HomeMy Public PortalAbout06/02/1981f ( STUDY COMMITTEE MEETING JUNE 2, 1981 This was a meeting of the Study Committee which was appointed by the Town Commission to review and study the existing zoning ordinances. The Study Committee consisted of Commissioner Robert Dixson and Mr. Charles Wanio. A report was prepared by Gene Caputo, President of Executive Management Consultants, for revisions of zoning ordinances; what the language should be in the zoning ordinances and how the ordinances should be changed. The report was entitled "Recommended Toning Ordinance Revisions ", which is attached hereto. Each area of the paper was discussed in detail by Mr. Caputo, Commissioner Dixson and Mr. Wanio. During the course of the meeting, there was a discussion for printing colored maps for the Town. The matters of revisions and deletions of different zoning ordinances as presented were agreed upon by the Study Committee. In conclusion, Mr. Caputo agreed to revise, as discussed, the zoning ordinances in order to present a new version, and also present the idea of { new colored maps to the Commission at their meeting of June 12, 1981. All matters were agreed upon by the Study Committee of the June 2, 1981, meeting. Town of Gulf Stream, Florida Recommended Zoning Ordinance Revisions June 2, 1981 The following revisions are the minimal actions necessary to establish consistency between the Zoning Ordinance and the Comprehensive Development Plan. 1. Because the basic goal of the Plan calls for a continuation of the low - density character of the Town, the nomenclature of the zoning districts should be changed so as to better represent this goal statement. It is recommended that: a. Residence District "A" becomes "RS" - Residential Single Family District b. Limited Apartment District "C -1" becomes "RM -1" - Multiple Family Low Density District c. Apartment and Residence District "C" becomes "RM -2" - Multiple Family Medium Density District d. Business District - delete entirely e. Outdoor Recreational District "R(A)" becomes "OR" - Outdoor Recreational District 2. As stated, The Comprehensive Plan projects a low density residential community, and the nature of existing development is less than one (1) unit per acre. However, the Zoning Ordinance currently permits the subdivision of land into 10,000.square foot parcels, which equates to a density of 4 times greater than both the pattern of existing develop- ment and the goals of the Plan. It is recommended that; a. Pg. 1139, Section III (D) (1), be revised to read as follows; - The minimum building site area shall be a parcel of land not less than 20,000 square feet in area for each single family dwelling unit. b. Pg. 1142, Section IV (F) (1), be revised to read as follows: - The minimum building site area shall be a parcel of land not less than 20,000 square feet in area for one or two dwelling units. For each additional dwelling unit in a multiple family dwelling of more than two units, 5,000 square feet shall be added to the minimum lot size of 20,000 square feet. C. Pg. 1142, 1143, Section IV (F) (2) (d), be revised to read as follows: - Area (square feet) 20,000 square feet. 3. Because the current Zoning Ordinance presents possible questions of interpretation with regard to the listings of permitted uses, a universal prohibition clause should be inserted in each zoning category. It is recommended that: a. The following clause be added at the herein cited references - Pg. 1138, Section III (A) (4) - Pg. 1141, Section IIIA (A) - Pg. 1142, Section IV (A) (6) - Pg. 1147, Section VA (B) (4) Any use which is not specifically permitted in this zoning district is hereby expressly prohibited. 4. While governmental uses are addressed in the Comprehensive Plan as a logical and necessary function within the Town, the Zoning Ordinance makes no provision for such uses. Inasmuch as the current Town Hall facility is situated within -the "C" zoning district, proper provisions should be made. It is recommended that: a. Pg. 1142, Section IV (A) (4), be revised to read as follows, and that the existing sub - paragraph (4) become sub - paragraph (5): - Town Hall, police station, or other similar governmental use which is owned and /or operated by the Town of Gulf Stream. 5. Since the original date of passage, the Zoning Ordinance has been revised by the addition of the Outdoor Recreational District and all lands used for such purposes should be removed from other zoning districts. It is recommended that; a. Pg. 1138, Section III (A) (4), be deleted. b. Pg. 1141, Section III (I) (4), be deleted. 6. As a result of the Plan objective to maintain its existing growth pattern, it is vital that any non - residential or non - recreational uses be strictly prohibited from locating within town limits. There- fore, all references to business activities or other related uses be removed from the Zoning Ordinance. -2- r ' It is recommended that: a. The Definitions section be revised as follows: - pg. 1132, Clubs: Organizations, e!X1ar--Rrivately owned and operated for a profit, or owned by members and not operated for profit, which maintain recreational and athletic facilities for the exclusive use of its members and their guests, and in which meals and alcoholic and other beverages may be served, and rooms for entertainment - but not for lodging - may be provided. - pg. 1133, Filling Stations - Delete entirely Garage, Public - Delete entirely - pg. 1134, Service Station - Delete entirely b. Section I, Districts and boundaries thereof. - pg. 1135, 1136, (A) In order to regulate and limit the height and size of buildings; to regulate and limit the intensity of the use of lot area; to regulate and determine the areas of open spaces within and surrounding buildings; to classify, regulate and restrict the location of the uses permitted herein, the Town of Gulf Stream, Florida, is hereby divided into zoning districts of which there shall be four (4) known as; "RS" - Residential, Single Family District - Residential, Multiple Family Low Density District lnJl"Frt "EM " - Residential, Multiple Family qty District "OR" - Dutdoor Recreational District j,,t c, Section III = Residence district "A" - Pg. 1140, (I) Additional Provisions (3) - Delete entirely i d. Section XI - Interpretation, purpose and conflict - pg. 1155, (C), Delete last sentence Additional note: Depending on the nomenclature used in the revised district titles, appropriate revisions should be made throughout the entire Zoning Ordinance. -4-
