SUMMARY STATEMENT:
Staff recommends that Council accept the Whitetail Escrow Agreement and Joint Escrow Instructions, and
Notice of Escrow Agreement. These documents are the final documents settling the eminent domain case
involving the widening of Boydstun Street along the eastern boundary of the Whitetail PUD. Under the
terms of the agreement funds will be collected from lot sales in the PUD and placed into escrow to be used
to install traffic improvements on Hwy 55 as required by the Whitetail Development Agreement.
Accepting the Agreement will result in settlement of the pending eminent domain case.
Attached is the draft escrow document. The signed escrow document will be available for Council and for
The Mayor's signature at the Council Meeting.
RECOMMENDED ACTION:
Accept the Escrow Agreement and Notice of Escrow and authorize the Mayor to sign.
