This is to confirm that at the Public Hearing held by the Town
Commission, sitting as the Board of Adjustment, on July 19, 1996,
your application for a variance and site plan approval to
permit construction of a single family, two -story dwelling
on the property located at 24 Hidden Harbour Drive, Gulf Stream,
Florida that is legally described as Lot 4, Hidden Harbour Estates,
was considered.
The variance to permit 295 square feet of additional floor area
as requested was granted provided that prior to the issuance of a
Certificate of Occupancy, a deed restriction that prohibits the
enclosure of the covered patio area or the addition of floor area
as currently calculated in the Design Manual shall be recorded.
The Level 3 Architectural /Site Plan Review was approved based on
the plans and documents submitted provided as follows: 1) a minimum
5 -foot fence or wall shall be provided to enclose the pool area as
per County building requirements; 2) the fountain north of the pool
deck shall maintain a minimum 9 -foot setback from the canal as per
the previously approved rear /water setback variance for minor accessory
structures; and 3) prior to the issuance of a Certificate of Occupancy,
a deed restriction be recorded which prohibits the future enclosure
of the covered patio area or the addition of floor area as currently
calculated in the Design Manual.

legal advertising for the variance to be $445.45. The Town
has paid for this so your check to cover this amount is to
be made payable to the Town of Gulf Stream.
If a building permit incorporating the aforementioned improvements
is not obtained and construction commenced by July 19, 1997 the
variance approval and site plan approval shall expire.

Wheeler; 24 Hidden Harbour Drive.
The applicant, Mark Marsh of Digby Bridges, Marsh & Associates as agent for Mr. Chris
Wheeler (contract holder for a parcel of property owned by Tetrad Limited Partnership),
is seeking approval to construct a new home on a parcel of property described as Lot
4 of the Hidden Harbour subdivision. The nature of the request requires a
recommendation to the Town Commission for a floor area Variance and a Level 3
Architectural /Site Plan Review. No other Board actions are required.
Site History
The site in question was the subject of ARPB File #95 -09 filed by another individual who
had a purchase option for the property. That application included requests for four
setback Variances, a Land Clearing Permit and a Level 3 Architectural /Site Plan Review,
all of which were approved by the Town Commission on November 9, 1995.
Subsequent to Commission approval, Mr. Wheeler obtained an option for the property.
His proposed home is different in design and size than the one previously approved;
however, his site plan incorporates the same setback Variances granted for the original
application. Because approvals run with the land and not the owner /developer, and the
Variances have not expired, Mr. Wheeler's request does not require re- approval of the
setback Variances.

Project Description
The applicant proposes to construct a two - story, four bedroom, five bath home with 5,467
square feet of living area. The total gross floor area including the living area, garage and
covered patios is 7,723 square feet. There are no atriums or ceiling heights above 15
feet.
The property has an Effective Lot Area (dry land area minus the private road and
simulated right -of -way) of approximately 24,138 square feet, as opposed to a platted lot
area 40,293 square feet. Under the Sliding Scale FAR, the maximum permissible floor
area is 7,428 square feet, or 295 square feet less than what is proposed. Accordingly,
the applicant has requested a floor area Variance.
The architectural style of the home is best described as Spanish- Mediterranean Revival.
Design elements include: a reddish, clay barrel tile roof with exposed cypress rafter tails;
tan /off -white stucco walls; casement windows with muntins; pronounced window sills and
rounded transoms on some windows; louvered shutters; and covered porches with
decorative column supports. Other design features include: french doors with rounded
transoms; a cast stone facade around the front entrance; a second floor balcony on the
rear with an exterior spiral stairway; and trellises at the front corners of the home as well
as one on the rear.
The proposed home has a first floor elevation of +8.50 feet NGVD. First floor eave lines
are 10, 12 and 14 feet above the first floor, with the second floor eave line at 22 feet
above the first floor. The peak roof elevation is about 26.5 feet above the first floor. All
roof areas have a 4/12 pitch, with the exception of two small flat areas.
The proposed garage /storage area is on the west end of the home and has an "L-
shaped" configuration. The bulk of the garage faces west and includes a one -car stall
on each end with a two -car stall in the middle. In addition, there is a single stall facing
south that provides access to the storage area. Screening the garages and adjacent
motor court is a 6 foot block wall on the west, and a 6 -foot wall and gate on the south.
Other proposed improvements to the site include a paver block parking area by the front
door and a walled garden with a fountain in rear yard outside of the master bath. Also
planned for the rear yard are a pool and deck area, a fountain, a multi - leveled terrace,
planters, and a wooden dock. The wooden dock runs almost the entire length of the rear
property line, stopping at the required 12 foot setback lines at both ends.
The proposed landscape plan has both formal and informal elements. The plan relies
heavily on palm trees, foundation plantings and perimeter hedging plus some cattley

guava and sea grapes used as accent trees. Also included are three live oak trees in the
east yard to provide additional screening from Hidden Harbour Drive.
None of the few existing trees are to remain as most are mature exotics which interfere
with the proposed building envelops. Further, the proposed plan calls for an +8.5 foot
NGVD first floor elevation, necessitating a need for fill material to raise the ground from
its current elevation of +4.5 to +5 feet NGVD. Because the proposed plan closely
resembles the previously approved plan in terms of vegetation removal and need for fill,
the applicant has not applied for a new Land Clearing Permit.
Finally, stormwater retention requirements will be met with three, independent french drain
systems. Sanitary sewage requirements will be met with an on -site septic system.
Variances

Requested Floor Area Variance
Chapter 66, Article V.3. of the Town Code of Ordinances provides that sites that receive
Variances cannot be granted Special Exceptions. It is staff's opinion that this provision
was added to the code because both the general and specific Special Exception review

standards assume that a project meets all other requirements except those which are the
subject of the requested Special Exception. If a Variance is granted, this assumption is
no longer valid. As a result, what otherwise would have been a Special Exception
request without Variances, itself becomes a Variance request when other Variances are
granted for the same project.
As discussed, the applicant has asked for a Variance to exceed the maximum permitted
floor area by 295 square feet. The applicant has based this request on the large area of
covered, unenclosed patio used along the back of the house. Article IV, Section E.2. of
the Design Manual permits a Special Exception to discount up to 300 square feet of roof
projections from the floor area calculation provided certain standards are met.
Chapter 66, Article V.2. of the Town Code of Ordinances provides the criteria for
reviewing Variances. For a Variance to be approved, the applicant must prove that his
request meets all of the criteria. As discussed, in the absence of the previously approved
setback Variances, the requested floor area Variance would have been processed as
Special Exception. However, because Variances have already been granted for this site,
the Special Exception must be processed as a Variance, and both the Variance and
Special Exception criteria should apply.
Variance Criteria
The requirements for a Variance generally can be summed up into three components;
uniqueness, hardship and mitigation. The Town approved setback Variances were based
on a finding of uniqueness in the shape of the property and the hardships the shape
causes in designing a suitable site plan. In addition, the Commission found the impacts
of the Variances were mitigated by the permanent open spaces on the properties to the
east and south, and the large expanse of water buffering the property to the north.
The applicant's current request for a Variance relies on these same findings plus
consistency with the Special Exception criteria found in Article IV, Section E.2. of the
Design Manual. The applicant has addressed all of the Variance criteria on Part IV.G. of
the application form, and on an addendum page to the application form, the applicant
has provided written responses to all four specific standards listed in the Design Manual.
Special Exception Criteria
The floor area Special Exception was created to encourage creative design through the
use of roof projections that would add architectural detailing to a structure without
contributing to the appearance of mass. In effect, the Special Exception rewards good
design by permitting up to 300 square feet of additional floor area. The proposed home
incorporates 754 square feet of covered patio, primarily along the back around the pool

deck. The applicant contends that the covered patio adds both architectural character
to the house while providing necessary weather protection.
Conclusion
There are several ways of looking at the 295 square feet of additional floor area. One
way is to consider that 295 square feet is approximately the area of the second floor
balcony over the northwest end of the covered patio. Another is to consider that
reducing the depth of the covered area from about 11 feet (as proposed) to about 7.5
feet also yields about 295 square feet. Lastly, 295 square feet is about 40% of the total
area of covered patio. One could argue that because the area is open, it appears 40%
less massive than if the area were enclosed.
Regardless of how the excess area is calculated, staff believes the home and covered
patio are of a very high quality design -- incorporating nearly all of the "Preferred"
elements and none of the "Discouraged" of the Spanish- Mediterranean style found in
Article VII of the Design Manual. The proposed covered patio adds appropriate detailing
while its open design looks far less massive than if the area were enclosed. While
discounting the entire 754 square feet of covered area would not be appropriate, staff
believes a discount of 295 square feet is acceptable.
Based on the material provided by the applicant, staff finds that the requested floor area
Variance meets the applicable Variance and Special Exception criteria. The covered patio
adds appropriate and desirable architectural detailing without adding the appearance of
mass that would result if the area was enclosed. Further, only a small corner of the
proposed covered patio fails to meet the required 30 foot minimum setback. Accordingly,
the previously approved rear setback Variance has only a limited impact on the area.
Staff recommends approval of the floor area Variance with the condition that the applicant
record a deed restriction that prohibits the future enclosure of any part of the covered
patio or the addition of any floor area as currently calculated in the Design Manual.
Level 3 Architectural /Site Plan Review
Chapter 66, Article V.1. of the Zoning Code enumerates the 12 standards applicable to
applications for a Level 3 Architectural /Site Plan Review. These standards include
consistency with all applicable sections of the Gulf Stream Design Manual. Please note
that the standards found in Article VII, Predominate Styles, of the Design Manual also are
applicable as the applicant has chosen to use the Spanish- Mediterranean Revival style.

Based on the materials submitted by the applicant, staff finds the project consistent with
all applicable standards, including those contained in the Gulf Stream Design Manual, with
the following conditions:
1. A minimum 5 foot fence or wall be provided to enclose the pool area as per
County building requirements;
2. The fountain north of the pool deck shall maintain a minimum 9 foot setback as
per the previously approved rear /water setback Variance for minor accessory
structures; and
3. The applicant record a deed restriction which prohibits the future enclosure of
the covered patio area or the addition of floor area as currently calculated in the
Design Manual.
Recommendation
1. A motion to recommend approval of a Variance to permit 295 square feet of
additional floor area based on the plans and documents submitted by the
applicant and a finding that the following condition is necessary for the
proposed improvements to be consistent with the applicable Variance criteria
and the Special Exception criteria found in Article IV Section E.2. of the Gulf
Stream Design Manual:
a. Prior to the issuance of a certificate of occupancy, the applicant shall record
a deed restriction that prohibits the future enclosure of the covered patio
area or the addition of floor area as currently calculated in the Design
Manual.
2. A motion to recommend approval of a Level 3 Architectural /Site Plan Review
based on the plans and documents submitted by the applicant and a finding that
the following conditions are necessary for the proposed improvements to be
consistent with the applicable review criteria:
a. A minimum 5 foot fence or wall be provided to enclose the pool area as per
County building requirements;
b. The fountain north of the pool deck shall maintain a minimum 9 foot setback

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and Planning
Board of the Town of Gulf Stream will hold a Public Hearing on Monday,
June 17, 1996 at 8:30 A.M., and the Town Commission will hold a Public
Hearing on Friday, July 19, 1996 at 9:00 A.M., both in the Commission
Chambers of the Town Hall, 100 Sea Road, Gulf Stream, Florida at which the
following will be considered:
An application for a Variance and a Level III Architectural /Site
Plan Review, submitted by Mark T4arsh of Digby Bridges, Marsh and
Associates, as Agent for Chris D. Wheeler, owner of the property
located at 24 Hidden Harbour Drive, Gulf Stream, Florida which
is legally described as Lot 4, Hidden Harbour Estates, Gulf Stream,
Florida,to permit the Construction of a two - story, single family
dwelling consisting of 7,723 square feet under roof which exceeds
the maximum permitted Floor Area Ratio by 300 square feet at
this location.
The Architectural Review and Planning Board shall make a recommendation
to the Town Commission, and the Town Commission shall make a final decision
regarding the subject application at their respective meetings noticed
above. These meetings may be adjourned from time to time and place to place
as may be necessary to hear all parties and evidence.
Complete application materials are on file in the office of the Town Clerk
located at 100 Sea Road, Gulf Stream, Florida 33483 and may be reviewed
during regular business hours which generally include non - holiday weekdays
from 9:00 A.M. to 4 :00 P.M.
ALIT PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of the Town
of Gulf Stream at the times and place aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE ARCHIT-
ECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COWIISSION WITH RESPECT TO
ANY MATTER CONSIDERED AT THESE PUBLIC HEARINGS /MEETINGS, SAID PARTY WILL
NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY NEED TO INSURE
THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES
THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS TO BE BASED.
