HomeMy Public PortalAboutAB 07-207 JUDICIAL CONFIRMATINON McCALL CITY COUNCIL 216 East Park Street AGENDA BILL McCall, ID 83638 Number AB 07-207 Meeting Date November 8, 2007 AGENDA ITEM INFORMATION Approvals: Department/ Initials Remarks SUBJECT: Committee/Individual (Originator/ Support) PUBLIC HEARING only: Mayor / Council Take Public Comment on whether or not to City Manager seek Judicial Confirmation to pay the Community Development outstanding balance of the Wausau judgment Treasurer FQ Originator Acting Clerk per the three part plan adopted by Council Police Department resolution 07-09 Public Works Golf Operations Parks & Recreation Airport COST IMPACT: Approximately $6.5M, Revenue Bond Library FUNDING SOURCE: Sewer Fees, Rate City Attorney Increase Grant Coordinator TIMELINE: Upon Judicial Confirmation Other: ( ) SUMMARY STATEMENT: Notice was published on October 18, that the City of McCall will conduct a public hearing today to determine whether to proceed with the issuance of a Warrant pursuant to Idaho Code Sections 50-1018, 31-2124 and 31- 2125 and Refunding Sewer Revenue Bond(s) pursuant to Idaho Code Sections 50-302, 50-237 and 57-501., respectively, for the purpose of the anticipated payment of Judgment(s) in favor of Employers of Wausau and St. Clair Contractors and whether to consider adoption of a Resolution for the filing of a petition pursuant to the Idaho Judicial Confirmation Law, Idaho Code, Section 7-1301 et seq., requesting a judicial confirmation of the power and the authority of the City under the Constitution and laws of Idaho to approve the issuance of a Warrant(s) pursuant to Idaho Code Sections 50-1018, 31-2124 and 31-2125 and Refunding Sewer Revenue Bond(s) pursuant to Idaho Code Sections 50-302, 50-237 and 57-501, respectively and to enter into the related documents in order to provide for the anticipated payment of said Judgments. The Resolution for the filing of a petition, cited above, is NOT appended to this Agenda Bill. That resolution will be finalized and submitted on the November 26 agenda. The Council will make a decision on the Resolution authorizing the filing of the petition for judicial confirmation at a special meeting on November 26. Note attachments: (1) Resolution for Warrant, (2) Warrant Refunding Trust Indenture. (These two documents are drafts only, and will be revised before they are finalized.) (3) Resolution 07-09.
