Dear Mr. & Mrs. Kurdziel,
Mr. Robert Dittman, 925 Orchid Iane, Gulf Stream, Florida
appeared before the Planning Board Meeting May 4, 1983
asking for the following variance.
1. A variance from the prohibition against construction
of accessory structures on a lot or parcel not loca-
ted on the same lot or parcel as the main residence
building in order to construct a 40 feet by 25 feet
wood or concrete deck with fire pit in the central
area of the property in question, an open -sided
wood chickee /gazebo immediately to the west of said
deck having dimensions of not more than 12 feet by
15 feet and a height of not more than 12 feet, a
walkway connecting the aforesaid deck within the main
residence structure, and night security lighting on
the corners of the chickee /gazebo, all as shown on
the attached sketch.
A variance from any applicable platting or other
ordinances, precluding the construction of the
aforesaid improvements.
According to the Town's Code of Ordinances we are notifying
all adjoing property owners. If you should have any ob-
jections the Planning Board will review this request at their
regular 9:00 A.M. Meeting Wednesday June 1, 1983 at the Gulf
Stream Town Hall, 246 Sea Road, Gulf Stream, Florida and all
interested persons will be given an opportunity to be heard.

I have reviewed the April 29, letter written to the Town from
Robert A. and Joyce 0. Dittman which you forwarded to me under
memorandum of May 6, 1983.
As long as a unity of title is filed by the property owner, it
does not appear to me that a variance would be needed from the
"prohibition against construction of accessory structures on a
lot or parcel not located on the same lot or parcel as the main
residence ". In regard to Mr. Dittman's item number 2, I do not
believe there are any platting problems, however, I would rec-
ommend that the Planning Board review the application to determine
that it meets all other requirements of the Town's code.

Dear Barbara:
Enclosed please find five copies of letter for the Town Planning Board rela-
tive to Bob Wiebelt's variance request; as you can see I am requesting their
reconsideration pending hearing by the Town Commission, which I have asked
you to set off until the July meeting.
I have asked Bob to send you the $25.00 balance due on his request; the site
plan fee, and review, preliminary to getting an o.k. for a building permit
comes later on, right?
I am also enclosing my own check for $125.00 as follows:
$ 25.00 balance of variance request fee.
100.00 plan review for house addition (this is separate from the
site plan review both Mr. Wiebelt and I'll need relative to our back yard im-
provements, assuming our variances pass.)
Please schedule me on the agenda for the next Planning Meeting in June regard-
ing my house remodeling; I should have the plans to you by the 25th of this
month.

Gentlemen:
As you may recall, I am representing Robert Wiebelt in connection with the
referenced matter.
I have been advised by Mrs. Gwynn that the Board has voted not to recommend
the request on the basis that a request for the set back variance does not
present a case of hardship.
In the limited amount of time available at the last Planning Meeting, this
subject was not addressed. Therefore, I have asked Mrs. Gwynn to defer this
request, as to action by the Town Commission, until the July meeting, when
Mr. Wiebelt will be able to attend, and would ask that the Planning Board
reconsider its vote at your June meeting, which I expect to attend.
On the issue of hardship, I would offer the following comments based upon my
personal knowledge. Mr. Wiebelt purchased the property in question in late
September of last year from Barry Eavenson, who then owned the entire 100 foot
strip north of Place Au Soleil; at that time I represented Mr. Eavenson in con-
nection with the sale. Mr. Wiebelt having indicated that he wanted the pro-
perty so he could build a tennis court on it, both Mr. Eavenson and I referred
him to the Town for a reading on any possible problems that that would pose,
including set backs. Mr. Wiebelt indicates that he was told that there would
not be a problem since set back requirements weren't being applied to tennis
courts. This coincided with what Mr. Eavenson and I had previously been given
to understand.
Relying on what he had heard from the Town, Mr. Wiebelt bought the property,
but did not desire to build until expiration of the annual seasonal building
moratorium in April of this year. Of course, by that time the Town zoning was

To me this presents a valid case of hardship and I would respectfully request
your reconsideration of this matter at your June meeting.

I have read a copy of Robert Dittman's letter to you of May 10,
1983, concerning the variance request of Robert Wiebelt and I would also
add that Mr. Wiebelt did, in fact, indicate that he was purchasing his
property with the intention of building a tennis court on it which, as I
was advised by the Town at that time, did not require compliance with
Town set back provisions. From what I understand, it appears that he
C_ could have built the tennis court prior to the new zoning code.

Gentlemen:
April 29, 1983
The undersigned, as owners of the property described in the
attached Deed, respectfully request the following variances from the provisions
of the Town Zoning Code be considered and granted by the Town:
1. A variance from the prohibition against construction of ac-
cessory structures on a lot or parcel not located on the same lot or parcel as
the main residence building in order to construct a 40 feet by 25 feet wood or
concrete deck with fire pit in the central area of the property in question, an
open -sided wood chickee /gazebo immediately to the west of said deck having
dimensions of not more than 12 feet by 15 feet and a height of not more than 12
feet, a walkway connecting the aforesaid deck with the main residence structure,
and night security lighting on the corners of the chickee /gazebo, all as shown
on the attached sketch.
2. A variance from any applicable platting or other oadiances,
precluding the construction of the aforesaid improvements.
In support of the aforesaid variance requests, the undersigned
would represent:
A. The property in question is contiguous to Lot 89, Place Au
Soleil, which is owned by the undersigned.
B. The property in question is zoned "single family residence"
and is Deed restricted as shown on the attached Deed, which restrictions were
heretofore required by the Town and Place Au Soleil Association; the proposed
improvements to the property are allowed by said Deed restrictions and have been
heretofore approved as to location and design by Barry F. Eavenson, the party
imposing said restrictions by Deed.
C. Because of said Deed restrictions required by the Town, the
property in question can not be transferred separately from Lot 89, on which the
main residence is situated; thus, a situation exists in which there is already
an effectual or de facto unity of title between said property and Lot 89, which
lies to the South of the property in question.

D. Property access is available from Lot 89 which, as
aforesaid, is effectively unified as to title with the property in question.
E. Zh the north of the property in question is a 30 foot strip
of property and to the west and east are 100 foot strips of property which are
owned by George and Alice Von Essen.
Also enclosed is a check for $50.00 payable to the Town for the
required variance fee. It is requested that the aforesaid variances be approved
in whole or part at the earliest possible date.

decks, fences, security and decorative lighting, shuffleboard
or" tennis courts, in- ground swimming pools or hot tubs, and ac-
cessory pumps, filters and heating equipment, open sided cabanas
not exceeding 180 square feet and 12 feet in height, and barbeque
grills; approvals from Grantor may be obtained by written request
therefor containing full particulars mailed certified mail return
receipt to Grantor, his heirs, successors or assigns at the address
appearing on the records of the Palm Beach County tax collector
relative to the contiguous retained lands of Grantor to the north
and east of the above described lands; Grantor's failure to respond
to such request within 60 days of the date of such request shall be

3. No motor vehicles or boats of any type or description
shall be parked or stored on the aforesaid property.
4. At such time as Grantee may remove the concrete louvre
party fence on and along the southern boundary of the above described
lands Grantee shall enclose the perimeter of said lands, excepting
the southern boundary thereof, with a chain link type fence of a
height of not less than five (5) feet, provided however, that the
eastern and /or western boundaries of said lands need not be fenced if
and so long as contiguous properties to the east and /or west, encum-
bered by similar deed restrictions, are enclosed in such a manner that
the aggregate of the above described lands and said contiguous pro-
perties are enclosed, excepting only the southern boundaries of said
lands.
Said fence shall be deemed to be an extension of the concrete
louvre party fence substantially surrounding Place Au Soleil sub-
division and obligations relative to maintenance thereof and rights
relative to enforcement shall be solely as set forth in Clause III
gB (Maintenance of Party Fence) of the subdivision Declaration of
Protective Covenants, recorded in Official Record Book 729, Page 117,
Public Records of Palm Beach County, Florida, which paragraph is in-
corporated herein by reference.
5. The above described lands shall be maintained as required by
the Town of Gulfstream.
6. These covenants and restrictions may be enforced through resort
to injunctive relief by the Grantor, his heirs, successors and assigns,
and Place Au Soleil Association, Inc., and in any such proceedings the
party obtaining enforcement shall be entitled to recover his reasonable
attorneys fees and costs.
And said Grantor does hereby fully warrants tht title to said land, and
will defend the same against the lawful claims of all persons whomsoever.

The meeting was called to order at 9:05 A.M., and Roll Call
was taken.
A variance request for a wood deck and gazebo for MR. ROBERT
DITTMAN, re Lot #89, Place Au Soleil, was considered. There
was discussion about the owner presenting a Unity of Title

The site plan review (remodeling) was approved.
Variance request of MR. ROBERT H. WIEBELT, 2765 Avenue Au Soleil,
was considered. Mr. Wiebelt and Mr. Dittman appeared before
the Board. There was discussion regarding purchase of contiguous
property. The matter of lighting was discussed, and he was
informed regarding the restrictions on lighting. The Town Clerk
advised that the Town will be advertising and sending letters
to his neighbors and the Home Owners Association before the
matter is approved by the Commission.
Mr. Gordon Ripma and Architect appeared before the Board
regarding LAND VENTURES, LTD., 2600 No. Ocean Boulevard, for
a review of site plans for buildings. Plans were examined.
Mr. Ripma stated that there was a change in the pools. There
was discussion regarding square footage and much discussion
of interpretation of Building Code. The Board was advised that
the Fire Marshal and Ocean Ridge have given approval. The
Chairman stated that he wishes to review the matter with the
Town Attorney and County Building Inspector, and the matter
will be presented to the Commission at their next meeting,
June 10, 1983.

The Board reviewed plans for pool of MR. MARTIN O'BOYLE,
Lot 5, Hidden Harbour. The shape of the pool and pool area
have been changed. Mr. Rubsamen questioned regarding drainage
going into the next property -- possibly a retaining wall and
landscaping is needed. Mr. O'Boyle will have to confer with
the Board before a Certificate of Occupancy is issued.
MR. ALEC T. RIGBY, 588 Banyan Road re review of plans for
seawall repair. This property is on the canal. It will be
necessary to check with D.E.R. as to how far the seawall may
extend in the canal. It was decided that if D.E.R. approval
is received, the Board will recommend approval.
MR. CLAUDE W. RENAUD, 532 Banyan Road, review plans for pool.
He must have a fence to comply with the Code. It has been
approved by the County. Plans were approved.
DR. SELVA GANESH, 2985 North Ocean Boulevard - variance request
for fence. This is to be on the owner's property line. A survey
will be needed.
Mr. Abe Wagner appeared before the Board re W. & PAULINE SWICICKI,
Lot 8, Place Au Soleil, regarding lot size. Mr. Wagner was
advised that the neighbors would have to approve the plans.
There was discussion regarding giving a variance, stating that
same is a buildable lot, subject to approval of the site plan.
It will be necessary for the Board to see a site plan. The
prospective buyer appeared before the Board at this time, and
requested a statement that the old Code will apply. It is a
buildable lot, provided that there are no variances. Mr. Rubsamen
stated that it is a previously platted lot -- lots of record can
be built on. The Town Clerk will forward them a letter and
copy of the Minutes.
MR. BARRY EAVENSON, 915 Emerald Row -- review site plans for
residence on Lot #64, Place Au Soleil. This is not an enclosed
pool. Approval was recommended, with a letter from the Town
stating that it is grandfathered into the Building Code.
The matter will be placed on the Agenda for the next Commission
meeting.

DR. LAWRENCE KLATT, 3777 Gulf Stream Road - review remodeling
plans for residence. He was advised that two sets of plans
will be needed, and they will be submitted to the County and
a fact sheet will be made up. A final survey will have to be
done. The matter was approved.
MR. ANTONIO MEDINA - Lot #2, Hidden Harbour - house site plan
review. Mr. Robert Currie, Architect, and Mr. Medina appeared
before the Board. He was advised that they will need a copy
of the plans. The matter was approved, and site plans will go
to the Commission.
There being no further business to come before the Planning Board,
the meeting was adjourned at 10:50 A.M.
