Box 2749 Tybee Island, Ga 31328 Attn: Dianne Otto RE: Paddison Critz House Corner of Taylor and Pulaski Streets Tybee Island, Georgia Dear Ms. Otto: EMC Engineering Services was asked by Greenline Architects to provide a certification letter and Asbuilt Record Drawing stating that the house and yard drainage were constructed according to the approved plan. On May 6, 2009, we inspected the project with the contractor and Pete Callejas, Greenline Architects, and discussed the concerns that Mr. Downer Davis had with the completed project. These concerns were as follows: 1. The construction of an additional driveway onto Taylor Street that was obstructing drainage in the roadside swale. 2. The construction of a retaining wall that was not proposed on the original site plan. 3. Obtaining permission from the property owner to the north to allow a portion of the swale to be constructed on the adjacent piece of property and for the the drainage swale to accept runoff from the referenced property. As of May 13, 2009, EMC Engineering Services performed a followup site visit and can certify the following: 1. The driveway onto Taylor Street has been removed and the drainage swale along Taylor has been reestablished and the flow of water is no longer obstructed. 2. The retaining has been analyzed and compared with the manufacturer's recommendation for construction. EMC certifies that the wall is structurally sound and was built in accordance with the manufacturer's recommendation. 3. During the certification process it was determined that the swale was not an issue and was serving both properties satisfactorily. Certify means to state or declare a professional opinion of conditions whose true properties cannot be known at the time such certification was made, despite appropriate professional evaluation. A design professional's certification of conditions in no way relieves any other party from meeting requirements imposed by contract or other means, including commonly accepted industry practices. This is acceptable in planting beds where landscaping is closely placed and around individual plant. As I have stated in the past, the Green Book allows mulch only as temporary cover. Vegetation with established roots is required for permanent ground stabilization. As the adjacent property on Pulaski to the north has a suitable stand of grass I believe this is achievable on this lot. 1 f' The mulch is not stable and is washing down the ROW's. The sediment protection around the inlet appears to be holding back the mulch from entering Tybee's storm system. This view is looking north up the east side of Pulaski. II This view is looking northeast from the north side of Taylor i rt. The approved plans did not show the headwall along the NW side of the lot and the swale was not part of the approved plans. The developed site reverses the previous flow of the sheet drainage towards the adjacent lot. I request, at a minimum, the bulkhead be shown on an asbuilt. Additionally, either a drainage asbuilt or a revised permit reflecting the design change is required. If the swale is even partially on the adjacent property, permission of the adjacent property is needed. I 2 R ti A v: Another closeup of the mulch flowing towards the drainage inlet. It was previously established that Joe Wilson Director DPW will not accept mulch in his roadside shoulders or swales. Additionally, mulch is not acceptable as general ground cover and is even more unsuitable for lining the onsite swales such as on the southeast side of the property. There is not information in this review that has not been previously communicated with the Property Owners or their project representatives. This projet has had more sediment control issues than any other lot or project on Tybee that I am aware of. The one positive thing is I find the developed drainage flow acceptable subject to the previously stated deficiencies being corrected. I will gladly accompany a Tybee employee for a site meeting if necessary as Joe and my past efforts at communicating the above have not been successful. Should this BMP fail due to it proximity to the pavement,filter rolls such as used at curb inlets will be allowed. 2)The entire silt fence is in need of maintenance. I will be by to check this by Friday. 3) Dust control must be provided. All unpaved areas are bare and unstable. During periods of high winds such as today, moisture must be added to control the migration of your surface to surrounding properties and R.O.W.s. 4)The City has documentation of the previous established grass cover in the R.O.W.s adjacent to your site. The previous grass cover was comparable to that on the other 3 corners of this intersection. Since your project commenced, a water line was installed down the other side of Taylor Street. As that disturbed area has been restabilized,there is no justification for the road shoulders along your site to remain bare. 5)The Co-Construction Entrance will be repaired no later than Friday,04-17-09, if the driveway is not completed and ready for use by the workers. You advised that the driveway should be completed by the end of next week and the landscaping would be completed withing the following two weeks.The landscaping should include the reestablishment of the road shoulders. The project must comply, as applicable, for areas permitted herein, with all other Federal, State, and local statutes, ordinances, and regulations, and the applicant must obtain all licenses and permits prior to commencement of construction. 2. This permit does not resolve actual or potential disputes regarding ownership of or rights in or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 3. No further encroachment or construction shall take place within State jurisdiction, except as permitted by the Shore Protection Committee. Any modification of the plans or structure in the jurisdictional area must be reviewed and approved by the Department prior to construction. 5. A construction placard will be required to be obtained from the Department up to 30 days prior to the start of project construction and must be posted at the site. This placard will include certain steps in the construction of the permitted project that must be approved by the Department prior to construction. 6. The exact location and configuration of this project must be reviewed onsite and approved by Department staff immediately prior to beginning construction. Minor changes to the location may be allowed or required in areas that have eroded or accreted subsequent to the original jurisdictional determination. 7. No construction materials may be disposed of in the jurisdictional area of the Shore Protection Act. 8. Any incidental impacts associated with the construction of this project must be rectified by restoring areas to their pre-construction topographic and vegetative states. 9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair,become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. The permit must be posted onsite within twenty-four(24) hours of beginning construction. 13. A copy of the above conditions must be supplied to the person in charge of construction. SHORE PROTECTION ACT O.C.G.A. § 12-5-230 STANDARD PERMIT CONDITIONS FOR DUNE CROSSWALKS Only one crosswalk structure shall be allowed on a parcel. In considering the design and routing of a crosswalk, the shortest route over the lowest area of the dunes shall be plotted to minimize impacts to the sand sharing system. For new construction, no decks or viewing platforms will be approved in the jurisdictional area. Previously permitted and grandfathered structures may be maintained provided they are serviceable. Additionally, the applicant requesting the structure must own 100% of the private lands through which the structure crosses or have the express written permission of the owner. The following standard conditions shall apply to dune crosswalks: Paddison/Critz SPA#354 Final Permit Conditions January 23, 2006 1. The height of the structure shall be at least 36" above the grade of the sand dune and the width shall be no greater than 6' as measured from the outside posts, to allow for sand movement or accretion in the dynamic dune field. 2. The structure shall begin at the toe of the landward most dune. 3. Heavy equipment is prohibited in the Shore Protection Act jurisdiction. This project must be constructed using hand tools. 4. Clearing and grading of dunes is not authorized in conjunction with the construction of this project; stockpiling of materials in the dunes is prohibited. 5. Vegetation may be cleared only for the width of the permitted structure. The maintenance trimming of jurisdictional vegetation will only be allowed within 6" of the sides of the structure and 7' high over the structure. 6. No motorized vehicles are permitted on the crosswalk structure, except for motorized wheelchairs for handicapped persons. 7. Any sand needed to restore the site to pre-project vegetated and topographic conditions, or for backfilling, must be beach quality and obtained from an upland source and not from the beach. SPECIAL CONDITIONS:, 1. All proposed driveways must be constructed of pervious materials. 2. Any fill associated with the construction will not exceed the 10 feet (NGVD 1929) elevation. 3. After construction the applicant must landscape disturbed areas with native vegetation. The landscape plans must be approved by the Department prior to installation. 4. Approximately 62% of the state's jurisdictional area will be maintained in its natural vegetated and topographic condition. 5. The length and exact landing of the crosswalk on the seaward side of the dune will be determined by Department of Natural Resources staff immediately prior to construction. 6. During construction no materials or equipment can be stored in the dune area; silt fence must be placed to clearly delineate the dune area where no impacts are permitted. 7. The native vegetation within the dune system must remain in its natural condition to maintain habitat and function. No landscaping is permitted in the dune areas. Alteration other than permitted specifically herein is prohibited. 8. Should the dunes shift landward, which is considered a natural function of the sand sharing system, no efforts can be mad by applicant to alter the sand sharing system. No retaining walls may be constructed within the dynamic dune field. 9. To protect marine turtle hatchlings, placement and use of exterior lighting must be consistent with the Department of Natural Resources' Wildlife Resources Divisions sea turtle nesting guidelines as well as the lighting ordinance of the City of Tybee. 10. Landscaped trees will not change the Shore Protection Area jurisdiction and must be noted as landscaped on the post construction survey.
