AWARDING CONTRACT FOR THE CARTERET PARK POND RESTORATION
PRO.JECT
WHEREAS, the Borough of Carteret ("Borough") has previously authorized the preparation of
bid speoifications and contract documents and advertisement for receipt of bids for the Canerot
Pond Restoration Project; and
WHEREAS, the Borough received bids for said project on November 30, 2005; and
WHEREAS, V & K Construction, Edison, New Jersey submitted the lowest bid for the selected
items as evidence by the response on file with the Borough's Purchasing pcpartment and
Borough's Consulting Engineer for the Project as follows:

WHEREAS, the Borough's ConslJlting Engineer, T & M Associates, has reviewed the above
referenced bid propasat(s) and has reconunended an award of a contract for the the above
referenced bid items; and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are or win be
available for the award of a contract for said work.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the Carteret Park Pond Restoration
Project to V & K Construction. Edison, New Jersey, in th~ amount of $962,495.00
for the Base Bid with D-I, A-I and A-2.
2. That the appropriate Borough Officials are hereby authorized and directed to enter
into a contract with V & K Construction as provided for herein, in the amount of
$962,495.00, and in accordance in all respects with the request for proposals and bid
on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department and T & M Associates for distrjbution to V & K.

Bids for the referenced project were received on Wednesday, November 30, 2005, at the Borough Annex.
Attached is a summary of bids. Three bids were received and are summarized as follows:

The low bidder for all scenarios is V &K Construction of Edison, New Jersey. However, immediately after the
bid opening, V&K submitted a letter (copy enclosed) stating that they made an error in their bid and requesting
the Borough allow them to withdraw their bid.
We have contacted V&K to clarify whether their entire bid is being withdrawn or just their dredging related
items, They advised that only their dredging bid was in error. All required forms were submitted by V&K
Construction. Their bid proposal had defects in that unit price written amounts were not written in. Further,
their unit price for Deduct AI! 0-1-1 does not match Base Bid Item 1 as required. There does not appear to be
any errors in the extended amounts as totals. These items seem to be minor deviations and do not affect the
order of the bidders and could possibly be considered informalities. The bid proposal has been sent to the
Borough Attorney for review.
V &K Construction is currently performing work for the Borough for the Waterfront Park Phase II project. I
understand from John DuPont, the Borough's Director of Engineering, that V&K's work has been satisfactory.
The second low bidder for all scenarios is The Dawson Corporation ofClarksburg, New Jersey. All reqUiI'Cd"'itf-1y-æ;--
forms were submitted by Dawson. Their bid proposal had defects in that one unit price written amount was "

The Dawson Corporation is a contractor with similar public park construction experience. I understand they
are currently under contract to perform work in Joseph Medwick Park in West Carteret on a project which will
require dredging to create new wetlands as part of a wetlands mitigation project. T &M Associates has
provided contract administration and inspection services for numerdus park projects constructed by Dawson
and we have found their work to be satisfactory.
J understand the Borough is considering awarding the pond restoration contract without the dredging element
(Deduct Alternate 0-1) and that the Borough may have its own DPW Staff perform the dredging.
Based on favorable review by the Borough Attorney and satisfactory past performance, J recommend the
Mayor and Borough Council award a contract to V &K Construction of Edison, New Jersey. The final contract
amount will depend on the alternate bids the Borough determines to award (see above table for possible award
amounts). Award should also be subject to certification of funds by the Chief Financial Officer, review and
approval of the bid documents by Green Acres, and approval of the New Jersey Department of Labor, Division
of Wage & Hour Compliance,

V &K's base bid in the amount of $495,695 is approximately 40% of the engineer's estimate and 47% of the
second low bidder. Based on the tàct that their bid is signitìcantly below our estimate, the bid appears
unreasonable.
Excluding the bid from V&K, the low bidder is The Dawson Corporation of Clarksburg, New Jersey in the
amount of$I,034,955. All required forms were submitted by Dawson, Their bid proposal had defects in that

It is understood that the Borough has funding available and would like to award a contract for the Base Bid.
The total amount of the Dawson Base Bid is $1,034,955.
Based on favorable review by the Borough Attorney and satisfactory past performance, I recommend the
Mayor and Borough Council award a contract to The Oaw~on Corporation of C!arksburg. New Jersey ir; the
amount of $1 ,034,955. Award should also be subject to certification of funds by the Chief Financial Officer,
review and approval of the bid documents by Green Acres, and approval of the New Jersey Department of
Labor, Division of Wage & Hour Compliance.
