Gentlemen,
A meeting of the Planning Board is scheduled for Thursday,
18 Jan 1973, 9100AM, at City Hall to discuss the following
items.
1. A proposed ordinance providing for a zoning classification
titled, "Outdoor Recreational Land." The Gulf Stream Golf
Club, The Little Club, and The Bath and Tennis Club desire
to have their property classified in this way; the present
classification is "Residence District A." Atty. Patrick
Coughlan represents the three clubs and will be present
to make a proposal. It is important that the Planning Board
act on this item at this time so that we can make a re-
commendation to the Town Commission for its special meeting
on 22 Jan 1973.
2. Other zoning ordinance modifications which may be
discussed but not necessarily resolved includes
A. A requirement that set back lines conform to
the applicable deed restrictions when these
are more restrictive than the general Gulf
Stream requirements.
B. Some restriction on the location of air -
conditioning condensors, pool pumps, and
other machinery which might generate noise
problems.
C. A zoning classification for land used for
school purposes.
D. A specification of
divisions including
storm drainage, and
plans and drawings.

Items discussed:
I. Outdoor Recreational Land
An amendment to the Zoning Ordinance to create the subject
classification and district was submitted by Patrick Coughlan.
The district is proposed to include land owned by Th� Little
Club, Inc., the Gulf Stream Golf Club, Inc., and the 4 th and
Tennis Club, Inc.

With minor alterations it was approved by the board for re-
commendation to the Town Commission for consideration in its
meeting 22 Jan 73.
2. Conformance of Set Back Lines With Deed Restrictions
Discussion brought out the fact that the present Zoning
Ordinance, Sec.XI A,specifies that the ordinance in no
way reduces restrictions imposed by deed or covenant.
A proper effort to enforce deed restrictions before issuance
of building permits could involve extensive title searches
and analysis. The Town is not prepared to take on the legal
responsibilities which might be involved and this is not
the responsibility of the Town. Nearby towns make no
effort to enforce deed restrictions.
It is recommended that this item be dropped.
3. Zoning District for School Use
Atty, Patrick Coughlan has agreed to prepare a proposal on
this subject for consideration by the Board at some future
meeting. Progress will be reported.
4. Requirements for Approval of Sub Division Plans
The Board recognizes the merit of controlling, in some way,
the layout of access roads, cul -de -sacs, drainage systems,
and other matters in any new subdivision in the Town. The
writing of such an ordinance would require legal advice.
The Board seeks further direction from the Commission.
Specifically, should the Town Counsel be asked to work on
this at this time?
5. Location of A/C and other noisey machinery
It has been proposed that some restriction on location of
such noisey machinery be considered. The Board feels that
in a practical sense any ordinance of this kind would
necessarily be far too complex to be enforceable. No
community, in this country or in Europe, has noise ordinances
which are really satisfactory.
It is recommended that this item be dropped.
