RESOLUTION NO. 95 -3398
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY ESTABLISHING A PENALTY ASSESSMENT SCHEDULE FOR
ANIMAL CONTROL CODE VIOLATIONS
WHEREAS, the Temple City Municipal Code authorizes City officials to issue citations for animal
control code violations; and
WHEREAS, Section 3604 of the Municipal Code provides that any violation of the City's animal
control ordinances shall constitute an infraction, punishable by a fme not to exceed that allowable by
California State law, as set forth by City Council resolution; and
WHEREAS, Section 3604 of the Municipal Code provides that any person violating any animal
control ordinance shall be guilty of a separate offense for each day during any portion of which any
violation of said ordinance is committed, continued, or permitted by any such person; and
WHEREAS, Section 36900 of the California Government Code provides that the first and second
violations of any provision of the City's animal control ordinances may be enforced as "infractions" and any
subsequent violations shall be deemed and enforced as "misdemeanors."
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. Any violation of the City's animal control ordinances prosecuted as an infraction
shall be punishable as follows:
1. A fme not to exceed $25 for the first violation;
2. A fine not to exceed $50 for the second violation of the same code section within one year;
3. A fme not to exceed $75 for the third violation of the same code section within one year.
- SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution.
