The meeting was called to order at 8 o'clock. Roll call: - Present – Trustees Em- minger, Hansen, Rees, Utendorffer and President Knox; absent – none. The minutes of the meetings held on December 6th and 13th, 1920, were read and approved. The reports of the Clerk, Marshal, Officials' Reports Treasurer and Recorder for the month of December, 1920, were read and ordered filed. On motion of Trustee Rees, seconded Building Permit by Trustee Emminger, and by vote of the Granted. Board, permission was granted to the Standard Oil Co. to erect a building as requested. On motion of Trustee Hansen, seconded Other Permits by Trustee Rees, and by vote of the Board, Granted. permission was granted the Standard Oil Co. to install the four gasoline tanks un- der the sidewalk as requested and in ac- cordance with ordinance, and also permis- sion to alter the sidewalk for the approach- es as requested. January 17, 1921 Adjourned Regular Meeting An adjourned regular meeting of the Board was held at the Town Hall on Monday evening January 17th, 1921. The meeting was called to order at 7:45 o'clock. Crane, for the erection of a com- bined woodshed and garage at his place on L street between 5th and 6th at an estimated cost of $150; John Luders, for the erection of an addition of a porch to his residence, at Eighth and G streets, at an estimated cost of $65. Ordinance No. 107, "An ordinance Ordinance No. amending Ordinance No. 104 entitled, 'An 107 Passed ordinance licensing for the purpose of rev- enue and regulation, various kinds of business transacted and carried on in the town of Livermore, also all shows, exhibi- tions and lawful games carried on therein; also fixing the rates of license tax, providing for the collection of the same by suit or other- wise and repealing ordinances and parts of ordinances, by amending Section 51 and by adding four new sections thereto to be numbered 49-a, 49-b, 49-c, and 49-d," was given second reading and, on motion of Trustee Hansen, seconded by Trustee Utendorffer, and by the following called vote, was passed and adopted; Ayes – Trustees Emminger, Hansen, Rees, Utendorffer and President Knox; noes – none; absent – none. Following is a printed copy of said Ordinance No. 107 as published: ORDINANCE NO. 107 ________ An Ordinance Amending Ordinance No. 104 Entitled: "An Ordinance Licensing, for the Purpose of Revenue and Regulation, Various Kinds of ?Business Transacted and Carried on in the Town of Livermore, Also All Show, Exhibitions, and Lawful Games Carried On Therein; Also Fixing the Rates of License Tax, Providing for the Collection of Same by Suit or Otherwise and Repealing Ordinances and Pars of Ordinances," by Amending Section 51 and Adding Four New Sections Thereto to be Numbered 49-a, 49-b, 49-c and 49-d. ________ The Board of Trustees of the Town of Livermore do ordain as follows: Section 1. Ordinance No. 104 of the Town of Livermore, entitled, "An ordinance licensing, for the purpose of revenue and regulation various kinds of business transacted and carried on in the Town of Livermore, also all shows, exhibitions, and lawful games carried on therein; also fixing the rates of license tax, providing for the collection of same by suit or otherwise and repealing ordinances and parts of ordinances," adopted June 28th, 1920, is hereby amended by amending Section 51 and by adding four new section thereto to read as follows: "Section 49-a. It shall be unlawful for any person or persons to maintain or conduct or keep open within the Town of Livermore any place where malt or cereal beverages, candy, ice cream, mineral waters, soft drinks, or non-intoxicating liquors arte sold without first having obtained a permit and license therfor(sic), as provided in section 49-b "Section 49-b. No person or persons shall have issued to him the license required to conduct or carry on any of the businesses mentioned in sections 47 and 48 of Ordinance 104, unless such person or persons first obtains permission as herein provided by making application in writing to the Board of Trustees of the Town of Livermore, which application shall set forth: "(a) The name and residence of the applicant and his length of residence in the Town of Livermore. "(b) The particular place for which the license is required. "(c) The name of the owner of the premises. "(d) The purpose for which the permit is desired. "If, after investigation, the Board of Trustees of the Town of Livermore, orders a permit and license issued to such applicant or applicants, the clerk of the Town of Livermore shall issue a permit in writing, which permit shall not become effective until the applicant or applicants have paid the license fee required for the conducting of such business, and said permit shall remain in effect for one year, unless revoked as provided herein. "Section 49-c. It shall be unlawful for any person, whether as proprietor, principal, agent, employe(sic) or otherwise, to sell or offer for sale any intoxication liquor in any of said places of business mentioned in said Sections 47 and 48, or in any room or compartment constituting a part of or connected with any such place of business. "The words 'intoxicating liquor' herein used, shall be construed to mean any beverage not permitted to be sold by any law of the government of the United States or law of the State of California now or hereafter enacted regulating the sale of intoxicating liquor. "Section 49-d. Upon sufficient cause being shown or proof furnished to the Board of Trustees of the Town of Livermore that any person or persons holding a permit or license hereunder has violated any of the provisions of this ordinance regulating the businesses mentioned in said sections 47 and 48 of this ordinance or any law of the State of California, or of the government of the United States, relating to any of the matters or things hereby prohibited, or has conducted or carried on said business in a manner detrimental to public morals, public peace or the safety or well-being of the community of the citizens of the Town of Livermore, the said Board of Trustees shall after notice given to the person or persons holding such permit or license, and a hearing had revoke, cancel, withdraw or suspend the permit issued hereunder and any license granted thereunder(sic)," Section 2. Section 51 of Ordinance No. 104 is hereby amended to read as follows: "Section 51. Every person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and be punishable by a fine or penalty of not exceeding three hundred dollars, or by imprisonment in the Town Jail no t exceeding three months, or by both such fine and imprisonment. Said fine or penalty to be recoverable by a civil action in the Recorder's Court." Section 3. This Ordinance shall by in force and effect at the time provided by law. Section 4. This Ordinance is hereby ordered to be published and printed in the "Livermore Herald," which newspaper is hereby designated for that purpose. Introduced at an adjourned regular meeting of the Board of Trustees of the Town of Livermore, held on the 10th day of January, 1921, by Trustee Hansen. G. Clarke and Edward Brendlin as sureties, in the sum of $24, to insure the Town of Liver- more against any loss as the result of is- suing a duplicate warrant to said Holm Bros. on account of warrant No. 1324, issued to them on November 1st, 1920, for the sum of $12 in payment for grading streets having been lost, was approved and accepter and ordered filed. On motion of Trustee Emminger, seconded Duplicate Warrant by Trustee Rees, and by vote of the Board, a Ordered Issued. duplicated warrant No. 1324, as issued to Holm Bros. on November 1st, 1921, for the sum of $12, in payment for grading streets, was ordered issued. Two applications for building permits Two Building were received and, on motion of Trustee Permits Granted. Hansen, seconded by Trustee Rees, and by vote of the Board, were granted, as follows: F. Beigbeder, for the erection of a laun- dry of fire tile, 36 by 70 feet in size, on his lots on Second street between I and J, at an $ estimated cost of 2,000; Chas. Retzloff, for the erection of a billboard 75 by 11 feet in size on the north side of East First street east of the Valley Garage, at an estimated cost of $120. On motion of Trustee Hansen, seconded by Trees Ordered Trustee Rees, and by vote of the Board, the Trimmed. Clerk was directed to notify H. P. Winegar by letter to have the trees growing over the sidewalk in front of his property on Second street between Lizzie and McLeod trimmed up as required by Ordinance No. 13, within ten days. February 17, 1921 Adjourned Regular Meeting An adjourned regular meeting was held at the Town Hall on Thursday evening, Feb- ruary 17th, 1921. The meeting was called to order at 7:10 o'clock. Roll call: - Present – Trustee Emminger, Hansen, Rees, Utendorffer and President Knox; absent – none. On motion of Trustee Rees, seconded To Advertise For by Trustee Emminger, and by vote of the Bids for Town Board, the Clerk was instructed to advertise Advertising in the official paper in the usual way for bids for the town advertising for the ensuing year, the said bids to be delivered to the Town Clerk by 8 p. m. of Monday, March 7th, 1921, and marked "Bid on Town Advertising; the Board reserving the right to reject any or all bids; the successful bidder to enter into a written contract with the Town within ten days after the award for a period of one year and said bidder to $ furnish a bond in the sum of 200, with tow sure- ties acceptable to the board, for the faithful performance of said contract. February 23, 1921 Special Meeting A special meeting of the Board was held at the Town Hall on Wednesday evening, February 23d, 1921, in response to a call signed by Trustees Rees, Hansen and Utendorffer, stating the purpose of the meeting to be "considering and acting on alleged violations of Ordinance No. 107." The meeting was called to order at 7:50 o'clock. Roll call: - Present – Trustees Emminger, Hansen, Rees, Utendorffer and President Knox; absent – none. February 23d, 1921, was presented, reading as follows; "On the 21st day of February, 1921, bought several drinks of 'jackass' brandy at the Livermore Hotel, at the Hub salon." Polomone, holds a soft-drinks permit and license for the Livermore Hotel, was called upon by President Knox; and stated that Roy Beck had not been in their place of business since the morning of February 16th, 1921; that he had asked his partner about the matter and he had said the same; that he had been selling "jackass" brandy up to February 16th, 1921, the day before Ordinance No. 107 went into effect, but had not sold any since, and that he was not yet a citizen of the United States. Max Berlin Sr. was then called upon by President Knox and, in response to questions asked, stated that he had sold some "Lash's Bitters" to Roy Beck on Feb- ruary 21st, 1921, but no other kind of liquor; that he had no other kind of liquor in his place of business; that Lash's Bitters con- tains 18 percent of alcohol, and that it was not contrary to law to sell it, he believed. After some discussion, the Board con- cluded to take the matter under advisement and endeavor to secure further evidence of possible. The Board then adjourned. The office of Fire Marshal of the Town of Livermore is hereby created, and the Chief of the Fire Department is hereby named as such Fire Marshal, and he and his duly appointed deputies are hereby authorized and empowered: 1st. To enforce all Ordinances relating to the management and condition, in regard to fire hazard, of mercantile or other property within said Town. 2nd. To take summary action in carrying out ordinances pertaining to the removal of rubbish in or on premises, building or buildings, structure or structures, streets, alleys and yards. 3rd. The Fire Marshal shall report to the Board of Trustees monthly regarding the condition of the Town as to all matters referring to fire prevention. SECTION 2. It shall be unlawful for any person, firm, corporation, his, her or their agent, servant, representative or employee to permit paper, rags, waste or combustible rubbish of any character to accumulate in any quantity in or on any building, structure, premises, year, street, alley or other place so as to increase the danger of fire. The accumulation of such rubbish is hereby declared a nuisance, and it shall be the duty of the Fire Marshal or any police officer to see that such nuisances are abated immediately after discovery, using summary measures if necessary to effect immediate abatement. SECTION 3. The Fire Marshal is hereby empowered and authorized to at any and all reasonable times enter upon and into any premises, building or structure within the corporate limits of the Town of Livermore for the purpose of examining and inspecting the same to ascertain the condition thereof with regard to the presence, arrangement of deposit of any articles, materials, substances, goods, wares or merchandise which may have a tendency to create danger of or from fire in said premises, building or structure, or to create danger in case of fire on or in the same, or personal injury of or persons on or in said premises, building or structure; also with regard to the conditions, size, arrangement and efficiency of any and all appliances for protection against fire on or in such premises, building or structure. SECTION 4. If he shall find upon such inspection of such premises, building or structure any rubbish, debris, waste or inflammable or combustible materials, and that the same is not so arranged or disposed as to afford reasonable safeguard against the dangers of fire, or if he shall find that the articles, materials, goods, wares and merchandise, on or in said premises, building or structure are so arranged and disposed that the occupants thereof or persons rightfully on or in the same would not, because of such arrangements and disposition, be afforded reasonable access to the exits of said premises, building or structure in case of fire, or if he shall find that by reason of such arrangement or disposition the members of the Fire Department would unnecessarily and unreasonably be interfered with in the exercise of their duties in and about such premises, building or structure in case of fire in the same, he may order in writing the removal of such rubbish, debris, waste or inflammable or combustible material from said premises, building or structure, or the disposing and arranging of the same on or in said premises, building or structure, in such manner as will remove such danger from fire. He may also order in writing that such articles, materials, goods, wares or merchandise may be so arranged and disposed on or in said premises, building or structure that the occupant thereof, or the persons rightfully on or in the same, will be afforded all reasonable access to the exits from the same in case of fire, and the members of the Fire Department will be afforded all reasonable facilities for the discharge of their duties in and about said premises, building , or structure in case of fire. SECTION 5. If he shall find that the appliances on or in such premises, building or structure for protection against fire are not in proper condition, or of insufficient size or number, or are otherwise insufficient for the purpose for which the same are designed and intended, or if he shall find that such appliances are reasonably necessary for the protection of such premises, building or structure and are wholly wanting, he shall order, in the case of such improper condition or insufficiency, that the same be placed in proper condition and rendered reasonably sufficient to afford reasonable protection against fire, and in the case of absence of such appliances where he may find that they are reasonably necessary for protection against fire, he shall order the installation of appliances sufficient to afford such reasonable protection in case of fire to said premises, building or structure and to the occupants thereof or persons rightfully on or in the same. SECTION 6. The services of any such order shall be made upon the occupant of the premises to whom it is directed by either delivering a true copy of same to such occupant personally or by delivering the same to and leaving it with any person in charge of the premises, or in case no such person is found upon the premises, by affixing a copy thereof in a conspicuous place on the door to the entrance of said premises; whenever it may be necessary to serve an order upon the owner of premises such order may be served either by delivering to and leaving with the said person a true copy of the said order, or if such owner is absent from the jurisdiction of the officer making the orders, by mailing such copy to the owner's last known post-office address. SECTION 7. No person, firm or corporation shall kindle, maintain or assist in maintaining any bonfire or other exposed fire within the Town, excepting under written permit from the Fire Marshal and under such conditions as may be approved by him and under such proper safeguards as he may direct as to time and weather conditions, and on condition that such permit carries an obligation on the part of the grantee to keep sufficient safe control of said fire, and to be responsible for all damages therefrom(sic), and that all resultant embers shall be extinguished and the hot ashes removed or wet down at close of said fire. SECTION 8. The Fire Marshal is hereby empowered and authorized to appoint such and as many deputies to make the inspections hereinbefore provided for, who shall report in writing the results of their inspections to the Fire Marshal. SECTION 9. Every person, firm or corporation or his, her or their agent, servant, representative or employee, violating any of the provisions of this Ordinance, or who shall fail or neglect to discharge the duties imposed by this Ordinance, or shall violate any order of the Fire Marshal issued pursuant to the provisions of this Ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than ten dollars nor more than one hundred dollars, or by imprisonment in Jail of said Town for not more than thirty days, or by both such fine and imprisonment; every day's continuance of a violation of any of the provisions of this Ordinance shall be deemed a separate and distinct offense, and shall be punishable accordingly. SECTION 10. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 11. This Ordinance shall take effect and be in force at the time provided by law. SECTION 12. The ordinance was numbered 109, and fol- lowing is a printed copy of said ordinance as published: ORDINANCE No. 109 ________ An Ordinance to Prevent Certain Animals and Fowls from Running at Large in the Town of Livermore and to Provide for Burial of Dead Animals, and Regulating the Impounding of Animals and Creating the Office of Poundmaster(sic), and Providing a Penalty for Violation of the Provisions hereof, and Repealing all Ordinances or parts of Ordinance in confict(sic) herewith. ________ The Board of Trustees of the Town of Livermore, do ordain as follows: SECTION 1. – The office of poundmaster(sic) of the Town of Livermore is hereby created, and the Marshal of the Town of Livermore is hereby named as such poundmaster(sic). SECTION 2. No person, firm or corporation shall cause, permit or allow any ox, bull, cow, horse, colt, jack, mule, calf, sheep, goat, hog, ducks, geese or other domesticated fowls to run at large in the Town of Livermore. SECTION 3. No person, firm or corporation shall cause, permit or allow any ox, bull, cow, horse, colt, jack, mule, calf, sheep, goat, hog, ducks, geese or other domestic fowls to be tied, staked, or herded for the purpose of grazing in any of the streets, lanes, alleys, courts, places, public squares, or other grounds belonging o or under the control of the Town of Livermore. SECTION 4. No person, firm or corporation shall cause, permit or allow any ox, bull, cow, horse, colt, jack, mule, calf, sheep, goat or hog to be tied, staked, pastured, or to run at large upon any private property within the limits of the Town of Livermore unless by consent of the owner or occupant of said property. SECTION 5. No person, firm or corporation shall in the Town of Livermore keep any ox, bull, cow, horse, colt, jack, mule, calf, sheep, goat or hog tied, staked, or pastured in any yard or lot within any distance less than ten feet from the property line of such yard or lot. The words "property line" as used in this section shall not include any portion of any street or sidewalk within the Town of Livermore. SECTION 6. It shall be the duty of the Poundmaster(sic) to take up, impound, and safely keep any of the animals or fowls enumerated in the foregoing sections found running at large, staked, tied or being herded or pastured in any street, lane, alley, court or place or public ground, or upon any private lot or ground in the Town of Livermore, contrary to the provisions of this Ordinance. When any animal is so impounded, the Poundmaster(sic) shall immediately notify he owner thereof, if known to him, and shall post three notices; one on the Town Hall, one at the postoffice(sic) and one in a conspicuous place a the pound. Said notices shall contain a full description of said animals, and shall set forth that, unless reclaimed, will be sold at public auction to the highest bidder at a time and place to be specified in said notice, the Poundmaster(sic) shall proceed to sell the same at the time and place and in the manner specified in said notice, provided that all animals so taken into the custody of the Poundmaster(sic), which by reason of age or disease or other infirmity are unfit for further use, or are dangerous to be kept impounded, shall be destroyed by him, within twelve hours from the time such animals have been impounded, and in case of such destruction of such animals the Poundmaster(sic) shall not be required to give the aforesaid notice. SECTION 7. The owner of any animals impounded shall have the right to reclaim the same at any time prior to the sale thereof upon payment to the Poundmaster(sic) of the costs and charges hereinafter provided in this Ordinance for impounding and keeping such animal, or, if sold, the owner shall have the right to receive the proceeds of the sale of such animal, less the costs and charges aforesaid, within thirty days after such sale, upon satisfactory proof of his or her ownership of such animal so impounded and sold. SECTION 8. The Poundmaster(sic) shall cause all animals impounded by him to be provided with sufficient food and water suitable for such animals, and upon his neglecting to do so shall be liable to the owner for all damages arising therefrom(sic). SECTION 9. The Poundmaster(sic) shall receive and collect from the owner of any of the following animals the following fees, to-wit: for impounding the said animals: Horses, bulls ,oxen and cows, per head, $2.00 Jacks, mules, steers and colts, per head, $2.00 Hogs, sheep, goats, calves and dogs, per herd, $1.00 and for keeping the same per day: Horses, bulls, oxen and cows, per head, $1.00 Jacks, mules steers and colts, per head, $1.00 Hogs, sheep, goats, calves and dogs, per head. $.50 SECTION 10. If any animal or domestic fowls be not redeemed or sold within the time and in the manner specified in this ordinance, the Poundmaster(sic) shall kill the same, and all animals so killed shall be buried by the Poundmaster(sic) in the Town burial place for dead animals. SECTION 11. it shall be the duty of all persons having dead animals upon their premises, or who shall be the owner or possessor of any dead animal which died within the Town of Livermore, to bury the same at least four feet underground, except cats, dogs or fowl, which shall be buried a last(sic) two feet underground, either upon the premises of such owner or person upon whose premises such dead animal is found or in the Town burial place for dead animals, within forty-eight hours after the same shall die; and, upon the request of any owner or possessor of any dead animal, it shall be the duty of the Poundmaster(sic) to proceed forthwith to bury the dame in the Town burial place for dead animas, for which he shall collect and receive from the owner or possessor of such dead animas, the following fees: For burying Horses, bulls, oxen and cows, $5.00, and cost of transportation to burial place. For burying jacks, mules, steers and colts, each, $4.00, and cost of transportation to burial place. For burying sheep, goats and dogs, each $2.00. SECTION 12. It any person fails or neglects to bury any dead animal as provided for in this Ordinance, then in such case it shall be the duty of the Poundmaster(sic) to proceed forthwith to bury the same; and it shall be lawful for the Poundmaster(sic) to charge, receive, collect or recover from the owner or possessor of such dead animal buried by him the fees hereinbefore provided; and any such person so refusing or neglecting to bury or cause to be buried any such dead animal shall be guilty of a misdemeanor. SECTION 13. If any person shall rescue any animal from the possession of the Poundmaster(sic) while such animal is being conveyed, or is about to be conveyed, to the Town Pound, or shall make any Pound breach, or in any way directly or indirectly convey or deliver any animal out of the Town Pound without lawful authority, he shall be guilty of a misdemeanor. SECTION 14. Every person taking up any animal liable to be impounded under the provisions of any Ordinance of the Town of Livermore shall, within twelve hours after taking up such animal, or if the same be attached to a vehicle within four hours, give notice thereof to the Pounmaster(sic) or his deputies, or to the Marshal, and the Poundmaster(sic) shall thereupon take such animal into his custody, and every person to whom such animal may be delivered or who shall rereceive(sic) the same, shall forthwith on demand deliver such animal to the Poundmaster(sic). Every person taking up such animal and failing or neglecting to give such notice or refusing or neglecting to deliver such animal to the Poundmaster(sic) on demand, shall be guilty of a misdemeanor. SECTION 15. The Poundmaster(sic) shall each month turn unto the Town Treasury all moneys received by him, or collected by him, in accordance with the provisions of this Ordinance. SECTION 16. Every person, firm or corporation or his, her or their agent, servant, representative or employee, violating any of the provisions of this Ordinance, or who shall fail or neglect to discharge the duties imposed by this Ordinance, or who shall fail or neglect to discharge the duties imposed by this Ordinance, shall be guilty of a misdemeanor and , upon conviction thereof, shall be punished by a fine of not more than fifty dollars, or by imprisonment in the Town Jail of the Town of Livermore for not mote than fifteen days, or by both such fine and imprisonment. SECTION 17. All Ordinances or part of Ordinances in conflict herewith are hereby repealed. SECTION 18. This Ordinance shall take effect and be in force at the time provided by law. SECTION 19. This Ordinance is hereby ordered to be printed and published in Livermore Journal, which newspaper is hereby designated for that purpose. The ordinance was numbered 110, and following is a printed copy of said ordinances as published: ORDINANCE No. 110 ________ An Ordinance Prohibiting the Sale, Gift, Storage, Manufacture, Transportation, Unlawful Possession, Importation or Exportation of Intoxicating Liquors for Beverage Purposes; Regulating All Other Traffic in Such Liquors; and Providing Penalties for Violation Hereof. ________ The Board of Trustees of the Town of Livermore do ordain as follows: SECTION 1. When used in this Ordinance (1) the word "liquor" or the phrase "intoxicating liquor" shall be construed to include alcohol, brandy, whiskey, rum, gin, beer, ale, porter and wine, and in addition thereto, any spirituous, vinous, malt, or fermented liquor, liquids, and compounds, whether medicated, proprietary, patented, or not, and by whatever name called, containing one-half of 1 per centum or more of alcohol by volume which are fit for use for beverage purposes: Provided that the foregoing definition shall not extend to dealcoholized(sic) wine nor to any beverage or liquor produced by the process by which beer, ale, porter or wine in(sic) produced, if it contains less than one-half of 1 per centum of alcohol by volume, and is made as prescribed in laws enacted by Congress, and is otherwise denominated than as beer, ale, or porter, and is contained and sold in, or from such sealed and labeled bottles, casks, or containers as the United States Commissioner of Internal Revenue may by regulation prescribe. The work "person" shall mean and include natural persons, firms, associations, clubs, co- partnerships, corporations and all associations or combinations of persons, whether acting by themselves or by a servant, agent or employee. SECTION 2. It shall be unlawful for any person within the Town of Livermore to manufacture, have, Import, export, deliver, furnish, possess or have in his possession, any intoxication liquor except as authorized in this Ordinance. Liquor for non-beverage purposes and wine for sacramental purposes may be manufactured, purchased, sold bartered, transported, imported, exported, delivered, furnished and possessed within the Town of Livermore, but only by a person holding a valid permit from the United States Internal Revenue Department, and only in accordance with the laws of the United States: Provided nothing in this Ordinance shall prohibit the purchase and sale of warehouse receipts covering distilled spirits on deposit in Government bonded warehouses, and no special tax liability shall attach to the business of purchasing and selling such warehouse receipts. SECTION 3. The following articles shall not, after having been manufactured and prepared for the market be subject to the provisions of this Ordinance, if they correspond with the following descriptions and limitation, merely: (a) Denatured alcohol or denatured rum produced and used as provided by laws and regulations now or hereafter in force. (b) Medical preparations manufactured in accordance with formulas proscribed by the United States Pharmacopeia(sic), National Formulary, or the American Institute of Homeopathy that are unfit for use for beverage purposes. (c) Patented, patent, and proprietary medicines that are unfit for use for beverage purposes. (d) Toilet, medicinal, and antiseptic preparations and solutions that are unfit for use for beverage purposes. (e) Flavoring extracts and syrups that are unfit for use as a beverage, or for intoxicating beverage purposes. (f) Vinegar and preserved sweet cider. Any person who manufactures any of the articles mentioned in this section within the Town of Livermore, may purchase and possess liquor for that purpose, provided permits be secured from the United States Internal Revenue Department to manufacture such articles and to purchase such liquor, as provided by the laws enacted by Congress enforced under the direction of the United States Internal Revenue Department. No such manufacturer shall sell, use, or dispose of any liquor within the Town of Livermore, otherwise than as an ingredient of the articles authorized to be manufactured therefrom(sic). No more alcohol shall be used in the manufacture of any extract, syrup, or the articles named in paragraphs b, c, and d of this section which may be used for beverage purposes than the quantity necessary for extraction or solution of the element contained therein and for the preservation of the article. Any person who shall, within the Town of Livermore, knowingly sell any of the articles mentioned in paragraphs a, b, c, and d of this section for beverage purposes, or any extract or syrup for intoxicating beverage purposes, or shall sell any of the same under circumstances from which the seller might reasonably deduce the intention of the purchaser to use them for such purposes, or shall sell any beverage containing one-half of 1 per centum or more of alcohol by volume in which any extract, syrup, or other article is used as an ingredient, shall be subject to the penalties in this Ordinance provided. SECTION 4. It shall be unlawful for any person to manufacture, sell, purchase, transport, or prescribe any liquor within the Town of Livermore without first obtaining a permit from the United States Commissioner of Internal Revenue so to do, except that any person may, without a permit, purchase and use liquor for medicinal purposes when prescribed by a physician as herein provided and except that any person who is conducting a bona fide hospital or sanatorium in the Town of Livermore, engaged in the treatment of persons suffering from alcoholism, may, under such rules, regulations, and conditions as the United States Commissioner of Internal Revenue shall prescribe, purchase and use, in accordance with the methods in use in such institution; liquor to be administered to the patients of such institution under the direction of a duly qualified physician employed by such institution. Nothing in this Ordinance shall be held to apply to the manufacture, sale, transportation, possession, importation, or distribution of wine for sacramental purposes, or like religious rites, by persons holding a valid permit therefore from the United States Internal Revenue Department. No person to whom such permit may be issued to manufacture, transport, imports, or sell wines for sacramental purposes or like religious rites, shall sell, barter, exchange or furnish any such to any person not a rabbi, minister of the gospel, priest, or an officer duly authorized for the purpose by any church or congregation, nor to any such except upon an additional application duly subscribed by him, which application, authenticated as regulations may prescribe, shall be filed and preserved by the seller. SECTION 5. It shall be unlawful for any one who is not a physician holding a permit for the United Stated Internal Revenue Department to prescribe liquor, to issue any prescription for liquor; and, no physician shall prescribe liquor unless after careful physical examination of the person for whose use such prescription is sought; or, if such examination is found impracticable, then, upon the best information obtainable, he in good faith believes that the use of such liquor as a medicine by such person is necessary and will afford relief to him from some known ailment. Not more than a pint of spirituous liquor to be taken internally shall be prescribed for use by the same person within any period of ten days and no prescription shall be filled more than once. Any pharmacist filling a prescription shall at the time indorse upon it over his own signature the word "cancelled," together with the date when the liquor was delivered, and then make the same a part of the record that he is required to keep as herein provided. SECTION 6. It shall be unlawful for any person to manufacture, purchase for sale, prescribe, sell or transport any liquor, within the Town of Livermore, without making at the time a permanent record thereof showing in detail the amount and kind of liquor manufactured, purchased, sold or transported, together with the names and addresses of the persons to whom sold, in case of sale, for whom prescribed, amount and purpose in case of prescription and, the consignor and consignee in case of transportation, and the time and place of such manufacture, prescription, sale, or transportation. SECTION 7. All manufacturers and wholesale or retail druggists of the Town of Livermore, holding United States Internal Revenue permits shall keep as a part of the records required of them, a copy of all United States permits to purchase on which a sale of any liquor is made, and no manufacturer or wholesale druggist shall sell or otherwise dispose of any liquor except at wholesale and only to persons having United States permits in such quantities. SECTION 8. All persons within the Town of Livermore manufacturing liquor for sale under a United States Internal Revenue permit shall securely and permanently attach to every container thereof, as the same is manufactured, a label stating name of manufacturer, kind and quantity of liquor contained therein, and the date of its manufacture, together with the number of the permit authorizing the manufacture thereof, and all persons possessing such liquor in wholesale quantities shall securely keep and maintain such label thereon; and all persons selling a wholesale shall attach to every package of liquor, when sold, a label setting forth the kind and quantity of liquor contained therein, by whom manufactured, the date of sale, and the person to whom sold; which label shall likewise by kept and maintained thereon until the liquor is used for the purpose for which such sale was authorized. SECTION 9. It shall be the duty of every carrier within the Town of Livermore to make a record at the place of shipment on the receipt of any liquor transported, and he shall deliver liquor only to persons who present to the carrier a verified copy of a United Stated Internal Revenue permit to purchase, which shall be made a part of the carriers permanent record at the office from which delivery is made. SECTION 10. It shall be unlawful for any person o use or induce any carrier or any agent or employee thereof to carry or ship any package of receptacle containing liquor without notifying the carrier of the true nature and character of the shipment. No carrier within the Town of Livermore shall transport nor shall any person receive liquor from a carrier unless there appears on the outside of the package containing such liquor, the following information: Name and address of the cosignor or seller; name and address of the consignee; kind and quantity of liquor contained therein; number of the permit to purchase or shop the same; and, the name and address of the person using the permit. SECTION 11. It shall be unlawful for any consignee to accept or receive any package containing any liquor upon which appears a statement known to him to be false or for any carrier or other person to consign, ship transport or deliver any such package, knowing such statement to be false. SECTION 12. It shall be unlawful to give to any carrier or any officer, agent, or person acting or assuming to act for such carrier, an order requiring the delivery to any person of any liquor or package containing liquor consigned to, or purporting or claimed to be consigned to a person, when the purpose of the order is to enable any person not an actual bona fide consignee to obtain such liquor. SECTION 13. It shall be unlawful for any person to advertise in said Town, any intoxicating liquor by means of any sign or billboard, or by circular, poster, price list, newspaper, periodical, or otherwise, or to advertise the manufacture, sale, keeping for sale, or furnishing of such liquors, or the person from whom, or the place where, or the price at which, or the method by which any such liquors may be obtained; provided, that manufacturers and wholesale druggists, holding valid permits under this Ordinance, may send price lists to those to whom they may legally sell such liquors and this section shall not apply to foreign newspapers mailed into the United States. SECTION 14. It shall be unlawful to advertise, manufacture, sell, or possess for sale any utensil, contrivance, machine, preparation, compound, tablet, substance, formula, direction or recipe advertised, designed, or intended for use in the unlawful manufacture of intoxication liquor. SECTION 15. It shall be unlawful to permit any sign or billboard painted, erected or otherwise constructed, containing any advertisement, rendered unlawful by Sections 13 and 14 or this Ordinance, to remain upon one's premises, or to circulate or distribute any circulars, price list or other advertisement rendered unlawful by this section, and it shall be the duty of all and every police officer of the Town of Livermore to remove and destroy any such advertisement when it comes to his notice. SECTION 16. It shall be unlawful for any person to solicit or receive, or knowingly permit his employee to solicit or receive, from any person, any order for liquor, or give any information of how liquor may be obtained in violation of Ordinance. SECTION 17. It shall be unlawful to have, possess, transport or manufacture any liquor, or any utensil, contrivance, machine, preparation, compound, tablet, substance, formula, direction or recipe designed for the manufacture of liquor intended for use in violation this Ordnance, or which has been so used; and no property rights shall exist in any such liquor or the aforementioned property. A search warrant may issue as provided in Title XI, of public law Numbered 24 of the Sixty-fifth Congress, approved June 15, 1917, and such liquor, the containers thereof, and such property as hereinbefore referred to, so seized shall be subject to such disposition as the Court may make thereof., No search warrant shall issue to search any private dwelling occupied as such unless it is being used for the unlawful sale, or manufacture of intoxicating liquor, or unless it is in part used for some business purpose such as a store, ship, saloon. restaurant, or boarding house the term "private dwelling" shall be construed to include the room or rooms used and occupied not transiently but solely as a residence in an apartment house, hotel, or boarding house. The property seized on any such warrant shall not be taken from the officer seizing the same on any writ of replevin(sic) or other like process. The Recorder of the Town of Livermore shall have power to issue search warrants as provided in this section. SECTION 18. Any person who shall violate any of the provisions of this Ordinance is guilty of a misdemeanor, and upon conviction thereof, shall be punished by imprisonment in the Town Jail in the Town of Livermore, for a period of not more than three months, or by a fine of not more than Three Hundred Dollars, or by both such fine and imprisonment. SECTION 19. No person shall be excused, on the ground that it may tend to incriminate him or subject him to a penalty or forfeiture, from attending and testifying or producing books, papers, documents, and other evidence in obedience to a subpoena of any Court in any suit or proceeding based upon or growing out of any alleged violation of this Ordinance, but no natural person shall be prosecuted or subjected to any penalty or forfeiture for or on account of any transaction, matter, or thing as to which, in obedience to a subpoena and under oath he may so testify or produce evidence, but no person shall be exempt from prosecution and punishment for perjury committed in so testifying. SECTION 20. In any affidavit, information, indictment, or complaint for the violation of this Ordinance, separate offenses may be united in separate counts and the defendant may be tried on all at one trail and the penalty for all offenses may be imposed It shall not be necessary in any affidavit, information, indictment, or complaint, to give the name of the purchaser or to include any defensive negative averments, but it shall be sufficient to state that the act complained of was then and there prohibited and unlawful, but this provision shall not be construed to preclude the trail court from directing the furnishing by the defendant of a bill of particulars when it deems it proper to so do. SECTION 21. The possession of liquors by any person not legally permitted under this title to possess liquor shall be prima facie evidence that such liquor is kept for the purpose of being sold, bartered, exchanged, given away, furnished, or otherwise disposed of in violation of the provisions of this title. Bit it shall not be unlawful to possess liquors in one's private swelling while the same is occupied and used by him as his dwelling only; and, such liquor need not be reported, provided such liquors are for use only or the personal consumption of the owner thereof and his family residing in such dwelling and of his bona fide guests when entertained by him therein; and the burden of proof shall be upon the possessor in any action concerning the same to prove that such liquor was lawfully acquired, possessed and used. SECTION 22. All records and reports kept or filed under the provisions of this Ordinance shall be subject to inspection at any reasonable hour by city, district, township, or county officials, or any of their agents or by any public prosecutor or by any person designated by him, or by any peace officer in the County where the record is kept, and copies of such records and reports duly certified by the person with whom kept or filed may be introduced in evidence with like effect as the originals hereof, and verified copies of such records shall be furnished to such city, district, township, or county official, when called for. SECTION 23. It shall be the duty of all police officers of the Town of Livermore, and their deputies, and all other officials charged with the enforcement of law, to enforce the provisions of this Ordinance. SECTION 24. Nothing in this Ordinance shall be construed to limit the sale or manufacture of industrial acohol(sic) by a person holding a valid permit therefore from the United States Internal Revenue Department, and when such industrial alcohol is manufactured and sold in accordance with the laws of the United States, and the rules and regulations of the United States Commissioner of Internal Revenue. SECTION 25. All ordinances or parts of ordinances that are inconsistent with this Ordinance are hereby repealed. SECTION 26. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not effect the validity of the remaining provisions of this Ordinance. The Board of Trustees of the Town of Livermore hereby declares that this Ordinance shall be deemed to be an exercise of the power granted by the 18th Amendment to the Constitution of the United States, and of the police power of the Town of Livermore, for the protection of the public health, peace, safety and morals of the people of said Town of Livermore; and, all of its provisions shall be liberally construed for the accomplishment of these purposes; and the Board of Trustees would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more of such sections, subsections, sentences, clauses or phrases might be declared invalid or unconstitutional. SECTION 27. This Ordinance shall take effect and be in force at the time provided by law. SECTION 28. This Ordinance is hereby ordered to be printed and published in Livermore Journal, which newspaper is hereby designated for that purpose. Still was sworn in by the President, and testy- fied that a permit to obtain a license to sell soft drinks was issued by the Board to said Mendes on March 21st, 1921, and that a license to sell soft drinks had been issued to him on that date and again on June 21st, 1921, and that neither the permit nor the license had been revoked or can- celled but were both still in force and effect. Night Watchman A. J. McDonald was then called to the witness stand and sworn in, and testified that on July 12th, 1921, he, accompanied by Night Watchman C. E. Conrad and Deputy Sheriff L. E. Wright visited the place of the said Mendes, having first se- cured a search warrant for the purpose and found liquor stored in the out- buildings in the rear; that on June 21st, 1921, Mendes pleaded guilty in the Recorder's court to violating Ordinance No. 110 and was fined $300. which he paid a few hours later; that the three officers took possession of the liquor found on the place, and that it was later tested and found to con- tain more than one-half of one per cent of alcohol by volume. The witness also stated, in answer to questions by Mendes, that Officer Wright had the key that was used in opening the place; that he did not know where Wright had gotten the key, and that Mendes was not there at the time the place was unlocked and entered. Mendes was asked whether he had any evidence or witnesses to pre- sent in his behalf, and replied that he had no witnesses present. Ratti was called before the Board, and stated that at the time in question he was away attending the mov- ing picture show and had left his son-in-law, Fernandez Cerruti, in charge of his place of business; that he did not know anything of about the matter of the liquor being sold at his place until his return; that the wine sold was some he had for his own use and was kept in the kitchen; that he did not keep wine for sale; that the wine sold was some that he had made himself; that he had no permit to make it, but saw in the paper that a person was allowed to make 200 gallons of wine for his own use, and that the wine was sold against his wishes and he could not help it. George Prescott was next called to the witness stand, upon being sworn in by the Presi- dent, testified that on the evening in question he asked for a gallon of wine at the Ratti place and paid $3 for it, but could not swear as to what it was, as it was taken away from him by officer Wright before he tasted it; that he did not know the name of the young man who had sold him the wine, and that he had not bought wine there before. Deputy Sheriff L. E. Wright was then called to the witness stand and sworn in, and testified that he did not see Prescott or his companion come out of the Ratti place at the time in question, but saw them across the street; that Prescott had the jug in a sack; that he, with officers McDonald and Conrad, took the jug away from the two men and examined the contents and found them to be a very poor grade of wine, and that he tested in and found it to contain five per cent of alcohol by volume, and that Prescott and his companion signed a written state- ment that he had purchased it at Ratti's for $3 Town Clerk Elmer G. Still was next sworn in and testified that a permit to obtain al license to sell soft drinks and been issued to N. Ratti and John Ratti on February 17th, 1921, and the min- utes showed; that a license had been issued to them under said permit, dated the same and reissued on May 17th, 1921, and that the permit and license were still in force and effect. John Ratti was next called to the stand and testified that at the time in question he was in Oakland and did not know of the matter until a day or two afterward; that they had hired his brother-in-law, Cerruti, who happened to be there, to be in charge of the place; that he was in court when Cerruti pleaded guilty; that they kept wine there for his father, who needed it for his health.
