HomeMy Public PortalAbout2015.11.20 Special MinutesMINUTES McCall City Council Special Meeting Legion Hall - McCall City Hall (Lower Level) November 20, 2015 Agenda Call to Order and Roll Call Work Session Adjournment CALL TO ORDER AND ROLL CALL Mayor Aymon called the special meeting of the McCall City Council to order at 9:11 a.m. Mayor Aymon, Councilor Giles, and Councilor Witte answered roll call. A quorum was present. Councilor Scott and Councilor Swanson were absent City staff present was Nate Coyle, City Manager; and BessieJo Wagner, City Clerk. WORK SESSION AB 15-223 Title 4 Rewrite Review The purpose of this work session is for staff to review with the Council the entire Title 4 and make any revisions. BessieJo Wagner, City Clerk, reviewed the following with the Council. The Direction from Council at the 11/5/15 Meeting was the following: 1. Reevaluate the peddler's license; maybe have an annual fee or an additional per day fee. 2. The snow removal license should be based on a season instead of a calendar year. 3. Double-check exceptions for all licenses to make sure nothing is left out. 4. Clarify the valid electrical inspection for a vendor's permit. 5. Rewrite the definition of a public event to make it simpler. 6. Clarify the permitting process for the street carnival, tent, and street shows. The Council worked through the following changes of the McCall City Code Title 4 re -write: Page 2 ITINERANT VENDOR: Removed from the definition place of residence to distinguish from a peddler. Page 6 - Trash Service required was added as a request from Council at the previous review of Title 4. In the next revision Title 5 of McCall City Code will be referenced. Page 19 — Replaced City Council in this section with Police Chief as requested at the prior review. The section now reads as follows: (F) The Police Chief may refuse to issue a license for any premises which, in the opinion of the Police Chief, is not suitably located for enforcement purposes having due regard to the type and McCall City Council Special Meeting Page 1 of 2 November 20, 2015 character of business and traffic in the locale of the proposed business. In the event that the Police Chief refuses to issue a license, the Police Chief shall provide the applicant a written explanation of the specific reasons for the denial. Page 26 — At the prior review it was requested to ensure that exemptions for Vendor permits were called out as follows: (H) Those exempt from requiring a Vendor's permit are school age children selling various fundraising items including but not limited to Girl and Boy Scouts, school sponsored sporting or music events, school age clubs such as Optimists. Page 29 — At the prior review it was requested to ensure that exemptions for Peddler permits were called out as follows: (F) Those exempt from requiring a Peddler's license are school age children selling various fundraising items including but not limited to Girl and Boy Scouts, school sponsored sporting or music events, school age clubs such as Optimists. Also exempt are those affiliated with religion and politics. Page 30 — In the prior review it was noted that fees for Farmers Market were per season so the following was stricken: (E) The fee for the license or permit shall be set from time to time by Resolution of the City Council, and shall provide for per diem and for per annum fees. Such fees shall be non- refundable. There was much discussion regarding Chapter 8 and events. The Council requested that staff revise this section to more clearly reflect what a public event is and what public events would be regulated and how. Also in the event chapter Council requested clarification of signage; indicating that the language refers to vendors but needs to reflect events whether they have vendors or not. Council also requested that the definition of Child Daycare and the policy in Chapter 6 be reflective of Idaho State Code. AB 15-224 Title 4 Fee Review Due to time constraints, Council did not review the revised fee schedule and requested that the fees be presented at the next meeting.
