And that's great. But when you find out through the news that one of the persons in the mural is an escaped convict and convicted murderer of a police officer, and you keep it up on the building for even a day, it shows that you are out of touch with the community and you are now part of the problem. The painting of Assata Shakur should be removed from the mural immediately and you should let the public know why with a positive message. Please take this opportunity to promote something positive and not sow more distrust between us and the police. We need the police to be fair and impartial now more than ever, and placing a painting of a cop killer on the front of city hall is not going to help that happen. Thank you. They have not followed the California Code that mandates open discussion on other methodologies to determine the local jobs-housing imbalances. The unattainable high housing numbers has and will increase traffic, put more jobs in job rich areas, instead of places that want more jobs, such as San Jose, and the East Bay, which want jobs, and already have housing. Consider the increase in pollution, look at the clear sky's we were experiencing, and the increase loss of livability. Here is my post to PA Online today. A lot of heat and not enough light are being spread around town. All of these details and opinions are informative but polarizing. Our city council and staff are avoiding the heat and light. There is no proactive effort for collaboration and compromise within our local government. The land use train in Sacramento is leaving the station. Here is some information about the milestones ahead. #1 I have not been able to get a straight answer when 100+ towns and cities in NorCal will know their RHNA allocations. It is hard to focus on RHNA urgency without this date. #2 Very important land use legislation is being finalized in Sacramento. If passed and signed by Gov. Newsom, then there will be more hard facts to debate. Here are a few dates to ponder for at least six powerful land use bills in the state senate and assembly. I hope our two newspapers and council will soon summarize these bills. State legislature schedule: Aug 7 last day for policy committee to meet and report bills Aug 14 last day for fiscal committee to meet and report bills Aug 17-31 Floor session only. We seek to work constructively with you and your staff over the next few weeks to address our issues and recommendations. Ultimately, we hope we can come to agreements that will earn support for Valley Water’s parcel tax measure from the environmental and fishing communities. 2 Our concerns and recommendations are as follows. I. Valley Water has demonstrated poor follow-through on environmental commitments. An example of the District’s failure to deliver on promises is the Fisheries and Aquatic Habitat Collaborative Effort (FAHCE) Settlement Agreement of 2003. Santa Clara Valley Water District, a number of other agencies, and environmental and fishing groups signed an agreement to restore the steelhead trout and Chinook salmon fishery on three major streams. Had the District implemented the FAHCE Agreement, the entire suite of Phase I measures would have been completed by 2016 or 2017. At a minimum, the steelhead trout population would have been well on its way to recovery by this time. Instead, a report released in 2019 summarized that lack of releases from Anderson Dam in late spring from 2015 through 2019 prevented outmigration of anadromous steelhead trout. This, together with the failure to remove fish migration barriers at Singleton Road and Ogier Ponds, caused the Coyote Creek population of steelhead trout to be at a very significant risk of extirpation. We recommend the addition of KPIs (in a separate document) to fulfill some of the desired outcomes of FAHCE. Another example is the lack of promised investment in riparian ecosystems and wildlife habitat that is critical to the survival of most species of plants and animals in our region, and for wildlife movement through our landscapes. At the end of the previous parcel tax measure, there were $16M of promised funds for habitat stewardship unspent. In the FY19 report of SCW, $25M of habitat stewardship funds collected through the parcel tax were unspent. After six years (40%) of SCW, only 19% of the funds specified for habitat stewardship have been spent. There is a deficit of habitat funding that we recommend be dedicated to environmental stewardship in the renewal parcel tax program. We have compared KPIs in the new 2020 parcel tax resolution with the 2012 resolution that was approved by the voters as Measure B. The new resolution merges the stream and wetland habitat restoration grant program (D3), pollution prevention grant program (B3), and volunteer creek clean-ups (B7) into a general-purpose grant fund (F9) for “safe clean drinking water, flood protection and environmental stewardship.” We recommend that the environmental stewardship grant program (F9) be moved back to Priority D. Grants for “drinking water or flood protection” should be separate. The 2012 SCW required 21 grant cycles. This renewal proposal has only 9 grant cycles for the same time period. Recommendations: 1) Valley Water should immediately submit the most recent FAHCE administrative draft EIR and Fish Habitat Restoration Plan and a request to publicly notice the Change Petition to the State Water Board for review and preliminary action to enable compliance with the construction schedules contained in the Districts’ Capital Improvement Plan. 2) The proposed grant program F9 should be moved back to Priority D and specify only grants for riparian vegetation and wildlife habitat stewardship and clean creeks, not “drinking water or flood protection” or access to trails, with one grant cycle per year. 3) Restore KPI “Develop 5 Stream Corridor Priority Plans” under Priority D. 3 II. Lack of adequate accountability and oversight. The draft measure calls for the parcel tax to last in perpetuity, or until voters elect to change or eliminate it. The environmental community feels strongly that we cannot support a parcel tax for Valley Water without a sunset date. Government accountability for Valley Water requires opportunities for the electorate to assess the effectiveness of an agency or measure, and make changes when necessary. We also have concerns about the strength of the Independent Monitoring Committee, members of whom are appointed by Valley Water Board Members, and their ability to advise. The current charter allows only assessments of prior year activities. The IMC should function as a true oversight committee with the ability to advise on all aspects of the program, including forward-looking recommendations. Some of us question the appropriateness of Valley Water managing the environmental grants programs, as it could be perceived as influencing an organization’s ability to speak openly about concerns with Valley Water. The District is proposing to issue $310 million in bonds – 35% of the total of $894 million over the next 15 years – with $295.5 million in debt service carried forward to the 2036-2050 period – over five times higher than in the existing SCW program. The debt service for the entire 30- year period needs to be included in the budgets for each program in which bond funds are used. The cost of debt service should not be shared among all programs. Recommendations: 1) The 2020 parcel tax should sunset after 15 years, as have previous measures. 2) We request that Valley Water revise the section of the draft resolution on the Independent Monitoring Committee to improve oversight of the parcel tax. 3) Commit to meeting with environmental groups to explore a new structure for grant management. 4) Proposed bonding for each Priority (A-F) should be identified, and forecast interest expenses should be allocated within each category. III. Valley Water lawsuits threaten to weaken environmental protections. Valley Water’s high-profile lawsuit over the Bay Delta Water Quality Control Plan has driven a wedge between the District and the environmental and fishing communities. Of less visibility, but also of great concern, is Valley Water’s legal challenge to the Regional Water Board’s authority to require mitigation measures as a permitting condition for the Upper Berryessa Creek Flood Protection Project. We also have concerns about the lack of collaboration among parties in Santa Clara Valley watersheds. We would like to see more inclusive decision-making, and a more visionary approach to watershed planning and restoration. 4 On a side note, we have concerns about Valley Water’s role in the San Luis & Delta Mendota Water Authority. Valley Water has lobbied side-by-side with the Westlands Water District (arguably the least environmentally-concerned agency in the state) for projects such as the Shasta Dam raise, which would be illegal, and would have a devastating impact on the environment. Recommendations: 1) Drop the two lawsuits, and prioritize alternatives to litigation over environmental safeguards in the future. 2) Commit to a meeting with the environmental community prior to the filing deadline for the parcel tax to discuss ways we all could build more trust and collaboration between Valley Water and the environmental community. 3) Board commitment to environmental stewardship, not only within our county borders, but for any watershed involved in District operations. IV. The parcel tax should not be used to fund water supply projects. We believe water supply and storage projects, such as the proposed expansion of Pacheco Reservoir, should be funded by the ratepayers who will benefit from the water supply. When water is subsidized, people use it less efficiently. When the full cost of developing and delivering water is incorporated into its price structure, a signal is sent to consumers to conserve water and use it more efficiently. Demographic projections were changing even before the COVID-19 pandemic, and Santa Clara County is likely to see less growth than previously forecast, and less demand per capita. Therefore, Valley Water should be cautious about moving forward with expensive water supply and storage projects that might prove unnecessary. Recommendations: 1) Remove water supply projects from the parcel tax, and target flood protection, water quality and environmental stewardship projects. 2) Valley Water should revise its demand projections and take a fresh look at water supply planning for the post-pandemic era. Conservation and water reuse should be prioritized. 3) If mitigation is required for water supply projects, water utility revenues, not parcel tax funds, should pay for the mitigation. It is not surprising that he believes that Jews control the economy, since in many poor Black neighborhoods often the  landlords were Jews and because of discriminatory laws in Europe and here in U.S.A. in years past,, Jewish people were  limited as to what profession they could work.     I am Jewish, I also have Israeli citizenship. I am anti‐zionist because the War Criminal Apartheid Terrorist State of Israel  commits War Crimes, Crimes Against Peace and Crimes Against Humanity on the Palestinian people on a second‐by‐ I've had maybe a couple dozen life threatening confrontations in my career where both the suspect and I ended up in a hospital. Not a single citizen complaint in my 38 years on the road. I find myself at the end of my career with a number of battle scars, rotator cup, hip, hand, elbow and knee injuries. Nothing serious, but it leaves me vulnerable in a physical confrontation. I've never really worried about my safety as I was comfortable my abilities and the atmosphere I worked in. I do not feel that way anymore. In the last year as age & injuries have tempered my abilities, the charged public & political atmosphere has had a dramatic effect on the way I'm treated upon arriving at a scene. Just fueling my patrol vehicle in the City of Pontiac Michigan last weekend I had a carload of young men hanging out the window of their vehicle screaming, "F**K The Police", as they drove by. What I'm not use to, and find heartbreaking, is to have public officials, while sitting quietly in a meeting, as a matter of coarse, make a decision without being coerced to put up a City sanctioned mural that included a person who has purposely killed a public servant police officer. It's a sad day for this old war horse and for the profession. Your City is one of many that have this attitude and I pray for the poor officers that serve your community. It affected me deeply and I live a couple thousand miles away. Okay, I will wrap this up. I thank God for my ability to serve and for keeping me alive for 38 years. I'm proud of my work, but I feel extra fortunate that I'm getting out of the police world alive and without getting caught up & crushed by the anti-police movement. There will be no celebrations, no parties, I will sneak quietly out the back door. My plan is to dispose of all my police gear that I own so it does not remind me of this sad ending. Here is a pdf document from my attorney outlining the illegal yet convenient destruction of “original”  video files evidence in Palo Alto Police Department evidence room. This destruction is a felony and was  deliberate. Through my contacts with the FBI have told me that if they had those “original” video tapes  they would have been able to start a Felony Investigation into the Santa Clara County DA immediately,  as to people involved in the chain of custody cover up at the PAPD, City Attorney, Santa Clara County  DA, illegally editing video tapes missing 7‐8 critical minutes. These videos were destroyed approximately  4 days before Stutchman Forensic Labs were scheduled to make copies of “original” video tapes.  The  originals were destroyed. We will never have the originals.        Observation Agent Dan Ryan assaults Mr. Pierce and due to Agent Ryan and his involvement in previous  cases at the PAPD coincidentally those cases also involved altering of AUDIO and VIDEO. (Google:  police  department audio video tampering).       So Agent Ryan asks for a “favor” from the dark side inside the Santa Clara County DA to alter videos,  as  he has done in two prior cases but was caught editing video, and charges dropped in those cases.      So the DA steps in and takes 8.5 months to turn over the “altered” videos minus the Agent Ryan  assault.  Then when Mr. Pierce requests for the Forensic Lab to make copies of “ORIGINALS” at the PAPD  which was advised to do by Joseph Ciampi in his brutal taser incident and videos were 100% altered by  the connection through the PAPD as Agent Dan Ryan was overseeing the Ciampi case.  Then Police Chief  who has access and processes ALL information that is removed from the “Safe Evidence Room”, stepped  in and did a favor for the DA to destroy the original videos.  The FBI has already indicated that "if the  Police Chief did not destroy those originals with the 7‐8 missing minutes on them then they would start  an immediate criminal investigation into the Santa Clara County DA, PAPD, City Clerk, City Attorney, and  others related to the cover up”,  which obviously did not go as planned.  24       (The 7‐8 minutes of MISSING time is Verified with the PAPD Dispatch Records, Dispatch Audio file, J.  Salkeld under oath,  Also Forensic Reports also show Anomalies, missing hash values, time stamps,  overlaps, and many other serious issues with video) The altered video shows only approximately 4  minutes of travel time for Officer Salkeld. Big difference exactly where Agent Dan Ryan assaulted Mr.  Pierce and with many other events during that time missing from the video as Mr. Pierce said from he  beginning. Now we finally have solid PROOF!! Proof that can be admitted in a trial so as Mr. Pierce to  take the witness stand and tell exactly what happened and why the BAC results proved to be a false  positive.  Unless you have proof you can’t testify or be telling a story that does not appear on the video  tapes. Thus if done so without positive proof of video being edited would be assuring Mr. Pierce a  conviction based on a fictitious story that does not correlate to the “altered” video.  Mr. Pierce begged  both attorneys to take witness stand but due to the complexities and felony conduct carried out by the  DA, Dan Ryan, Dennis Burns and the City Attorney not limited to.  Taking the witness stand was not  advised.      Due to the fact that in this Mr. Pierces case prior to the original videos being destroyed, Mr. Pierce  already had a Federal Lawsuit filed against the PAPD, City of Palo Alto, Agent Dan Ryan, and Police Chief  Dennis Burns. The lawsuit points out that video tapes have been altered and missing 7‐8 minutes during  the timeline between J. Salkeld was called for back up and he also testified to the fact under oath that it  took him 13 minutes as he read from his notes on the witness stand.       The forensic lab indicated that the VIDEO that was altered by the Santa Clara County DA only shows  approximately 4 minutes.  They also said that I should go to the Clerks office and look up David Mariant  case.  The Mariant case has a report from Stutchman Forensic Labs that outline blatant and gross editing  of these video tapes in this other case.  Over 200 pages and a lengthly official report showing how the  Santa Clara County DA edited these videos on the Mariant case.  The forensic lab was scheduled to  testify against the DA to show the gross and blatant editing that occurred with many screen shots  pointing to all the missing audio and overlap.      The missing 7‐8 minutes would have shown Agent Dan Ryan forcibly assaulting Timothy Pierce for  absolutely no reason as Ryan just snapped and made a solid punch to the chest of Mr. Pierce while  standing in front of him. Other parts of the video sequence has also been altered with voice over and  extraction.       (You can read the details Mr. Pierces assault in the filing,  15cv06117DMR ‐ filed prior to audio video  being destroyed by Dennis Burns, who was responsible for ALL EVIDENCE being removed from the  Evidence Room.       The PAPD Dispatch records clearly show approximately 7‐8 minutes of missing video EXACTLY where  Mr. Pierce said. These events occurred and told to the attorney L. Potter the week after the false arrest  of DUI charges. The PAPD did not follow protocol in the DUI process of collecting samples.  Stating Palo  25 Alto Police Department Policy Manual 2013 & 2019 (514.5.2 Breath Test, 514.5.3 Blood Test and 514.5.4  Urine Tests under Impaired Driving and Evidence Collection ‐ 360)       These PAPD Department procedures were not followed and "should also require the person to submit to  a blood test”, it continues  “the handling officer shall advise the person that the breath‐testing  equipment does not retain a sample, and the person may, if desired provide a blood or urine specimen,  which can be retained to facilitate subsequent verification testing" (Vehicle Code / 23614.) None of  these procedures were followed or carried out.  IF procedures are not followed innocent people will be  hurt and abused by the system.  Because of 2 trials lasting 2 weeks long one hung jury and the other a  false conviction which is in appellate court not having the ability to testify to the truth as Pierces story  will not align up with the Santa Clara County DA altered video (4 minutes travel time should be 13  minutes) being presented  in court to point out what actually happened.  Pierce was advised not to take  the witness stand due to the unavailable data being presented.        Also the DA refused Mr. Pierce to use the Drager Machine to replicate the event evening and prove his  innocence.  Even Felix Li who works for the DA in toxicology indicated Pierce was not showing any signs  of being near or over .08 in the video. Pierces own witness expert testified also to this .12 not aligning  with the behavior in the video.         Also Dan Ryan falsified and wrote in report Mr. Pierce was slurring speech, yet no where in the video  this occurred which was pointed out when asked by Dan Ryan.        Also speeding was not digitally written on video itself but Dan Ryan verbally calling out MPH, but as call out MPH. Proper pacing should have been implemented by the duty officer and clearly was not done  when viewing the “altered” video.  Pacing should have been called out when Agent Dan Ryan was  following behind at the same speed to then call out actual MPH. This was clearly not done on the video  as Mr. Pierce was shocked when Ryan was talking about the much higher speeds he was clocking, with  improper techniques similar to entrapment. At no point in that evening Mr. Pierce did not go over the  speed limit. Agent Dan Ryan was only playing catch up deliberately reading out improper MPH. A The development should not be visually intrusive from public roadways and public parklands.                  As much as possible, development should be sited so it is hidden from view.  2. Development should be located AWAY from hilltops and designed to not extend above the nearest ridge line.    The 700 Los Trancos development does not seem to conform to any aspect of this good and farsighted municipal code.     The City Council went ahead in 2017 and approved the development anyway.  Promises were made by the  owner/developer to screen buildings from public view (from the park) with significant tall plantings.      Construction began in 2017    Let’s fast‐forward now to the present.    Construction has not been performed in a timely or consistent manner.  After over 3 years, the building and project is nowhere near completion.    This slowly‐executed project is imposing an ongoing source of VISUAL UGLINESS (unfinished steel beams, cranes)  6     and construction NOISE,  exacerbating the ill effects of the project on the public trying to enjoy the park.    On Tuesday July 7 the following construction noises were heard by this hiker, as far as half a mile away, for at least 2  hours:    ‐      Very loud, deep, grinding or winching sounds, heard as far as half a mile away  ‐             on the upper west slopes of the park.  This went on for the 2 hours I was there.  ‐ Truck back‐up beeping  ‐ A truck honk  ‐ Clanging and clattering of perhaps steel beams  ‐ Workmen talking  ‐ A crane hovering very high in the sky.  On some days it moves, on others, not.  ‐     It has been up there for months, impeding the sky view.  ‐ and on other days hammering is heard, and other machine noises.    This is not ok.       If performed in a timely manner, this construction project could have been finished (and landscaped) by 2019.    Furthermore, there are no effective plant screenings in place, to conceal this big project from the park.     Whatever trees may have been planted far downslope from the project are spindly and useless to screen      the building.  The owner should not be permitted unhindered panoramic views at the expense of the park.    The mansion being built will be bad enough to look at, impeding once‐natural sky views when looking uphill from trails  below.           At the very least its construction should be completed in a timely manner,          to lessen the ongoing noise, worker movement, and the esthetic burden on park users.    Are you familiar with Arastradero Open Space Preserve ?    It is a natural gem hosting an abundance of wildlife,  including deer, coyotes, turkeys, rabbits, voles, snakes, lizards and a great variety of birds large and small.  Wildflowers in spring. The oak woodlands are of unsurpassed beauty and changing color during the year.    If the public is to bear forever this mansion’s permanent impediment to the open sky views we once enjoyed,  at the very least its creation should not also impose excessive years of ugly construction and noise.    Additionally:   it is of paramount importance to install effective screen plantings to block views of the building,  especially from downslope and east.  These should have been planted by now, to have time to grow.    Other homes in the area are sufficiently nestled among greenery, partially screening them from public view.  This property at 700 Los Trancos Road does not appear to be in compliance with promised plantings and sits  visibly above a mostly bare grassy slope, as seen from trails to the east of it.    I have written to the City Council this past week about the problem,  but perhaps should have written directly to you.  They have been sent a copy of this communication to you.    It is understood that during the pandemic you may not be able to visit the site.  However, as it sits in open space,  perhaps you can take a look.      In any event, you have on file the date(s) when you issued building permits for this project, and you know what a  reasonable rate of progress should be under these permits.  The owner/developer should be held to fair time limits.        To sum, the issues I ask you to please kindly look at are    7                                                                            ‐ speed of construction  (way too slow)  & ongoing park disruption   ‐                              ‐                                ‐ screen plantings            (little or none,  on an open hilltop site)    Thank you,      Kim Atkinson        94301                     Redacted 8 Baumb, Nelly From:Canopy <info@canopy.ccsend.com> on behalf of Canopy <info@canopy.org> Sent:Monday, July 13, 2020 2:01 PM To:Council, City Subject:Last Chance to Register!  citizens  from  MidPeninsula  cities  in  the  Bay  Area,  and  across  the   country,  we  are  alarmed  that  Congress  asked  DOT/FAA  to  take  up  domestic  noise  certification   of  supersonic  transport.  Furthermore,  this  docket  is  deceptive,  asking  for  input  on  noise   certification  of  SST  with  a  stated  intent  “to  make  commercial  space  transportation  regulations   more  efficient  and  effective,  while  maintaining  public  safety,”    Using  the  term  safety  is  a   known  DOT/FAA  tactic  to  evade  noise  concerns  and  provide  regulatory  supports  to  promote   aviation  interests,  in  this  case  regulatory  supports  for  a  business  jet  market  segment.  An   investigation  on  SST  certification  would  be  welcome,  similar  to  the  recently  published  Inspector   General  Timeline  analysis  of  the  MAX  8  certification.     If  the  subject  was  noise  and  public  safety,  the  docket  would  more  robustly  reflect  noise   concerns.  In  the  six  years  of  our  involvement  with  all  levels  of  government  and  FAA  about   aviation  noise,  our  observation  is  that  DOT  and  FAA  do  not  have  the  capability  to  consider  noise   safety  for  the  American  public.  Creating  the  appearance  of  having  processes  or  appropriate   noise  policies  with  this  notice  contributes  to  the  confusion.         For  the  record:     1.  Unlike  noise  standards  used  by  aviation  agencies  in  the  rest  of  the  world,  the  US  stands   out  with  aviation  policy  that  does  not  attempt  to  address  what  metrics  and  threshold   criteria  are  consistent  with  protecting  public  health  with  an  adequate  margin  of  safety.   DOT/FAA  noise  policy  is  litigation  risk  based  and  budget  based.   2.  With  the  current  sole  metric  DNL  and  threshold  of  65  DNL  that  the  FAA  employs  to   consider  noise,  the  system  is  rigged  to  filter  out  most  of  what  is  experienced  on  the   ground.  Congress  has  asked  the  FAA  to  review  these  standards,  and  until  this  is   adequately  addressed,  FAA's  noise  practices  and  policies  are,  at  best,  controversial.   3.  The  Airport  Noise  and  Capacity  Act  of  1990  took  away  local  control  of  aviation  noise   (such  as  the  ability  for  local  governments  to  set  night-­time  flight  limits)  with  provisions  to   ensure  progressively  quieter  aircraft.  Should  SST  abuse  ANCA,  introducing  new  or     February  22,  2019   Page  2   different  impacts  that  the  FAA  cannot  project  or  mitigate,  local  noise  control  should   prevail  for  SST,  including  the  choice  for  cities  to  ban  operations.       With  lax  to  non-­existent  protections,  the  US  embarking  on  SST  is  the  equivalent  of  fast-­tracking   a  vaccine  with  zero  protocols  to  assess  public  health  safety.       In  recent  Covid-­related  communications,  the  FAA's  Administrator  suggested  that  the  FAA  is  not   in  the  health  care  business.  FAA  and  DOT  are  in  fact  bystanders,  evading  and  avoiding  all   responsibility  for  public  health  impacts  from  airspace  operations.  We  suggest  that  it’s  time  for   the  FAA  to  relinquish  the  privilege  of  setting  aviation  noise  policies  and  certification  of  SST.       New  protection  agencies  and  methods  to  address  noise  impacts  are  needed.       Please  suspend  SST  plans  until  the  American  public  can  count  on  responsible  agencies  to  help   DOT  and  FAA  address  noise  pollution.  The  costs  to  citizens,  and  to  vulnerable  populations  in   particular,  from  excessive  and  unacceptable  noise Be cautious of opening attachments and clicking on links.  To the Palo Alto Planning Enforcement Department,           I hope you are all doing well during the pandemic.           This letter is to ask you, when you can,  to please kindly examine the lack of timely construction progress                 at 700 Los Trancos Road – a private property being developed above Arastradero Open Space Preserve,                 and also the lack of screen planting there, that is supposed to shield the project visually from park users.           The Palo Alto City Council approved construction of this private property (a nearly 10,000 foot residence) in April  2017,  at 700 Los Trancos Road (formerly 670 Los Trancos), which lies directly above (southwest of) Arastradero Open Space  Preserve.            This property is, unfortunately, highly visible from trails in the upper part of park.            A handful of us who protested this development at city hearings in 2017 pointed out that this project does not  comply  with city Open Space Regulations,  Municipal Code 18.28.070,  which states:    1. The development should not be visually intrusive from public roadways and public parklands.  As much as  possible,  development should be sited so it is hidden from view.  2. Development should be located AWAY from hilltops and designed to not extend above the nearest ridge line.    The 700 Los Trancos development not seem to comply with any aspect of this good municipal code.     The City Council went ahead in 2017 and approved the development anyway.  Promises were made by the  owner/developer to screen  the development from public view (from the park) with significant tall plantings.      Construction began in 2017    Let’s fast‐forward now to the present.    Construction has not been performed in a timely or consistent manner.  After over 3 years, the building is nowhere near completion.    This delayed, slowly performed project is imposing an ongoing source of VISUAL UGLINESS (unfinished steel beams,  cranes)      and construction NOISE,   prolonging the ill effects of the project on the public trying to enjoy the park.  28   On Tuesday July 7 the following construction noises were heard by this hiker, as far as half a mile away, for at least 2  hours:    ‐      Very loud, deep, grinding or winching sounds, heard as far as half a mile away  ‐             on the upper west slopes of the park.  This went on for the 2 hours I was there.  ‐ Truck back‐up beeping  ‐ A truck honk  ‐ Clanging and clattering of perhaps steel beams  ‐ Workmen talking  ‐ A crane hovering very high in the sky.  On some days it moves, on others, not.  ‐     It has been up there for months, impeding the sky view.  ‐ and on other days hammering is heard, and other machine noises.    This is not ok.       If performed in a timely manner, this construction project could have been finished (and landscaped) by 2019.    Furthermore, there are no effective plant screenings in place, to conceal this big project from the park.     Whatever trees may have been planted far downslope from the project are spindly and useless to screen      the building.   The owner should not be permitted to preserve his panoramic views at the expense of the public.    The completed mansion  itself will be bad enough, impeding the natural sky views that we used to enjoy:           at the very least its construction should be completed in a timely manner,          to lessen the ongoing noise, worker movement, and the esthetic burden on park users.    Are you familiar with Arastradero Open Space Preserve ?    It is a natural gem hosting a plethora of wildlife,  including deer, coyotes, turkeys, rabbits, voles, snakes, lizards and a great variety of birds large and small.  Wildflowers in spring. The oak woodlands are of unsurpassed beauty and changing color during the year.    If the public is to bear, forever, the permanent impediment of the natural sky view we once enjoyed up there,  at the very least, we should not have to bear excessive years of ugly construction and noise.    Additionally:   it is of paramount importance to install effective screen plantings to block views of the building,  especially downslope and east.  These should have been planted by now, to have time to grow.    Other homes in the area are sufficiently nestled among greenery, partially screening them from public view.  This property at 700 Los Trancos Road does not appear to be in compliance with promised plantings and sits  visibly above a mostly bare grassy slope, as seen from trails to the east of it.    I have written to the City Council this past week about the problem,  but perhaps should have written directly to you.  They are cc’d here.    It is understood that during the pandemic you may not be able to visit the site.  However, as it sits in open space,  perhaps you can take a look.      In any event, you have on file when you issued building permits for this project, and you know what a reasonable  rate of progress should be under these permits.        To sum, the issues I ask you to please kindly look at are                                                                               ‐ speed of construction  (way too slow) & ongoing park disruption   ‐                              ‐                                 ‐ screen plantings            (little or none, on an open hilltop site)  29   Thank you,      Kim Atkinson        94301                     Redacted 30 Baumb, Nelly From:Michelle Mascarenhas-Swan <michellems3@gmail.com> Sent:Monday, July 13, 2020 9:10 AM To:PAC; Council, City Subject:Don't let police wield political power to censor CAUTION: This email originated from outside of the organization.
