
her as a “Cop killer” (even though she was acquitted of that charge) in order to perpetuate fear among people in the
Black Lives Matter movement and to justify the abuses committed by police to this day.
Assata Shakur represents a voice of freedom, equality, survival and leadership in the black community and artists should
be able to express her heroism and the injustice placed upon her in peaceful protest such as this mural by Cece Carpio.
This is a political art intervention and deserves no censorship.
Given the horrible injustice Assata endured, at the very least, we demand that you keep your hands off of symbolic
images of Assata Shakur, the artists who believe her, and work to support the Black Lives Matter movement.

As not only did Sunnyvale POS/DPS hold a police briefing one morning regarding my own You Tube
videos attempting to violate the rights of a journalist/videographer; but also whether or not POS/DPS
fired any particular officers to shrug off potential liability or responsibility to form yet another illegal
enterprise designed to alternately protect and ruin reputations (Lik Roper Enterprises is now a
reference to the various illegal enterprises formed against me that I now OWN through this online
self-litigation) POS/DPS was and/or is still quite complicit in their various "official" obstructions of
justice and/or formations of overarching illegal enterprises...
For instance; the morning police briefing held by POS/DPS makes it nearly impossible for POS/DPS

Almost every weekend night my client's band played a keg party; cops would show up and tell the
band to stop or they would confiscate their equipment (not the kegs haha that came later when the
parents were held accountable)...Which in turn caused the music to cease and desist
immediately...My point being; the RPF (Rebholtz-Paolinetti Familias) were quite often using their
parents' vehicles for the non-coincidental stalking and harassment and menacing and vandalism they
directed at my client's residence...
So just like the time when a Sunnyvale cop found Mark Chapman and John taking bong hits with
some beer at the corner of Henderson and El Camino Real under the big trees in the two parking
spots directly underneath; they took them both home to their parents and told their parents the low
down about what we were keeping on the down low...In other words; cops used to do their jobs back
then -- apprehending teenage suspects and hauling them back to their home compounds to get them
into BIG trouble...
Because parents can straighten out teens in ways that cops can't -- and perhaps cops used to know
this...When parents find out about a secret teen life -- that secret teen life is quite often over...Leading
us directly to; if POS/DPS/SCPD had just spoken to the RPF parents (they had numerous chances)
saying something like "a neighbor seems to think that he is being bothered by your children using
your vehicles; so if the various alleged disturbances do not cease and desist we will have to consider
impounding your vehicles at a later date..."
Which would have immediately caused an appropriate knee-jerk response within the upper ranks of
the RPF clan; officially putting on police record what had occurred after informing various RPF
parental units of their childrens' misdeeds they perhaps inadvertently supported and/or perhaps did
not know about; therefore causing an immediate end to what ended up as a years-long police-
sponsored harassment/stalking/menacing/vandalism campaign (YLPSNCHSMVC) that almost took
my clients' life... Tooth infections in his upper jaw could have burst into his brain and killed him right

(It was police-sponsored largely due to: 1) An SCPD police officers' personal vehicle (Don Paolinetti)
often being used for the various non-coincidental disturbances by his son Jake Paolinetti; 2)
Excessive police harassment of my client on the part of POS/SCPD/DPS for lesser things (a SWAT
team for Santa Clara Mayor-approved duck feeding; and another SWAT team for cleaning up litter in
the neighborhood etc etc etc -- defaming my client's good name and reputation with these SWAT-
teams-for-nothing) while criminal threats made by Mister Olenak and and early-morning assault along
with an assault by Crazy Tom Foley who was a drunk felon on parole at the time of the attack (etc etc
etc) were totally ignored by POS/SCPD Officers Seagrave and Lopez; 3) After trying desperately for
many years to get Sunnyvale POS/DPS to stop the non-coincidental harassment with no end to the
night time disturbances ~ by default the police inherited the mess due to their foot dragging and gross
negligence (in other words; people screaming what sounded like death threats in the middle of the
night right outside my client's window as he slept -- many times over and over without end right after
an ambush in July 2007 that occurred right after my client requested a public hearing regarding
(among other things) Pablo Lopez rubbing his genitals up against my client's leg "all sweaty" during

without any warning to Lee Bagly (his African-American lawyer just showed up one morning without
warning to pick up Lee and take him up to SF) 2) but the City of Sunnyvale also avoided adding me to
the case for a pattern and practice lawsuit we could have easily won after I was emailing them about

Local cities are so desperate to build they are doing it in places no one wants to live...Including in the
City of Santa Clara at Central Expressway and Lawrence Expressway; with large new high density
housing units that are so compacted that some units will have no windows...I can't think of a worse
way to live...No one wants to admit we have reached a critical mass point of development that cannot
be fixed without angering people...
And this new housing needs to be more rent to own than rent to rent so people can save their money
and not be broke when they are old; needing public assistance from government...
And the rest of the new half-built developments here in Sunnyvale and Santa Clara are going to be
the same; largely empty for quite awhile until the economy comes back enough to substantiate the
new development...For instance; The Empire State building was largely empty for about a decade
after first building it due to the glut of high rise buildings that were being constructed at the time in

So yeah? Let's double our housing goals even though the current housing cannot even be filled?!

News is of course equally out of their minds as well right there with Newsum ~ since San Jose seems

Mural in your city, which graces Hamilton Avenue in front of City Hall. In particular, I want to

Her portrait of such an important Black leader in the struggle for racial justice is key to the
message of the mural, and an educational image for young people who may not be aware of
Assata Shakur’s legacy. And the message of the text could not be more timely or necessary for
healing the wounds of our urban centers: “We must love each other and support each other”.
This also summarizes my plea to you, as public servants.
Shakur’s groundbreaking book, Assata, An Autobiography, should be part of American history
reading in Palo Alto public schools. It is time, as Elizabeth Boubion’s letter eloquently states, to
set the record straight on Assata’s innocence and persecution under the now‐discredited
COINTELPRO program of the mid‐twentieth century. (COINTELPRO (syllabic abbreviation derived
from COunter INTELligence PROgram) (1956–1979, and beyond) is a series of covert and illegal
projects conducted by the United States Federal Bureau of Investigation (FBI) aimed at
surveilling, infiltrating, discrediting, and disrupting American political organizations.

I just read about the mural placed at City Hall that depicts honoring black lives matter and Joanna Chesimard
AKA Assata Shakur.
Words cannot describe how offended and disgusted I was at the ignorance and stupidity of allowing this
mural.
First, black lives matter is not in the least concerned with justice for blacks or saving black lives. They are a
stated marxist group who's purpose is to deal negatively with whites and to replace our government with a
marxist system. It's easy to verify this by going to their page and reading their mission statement.
Joanna Chesimard took part in the murder of New Jersey State Trooper Werner Foerster. She was captured,
tried and convicted. She then escaped and fled to Cuba.
I'm sure the police officers using that facility feel this mural makes for a hostile work environment.
Will Palo Alto next honor the nurse murderer Richard Speck or Dan White who murdered Mayor George
Moscone and Harvey Milk?
If the city is truly interested in justice and truth, this mural will be taken down IMMEDIATELY.

which have become a serious fire hazard. The same happened last year and the owner
responded by having the weeds removed. The truck sitting in the driveway is a relic of
that effort.
In addition to my concern about the fire hazard, the property is an eyesore for the
entire neighborhood. The owner should be prodded to do something, either get on with
posted plans to build a new house or maintain the house and lot as is.

powerful and important statement. Please continue to advocate for the lives of black residents in Palo Alto. Black
residents deserve a safe and healthy place to live just like every other resident who calls Palo Alto their home. Public art
is a powerful and important way to create dialogue among different people and communities. I hope this mural is only
the beginning of many changes that need to be made by the City of Palo Alto in order to improve the lives of black
residents. No one deserves to feel like an outcast in their own community. Please also continue to support the public
art program in Palo Alto. We need it now more than ever.
