Also enclosed are ten copies of my own variance request and a check for $50.00 as the required fee. I will be away from August 5 through 16, so it may well be that same may have to wait until September to be reviewed by the Planning Board and considered by the Commission; I'll let you work that out since you know when the meeting dates are scheduled. The final matter I'd like to take care of is to get a memo from you to the effect that the Town has approved my request to relocate the fire hydrant in front of my house to my West property line. BOX 2166 Pursuant to 59 -3 Gulf Stream Code, the undersigned, as owner of the pro- perty referenced above and located at 925 Orchid Lane, Gulf Stream, Florida, respectfully requests that the following variances be considered and granted by the Town: 1. That the requirements of SIII(F) (1) of the Gulf Stream Code re- specting side yard set backs be reduced from fifteen (15) feet or fifteen (15) percent of the average footage of lot width, whichever is greater, to not less than twelve (12) feet, excluding porches, overhangs and eaves, but only as to the side yard along the eastern boundary line of Place Au Soleil Lot 89. 2. That the requirements of §III(g) (1) of the Gulf Stream Code re- specting rear yard set backs be reduced from fifteen (15) feet or fifteen (15) percent of the average footage of lot depth, whichever is greater, to not less than twelve (12) feet, as to the north boundary line of said Lot 89. The Petitioner offers the following reasons for this Petition: A. Petitioner desires to construct a second story addition on his home of about 760 square feet of which only 160 square feet will be on property not already improved with the existing residence. The purpose of the addition is to expand Petitioner's family room, add one bathroom, and incidentally relocate one of the four resi- dence bedroom. The total square footage (air conditioned) of the house after the proposed addition is constructed will be approxi- mately 2,750 square feet, excluding porches and garage. B. In order to do this, a variance is sought to reduce side and rear year set backs to essentially what they were when the home was built in 1977. Town of Gulf Stream Page Two RAD/ amf July 22, 1982 C. Filed with the Town Clerk simultaneously herewith is a copy of the Plat of Place Au Soleil and copy of proposed site plan which depicts that 160 square foot portion of the proposed ad- dition which will require additional ground space not already improved, the balance of the square footage to be built over and to the south of the north section of the residence. D. To the north of the property in question is a 100' strip of unimproved property owned by Mr. Eavenson. HARRISBURG, PENNSYLVANIA REED SMITH TOWNSEND & MUNSON PHILADELPHIA, PENNSYLVANIA We are counsel for Ralph Hibbard, the record owner of the property on Shore Road being developed by Harry Teel (Mr. Hibbard's joint venturer). Mr. Hibbard is anxious to complete any work necessary to obtain the certificates of occupancy. My understanding is that following a meeting in late June between Harry Teel, a representative from your office, and a representative from John A. Grant, Jr., Inc., an acceptable arrangement was negotiated by all parties involved. My understanding also was that Mr. Sims from the Grant office was to produce that "agreement" in writing, which I assume would still be subject to your (and the town's) approval. Harry Teel is currently out of town, Mr. Sims has not yet produced any letter, and Mr. Hibbard has represented to us that he is still willing to perform any work which the town requires. Are you in any position to recommend to Mr. Hibbard (and to the town) those changes to the property's drainage system which will be necessary to obtain the certificates of occupancy? I am today sending Mr. Sims information from the manufacturer 2 of the water pump which indicates that the pump can run on a maximum of 14.5 amps.
