SUMMARY STATEMENT:
The proposed code amendment would change the way the side yard setback is calculated within the City and Impact
Area of McCall. The current determination of side yard setbacks uses a graph and a percentage of frontage for the
calculation. The amendment would change Note #3 of Table 3.3.03 to read, “no Building Element shall be closer to
a side property line than one-half (1/2) the Building Element Height (see Definitions, Chapter 2); use the greater of
this measurement or that determined from § 3.3.04 and Figure 3.3.04.”
The proposed code amendment proposes to calculate the side yard setback as using the greater of the two
measurements. This would address issues with large building faces located very close to the property line, because
the current setback is based on lot width and does not incorporate building scale in to the calculation. It will also
ensure houses are not build across the large percentages width of the lot.
On July 10 and August 7, 2007, the McCall Planning and Zoning Commission held a regularly scheduled and noticed
public hearing to consider this proposed text amendment. After considering all testimony, the Commission
recommended its approval to the McCall City Council.
