Communications Received No communication was received. 6. New Business — Public Hearings Page 2 Case No. B220012 — 623 Norris Drive, Front Setback Variance. Request filed by Kennan Russell and Lori Brown, property owners, for an 8-foot variance from the required 25-foot front setback for the RS-2 Single Family Residential zoning district to permit a 17-foot front setback to accommodate construction of a 24 foot by 19.5-foot garage. The property is located on the western side of Norris Drive 650 feet south of Boonville Road and is described as Edgewood Addition Lot 6 & Part of Lot 7 in Block 1, in the City of Jefferson, Cole County, Missouri. Ms. Bliss described the location of the request, zoning of the property and surrounding property, and the proposed desire to construct a 24' by 19.5' main level garage addition to the front of the house. The applicant is requesting an eight -foot variance from the required 25-foot front setback variance to permit a 17' front setback for the subject property. Lori Brown -Russell, property owner of 623 Norris Drive, presented the case. The house was purchased in poor condition with hopes to add a two -car garage on the main level. The Russell's previously spoke to a contractor and carpenter who didn't notice any issues with the setback. Terry McDaniel told the Russell's he spoke to city staff who advised him the setback would not be a problem. Ms. Brown stated she spoke to neighbors on the north and south side and across the street, those neighbors did not present any issues to the applicant about building a two -car garage. Ms. Brown answered questions from members and stated the new garage would be 30.5 feet to the curb. If a vehicle parks outside the new garage, there would still be 14 feet to the street. The proposed garages will not encroach any of the neighbor's views. Bunnie Trickey-Cotton, resident at 1815 Cedar Ridge Ct. spoke in favor of the request. Ms. Trickey- Cotton was the realtor that helped the Russell's with the purchase of this property. Ms. Trickey- Cotton stated the Russell's have made huge improvements that has increased the value of the neighborhood. No one else spoke regarding the request; the Chair closed the public hearing. Ms. Bliss described that information about the required findings is contained within the application forms and within the staff report. Ms. Bliss stated with the setback variance, there will be 17 feet from the Right -of Way. The Russell's will not change the direction or size of the driveway. Many of the houses in the area have garages and carports Ms. Bliss described the recommended form of motion. Mr. Seaver moved and Mr. Crabtree seconded to approve a requested 8 feet variance from the required 25 feet front setback for the RS-2 Single Family Residential zoning district to permit a front setback of 17 feet for construction of a garage. The motion passed 5-0 with the following votes: Aye Cartwright, Crabtree, Hake, Schaefer, and Seaver. Nay: None. A slight recess occurred so staff could meet with the requestor of B22011. Case No. B220011 —1560 Bald Hill Road, Front Setback Variance. Request filed by Christopher Billings, property owner, for a 6-foot variance from the required 25-foot front setback for the RS-3 Single Family Residential zoning district to permit a 19-foot front setback to accommodate construction of a new single-family home. The property is located on the western side of Bald Hill Page 3 Minutes/Jefferson City Board of Adjustment December 13, 2022 Road at the intersection of Nelson Drive and is described as Part of the Outlet 103, in the City of Jefferson, Cole County, Missouri. Ms. Bliss described the location of the request, the property and surrounding area is zoned RS-3 family residential. The applicant plans to build a 1,428 square foot home that would extend a maximum of 6' into the 25' front setback. Staff and members discussed the topography of the property, the terrain of the property has approximately 30' of elevation fall across the front portion of the property. Christopher Billings, property owner of 1560 Bald Hill Road, presented the case. Mr. Billings stated they have brought approximately 270 dump truck loads of rock and dirt in to build the foundation up. Mr. Billings is planning to build his mother a slab home on the property. Mr. Billings also plans to install a privacy fence behind the residence to protect anyone from falling off the ledge. Alan Barnett, resident at 1605 Bald Hill Road, spoke regarding the request. Mr. Barnett is concerned with speeding in the area and additional vehicles parked on the roadway. No one else spoke regarding the request; the Chair closed the public hearing. Ms. Bliss described the request and the recommended form of motion. Mr. Cartwright moved and Mr. Seaver seconded a motion to approve a 6 feet variance from the required 25 feet front setback for the RS-3 Single Family Residential zoning district to permit a front setback of 19 feet for construction of a single-family home. Mr. Barron stated staff can direct Mr. Barnett to the Traffic and Transportation Commission about his traffic concerns in the area. The Building Official is aware of the fill at the property and any building on the property will still need to meet all of the building related requirements within the city. A brief discussion occurred between staff and commission members about various concerns and questions with the request. The motion passed 5-0 with the following votes: Aye Cartwright, Crabtree, Hake, Schaefer, and Seaver. Nay: None. 7. Miscellaneous Reports None 8. Other Business A. Adoption of 2023 Board of Adjustment Calendar Mr. Crabtree moved and Mr. Seaver seconded a motion to approve the 2023 meeting calendar. The motion passed unanimously. B. Request filed by Unilever Manufacturing Inc for 50 feet variance from the required maximum building height of 60 feet (outlined in Section 35-51) to permit a building height of 110 feet for an automated warehouse. The property is located on the northeast corner of Schumate Chapel Road and West Truman Blvd and is described as part of Section 34 Township 45 North Range 12 West and part of Section 3 Township 44 North Range 12 West, Jefferson City, Missouri (Primus Building, Consultant) PUBLIC NOTICE By publication in the newspaper, letter to adjacent and affected property owners within 185 feet, and by property sign posting. NATURE OF REQUEST The purpose of the request is to construct a 110' tall automated warehouse building. The property is zoned M-2 General Industrial. The maximum building height in the M-2 zoning district is 60 feet. STAFF ANALYSIS The Unilever facility consists of about 72 acres of property, and contains multiple buildings including a—450,000 main manufacturing building, two—50,000 sf buildings, a multitude of fluid and product storage facilities, an employee parking lot consisting of about 350 spaces, parking for upwards of 300 tractor trailers, and stormwater detention basins. The Unilever property is bordered by single family residential areas to the north and west. The building (which would replace an existing building on the site) would be located behind the main manufacturing building, approximately 1200 feet north of Truman Boulevard and 900 feet from the main vehicle entrance from Schumate Chapel Road. The building would sit approximately 140 feet from the nearest side property line and approximately 450 feet from the nearest offsite building (a residential home). About 25% of the property (roughly 20 acres) is rough topography with steep slopes, and remains forested and undeveloped. The western property line (closest to the proposed building location) consists of a forested row of mature trees. The application materials include a site plan showing the location of the building, interior floorplan of the building, 3D renderings of the proposed building, building elevations, and street views from areas surrounding the property with the building outline noted. The exterior of the building is shown as insulated metal panel. The footprint of the building is noted as 207' x 414' (approximately 86,000 sf). Section 35-51.C.3.e of the Zoning code states that variances to the maximum height limits may be granted by the Board of Adjustment subject to findings. FINDINGS REQUIRED The applicant has provided responses to the required findings. In reviewing this case, the Board may wish to consider the following questions: 1. Would the proposed variance eliminate an adequate supply of light or air to the adjacent property? The proposed variance would not reduce or eliminate any supply of light or air to adjacent properties. The proposed building location would demolish an existing building currently in place. This location takes advantage of significant topographical separation as well as heavy tree cover from the adjacent parcels. The nearest building to this proposed facility is over 500' away. 2. Would the proposed variance substantially increase congestion on the public street? The proposed building expansion is part of a confidential network optimization for the Unilever supply chain. The new automated warehouse will allow shipping and receiving operations to be fully vetted and scheduled prior to any transporation activity. This project will not increase traffic flow and as defined in the confidential strategy charter, it will minimize the current situation and allow for greater control of truck movements for both shipping and receiving operations. 3. Would the proposed variance increase the danger of fire or endanger the safety of the public? The new facility will be constructed in 100% compliance with the current building codes in force at the time of permit submission, inclusive of code -required fire and life safety provisions. The facility will include an NFPA-13 compliant, fully automatic fire suppression system which will be monitored within the existing fire alarm control system currently in use on this campus. 4. Would the proposed variance be unduly injurious to the use and enjoyment of the adjacent property? Adjacent parcels have significant visual barriers to the site based on their proximity, and as such, will not be subject to any adverse effects of this proposed facility. No impact to any existing code required setbacks will be felt as this new expansion will be built in the the location of a portion of the existing facility subject to demolition. Aerial views have been provided in this request package to illustrate the surrounding properties and their relation to this existing facility. The proposed request will not diminish existing property values. The new facility will provide workplace improvements and career laddering for existing Unilever associates. This new facility will offset existing distribution operations providing new higher skilled, higher paying work opportunities for the existing staff, thereby increasing overall Unilever team morale. This will be a benefit to the community at large reinforcing that Unilever is a great place of employment. 6. Would the proposed variance be in keeping with the general spirit and intent of the Zoning Code? This variance request for additional building height would be in keeping with general industrial uses. Many similar facilities utilize taller structures to optimize their manufacturing processes for consumer items. The existing conditions provide significant visual as well as topographical separation from the neighboring parcels and will have zero impact on the use and enjoyment of these properties. The intent of this district as defined provides for criteria by which manufacturing can be undertaken. This request is complementary to that intention to allow for this land use.
