HomeMy Public PortalAbout2009.114 (06-16-09)RESOLUTION NO. 2009.114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD TO APPROVE AN AGREEMENT TO ENGAGE A CONSULTANT TO CONDUCT A DATA GAP INVESTIGATION AND ACQUIRE A REMEDIAL ACTION PLAN FOR THE SOUTH EAST CORNER OF LONG BEACH BOULEVARD AND THE I-105 FREEWAY WHEREAS, The City of Lynwood approved the Long Beach Specific Plan to encourage development along its major commercial corridor; and WHEREAS, A major disincentive to development along this corridor is the potential existence of hazardous substances and petroleum contamination at various locations along this corridor; and WHEREAS, The owner of 11600 Long Beach Blvd has received several Cleanup and Abatement Orders; and WHEREAS, There is a need to do additional investigation of the contamination along the site area to acquire a remedial action plan and appropriately remediate the contamination known to exist in the area; and WHEREAS, The City of Lynwood distributed a Request for Proposals and acquired four qualified responses; and WHEREAS, The City of Lynwood evaluated the Responses after a full interview and determined that Bryan A. Stirrat and Associates and Gannett Fleming submitted proposals which met the requirements of the Request for Proposals at a reasonable cost; and WHEREAS, The City of Lynwood determined that the experience of Gannett Fleming would assist the City in acquiring the required Remedial Action Plan in an expeditious and appropriate manner if such experience was allowed to be utilized on the site; and WHEREAS, Gannett Fleming will acquire the necessary written releases from the Responsible Parties to ensure a thorough and complete data gap investigation leading to a remedial action plan; and WHEREAS, Any authorization for an agreement with Gannett Fleming is contingent upon Gannett Fleming actually receiving written releases and waivers necessary to ensure a thorough and complete data gap investigation leading to a remedial action plan. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. Authorize the City Manager or his designee to take necessary steps, including the execution of an agreement with Gannett Fleming or Bryan A. Stirrat and Associates to undertake a data gap investigation leading to a Remedial Action Plan or Removal Action Workplan at the Lynwood Springs site. Section 2.
