SUMMARY STATEMENT:
At the March 10, 2005 meeting, the Council considered a request from Ray Alford for an easement across
City property. The request was made so that affordable housing could be developed on a small parcel
located just south of Deinhard Lane, on the west side of Mission Street. The parcel was landlocked when
the City acquired the right-of-way for Deinhard Lane from Camp Pinewood. Mr. Alford acquired the parcel
from Camp Pinewood. The Council was generally agreeable to the request and asked for assurances that the
parcel would be developed into affordable housing. The property was never developed and Mr. Alford’s
development partner/prospective buyer who was going to build the affordable housing did not purchase the
property. A portion of the minutes from that meeting are attached, as well as the agenda bill.
At the September 8, 2005 meeting, the Council settled a condemnation case with the Lutheran Church,
completing the acquisition of another part of the right-of-way for Deinhard Lane. Part of that settlement was
the granting of an easement to the Lutheran Church. A portion of the minutes from that meeting are also
attached, as well as portions of the agenda bill.
Mr. Alford has renewed his request for an easement across City property. He proposes to develop the site
for housing, and ensure that 20% of it will be affordable, as required by City Code.
RECOMMENDED ACTION:
Authorize staff to negotiate an easement with Mr. Alford, on the condition that at least 40% of the housing
units created are deed-restricted community housing units, available for either rental or purchase.
