Mr. Frank Carpenter from the Gulf Stream School presented plans for an addition to the school. The Board accepted the plans as presented and will bring then to the Commission Meeting May 14, 1982. Mr. Devlin's request for a variance to place a residential swimming pool in a Multiple Family Zoning Area, located at 1100 North Ocean Boulevard, was denied by the Board until plans are resubmitted showing a proper drainage, run -off from the pool, etc. The Board approved the plan presented by Mr. Dittman. A letter in ref- erence to this subject is attached. The plan will be presented to the Connnissioners on May 14, 1982. The St. Andrews Tennis Club presented plans for a storage house on the tennis courts. A copy of the proposed storage house is attached. The plans were passed on to the County Building Department after being approved by the Board. Barbara , Town Clerk PETITION FOR VARIANCE TO: TOWN OF GULFSTREAM:; TOWN COMMISSION TOWN PLANNING BOARD DATE: May 3 , 1982 Gentlemen: Pursuant to 5 9 -3, Gulf Stream Code, the undersigned, as owner of the property legally described on the attached Sketch and Description, which Sketch and Description is hereby made a part hereof, hereby respect- fully requests that the following variances to the Gulf Stream Code be con- sidered and granted by the Town: 1. That the property described and depicted as "Parcel A" on the attached Sketch and Description, owned by the Petitioner, same being in excess of 20,000 square feet, may be developed by Petitioner as one (1) single family residence building lot without necessity of platting said parcel as may be required by 59 -16 and Appendix A. 5X, of the Gulf Stream Code, provided that: (a) Petitioner shall deed restrict the property des- cribed and depicted as Parcel B on the attached Sketch and Description to preclude any improvements on the property other than recreational facilities (defined in the Gulf Stream Code to be "accessory structures ") as may be allowed by and subject to the Gulf Stream Code. (b) The Petitioner or future owner(s) of Parcel A shall comply with 5X. (Plats), q B of Appendix A of the Gulf Stream Code by furnishing a site plan, in duplicate, in lieu of a Plat. (c) The Petitioner and /or future owner(s) of Parcel A shall comply with all other provisions of the Gulf Stream Code for which no variance shall be granted.' 2. That the provisions of SIII(E)(1) of the Gulf Stream Code respecting the requirement of one hundred (100) foot width of front yards shall not be required as to the totality of required front yard depth of Parcel A as described and depicted on the attached Sketch and Description. N 3. That the requirements of 5III(F)(1) of the Gulf Stream Code respecting side yard set backs be reduced from fifteen (15) feet or fifteen (15) percent of the average footage of lot width, whichever is greater, to not less than twelve (12) feet, excluding porches, overhangs and eaves, but only as to the side yard along the northern boundary line of Parcel A, as described and depicted on the attached Sketch and Description. 4. That the requirements of SIII(G)(].) of the Gulf Stream Code respecting rear yard set backs be reduced from fifteen (15) feet or fifteen (15) percent of the average footage of lot depth, whichever is greater, to not less than fifteen (15) feet, as to the easterly boundary line of Parcel A, as described and depicted on the attached Sketch and Description. The Petitioner offers the following reasons for this Petition which, for convenience, are enumerated in lettered paragraphs corresponding to the foregoing numbered paragraphs: A. Platting of Parcel A would impose a considerable financial hardship on applicant in that applicant desires that only one residence be constructed on the entire property. Applicant stipulates and agrees to deed restrict the contiguous Parcel B so that no residences or extensions thereof can be built thereon. Accordingly, there will in actuality, be but one "building lot" namely Parcel A, and no streets will be dedicated to public use or use of owners of fronting and adjacent lots, which creates an ambiguity whether platting is required in the first instance, other than by implication, by the Town Code. The private drive serving the one residence to be built on Parcel A shall lie at least 75 feet north of the northern boundary of PLACE AU SOLEIL, Parcel B, restricted as aforesaid, to be reserved as a "buffer zone" for future transfer to abutting PLACE AU SOLEIL lot owners. Applicant believes that the character of the area can best be restored and preserved by this limited plan of development while substantially increasing the Town's tax base (total 1981 taxes on both Parcels being less than $40.00) and increasing the security and property values of PLACE AU SOLEIL lot owners abutting the property in question. A variance from the platting requirements is, thus, sought because of the aforesaid hardships and to resolve an ambiguity in the Town Code pertaining to platting. B. The front yard width requirement is ambiguous as to whether the required 100 feet front yard width requirement applies to the full required front yard depth. A variance is sought to resolve this ambiguity and also the hardship imposed by reason of the irregular lot size, same being in excess of 800 feet in depth, As is shown on the attached Sketch and Description, the actual "building area" on Parcel A is restricted to a small area on which an easement release can be obtained. This results in an "actual front Yard" width of 100 feet extending over 200 feet in depth from the actual "building area ". M-C C C. A variance is requested reducing the northern side yard set back, bordering the vacant and uninhabited F.I.N.D. property to 12 feet from the northern -most building wall. The reason for this request is because of the limited "building area" that is available by reason of the aforesaid release of the easement which encumbers the entire property. Without such a reduction, it would be extremely difficult, if not impossible, to meet other provisions of the Town Code respecting minimum square footage, etc., while preserving the natural environment of the area and keeping improvements the furthest possible distance, buffered by woods, from the northern boundary of PLACE AU SOLEIL. D. A variance is requested reducing the rear yard set back, bording the Intracoastal Waterway, to 15 feet. The reason for this request is the same as was given for the side yard set back reduction request, stated above, that is, the limited actual building area available for erection of improvements. The above- described general plan of development has been carefully weighed, worked on and discussed with various town officials, including the Town Planning Board, over a two -year period. The Applicant feels that such a plan would preserve, to the greatest degree, the character and natural environ- ment of the area and would act to prevent the illegal dumping on the property and in the F.I.N.D. which has occurred with regularity in the past creating an C' unsightly and unhealth condition. Moreover, such a plan would create a buffer zone aldng most of the northern boundary of PLACE AU SOLEIL while increasing property values for most, if not all affecting properties. The undersigned applicant has constructed three homes in PLACE AU SOLEIL Subdivision at 925 Orchid Lane, 2730 Cardinal Circle and 2755 Cardinal Circle and presently owns Lot 64 in said subdivision as well as the property discussed above. This drainage system was not constructed in accordance with approved plans in several respects. These items are the result of a cursory inspection by the writer and a discussion with Mr. William Sims of John A. Grant, Jr., Inc., and are not intended to be a complete listing. 1. The drop inlets and drain field on the north side of the property was not installed. 2. Site grading, as delineated by surface flow arrows on the plans, was not followed, resulting in runoff being directed onto Shore Road rather than being retained on the site. 3. The storm water pump has not been verified to be of the planned capacity; indeed, the pump is only 2 h.p. where a 3 h.p. pump was specified. The drop inlets on the north side of the property are not considered to be a major problem, except that the storage and infiltration capacity of the site has been diminished. The capacity could be placed elsewhere if necessary. Retaining walls have been con- structed which do not show on the drainage plans, resulting in overland water flow which does not enter the drop inlets, but generally flows down driveways and onto Shore Drive. Shore Drive slopes away from the property from north to south; therefore, any water entering Shore Drive will flow to the drainage basin in the tennis court parking lot rather than to the drop inlets as intended. Normally the pump provided to transport water to the higher easterly French drain will not pump an appreciable amount until Shore Drive is flooded and water backs up into the southern drop inlets. The pump capacity and horse power should be verified and possibly re- evaluated. In light of the above conditions, we cannot recommend acceptance of the site drain- age as constructed. Although we feel that the elimination of the northerly drains are not critical due to the diminished drainage area they would handle, we also feel that measures should be taken to assure retainage of storm water on this part of the site. It is our recommendation that the Town require the developer to provide plans for modifications to the drainage system so that the required amount of water will be retained on site rather than entering Shore Drive. After these plans have been reviewed and approved, the Town may elect to have the work done prior to final accep- tance or to require a bond assuring the work will be done within a specified time. Proper notification to the designing engineer and proper inspection of system construction should be assured. I trust this letter will aid the Town in determining a fair and proper course of action.
