Attached are several documents for the Council's further consideration: 1. Memo dated August 8, 2008 from Lindley Kirkpatrick 2. Letter dated August 8, 2008 from Deborah Nelson, representing Mile High Marina, LLC and Snowy Peaks, LLC/Brown's Industries, Inc. The issue before the Council is whether either MGSI or Mile High Marina have already obtained approval from the City to submit a land use application, or if they have only obtained approval to negotiate a lease, or if they have some other agreement with the City. The relevant documents were provided to the Council on August 1 and are the 1995 Memorandum of Understanding between the City of McCall and McCall Gas Station, Inc. and the 2007 Mile High Marina lease extension. Council should accept public comments on two limited questions: 1. Does the 1995 MOU between the City of McCall and MGSI authorize MGSI to submit conditional use permit and design review applications for a new marina? 2. Does the 2007 Mile High Marina lease extension authorize Mile High Marina to submit conditional use permit and design review applications for an expanded marina? If the answer to either question is `yes', then the applicants have the permission of the landowner — the City of McCall — to make the land use applications. If the answer to either question is `no', then the applicants must obtain permission from the City prior to submitting any land use applications. RECOMMENDED ACTION: Provide direction to staff, Mile High Marina, and McCall Gas Station, Inc.
