This has all the hallmarks of high speed rail, which the Palo Alto council supported and hyped, as indicated in  this January 2009 op‐ed by then‐Councilwoman Kishimoto:   Many — including myself — hope this will create an attractive and clean high‐tech alternative to expanding  airports or highways and help spur the transformation of California into a more transit‐friendly, green economy  with vibrant, walkable downtowns up and down the state.   The system is expected to cost $45 billion to build, with annual operating costs of $1.6 billion when it is fully up and  running. In return, the system is expected to support a robust and productive economy by providing service  between Los Angeles and San Francisco in 2 1/2 hours for up to 93 million passengers per year by 2030. resident taxes for transit, he said. Today the Metropolitan Transportation Commission helps oversee transit in  the nine county Bay Area, but D’Souza says the governance hasn’t been effective and that billions of dollars  have already been wasted.  “In order for these things to happen, you need some change to occur at MTC,” he said. “MTC is made up of  about 40 major transit organizations and none of them agree with each other.” We are writing to express our concerns about the report and to provide additional information that we believe will be useful in the committee’s and Council’s discussions related to the Palo Alto City Auditor’s Office. A government auditing function independent of management and operating under Government Auditing Standards plays a key role in effective governance, public accountability, and transparency. The Palo Alto City Auditor’s Office is established as an independent government audit function with the city auditor appointed by and reporting to the City Council.1 The office is also required to follow Government Auditing Standards (GAGAS) in conducting its work.2 The office conducts audits in accordance with these standards and has successfully undergone required external peer reviews. The opinions from the last two peer reviews (2014 and 2017) found the internal quality control system of the Palo Alto City Auditor’s Office was suitably designed and operating effectively to provide reasonable assurance of compliance with Government Auditing Standards. The consultant’s recommendations would weaken the existing structure. The consultant’s report relies on internal auditing standards and guidance that are more oriented towards the private sector rather than the Government Auditing Standards that are used in Palo Alto and relevant for government auditing. The report also focuses on “internal audit” however, under Government Auditing Standards the Palo Alto City Auditor’s Office is an “external audit” function, which further protects and enhances its independence. Government Auditing Standards (2018 Revision) 3.52 The ability of an audit organization structurally located in a government entity to perform work and report the results objectively can be affected by its placement within the government entity and the structure of the government entity being audited. The independence standard applies to auditors in both external audit organizations (reporting to third parties externally or to both internal and external parties) and internal audit organizations (reporting only to senior management within the audited entity). Such audit organizations are often subject to constitutional or statutory safeguards that mitigate the effects of structural threats to independence. 3.53 For external audit organizations, constitutional or statutory safeguards that mitigate the effects of structural threats to independence may include governmental structures under which a government audit organization is: b. placed within a different branch of government from that of the audited entity—for example, legislative auditors auditing an executive branch program. 3.54 Safeguards other than those described in paragraph 3.53 may mitigate threats resulting from governmental structures. For external audit organizations, structural threats may be mitigated if the head of the audit organization meets any of the following criteria in accordance with constitutional or statutory requirements: b. elected or appointed by a legislative body, subject to removal by a legislative body, and reporting the results of engagements to and accountable to a legislative body; 1 Palo Alto Charter Sec. 1. 2 Palo Alto Municipal Code 2.08.130(4)(b). The city auditor works for the Council and audits management. The charter and ballot language establishing the city auditor created a position and office that is independent of management to provide elected officials and the public with information. Independence is a requirement under Government Auditing Standards. Government Auditing Standards (2018 Revision) 3.18 In all matters relating to the GAGAS engagement, auditors and audit organizations must be independent from an audited entity. The consultant’s recommendation, based on IIA guidance, that the city auditor report to the city manager in an administrative manner is a significant structural threat to the independence of the City Auditor’s Office and not appropriate for an external government audit function. Some of the administrative reporting examples outlined by the consultant could result in management inappropriately exerting control over audit work. The Council can exercise functional and administrative oversight of the city auditor and City Auditor’s Office as a body and/or through an Audit Committee that does not include anyone from management. ALGA has developed Audit Committee Guidance that describes the importance of an audit committee, how it should be structured, and the responsibilities of the committee. The consultant also recommended the city auditor provide management with advisory/consulting services as well as track this as a performance measure. Advisory/consulting services can create threats to independence, even to the point that the city auditor could not audit programs and activities for which advisory/consulting services were performed. The Government Auditing Standards outline processes for conducting nonaudit services that could be provided to management and identifies safeguards to protect the office’s independence. However, providing nonaudit services to management reduces the amount work the city auditor and City Auditor’s Office can conduct for the Council. The consultant listed and recommended a number of measures to evaluate the performance of an audit office. ALGA has also developed Performance Measures for Audit Organizations to provide examples of performance measures that can be used to evaluate a government audit office. Palo Alto Municipal Code notes that the city auditor shall be a licensed CPA or CIA; the consultant report notes this as a preference and recommends a set of minimum qualifications. I’ve done 10 shows in the room. My plan — although I’m moving the goal posts, so to speak — is to do 2 shows a month there for 2 years to see how it goes over. In context, I’ve been producing shows here for 25 years — since Fall, 1994 — including a run of 150 shows at Cubberley, either the theatre or auditorium(cafeteria/multipurpose room/”temporary library”/”temporary junior museum”), 1994-2001. (For instance Cake, blink 182, Jonathan Richman, Train, AFI, Steve Lacy, Fred Eaglesmith et cetera). Also, as a one-off, I produced a recent show in Cubberley H-1 — a classroom with banked seating but no stage — capacity 100; it was last month featuring Matt The Electrician and Sylvie Simmons. I rent these rooms from the City, at a standard commercial rate. (I am not a 501.c3 nor co-sponsored by the City, the way, for example MusikWest is). I bring in my own sound, or more specifically subcontract such with a company Audio Pro (formerly LDR) of San Carlos, owned and run by Andy Heller. The legal capacity for seated assembly at “The Mitch” is 210 — Elvin Bishop sold out in advance, and 98 percent of the tickets were sold online at EventBrite. To my mind, based on my knowledge of the artist (born, 1942) and on several calls I had received from ticket holders and prosective attendees, I estimated ahead of time that the average audience member would be roughly 50-60 years old. The Elvin Bishop crowd, in a room as intimate as The Mitch, would not, for example prefer the entire house be arranged for dancing or standing, like, at The Fillmore. In some ways, without using the term in advertising, I see the Mitch series as “a listening room” or “theatre-style” (though in fact the El Palo Alto Room — which confusingly can be rented half-house as El Palo Alto North and or El Palo Alto South — though I would NEVER do such — is in places called “a ball room”). Of the 10 shows I have produced so far — jazz, bluegrass, and blues –the average attendence was closer to 100 than 200, i.e. half full. The only other show where the size of the audience influenced my thinking on your topic was Molly Tuttle, Monday, September 30 — also a sellout, clean. And in fact I left up to her tour manager the final call for a stage or no stage. (And, further, I fretted about this topic or ruminated until about 30 hours before my show at which time I was attending the Gryphon Stringed Instruments 50th anniversary party and show Sunday, September 29 featuring Molly Tuttle as an secret special guest — her dad Jack works there — and noted that their stage including Molly’s 2 set was not a stage but merely the ground level parking lot of the auto body shop across the street. My thought was: if ground level staging was good enough for Molly’s set at the Gryphon party Sunday, it was good enough for Molly Monday at The Mitch. I did, if memory serves, tell her agent that the previous shows in that room were stageless and there would be a discussion with the tour manager when they advanced the show, although he the tm never brought it up). If I had a band that I knew could definitely sell 350 tickets at The Mitch and the audience was young enough to stand or dance the entire night, I might elevate the band and strike the seats — I think Yoshi’s and Freight and Salvage have, at times, struck seating and tables to create a dance floor or room for “kelpers”* at Charlie Hunter shows or for salsa bands. So, basically, my concept is an intimate environment to hear and see (in that order) local national and international acts of various genre but to put the artists at the audience level, and not elevated. Besides the simplicity of the staging (“KISS”), and the cost savings, I feel that there is something egalitarian about staging in that manner — in all my shows, over 25 years and 300 or more events, with 500 or more booked acts, and maybe 10,000 attendees, there is a blurring between act and audience and staff. For example, many fans — like yourself, apparently, I learn — are also musicians, as are my staff, or volunteers. (I’ve never hired security per se for an event — when required, by the City, I had laminates designating Earthiwise Cubberley staff but they were frequently worn by musicians, who also helped load in — not the featured performer but off-duty musicians, who frequented my shows. I have been asked this question, or fielded that comment several times. I usually say that because the seats are stackable and not fixed — meaning we lay them out. In Friday’s case I personally unstacked and set out all 200 chairs — so that people like you can move your chair to the left or right if that helps your sight-line. You can also, in open seating, move closer to the stage, or stand, or dance. (And we left it up to Elvin’s team whether, in the event of a rush on tickets, we would try to accomodate all comes versus leaving more room for the comfort level of the artist performing). Further or similarly, if I had employed a feature offered by EventBrite, that lets me “scan” and not merely inspect all the tickets — hard copies and electronic — I might have been able to ascertain the order of arrival for paid parties and for example, learned, potentially if you had arrived early or late to the show, which might have influenced how I answered your question: I’m guessing that someone who asked such a question arrived late, and therefore sat in the back. But, I prefer to “Keep It Simple”, and have not even downloaded the app that would let me scan all tickets and gather such data — the service does tell me the names and email addresses of ticket holders). That Elvin Bishop not only sits during Big Fun Trio but to my observation slouches probably worsens the problem you identify. (Another question I fielded more than once Friday was whether we should get a bar to serve alcohol, or sell more food. Although I did take the business card of the bartending crew at the Palo Alto Black and White ball recently — at Lucie Stern Center – -I doubt I will ever sell alcohol at Earthwise events; for concessions, OTOH, I was expecting ADA’s Cafe to remain open, but somehow I dropped the ball in coordinating that with Mrs. Hughes, the spearhead of that project; for the Molly Tuttle show the artist, whose mom is friends with Mrs. Hughes, even called from the stage for the audience to visit the cafe during her set break. Circling back to your comment or what I started to say: I think the old Cubberley High for 150 events in the 1990s “quaint” whereas today, 25 years later it would be “sad”. (And I am of the age to recall attending a high school dance in that same multipurpose room). I also think Cubberley Theatre per se (but not H-1, different department) is slightly mismanaged, relative to the staffing or policy of the 1990s and that to me is a barrier or disincentive to resume a series there. I did the Matt The Electrican show on a whim and although Room H-1 is not ideal, I am pondering an ongoing singer-songwriter series there, between now and when the wrecking ball hits (you may know that Cubberley is targeted for redevelopment). For me, with banked seating, a folk series there would not need a stage although we brought in sound – but no technical staff. It’s debatable whether such a series or repeat production needs sound reinforcement, though I would more likely err on the side of better-than-needed sound rather than making do with less. What I think H-1 might need, however, if you excuse the digression, 3 for purchase as a room for the arts, might be a mural on the wall that indicates subtly that art belongs there — not to the exclusion or more mundance uses and not to the extent of naming a series or identifying the producer: more like a rendering of a musician or something with a graffiti-styling and the words “sound” or “noise” or the like; mos def not WELCOME TO EARTHWISE AT H-1. Similarly, although I should have stated this further up, in lieu of a stage for the Mitch shows we purchased you may have noticed a Persian rug which we jokingly call “a magic carpet” on which the featuring musicians set up — although even that, the tour manager/guitar tech before he realized what he was dealing with started to direct us to use the rug for the drummer only, even on cajon. We usually have a second, less fancy rug specifically for a drum kit, as you likely know, to prevent the kit from sliding. A rock band with a kit drummer we might get a drum riser, but have not yet had call to do so. I am also in part booking “to the room” in that I have a series of piano-duos coming — in that series or sub-series we are trying it with no sound. The room you may have noticed has a passable Baldwin donated at the opening five years ago, which Mitch Woods but not Bob Welch played Friday. I don’t think I will decide conclusively on the utility of Mitchell Park for a great concert series until after the first 50 shows. The room was not designed for concerts, yet I believe my concerts are its highest and best use. (With Cubberley I did not decide after a while: and in fact it was Charlie Hunter, the first to sell out the room, and who returned four times with five different combos, who said I had to keep doing the shows; he said that when he played a bar in San Jose he was unsure whether he or the mixed drinks were the draw, whereas my room, the Cubberley Theatre, was a true listening room, or a pure listening room). In response, and over the course of just one month, Los Altos City Council drafted and unanimously approved an urgency ordinance, and consequently denied all 13 applications. Following the rejected applications, AT&T and Verizon appealed the decision. Based on Los Altos's precedent, we should comfortably be targeting 91%, not 10%. How much of our city we would be prohibited if we increased residential setbacks from 20 to 100 feet and school setbacks from 300-600 to 1100 feet? Jonathan - I recall you mentioning Monday that just increasing residential setbacks to 100 feet would result in about 90% of Palo Alto prohibited, is that correct? If so, that would be in line with Los Altos. Asked another way, what would be the maximum distance we could increase residential and school setbacks to achieve 91% prohibition in Palo Alto? Like Los Altos, we should be targeting 91% prohibition seeking the maximum setback distances from homes and schools. The PF zones, the many city parking lots surrounding the two downtowns, University and California Avenues, are the best potential locations for Palo Alto’s response to the State’s housing initiative. There are several very significant reasons why this is an appropriate idea: The first and most important fact is the city’s ownership of the land. The most significant cost to a developer is the first one – the purchase of the land. If this cost is minimized, or if the city leases the land to the developer for some significant period these savings could be leveraged to reduce the rents to an affordable level to satisfy the state’s program requirements. In a mixed income development, this initial cost savings could be used to skew the rentals to allow a significantly larger percentage of affordable units. A second benefit would be the retention of the parking under this new housing. The Senate Bill (SB50) proposes a significant reduction in the parking requirement for such transportation rich areas, so the parking can remain as a public amenity to reinforce the viability of the retail commercial uses. The state has insisted on an abbreviated local review process. So a third benefit of city ownership is the opportunity to study the potential of these sites now, by exploring various planning and architectural options such as massing and density modeling; contextual issues; site development schemes including how to incorporate the parking; whether to provide ground floor retail uses; how to improve the quality and minimize the negative impact of the service areas at the rear of the retail; and how to landscape the residual spaces either at the ground level or on decks or rooftops, etc. While these would be early schematic exercises, they would establish a format for further development and prioritize the sites with the most obvious potentials. A fourth benefit would be that these sites would not displace any existing residential use. And a fifth benefit would be aesthetic. The least attractive areas around these two downtowns, especially at California Street, are these endless parking lots. This forward thinking initiative would give Palo Alto a leg up on the state’s mandate and allow a reasonable timeframe for the necessary input and coordination with the Council, City Planning, the review Boards and the City’s technical agencies. The task of organizing this effort is quite significant: it really requires a leader, someone to establish the milestones and deliverables who can properly analyze economic feasibility; who can determine if additional funding such as tax incentives or the use of the impact fees or other forms of subsidies are needed; and who can present these findings along with physical models to the Palo Alto community. This decision will likely require much discussion, which means it will not be coordinated with the Objective Standards Project as scheduled by City Planning to be completed by August 2020. While this is unfortunate, perhaps it will be an incentive for the Council to act expeditiously. I hope you will consider this. As you know we planned to implement the new bus service on the same day as BART service started in Santa Clara County... When the BART opening was delayed, we decided to proceed with the new transit service because of the necessary logistics and level of investment that we had in place. We did our best to relay this information and did so through many venues including:  Friday December 13th, an email was sent to Martha Elderon Gunn HS secretary, several Gunn HS parent distribution lists regarding schedule adjustments for Finals the week of December 16th-20th. The e-mail also informed the school that VTA will be implementing service changes on December 28th. Links to new lines 288, 288L & 288M schedules were provided to share with staff and students.  We reached out to Avenidas and the Oshman Family Jewish Community Center’s Older adult program. With the assistance of the Santa Clara County Senior Nutrition program, we reached out to the participants at the following nutrition programs: La Comida de California, Stevenson House, and Cubberley Community Center.  VTA Revenue services also sent VTA’s All New Service flyers along with the January passes Gunn High School purchased on December 13th, and we requested the school distribute them along with the passes. Palo Alto Unified School District were also given flyers to distribute with the January passes they purchased on December 17th. Please note that Gunn ordered December passes before we were able to include the “All New Service” flyers. A Weekly Ad in the Palo Alto Daily News announcing the start date began on November 22, 2019. The ad will run weekly until the end of the year.  Our planning department has been in communication with Joanna Chan from the City of Palo Alto throughout the implementation process in the interest of keeping them in the loop since the middle of November. The new service plan will continue as scheduled and I would like to provide as much information as needed for you. Attached are the links to the upcoming schedules for reference. The Daily Post emphasized that Councilwoman Lydia Kou was a principled voice in opposition to the tax. Over the last several elections, voters in Santa Clara County have passed multiple tax and fee increases including gas taxes, two bridge toll increases, three VTA sales taxes, Santa Clara County’s Measure A 1/8 cent sales tax, the state prop 30 ¼ cent sales tax and the 2010 Measure B Vehicle Registration Fee of $10. Additionally, we’re on the hook to pay back numerous state bond issues including high speed rail, the Proposition 1 water bond and the infrastructure bonds of 2006. All this nickel and diming has contributed into making the Bay Area a horribly expensive place to live; especially for people of modest means, who must pay the greatest percentage of their income in these regressive taxes and fees. Each increase by itself does not amount to much, say a quarter cent, but the cumulative effect is to add to the unaffordability of the region. Before increasing taxes YET AGAIN, waste needs to be removed from transportation projects. For example, we need to eliminate the redundant and wasteful section between the San Jose and Santa Clara Caltrain stations. The BART segment from these stations would duplicate both the existing Caltrain line and VTA's 22 and 522 buses to a station that has approximately 1000 riders each weekday. Why don’t the wealthy high rollers in the “Leadership Group” suggest taxing their rich companies and leave the little guy alone for a change? I request Councilwoman Kou reach out to her colleagues in neighboring cities to explain why this tax is a bad idea. I’m Jeanne Fleming, and I’d like to show you three photographs. The first is of the so-called “Painted Ladies,” the iconic row of Victorian houses in San Francisco. It seems unimaginable that a telecom company would want to install cell towers in front of this row of homes. But believe it or not, T-Mobile did. That’s how little respect these companies have for the aesthetics of their host cities. 2 The good news is that San Francisco stood up to T-Mobile. They went to court. And this spring, the California Supreme Court ruled in San Francisco’s favor. Moreover, in doing so, the court conclusively reaffirmed the right of local authorities to require that the siting and appearance of cell towers conform to municipal aesthetic standards. In other words, Palo Alto has the right to tell the telecom companies who wish to operate here where cell towers can go, and what they can look like. Why am I telling you this? To remind you that nothing residents are asking for is unlawful, unreasonable or even new. Here’s the second photo. That’s my house, and those boxes are located twenty feet and one inch from it. That’s how close to a home the proposed Resolution allows a telecom company to put a cell tower. How can that be right? What’s the point of allowing cell towers in residential areas only by exception, as this Resolution specifies, if, should an exception be granted, a tower can then be placed that close to a home? A setback of only twenty feet is an invitation to telecom companies to seek exceptions, then place their cell towers wherever they want. Here’s the last photo, of a home on Waverley currently on the market for $40 million. See that utility pole? The proposed Resolution prohibits installing a cell tower on a mid-lot pole like that. That’s fine. But how about protecting residents whose lots aren’t so enormous that a utility pole is sited in the middle of it, but who still would have a clear view of a proposed cell tower because, for example, their lot’s so small? To protect them—to protect all Palo Altans—we’re asking you to approve a provision that allows residents the right to prove, with a photograph, that were a proposed cell tower installed, they’d be looking right at it from inside their home. from Mr.Kamhi was simply a regurgitation of everything that’s on the website, information I already know inside and  out. He did not acknowledge the problem that I brought to his attention. This kind of bureaucratic backhanded BS just  adds insult to injury, a response that I expressly requested not to receive, as in I’d rather get no response.    Whether or not the “tone” of my email was off putting or not may or may not be true, but if it’s all the same with you, I  am not a city employee. I don’t represent the city and I don’t act on it’s behalf as Mr.Kamhi does. In that capacity, seems  to me the “tone” of his email, and in this I am refering to the last paragraph, is not appropriate and hopefully that will be  called to his attention. services, and Serco has served Palo Alto for the past five years. In our contract with Serco, we require  regular and timed enforcement from 8 AM to 6 PM, Monday through Friday for your RPP district. In our  standard operating procedures, vehicles not displaying an RPP permit are marked through a  2 combination of chalking or wheel positioning. Enforcement staff records vehicle information and verifies  the length of parking when they return in approximately two hours. Based on documentation and the  number of citations issued, processed, and paid, Serco has performed their duties as our enforcement  provider.      Palo Alto offers two types of permits for visitors or contractors parking within all of our parking districts.  RPP residents or employees with active accounts can order and print daily permits directly from their  account or by visiting City Hall. Daily permits available for residents are $5/day, while employees pay  $25/day. RPP daily permits are transferable and can be used by any member of the public, available  immediately if the customer has access to a printer. Customers can also purchase daily scratchers, which  can be ordered months in advance and used anytime within a program year.      The Planning and Development Services Department, located at 285 Hamilton Ave, Palo Alto, CA 94301,  also offers parking permits for construction ranging from $16 ‐ $734 depending on intended use or Also, the contractor was wrong. The parking enforcement contractor drives through our neighborhood a  couple times a year and issues tickets to every single vehicle without a permit no matter how long it has  or hasn’t been parked.  They never do a time check.     According to DeMattei staff, it is the responsibility of the subcontractors to get day permits for their  workers. The subcontractors are supposed to go to city hall in person with the liscense plate numbers as  well as make, model and year of vehicle of each car that the workers drive to get permits. If the work  takes more than ten days, the cost of permits is more than an entire years permit for a resident.     Contractors and subcontractors have about as much time to waste at city hall as the president of  Stanford or the CEO of Facebook does, probably less. Second, the nature of the work means you can’t  know weeks in advance the exact days and you don’t know the liscense plate number, make, model and  year of vehicle until the workers show up that day.     This arrangement is in the “let them eat cake” category of bureaucratic absurdity with the bottom of the  economic ladder workers having to take the crap whether they like it or not.     Mr. Heur ‐ please don’t bother to respond unless you are telling me you are working on a solution to this  or you have forwarded this email to the correct persons. If you respond with some kind of stupid
