SUMMARY STATEMENT:
On February 19, 2008, the City received the Memorandum Decision and Order from the District Court on
the Mountain Central Board of Realtors, Inc. vs. the City of McCall on the Community Housing
Ordinances. The judge concluded that Ordinance 819 (Inclusionary Housing Ordinance) and Ordinance
820 (Community Housing Fee) to be void and force and effect. Therefore, staff will prepare the
documents to repeal Ordinance 819 and 820 for Council's consideration at the April 24, 2008 meeting.
A refund policy (resolution) for Community Housing fees paid under Ordinance 820 will be developed for
those who are requesting a refund for funds paid. The refund policy will be presented to Council at the
April 24, 2008 meeting.
A new incentive based community housing strategy is being developed and will move through the public
process according the zoning ordinance amendments [MCC 3.13.051.] The Commission will hold a
public hearing at the May 6, 2008 P&Z meeting and make a recommendation to Council. The incentives
added in to the 2006 Planning and Zoning Code will be connected to Community Housing Plans
accordingly.
