RESOLUTION NO. 95 -3403
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY DENYING ZONE VARIANCE 94 -1220 TO ALLOW A TWO -CAR
GARAGE RATHER THAN A THREE -CAR GARAGE WHICH IS
REQUIRED BECAUSE OF INTERIOR MODIFICATIONS TO AN
EXISTING DWELLING, RESULTING IN TWO ADDITIONAL
BEDROOMS FOR A TOTAL OF SIX BEDROOMS IN THE SINGLE
FAMILY (R -1) ZONE AT 5342 EL MONTE AVENUE (LIN)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon testimony received at a noticed public hearing before the City Council
and upon facts contained in the Planning Commission Minutes and staff report dated February 14, 1995,
the City Council sustains the Planning Commission's denial and finds:
1. That there are not exceptional and extraordinary circumstances or conditions applicable
to the property which do not generally apply to other properties in the same zone in that
the lot is a total of 9,297 square feet in size and contains ample room in the front of the
property for the consturction of an additional garage space; and
2. That such a variance is not necessary for the preservation and enjoyment of a substantial
property right possessed by other property similarly situated but which is denied the
property in question in that the lot contains enough space for a single car garage at the
front of the lot; and
3. That the granting of the variance will be materially detrimental to the public welfare or
injurious to adjacent or neighboring properties in that the addition of bedrooms will create
a need for additional garage parking spaces; additionally, interior modifications were
performed without approvals from the Building and Planning Departments which could
be injurious to the public welfare; and
4. That there are no special circumstances as provided in Section 65906 of the California
Government Code in that the lot is adequate in size to accommodate an additional garage
space.
SECTION 2. Accordingly, Zone Variance 94 -1220 is denied and the interior improvements which
were performed without the obtaining of permits shall be removed.
SECTION 3. The City Clerk shall certify to passage and adoption of this resolution and enter
it into the book of original resolutions.

Council of the City of Temple City at a regular meeting held on 21st day of March, 1995 by the following
vote:
