SUMMARY STATEMENT:
The proposed code amendment regards a graduated setback requirement for building within the Scenic Route and Airport Zone.
The full amendment is provided in the staff report; a map illustrating the setbacks of the amendment is also provided.
On December 4, 2007, the McCall Planning and Zoning Commission held a regularly schedule and publicly noticed hearing to
consider the proposed text amendment. After considering all testimony, the Commission recommended denial of the
amendment to the Council. However, the Commission recognized the need to modify the setback requirements but felt that a
process involving the Airport Advisory Committee (AAC), local designers, citizens and City staff should be undertaken to
develop a new or revised amendment.
According to the first sentence of MCC 3.13.04 (D): "All applications will come to the commission for action, and proceed for
final council action." As such, the code amendment is before the Council for action. However, because the second sentence of
MCC 3.23.04 (D) which states "Final approval of amendments will require the concurrence of both the commission and the
council" the Council is unable to approve the Code Amendment at the present meeting. Accordingly, staff makes the
recommendations listed below.
RECOMMENDED ACTION:
1. Deny CA-07-07.
2. Direct staff to work with interested parties to develop a Code Amendment which addresses the building height limits in
the Airport zone and Scenic Route portion of the Airport property.
3. Initiate a code amendment to remove the second sentence of MCC 3.14.04 (D)
