SUMMARY STATEMENT:
In an effort to avoid bankruptcy and an attempt to satisfy the City’s obligations, Resolution 07-9 (attached)
lays out a plan of action in response to Judge Winmill’s April 23 Order. The Resolution includes the
following actions:
1. Start the budget amendment process to pay the $300,000 General Fund surplus fund balance to St.
Clair Contractors
2. Start the process to borrow the maximum amount under Idaho Code §50-1006, to be repaid from
next year’s property taxes, under the 3% cap of Idaho Code §63-802
3. Begin judicial confirmation proceedings to fund the balance of the judgment
4. Ratify the City Manager’s decision to direct the City’s attorney to file an appeal of the District
Court’s April 23 Order, seeking a clarification of the maximum amount that the City can raise to
satisfy the judgment
5. Retain Richard Skinner, of Skinner Fawcett, as bond counsel
6. Direct staff to review all City finances and assets to identify possible sources of funds to reduce the
amount that must be borrowed
7. Authorize the dismissal, without prejudice, of the Declaratory Judgment action filed in state court
against Wausau Insurance and St. Clair Contractors, as an attempt to get a State Court review of the
Idaho Code issues raised in Judge Winmill’s April 23 Order. The Declaratory Judgment action has
been removed to the federal court.
