Orchard St. Boise, Idaho October 16, 2014 Agenda Call to Order Work Session Adjournment CALL TO ORDER AND ROLL CALL Mayor Aymon called the Special meeting of the McCall City Council to order at 1:05 p.m. Mayor Aymon, Councilor Giles, and Councilor Witte (by phone) were present. Councilor Scott and Councilor Swanson were absent City Staff present were Gene Drabinski, City Manager; Peter Borner, Public Works Director; Nate Coyle, Special Projects Manager and Airport Manager; Cathy Cooper, SPF Water Engineering; and Matt Johnson, City Attorney from White Peterson. Attendees from IDEQ were A.J. Maupin, Todd Crutcher, Jack Gantz, Gary Carroll, Andrea Courtney (AG's Office), and Chas Ariss WORK SESSION Discussion regarding the Fourth Consent Order A.J. Maupin started the page by page discussion on the 4th Amended Consent Order. Gene Drabinski, City Manager, discussed the role of City Council and their desire to wrap their arms around the issues. A.J. Maupin discussed how the 4th Amended Consent Order would also need to be in compliance with the Reuse Permit. Gary Carroll gave some background information on the Reuse Permit. He brought up how the City of McCall and the Payette Lakes Recreational Water and Sewer District signed a Memorandum of Understanding to allow the District to apply for the Reuse Permit. He spoke about the joint meeting that was held between the City and the District. A question was asked about when the draft Reuse Permit would be issued for public comment. The draft Reuse Permit cannot be issued until contracts with the City, the farmers and the irrigation company are signed. Peter Borner discussed the process after the Memorandum of Understanding was signed. McCall City Council Special Meeting Page 1 of 3 October 16, 2014 A.J. Maupin asked for clarification on the timelines for the Reuse Permit. Mr. Maupin started discussion on pages 1 and 2 of the Amended Consent Order. These pages were basically historical information. Then Mr. Maupin led a discussion about Page 3 and the discussion on Total Maximum Daily Load. He also discussed Section 6c. One of the tools that IDEQ will conduct is an Algal Assay above and below the discharge pipe from the Winter Storage Pond. Testing would have to be done long enough to acquire a Statistically Significant Data Set. Councilor Giles asked about how long it would take to get a Statistically Significant Data Set. Mr. Maupin replied stating that a Statistically Significant Data Set is based upon the quality and the number of samples. This would also be based upon the Quality Assurance Plan that would be developed by SPF Water Engineering. Todd Crutcher reviewed and discussed Section 7e which is the pump back system. Peter Borner discussed how it was the City's belief that adequate testing to get a Statistically Significant Data Set is needed before a pump back system is constructed. Councilor Giles asked if there were other options available to fix the problems with the Winter Storage Pond. Mr. Drabinski brought up the impact of pumping back into the Winter Storage Pond 60 MG (estimated underdrain flow). Mr. Borner and Mr. Maupin discussed of the issues surrounding the City of McCall's wastewater system. Mr. Maupin explained we are here due to the Winter Storage pond leaks. He spoke about the algal assay, the growing season and potentially developing constructed wetlands to treat the discharge coming from the Winter Storage Pond. There was the then a group discussion about constructed wetlands. Cathy Cooper asked if the Amended Consent Order could be modified to place the pump back system into Section 8 on Page 5. Todd Crutcher brought up that the City of Horseshoe Bend will be conducting a dye test of their lagoons. IDEQ is partnering with Horseshoe Bend on the testing and IDEQ is buying the dye. Mr. Maupin stated that all agree that the Winter Storage Pond was leaking. The real concern was how much and what was the quality of the discharge. There was a discussion about monitoring wells and performing the study to acquire baseline data, pump back or not. There was then a discussion about the possibility of being granted a load allocation and having the Total Maximum Daily Load rewritten. Mr. Borner asked Mr. Maupin about a contact at EPA to discuss the possibility of changing the TMDL. A.J. Maupin stated to start the discussion with Kim Ogle, Lance Holloway, and/or Mike McIntyre. Councilor Giles then asked about discussing those items in Table 2. Mr. Maupin reviewed Section 9. McCall City Council Special Meeting Page 2 of 3 October 16, 2014 Cathy Cooper stated that the Amended Consent Order and the Reuse Permit has language that is at odds. Todd Crutcher stated that IDEQ will make sure that the language in both documents is consistent. A.J. Maupin then reviewed Section 10. Marcia Witte left the meeting at 2:00 PM Peter Borner discussed that the City of McCall just approved a cancellation policy for existing will serves. He also stated that the City is identifying the correct gallons per EDU and that IDEQ should expect to see updated Declining Balance Tables for both Water and Sewer after the first of the year. Mr. Drabinski asked that notwithstanding the problems with McCall's storage lagoons, what the future of waste water treatment is. Is land application the right thing? A.J. Maupin stated that the future of waste water treatment is more reuse not less. The principle word in NPDES is elimination. Gary Carrol also agreed. He stated that there are other uses for reuse water. Chas Ariss stated that the main component of reuse is available land and that there is use for potable reuse in groundwater recharge. Mr. Drabinski then stated that reuse appears sustainable even with the challenges that the City has. Chas Ariss stated that the constraint is land. Mr. Ariss then asked about I & I and what the City was doing to remove I & I. Mr. Borner replied. Mayor Aymon asked if building constructed wetlands was a good idea. Todd Crutcher stated that constructed wetlands were an approved method of treatment for wastewater. Mr. Drabinski also had a question about wetlands. Mr. Maupin stated that constructed wetlands needed to be designed for the specific load. In closing the City of McCall was to work with the IDEQ Regional Office to modify the Amended Consent Order. ... .......................... ...
