COUNCIL. MINUTES
AUGUST 7, 1973
INITIATION:
1. Mayor Tyrell called the regular meeting of the City Council
to order at 7:35 p.m. on Tuesday, August 7, 1973, in the
Council Chamber of the City Hall.
2. The invocation was given by Reverend R. E. Schulz, Pastor,
First Lutheran Church, 9123 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.

Councilman Merritt moved to excuse Councilman Briggs for cause,
seconded by Councilman Gilbertson and carried.
5. APPROVAL OF MINUTES:
Councilman Gilbertson moved to approve the minutes of the regular
meeting of the City Council held on Tuesday, July 17, 1973, as
written, seconded by Councilman Dennis and carried.
Councilman Gilbertson moved to approve the minutes of the special
meeting of the City Council held on Monday, July 30, 1973, as
written, seconded by Councilman Merritt and carried.
Boy Scout Troop No. 157 was given recognition by Mayor Tyrell and
presented a. special certificate to the group. Troop No. 157, sponsored
by Cloverly School PTA, has 18 members, has had a total of 11 Eagle
Scouts. Caesar Milch, Sr. Patrol Leader, gave a history of the troop
and their activities, and introduced other officers of the troop and
members present, as well as their Scoutmaster, Keith Ritterhouse,
City Council acknowledged the presence of Thomas Breazeal, appointed
to the Planning Commission, and Elloise Konrad, appointed to the Parking
Commission, each appointment effective August 1, 1973 for a term of one
year, following which the Oath of Office was administered.
UNFINISHED BUSINESS:
6. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of August 1, 1973
TRAFFIC ENGINEERING SURVEY RE: SECTION 40802, VEHICLE CODE
(Speed Limits ) - ADDITIONAL STREETS
City Manager Koski presented background information, advising
the Traffic Commission had confirmed all speed limits previously
established at the Council meeting held July 30,, 1973 and had
made further recommendations at their meeting held August 1, 1973.
Traffic Engineer Envall presented precise information in
establishing recommended speed limits on various streets not
included in Council approval at their meeting of July 30, 1973,
which new recommendations are contained in memos dated August 2
and August 7, 1973 and on file in the City Clerk's office.

City Council again disagreed with the current statutes applicable
to establishing speed limit regulations, feeling they are totally
arbitrary and without justification.
Councilman Gilbertson moved to approve, seconded by Councilman
Dennis and carried.
NEW BUSINESS:
7. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION - Meeting
of July 18, 1973
A. JOINT USE OF TEMPLE CITY HIGH SCHOOL TENNIS COURTS
City Manager Koski presented background information, advising
that the Parks & Recreation Commission, at their meeting held
July 18, moved to recommend to the City Council that the City
explore with the Temple City Unified School District, ways to
make necessary improvements to the High school tennis courts
to allow them to be used more for public play.
Councilman Merritt stated he had originally asked for information
regarding the use of the high school courts and felt every effort
should be made to bring them up to a useable standard, including
lights for night use.
Mayor Tyrell felt that the proposal to upgrade the high school
courts would result in a maintenance program of refinishing
courts which will always be substandard, and he felt any money
spent should be for additional courts at Live Oak Park to create
a tennis center.
Councilman Gilbertson felt that additional tennis courts need not
be of a professional standard and that it was important to have
courts available for all levels of tennis participation.
Councilman Dennis felt the City should investigate the possibility
of doing without lights and maintaining the courts on a weekend
and summer time basis. He inquired if the courts are in a
suitable condition at the present time for public use.
Parks and Recreation Director Kobett advised that the courts are
presently used for multi-purpose--tennis, basketball and volley
ball. The Commission would like to explore the upgrading of the
courts, which would include relocating basketball and volley ball.
The courts are presently used for high school tennis and varsity
games after school, and general public use on weekends and during
the summer.
Mr. C. J. Asmus, 4950 Camellia Avenue, spoke to the matter, stating
there are not_ enough courts available for the number of residents
who wish to play and felt that funds available should not be
limited to professional courts.
Councilman Gilbertson moved to refer the matter back to the Parks
and Recreation Commission to explore further the possibility of
utilizing the courts at the high school, either in their present
condition or present to City Council specific recommendations as to
how they may be made more available for public use and recreational
instruction thereby relieving the tennis courts at Live Oak Park for
residents wishing to play. Motion was seconded by Councilman
Merritt and carried.

B. OUTDOOR CONCERT - TEMPLE CITY PARK, AUGUST 21, 1973
City Manager Koski advised that the Parks & Recreation Commission,
at their meeting held July 18, 1973, considered request received
from the Church of the Nazarene to conduct a Jesus Concert at
Temple City Park on Tuesday, August 21, 1973 and recommended its
approval by City Council, subject to City's established procedures
and conditions for park use.
Councilman Merritt moved to approve the request by Church of the
Nazarene to conduct a Jesus Concert at Temple City Park on Tuesday,
August 21, 1973 between the hours of 6:30 p.m. and 8:00 p.m.,
subject to conditions of park use, seconded by Councilman Gilbertson
and carried.
City Attorney Martin directed City Council's attention to the fact
that the concert cannot involve any religious worship activities.
Staff was directed to so advise the Church of the Nazarene and
assist in the coordination of the activity.
C. DONATION FROM TEMPLE CITY GIRL SCOUT DAY CAMP
City Manager Koski advised that the Temple City Sunset Girl Scout
Day Camp had offered the donation of a Liquid Amber tree to the
City, that the Parks and Recreation Commission recommended approval.
Councilman Gilbertson moved to accept, with thanks, the donation
of a Liquid Amber tree to the City by the Temple City Sunset Girl
Scout Day Camp, seconded by Councilman Merritt and carried.
D. RE- COSPONSORSHIP OF TEMPLE CITY YOUTH FOOTBALL, INC. FOR 1973
City Manager Koski advised that the Temple City Youth Football, Inc.
was originally cosponsored by the City in 1965, and that yearly
requests for renewal had been granted by the City for this self -
sustaining group, and that the Parks & Recreation Commission again
recommended renewal of re- cosponsorship. Councilman Dennis moved
to approve as recommended, seconded by Councilman Merritt and carried.
8. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of July 10, 1973
PROPERTY NUISANCE CASE #14 - 9044 OLIVE STREET
City Manager Koski presented background information, advising that
the Planning Commission, at their meeting held July 10, 1973,
passed Resolution No. 73 -508PC determining the existence of a
public nuisance on subject property and recommended abatement
thereof. The owner of subject property was contacted originally
in June of 1972 and little effort has been made to remedy the
condition.
Councilman Gilbertson moved to concur with the Planning Commission
and adopt Resolution No. 73-1300 A RESOLUTION OF THE CITY OF
TEMPLE CITY DECLARING CERTAIN PREMISES A PUBLIC NUISANCE AND
ORDERING ABATEMENT THEREOF WITHIN 10 DAYS, seconded by Councilman
Merritt and carried.
9. RESOLUTION NO. 73 -1297 - WARRANTS & DEMANDS, Demand Nos. 8306
through 8438 in the amount of $94,258.20.
City Manager Koski presented Resolution No. 73-1297 entitled A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $94,258.,20, DEMAND
NOS. 8306 THROUGH 8438. Councilman Merritt moved to approve,
seconded by Councilman Gilbertson and carried.

10. RESOLUTION NO. 73 -1298 - EMPLOYMENT OF PERSONNEL
City Manager Koski presented Resolution No. 73 -1298 entitled A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING PERSONNEL. Councilman Gilbertson moved to adopt,
seconded by Councilman Dennis and carried.
11. COMMUNICATIONS:
A. Temple City Lionettes - Request to conduct eye clinic,
Saturday, October 6, 1973.
Councilman Gilbertson moved to approve the request of Temple
City Lionettes to conduct an eye clinic on Las Tunas Drive
between Golden West and Kauffman Avenues,. on Saturday,
October 6, 1973, subject to required insurance, seconded by
Mayor Tyrell and carried.
B. Supervisor Peter Schabarum - Environmental Protection Agency,
Los Angeles Plan
City Manager Koski presented a letter from Supervisor Schabarum
concerning a transportation control plan as proposed by the
Environmental Protection Agency. A task force consisting of
Los Angeles County, Los Angeles City, California Department
of Transportation - District 7, California Highway Patrol -Zone 5,
Southern California Rapid Transit District, Southern California
Association of Governments and League of California Cities has
evaluated the EPA Los Angeles Plan and concluded that it would
have a drastic effect on the economy and overall welfare of
the Metropolitan Los Angeles Air Quality Control Region, and
has developed an alternate transportation plan to be submitted
at an August 9,1973 scheduled public hearing of the EPA.
Councilman Gilbertson moved to write a letter to the Board of
Supervisors supporting the alternate plan of the task force,
seconded by Council Dennis and carried.
C. City Council received and filed a letter from Margie Calamia,
General Chairman of the 1974 Camellia Festival and directed staff
to write a letter giving support to the Camellia Festival Committee.
12. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Mrs. Penny Graham, President, Temple City Chamber of Commerce,
advised the Council of dates of Chamber functions; 1) General
Membership Luncheon, Wednesday, August 8, noon, Santa Anita Bowl;
2) September 6, 1973 - Dodger Night, with August 28 deadline for
reservations; and 3) September 9 -Golf Tournament at Montebello
Community Golf Course. Mrs. Graham invited Council participation
in all activities.
13. MATTERS FROM CITY OFFICIALS:
A. City Manager Koski presented literature from the Southern
California Automobile Club concerning their opposition to AB 422
which would permit trailer coaches up to 14 feet in width to travel
California roads. Councilman Gilbertson moved to support the
Automobile Club's position, seconded by Councilman Merritt and
carried. Staff was instructed to write to the City's representatives
in Sacramento opposing the proposed legislation.

B. RESOLUTION NO. 73 -1299: Re: Request for Allocation of
County Aid -to- Cities Funds for Maintenance of Select System Streets.
City Manager Koski advised that the County of Los Angeles has
appropriated funds for maintenance of the City's approved select
system streets in the amount of $45,833. Councilman Gilbertson
moved to adopt Resolution No. 73 °1299 entitled A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING AN
ALLOCATION AND PAYMENT OF COUNTY AID -TO- CITIES FUNDS FOR THE
MAINTENANCE OF SELECT SYSTEM STREETS. The motion was seconded
by Councilman Dennis and carried.
C. City Manager Koski advised that the Heritage Inn has changed
ownership and the new owners have applied for an Entertainment
Permit. Councilman Gilbertson moved to set public hearing to
consider the application to August 28, 1973, seconded by
Mayor Tyrell and carried.
D. City Manager Koski advised that the July Newsletter had
been delivered to more than 13,000 residents by 6 Boy Scout
Troops, which furthered City relations with the Boy Scout Troops
and afforded them monetary assistance, as well as a sound
community service project. Councilman Gilbertson moved to
authorize payment in the amount of $250, seconded by Councilman
Merritt and carried.
E. Mayor Tyrell advised that he'd received a letter of
resignation from William Cole, Traffic Commissioner, for the
purpose of taking a sabbatical leave to attend Texas A & M
University. Councilman Gilbertson moved to accept Commissioner
Cole's resignation, with regret, seconded by Councilman Dennis
and carried.
F. Councilman Gilbertson addressed himself to a new organization,
California Mayors and Councilmen, being formed by those dedicated
to the principle of local government and home rule.
14. ADJOURNMENT:
On motion of Councilman Gilbertson, seconded by Councilman Merritt,
the Council adjourned to a study session at 9:00 p.m., to discuss
the Community Seminar to be held October 13, 1973, following which
they adjourned to the next regular meeting to be held Tuesday,
August 28, 1973, 7:30 p.m. in the Council Chamber of the City Hall.
