COUNCIL MINUTES
SEPTEMBER 18,1973
INITIATION:
1. Mayor Tyrell called the regular meeting of the City Council to
order at 7:35 p.m. on Tuesday, September 18, 1973, in the
Council Chamber of the City Hall.
2. The invocation was given by Reverend Dean Grelling, Pastor,
Temple City Southern Baptist Church, 5221 El Monte Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.

Councilman Gilbertson moved to excuse Councilman Briggs for cause,
seconded by Councilman Dennis and carried.
5. APPROVAL OF MINUTES:
Councilman Gilbertson moved to approve the minutes of the regular
meeting of the City Council held on Tuesday, August 28, 1973, as
written, seconded by Councilman Merritt and carried.
Councilman Merritt moved to approve the minutes of the adjourned
meeting of the City Council held on Wednesday, September 12, 1973,
as written, seconded by Councilman Gilbertson and carried.
Boy Scout Troop No. 164 was given recognition by Mayor Tyrell who
presented a special certificate to the group. Peter Williams, Senior
Patrol Leader and Eagel Scout, gave a short history of Troop No 164,
which is sponsored by Las Flores Ward, Church of Jesus Christ Latter
Day Saints and introduced Scoutmaster, Mr. Clyde McKelvie, and Jim
Cutler, president of the troop's newly organized venture post.
6. PUBLIC HEARING: 7:30 p.m. AMEND TEMPLE CITY MUNICIPAL CODE RELATING
TO ZONE CLASSIFICATION FOR AUTOMOTIVE STEAM CLEANING
City Manager Koski presented background information, stating the
Planning Commission, at their regular meeting of August 14, 1973,
passed Resolution 73 -517PC recommending an amendment to the
Municipal Code to include steam cleaning operations, conducted
within an enclosed building, as a permitted use in the M -1 Zone.
Planning Director Dragicevich advised that this use is not specifi-
cally included in any zone and does not fit into the definition of
"service station" in Section 9126 of the Zoning Code; that the
Planning Commission recommends automotive steam cleaning be regarded
as a permitted use in the M -1, Light Manufacturing Zone, provided
they are located within an enclosed building.
Following discussion regarding steam cleaning as incidental to car
wash operations and steam cleaning as the sole operation, Council-
man Gilbertson moved to refer the matter back to the Planning
Commission for clarification of steam cleaning as an incidental
use with car washes which are permitted in the C -3 zone and continue
Public Hearing to the regular City Council meeting of October 16,1973,
seconded by Councilman Merritt and carried.

7. PUBLIC HEARING: 7 :30 p.m. AMEND ORDINANCE TO INCLUDE LIVING
QUARTERS AS AUXILIARY USE TO MORTUARIES WITH CONDITIONAL USE
PERMIT APPROVAL
City Manager Koski presented_ background information, stating the
Planning Commission, at their regular meeting of August 14, 1973,
passed Resolution No: 73-518PC recommending an amendment to the
Temple City Municipal Code to include living quarters as an
auxiliary use to mortuaries with a conditional use permit; that
City Council, at their regular meeting held August 28, 1973, set
public hearing.
Mayor Tyrell declared the Public Hearing open and invited those
present who wish to speak for or against the request to come
forward.
Mr. Louis Randall, Lee R. Hill Mortuary, 5800 Temple City Blvd.
stated he is interested in enlarging the number of living quarters
at the Mortuary to two to accommodate employees since the nature
of the business requires someone to be on duty at all times.
There being no one else in the audience come forward to speak,
Councilman Gilbertson moved to close the public hearing, seconded
by Councilman Dennis and carried.
City Attorney Martin presented Ordinance No. 73 -377 AN ORDINANCE
OF THE CITY OF TEMPLE CITY ADDING NEW PARAGRAPH 23A TO SECTION
9202 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO CONDITIONAL
USES by title only. Councilman Gilbertson moved to waive further
reading, seconded by Councilman Merritt and carried.
8. AMENDMENT TO THE BRADLEY -BURNS LOCAL SALES AND USE TAX
City Attorney Martin presented background information, advising
the State Legislature enacted a law which repealed and re- adopted
provisions of Sections 7202 and 7302 of the Revenue and Taxation
Code which contain the required provisions of each city and county
ordinance enacted pursuant to the Bradley -Burns Uniform Local Sales
and Use Tax Law. Accordingly, all ordinances must be amended to
conform to the requirements set forth in Chapter 1406 prior to
January 1, 1974; any city which has not amended its Bradley -Burns
Ordinance will cease to be a conforming city and will lose its
Bradley -Burns revenue for at least three months.
City Attorney Martin presented Resolution No. 73 -1304 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PROVIDING FOR ALL
FUNCTIONS INCIDENT TO THE ADMINISTRATION AND OPERATION OF LOCAL
SALES AND USE TAXES, AND AUTHORIZING EXECUTION OF A CONTRACT
WITH THE STATE BOARD OF EQUALIZATION WITH RESPECT THERETO.
Councilman Merritt moved to adopt, seconded by Councilman Gilbertson
and carried.
City Attorney Martin presented Ordinance No. 73-378 AN ORDINANCE
IMPOSING A SALES AND USE TAX TO BE ADMINISTERED BY THE STATE
BOARD OF EQUALIZATION AND PROVIDING PENALTIES FOR VIOLATIONS by
title only. Councilman Merritt moved to waive further reading,
seconded by Councilman Gilbertson and carried.
9. RECOMMENDATION FROM PLANNING COMMISSION - MEETING OF SEPTEMBER 11,1973 -
CLARIFICATION OF AMBIGUITY, PLANNING COMMISSION RESOLUTION 73 -523PC
City Manager Koski advised the Planning Commission received a request
for permission to locate a scuba diving school and corporate offices
on C -2 property. Presently the Temple City Zoning Ordinance permits
business colleges, dance academies, music instruction and other
commercial schools in the C -2 zone, but is not specific as to the
requested use. Planning Commission passed Resolution No. 73 -523PC
recommending scuba diving schools with an accessary pool be added

to Section 9390 (51) of the Municipal Code.
Councilman Gilbertson moved to approve recommendation of the
Planning Commission, seconded by Councilman Dennis and carried.
10. SET PUBLIC HEARING: STREET IMPROVEMENTS (Curb, Gutter and Driveway
Approaches, pursuant to Chapter 27, Streets and Highways Code)
A. LONGDEN AVENUE, south side, Eaton Wash to Rosemead Blvd.
B. LONGDEN AVENUE, both sides, Rosemead Blvd. to Loma
C. AGNES AVENUE, west side, La Rosa Drive to Key West
D. CLOVERLY AVENUE, east side, Live Oak to Wedgewood
Councilman Gilbertson moved to set Public Hearing for Street
Improvement for above named projects for Tuesday, October 16, 1973,
7:30 p.m., seconded by Councilman Merritt and carried.
11. RESOLUTION NO. 73 -1305 - EMPLOYMENT OF PERSONNEL
City Manager Koski presented Resolution No. 73 -1305 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL.
Councilman Dennis moved to adopt, seconded by Councilman Gilbertson
and carried.
12. RESOLUTION NO. 73 -1306 - WARRANTS & DEMANDS, Demand Nos. 8526
through 8635 in the amount of $58,505.90.
City Manager Koski presented Resolution No. 73 -1306 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS
AND DEMANDS IN THE SUM OF $58,505.90, DEMAND NOS. 8526 THROUGH
8635. Councilman Gilbertson moved to adopt, seconded by Council-
man Merritt and carried.
13. COMMUNICATIONS:
City Council received and filed letter from Supervisor Schabarum
concerning a phased construction program for the improvement
of Lower Azusa Road between Eaton Wash and El Monte Avenue.
14. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Mayor_ Tyrell introduced Lt. Richard Wallace, Los Angeles County
Sheriff's Department, recently assigned to the Temple Station
and liaison to the City Council.
15. MATTERS FROM CITY OFFICIALS:
A. REQUESTS FOR PROCLAMATIONS
City Manager Koski presented letters requesting proclamations
from two organizations. City Council supported the Mayor pro-
claiming the month of October as PTA MEMBERSHIP MONTH and the
week of September 24 -30 as CALIFORNIA TRAFFIC SAFETY WEEK.
B. LEAGUE OF CALIFORNIA CITIES CONFERENCE - OCTOBER 21 -24, 1973,
SAN FRANCISCO
City Manager Koski advised that registrations for the League
of California Cities Annual Conference to be held in San Francisco
from October 21 -24, 1973, were now due, and requested authorization
for official representatives, Councilmen, Commissioners and staff,
to attend, as set forth in the budget. Councilmen Gilbertson
moved to approve, seconded by Councilman Merritt and carried.
Funds were also requested for expenses for Commissioner Greenberg
to attend the California Association of Park and Recreation
Commissioners and Board Members mid -year meeting to be held two

days in advance of the League Conference. Councilman Gilbertson
moved to approve, seconded by Councilman Dennis and carried.
C. CALL DIRECTOR TELEPHONE SYSTEM
City Manager Koski presented a report of projected costs and
savings to implement a call director telephone system as discussed
at a previous study session. Councilman Gilbertson moved to
approve the telephone system change and amend the budget accordingly,
seconded by Councilman Dennis and carried.
D. ATTENDANCE TO PARKS AND RECREATION INSTITUTE - ASILOMAR,
NOVEMBER 4 -9, 1973
City Manager Koski presented request for authorization for Director
of Parks and Recreation to attend the Parks and Recreation
Administrators Institute, November 4 -9, 1973, in Asilomar, California,
a budgeted item. Councilman Merritt moved to approve, seconded by
Councilman Gilbertson and carried.
E. ICMA ANNUAL CONFERENCE - BOSTON, MASS., SEPTEMBER 23 -27, 1973
City Manager Koski presented request for authorization to attend
the ICMA Annual Conference to be held in Boston, Mass.,
September 23 -27, 1973. Councilman Dennis moved to approve request,
seconded by Councilman Gilbertson and carried.
F. 1972 -73 FY SIDEWALK PROGRAM - ACCEPTANCE OF WORK
A. ARDEN DRIVE, Olive to Lower Azusa Road
B. BROADWAY, Golden West Avenue to Temple City Blvd.
C. OLIVE STREET, Baldwin to Halifax Road
D. GARIBALDI AVENUE, Temple City Blvd. to Oak Avenue
City Manager Koski reported that construction of the sidewalk
and driveway approaches on subject streets is now complete;
that a letter of acceptance has been received from the Los
Angeles County Road Department, who provided the inspection
for the projects. Councilman Gilbertson moved to accept the
work completed by Louis Lopez Company; to authorize filing of
Notice of Completion with the County Recorder within 10 days;
to authorize payment in the amount of $19,476.99; and authorize
release of ten percent retention in the amount of $2,164.11 at
the end of '35 day lien period, seconded by Councilman Merritt
and carried.
G. Councilman Gilbertson called staff's attention to the
deteriorating condition of the 24 -hour flag in Temple City Park,
and was advised that a new flag is on order. Councilman Gilbertson
also requested staff investigation of a reported site obstruction
at the northeast corner of Encinita and Garibaldi Avenues.
H. Councilman Dennis expressed appreciation for flowers sent
to Mrs. Dennis following her recent accident.
I. Mayor Tyrell asked each of the Councilmen to make a personal
call to those persons the individual Councilman had invited to
the Community Seminar to be held on October 13, 1973, encouraging
their participation.
Mayor Tyrell also brought to Council's attention the Picnic /Band
Concert to be held at Temple City Park, Saturday, September 22.

16. ADJOURNMENT:
On motion of Councilman Gilbertson, seconded by Councilman Merritt,
and carried, the Council adjourned to a study session at 8:15 p.m.,
following which they adjourned to the next regular meeting of the
City Council to be held on Tuesday, October 2, 1973, at 7:30 p.m.
in the Council Chamber of the City Hall.
