SUMMARY STATEMENT:
This zoning map amendment was heard by the McCall City Council on May 10, 2007. After public testimony and
Council deliberation the land use was approved on a two one vote (out of five possible votes), with one Council
member abstaining and another member not voting due to potential conflict of interest. The staff findings and
conclusions were adopted and Ordinance 835 was read by title only one time only. At the May 24, 2007 City Council
meeting there was a second reading of the ordinance. On June 7, 2007 the Council held and approved a third and final
reading of Ordinance 835.
Subsequent to the public hearing, it was determined that the Council's public notice procedure was defective because
a map had not been attached to the legal advertisement as required by the provisions of McCall City Code 3.15.03(I).
With guidance from the City's attorney a new notice procedure was crafted and a new public hearing was scheduled
for July 12, 2007. Meantime, staff was advised that the new notice may be subject to legal challenge and as an act of
caution, the land use application was pulled from the July 12 agenda with the intent of re -noticing and re -advertised it
in several different formats to a date certain.
The Council reviewed their options at the July 12, 2007 meeting and determined to defer action on how the rezone
action should proceed to the July 26, 2007 meeting.
RECOMMENDED ACTION:
The Council should determine whether to proceed with this land use action or discontinue the effort
until other land use issues are addressed.
