Mayor Tyrell called the regular adjourned meeting of the City Council to order at 7:45 p.m. on Tuesday, August 28, 1973, in the Council Chamber of the City Hall. 2. The invocation was given by Mr. Merrill Byington, Elder, Reorganized Church of Latter Day Saints, 9458 E. Broadway. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Councilmen - Dennis, Gilbertson, Merritt, Tyrell Absent: Councilmen - Briggs Also Present: City Manager Koski, Assistant City Attorney White, Assistant to the City Manager Biel, Planning Director Dragicevich, Parks & Recreation Director Kobett. 5. APPROVAL OF MINUTES: Councilman Gilbertson moved to approve the minutes of the regular meeting of the City Council held on Tuesday, August 7, 1973, as written, seconded by Councilman Dennis and carried. The Y's Men's Club of Temple City was given recognition by Mayor Tyrell and presented a special certificate to the group. Mr. Ray Hatch, incoming Treasurer and past President, gave a history of the group and their activities, and introduced other officers. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. REQUEST FOR ENTERTAINMENT PERMIT - HERITAGE INN, 8905 LAS TUNAS DRIVE City Manager Koski advised the City received an application for an entertainment permit from Maer, Inc., new owners of the Heritage Inn, to include Piano Bar and singing, between the hours of 9:00 p.m. and 2:00 a.m., 6 nights per week, Monday through Saturday; that no protests had been received by the City Clerk. Mayor Tyrell declared the Public Hearing open and invited those present who wished to speak for or against the request to come forward. There being no one in the audience come forward to speak, Councilman Gilbertson moved to close the Public Hearing, seconded by Councilman Merritt and carried. Councilman Gilbertson moved to approve request for entertainment permit for a Piano Bar and singing from Heritage Inn, 8905 Las Tunas Drive, seconded by Councilman Dennis and carried. 7. FINAL MAP - SUBDIVISION TRACT NO. 29610, 6047 N. CAMELLIA AVENUE AND VACANT PARCEL SOUTHERLY OF 6047 N. CAMELLIA AVENUE 1 City Manager Koski gave background information, advising that the Tentative Tract Map No. 29610 was approved by the City Council on July 3, 1973, subject to conditions as outlined in Resolution No. 73- 503PC, that the proposed subdivision would consist of a 14 -unit condominium project to be located on the west side of Camellia Avenue, north of Woodruff Avenue, that a subdivision bond and bonds for faithful performance and labor and material are on file in the City Clerk's office. Council Minutes, August 28, 1973 - Page 2 City Council confirmed the fact that a negative Environmental Impact Report had been accomplished at the time the Tentative Tract Map was approved as required by state law. Councilman Merritt moved to approve Final Tract Map No. 29610 subject to all recommendations of staff report dated August 22, 1973 and on file in the City Clerk's office, and find that the subdivider had, in good faith, attempted to secure the signatures of Security Pacific National Bank, easement holder, and had been unable to do so, and that development will not unreasonably interfere with the free and complete exercise of easements held by Pacific Telephone and Southern California Edison, and accept the map without the signatures of said easement holder. Councilman Dennis seconded the motion and carried on voice vote. NEW BUSINESS: 8. RESOLUTION NO. 73 -1301: Setting Zero .Tax Rate for City of Temple City for Fiscal Year 1973 -74. City Manager Koski presented Resolution No. 73 -1301 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY INDICATING NO CITY TAX RATE FOR THE FISCAL YEAR 1973 -74. Councilman Merritt moved to• adopt, .seconded by Mayor Tyrell and carried. 9. RESOLUTION NO. 73 -1302: Levying .a Special Assessment Tax Within the Temple City Municipal Lighting District for Fiscal Year 1973 -74. City Manager Koski presented Resolution No. 73 -1302 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY LEVYING A SPECIAL ASSESSMENT TAX WITHIN THE TEMPLE CITY MUNICIPAL LIGHTING DISTRICT FOR THE FISCAL YEAR 1973 -74. Councilman Dennis moved to adopt, seconded by Councilman Gilbertson and carried. 10. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of August 14,1973 A. AMEND TEMPLE CITY MUNICIPAL CODE RELATING TO ZONE CLASSIFI- CATION FOR AUTOMOTIVE STEAM CLEANING City Manager Koski advised that the Planning Commission, at their regular meeting held August 14, 1973, passed Resolution No. 73 -517PC recommending to the City Councilman amendment to the Municipal Code relating to Zone classification for automotive steam cleaning operations conducted within an enclosed building, as a permitted use in the M -1 Zone. Councilman Gilbertson moved to set Public Hearing September 18,1973 to consider an amendment to the Municipal Code relating to zone classification for automotive steam cleaning operations conducted within an enclosed building, as a permitted use in the M -1 Zone, seconded by Councilman Dennis and carried. B. AMEND ORDINANCE TO INCLUDE LIVING QUARTERS AS AUXILIARY USE TO MORTUARIES WITH CONDITIONAL USE PERMIT APPROVAL City Manager Koski advised that the Planning Commission, at their regular meeting held August 14, 1973, passed Resolution No. 73 -318PC recommending to the City Council an amendment to the Municipal Code to include living quarters as auxiliary use to mortuaries with a conditional use permit. Council Minutes, August 28, 1973 - Page 3 Councilman Gilbertson moved to set Public Hearing September 18, 1973 to consider an amendment to the Zoning Ordinance relating to living quarters as auxiliary use to mortuaries with conditional use permit, seconded by Councilman Dennis and carried. 11. REQUEST FOR REFUND OF FEE - CONDITIONAL USE PERMIT 73 -399 City Manager Koski presented background material, advising that the purchaser of property at 6539 Rosemead Boulevard made application for a conditional use permit for a drive -in dairy; had subsequently withdrawn his application; that no staff time had been involved other than accepting his application. Councilman Merritt moved to approve the refund of $100 to Mr. Hak H. Kim, applicant, seconded by Councilman Gilbertson and carried. 12. RECOMMENDATIONS FROM PARKS AND RECREATION COMMISSION - Meeting of August 15, 1973 A. MASTER PLAN FOR LIVE OAK .PARK City Manager Koski presented background material, advising that City Council had authorized $1,250 to retain the services of a professional park planner to assist in the preparation of a Master Plan for Live Oak Park. The Parks and Recreation Commission held a public hearing July 18, 1973, and at their meeting held August 15, 1973 reviewed the final plans and approved the development plan for Live Oak Park as submitted by Recreation Systems, Inc. Mr. Philip Andrews, Parks and Recreation Commissioner, speaking as President of the Temple City American Little League, pledged their support to the plan as recommended by the Parks and Recreation Commission. Mr. Bud Adams, Chairman, Parks and Recreation Commission, stated the Commission was pleased with the final results and would like to see the plan implemented by phases. Councilmen Gilbertson and Dennis expressed a willingness to accept the master plan; Mayor Tyrell felt there were some areas yet to be discussed, specifically, the shifting of sports fields to the east and the nature walk, which, although aesthetically interesting, could create a-police and maintenance problem. Following brief discussion, Councilman Gilbertson moved to receive the proposed master plan for Live Oak Park as recommended by the Parks and Recreation Commission and hold for final adoption pending study session with the Parks and Recreation Commission to discuss the final details and determine means of financing the proposed improvements prior to final acceptance, seconded by Councilman Merritt and carried. City Council scheduled the joint meeting of the City Council - Parks and Recreation Commission for Wednesday, September 12, 1973, 7:30 p.m. B. RE- COSPONSORSHIP OF TEMPLE CITY UNITED SOCCER CLUB City Manager Koski advised that the Temple City United Soccer Club was originally cosponsored by the City in 1962, and that yearly requests for renewal had been granted by the City for this self - sustaining group, and that the Parks and Recreation Commission again recommended renewal of re- cosponsorship. TEMPLE CITY FAMILY YOUNG MEN'S CHRISTIAN ASSOCIATION - Request to conduct Rally at Temple City Park, September 29, 1973 City Manager Koski advised that the Parks and Recreation Commission, at their regular meeting held August 15, 1973, received request from the Temple City Family Young Men's Christian Association for use of Temple City Park for the purpose of conducting a Rally on Saturday, September 29, 1973, from 11:00 a.m. to 7:00 p.m. and recommended City Council approve. Following brief discussion and confirmation from Parks and Recreation Director Kobett that the easterly portion of the park would be available for the general public, and that the general public is invited to this particular activity, Councilman Gilbertson moved to approve the request subject to all conditions as set forth in memo dated August 21, 1973 on file in the City Clerk's office, seconded by Councilman Merritt and carried. 13. RESOLUTION NO. 73 -1303: WARRANTS AND DEMANDS, Demand Nos. 8439 through 8525 in the amount of $110,818.37. City Manager Koski presented Resolution No. 73 -1303 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $110,818.37, DEMAND NOS. 8439 THROUGH 8525. Councilman Gilbertson moved to adopt, seconded by Councilman Merritt and. carried. 14. COMMUNICATIONS: A. REQUESTS FOR PROCLAMATIONS City Manager Koski presented letters requesting proclamations. Following brief discussion, Council supported the Mayor pro- claiming the week of September 23, 1973 as TEMPLE CITY FAMILY YMCA WEEK, and September, 1973 as WEIGHT WATCHERS MONTH IN TEMPLE CITY. B. LION'S CLUB - Request to place banner - October 8 -15, 1973 - Las Tunas Drive and Temple City Boulevard, White Cane Days City Manager Koski presented a request from the Lion's Club to place a banner across Las Tunas Drive and Temple City Blvd. October 8 -15, 1973. Councilman Merritt moved to approve the request, subject to the necessary insurance, seconded by Councilman Dennis and carried. C. LIABILITY CLAIM - Martha Callaghan City Manager Koski presented a claim for physical injuries and related mental anguish suffered by her son resulting from an alleged accident which occurred at Rosemead High School Auditorium on June 3, 1973, while attending the Girl's Dance Recital sponsored by the Temple City Parks and Recreation Department, in the amount of $300. Councilman Gilbertson moved to deny the claim and refer to the City's insurance carrier, seconded by Councilman Dennis and carried. Council Minutes, August 28, 1973 - Page 5 D. TEMPLE CITY CAMELLIA FESTIVAL COMMITTEE - Annual Festival and Parade to be held February 22, 23 and 24, 1974. City Manager Koski presented a request from Mrs. Dan Clapp, General Chairman, 30th Annual Camellia Festival Committee, for use of bleachers, light standards for hanging banners, street parking ban as needed, use of Temple City Park, as set forth in their letter dated August 15, 1973. Councilman Gilbertson moved to approve, subject to necessary permits and legal requirements, including insurance, seconded by Councilman Dennis and carried. E. LOS ANGELES COUNTY REGISTRAR OF VOTERS - Request to use City facilities for check -in center, November 6, 1973. City Council approved a request from the Los Angeles County Registrar of Voters to use the City Hall as a check -in center for the special statewide election, November 6, 1973. 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: There were none. 16. MATTERS FROM CITY OFFICIALS: A. RAPID TRANSIT DISTRICT - Public Hearings on consultant's recommendations for mass rapid transit system. Councilman Dennis advised that he, with other City officials, had attended a very informative breakfast meeting with Los Angeles Mayor Bradley and Senator Cranston; that because other meetings were being scheduled, it would be premature to attend the public hearing to be held at Rosemead High School Auditorium, September 13, 1973. Council did feel, however, that the public hearing should be publicized so that the public could attend. B. City Council received and filed a staff report concerning AB 1588, recently enacted legislature which will enable the transfer of special tax district tax rates to the cities, thereby increasing tax effort for cities as computed in the revenue sharing allocation formula. City auditor computed the revenue sharing allocation formula using the greater tax effort of the library and fire district, which resulted in no change in revenue sharing funds as the City still did not exceed the minimum allocation. Also, City Attorney has advised that the effort would be to preclude establishing a municipal tax rate that is possible under SB 90 since the City presently has a zero tax rate. C. Councilman Gilbertson moved to designate Councilman Dennis voting delegate to the League of California Cities Conference to be held in San Francisco October 21 -24, and Councilman Merritt as alternate, seconded by Mayor Tyrell and carried. D. Councilman Gilbertson expressed appreciation to the Council for flowers sent to Mrs. Gilbertson during her recent hospitalization. Councilman Gilbertson also commented on the improvement of the traffic island at Encinita Avenue and Broadway. Mr. Gilbertson read a communication from new Temple City residents expressing their approval of the position Council had taken with reference to the Conflex program. E. Councilman Dennis advised Council he had reviewed proposed resolutions to be acted upon at the League of California Cities conference, and invited comments from the Council. Council Minutes, August 28, 1973 Page 6 1 Councilman Dennis also called Council's attention to the City Mayor's and Councilmen's Association meeting to be held August 30, 1973. F. Mayor Tyrell introduced Lt. James Watson of the Temple Station from the audience. He also reminded the Council to return their list of proposed participants for the Community Seminar to staff. Mayor Tyrell also called Council's attention to the proposed material for the Newsletter and advised Council to contact the Public Relations Coordinator if they had any suggestions. 7. ADJOURNMENT: Council adjourned at 8:40 p.m. The next regular meeting of the City Council to be held Tuesday, September 18, 1973, 7:30 p.m. in the Council Chamber of the City Hall.
