Be cautious of opening attachments and clicking on links.  The link below is to a San Mateo County Civil Grand Judy report regarding Caltrain grade separations that might be of  interest to you.    ‐‐‐‐‐‐‐‐‐‐ Forwarded message ‐‐‐‐‐‐‐‐‐    Subject: 2018‐19 SMCo. Civil Grand Jury on Caltrain grade seps  Just FYI:    GRADE SEPARATIONS – BYPASSES TO GREATER SAFETY  2018‐2019 San Mateo County Civil Grand Jury    A new, corridor‐wide approach that balances Caltrain’s needs with those of the three counties in the Caltrain Peninsula  train corridor is needed. The Grand Jury recommends:     1. The PCJPB create a Caltrain Peninsula train corridor Grade Separation Master Plan, including all at‐grade crossings in  the corridor, based on a prioritization that takes into account the needs and special circumstances of the cities and  counties through which the corridor passes, with special attention to adjacent at‐grade crossings so as not to limit future  design alternatives.    2. In support of developing the Grade Separation Master Plan, the PCJPB should study other train corridors worldwide to  learn how they implemented similar master plans, including methods developed for securing funding.    3. The PCJPB should engage with all cities on the Caltrain Peninsula train corridor to gain support for the Grade  Separation Master Plan.    4. After completing the Grade Separation Master Plan, the PCJPB should offer to support funding and design efforts to  the cities in the order determined by the prioritization in the master plan. If a city rejects such support for an at‐grade  crossing, the PCJPB should then proceed to support the next highest priority at‐grade crossing in the plan.    Despite the importance the public puts on completing grade separations, a range of responses among cities were aired  during grand jury interviews. For example:   San Mateo (City) obtained funding and is completing a grade separation.   Menlo Park has analyzed design alternatives for decades.   Atherton does not currently have plans to undertake grade separations. However, “Atherton supports grade  separations at its two at‐grade crossings, and it does not have a source of funding to complete grade  separations. If grade separations at those at‐grade crossings were proposed and funded by other agencies, the  Town would support them.”    2 With the current city‐by‐city approach, grade separation projects emerge where there is local interest, political will,  grade separation project expertise and funding, and not necessarily where there is the most potential positive impact.  Further, the current approach does not take into account the impact that a grade separation’s design in one city will  have on the available design alternatives in a nearby city. For example, if Menlo Park constructed an elevated grade  separation at Ravenswood Avenue, then Atherton would be limited in the design alternatives it could consider.     Adopting a corridor‐wide grade separation master plan will have challenges. It is clear from grand jury interviews with  SMC city managers that some cities would resist a regional approach if it meant receiving a lower priority status for their  city’s grade separation project(s).   1 Brettle, Jessica From:holly kim <kimhol@yahoo.com> Sent:Monday, July 15, 2019 11:34 AM To:Talley, Eric Cc:Silva, Jorge; Council, City Subject:Re: 3241 South Court Plumbing Problems CAUTION: This email originated from outside of the organization. The Professorville neighborhood would like to remind Staff and Council that a robust and transparent traffic study, with effective traffic mitigations, was promised. A stated criteria throughout this process has been to maintain or improve local access and reduce the impact of regional traffic on neighborhood streets. Our 1100 block of Emerson St. repeatedly asked Staff for a meeting with the former traffic consultants to discuss mitigation options for the already heavily congested and dangerous clover leaf of Alma, Lincoln and Emerson St., but to no avail. Therefore, we continue to request a meeting with Staff, AECOM and Hexagon Transportation Consultants for them to explain, in-person, their traffic findings regarding the impacts to these streets and their proposed mitigations if Churchill is closed. Further, why should Churchill be closed at all or 24/7? What are the specific traffic findings that support full closure versus partial closure versus no closure? The Professorville neighborhood would like to remind Staff and Council that a robust and transparent traffic study, with effective traffic mitigations, was promised. A stated criteria throughout this process has been to maintain or improve local access and reduce the impact of regional traffic on neighborhood streets. Our 1100 block of Emerson St. repeatedly asked Staff for a meeting with the former traffic consultants to discuss mitigation options for the already heavily congested and dangerous clover leaf of Alma, Lincoln and Emerson St., but to no avail. Therefore, we continue to request a meeting with Staff, AECOM and Hexagon Transportation Consultants for them to explain, in-person, their traffic findings regarding the impacts to these streets and their proposed mitigations if Churchill is closed. Further, why should Churchill be closed at all or 24/7? What are the specific traffic findings that support full closure versus partial closure versus no closure? I’ve raised my kids here as well, and am now beginning the empty nest stage of life. I must say that while Palo Alto has many things to credit it, being a dog owner here is not one of them. As a responsible, and generally law-abiding person, I am unable to allow my dog to play off leash anywhere near or walking distance to my neighborhood. After a long day of work, my dog- owning neighbors and I are required to either get back into our cars and fight increasingly dense Palo Alto traffic to get to Peers Park or other legal off leash areas in neighboring cities or risk being stopped by animal control in our own neighborhood park or at a school yard. This is more than bad for us, this is bad for the environment as well.   There is clearly a desperate need for more off leash areas, and dog owners feel this intensely on a daily basis. Allowing our dogs to run off leash, to chase a ball or play, is not optional for us. My dog is young, very social and playful and wants nothing more than a chance to play at least once a day. No matter how long I walk her, a play session would do so much more for her and for me. I would get a chance to meet with neighbors that I would otherwise never see. My own mood is always uplifted by the interaction with familiar faces that I see regularly. If I drive to distant parks it is difficult to establish any consistent relationship or sense of community with other dog owners. A dog enclosure at Pardee or even some legal off-leash hours in the evening at a local school yard would benefit the community and the emotional health of so many of its dog owning residents. It would also benefit those who do not like off-leash dogs running loose as there would be a viable alternative.  I realize that the issue of a dog park at Pardee has been raised before, I attended those meetings several years ago, led by Howard Hoffman. He did great work in helping us get Peers 2 Park rolling and that was a very good thing. I realize Pardee is controversial but the problem of off-leash dogs there will not go away unless an enclosure is added. Right now dog owners do not have a viable alternative. We need to exercise both ourselves and our dogs. Having a destination to walk to, release dogs for a bit to socialize, then continue onward to home gives everyone a mental health break. Getting in the car does no such thing. I hope you will consider giving this subject a hearing. Please let me know how best to proceed. I have met with Howard Hoffman and Daren Anderson at the Open Space office and we are trying to move the needle forward on more dog parks and possibly the idea of a temporary ‘pop up’ dog park. One man, Mr Gaston, was a high‐ranking officer in the Lucas County, Ohio, sheriff’s department with 34 years  of experience.  The other was a security guard contracted to protect an Internal Revenue Service (IRS) office in Toledo.  But then the guard pulled his gun. He raised his voice. He put a hand on Mr Gaston’s arm and rested his finger  on the trigger.  In a matter of seconds, what began with a routine errand at the IRS escalated into a frightening standoff  between a white security guard and a black police officer, who said he heard hate in the guard’s shouts and  believed he would be shot.  “You don’t expect to be ambushed by someone who you think is on the same team,” Mr Gaston told The  Washington Post.  “I feel there was definitely some racial overtones involved. And I’m not the type of person to throw the race  card, I’m just telling you the facts. I looked in his eyes and I saw hate in his eyes.”  He had stopped by the IRS office during his shift on 31 May to ask a question about a letter the agency sent  him.  He was in full uniform, his badge and his firearm in clear view.  The security guard, identified in court documents as Seth Eklund, asked Mr Gaston to leave his gun in his patrol  car.  When Mr Gaston replied he couldn’t do that, he said Mr Eklund became hostile. Mr Eklund accused Mr  Gaston of reaching for his weapon, shouting “get your hands off your gun”, even though Mr Gaston said his  hands were visible and nowhere near his holster.  Mr Gaston, who has years of experience teaching defensive tactics, decided it was time for him to leave.  He recalled a wide‐eyed elderly couple in the office waiting room watching the exchange, and he said he feared  for the bystanders’ safety. Mr Gaston turned to go.  2 As he walked out of the cramped office, Mr Eklund drew his gun, trained it on Mr Gaston’s back and  followed him. At one point, Mr Gaston said, Mr Eklund tried to arrest the uniformed officer.          “He came around the corner with his weapon out, telling me, ‘you had your chance, you’re not going  anywhere, I’m detaining you’,” Gaston said.    “That’s when I was preparing myself to be shot. The hate and anger he had against me, I was getting ready  to be shot by this security guard for no reason.”    Mr Eklund, who could not be reached for comment, pleaded not guilty to one charge of aggravated menacing  in a court appearance on Monday.  Mr Gaston and his wife have also filed a lawsuit against Mr Eklund and the two security firms that apparently  employed him.  Representatives of those companies, Paragon Systems and Praetorian Shield, did not respond to requests for  comment. The IRS declined to comment.  The local news station WTVG published what it claims to be security camera footage of the interaction and The  Washington Post obtained screenshots of the video.  The images show Mr Gaston backing away and attempting to leave the building in an elevator. But Mr Eklund,  gun still drawn, blocks the door with his foot.  Mr Gaston says he felt cornered, scared. He took out his phone to take a picture of Mr Eklund, he said, and the  security guard finally holstered his weapon.  Heather Taylor, president of the Ethical Society of Police in St Louis, said that Mr Eklund behaved recklessly  and likely would not have treated a white officer the same way.  “We know what it’s like being an African American police officer in a city,” Ms Taylor said. “A lot of us realize  that, hey, even though you’re in uniform, that doesn’t mean you’re safe.”    The tense scene recalled other, infamous incidents with grisly endings. Ms Taylor pointed to the case of Jemel  Roberson, a black security guard who was killed by a Midlothian, Illinois, police officer while they both  responded to a shooting at the bar where Roberson worked.  She also mentioned Detective Jacai Colson in Maryland, who was killed by a fellow officer while working  undercover. Mr Colson, according to a lawsuit, had his badge in his hand and was shouting “Police! Police!”  before he was killed.    3 “You’re not given the benefit of the doubt as a minority,” Ms Taylor said. “It’s something we’ve been  highlighting forever and now here’s another example of it.”  She applauded Mr Gaston’s cool demeanour in the face of what she said was potentially lethal bigotry.  Mr Gaston said he didn’t feel that Mr Eklund respected him as a law enforcement officer, and in more than  three decades of police work has never dealt with anything like that.  He was diagnosed with post‐traumatic stress disorder and severe depression, he said. He’s been on medical  leave and is seeing a counsellor twice a week. The civil suit Mr Gaston and his wife filed seeks compensation.  The standoff between Mr Gaston and Mr Eklund ended, he said, when Toledo police officers responded to a Yesterday, I drove down Arastradero/E. Charleston from El Camino Real to Middlefield, which is my route to work.  I was  shocked by the mess that has been created on the street, jeopardizing the safety of bikers, drivers and pedestrians.  In  my wildest imagination, I cannot figure out the goal of such construction.  I drive a small Prius and found the street a  veritable obstacle course which took every ounce of my concentration to remain in my lane.  The slightest mishap would  result in potentially hitting a cyclist in the narrow bike lane.  Why in the world would one put concrete medians in the street thereby narrowing the lanes and bike lanes?  Not only  that, the street twists and turns and is not straight.  I am a teacher and teach my second graders the shortest distance  between two points is a straight line.  Why have drivers navigate such a difficult road?  I would appreciate understanding the engineering and science behind this plan.  If the goal was traffic calming, a safety  hazard has been created in lieu of calming.  Effectively, what has been accomplished is to push more cars onto E.  Meadow past two schools because E. Charleston is such a nightmare.  Can you please explain to me what the goal of this  costly project is and how will the effectiveness of the goal be evaluated? Be cautious of opening attachments and clicking on links.  Opposition to the Foothills Park item proposing open access for non Palo Alto residents.      To the Parks and Recreation Commission and the City Council:    I am a resident of Palo Alto.    From prior reading on this subject, I understand that the City of Palo Alto purchased Foothills Park with past City of Palo  Alto residents' taxpayer dollars and that maintenance of the park is accomplished via current City of Palo Alto resident  taxpayer dollars.  And I assume that any prospective maintenance costs for the park would be borne by the resident  taxpayers of the City of Palo Alto.     Thus, I believe that it is appropriate and necessary to maintain the procedures currently in place regarding access to  Foothills park solely to City of Palo Alto residents, particularly since the unique park could easily be prone to wildfire and  abuse, given its location and its foliage, which would then impose further costs on City of Palo Alto residents.    Foothills park was purchased, at least in some measure, to provide recreation for the residents of the City of Palo Alto,  whose labor, in the form of tax dollars, was used to purchase it.  Thus let it remain so.     Palo Alto Unified School District schools are limited to residents and students enrolled via a legal settlement; do City of  Palo Alto utility workers work on other cities' utility infrastructure? Do City of Palo Alto police officers police other cities'  streets? If so, as a taxpayer I object, and ask that other cities' residents pitch in for services we Palo Alto residents and  taxpayers finance.    Please respect the contributions of your residents and taxpayers by continuing the current Foothills park policies in place  regarding access.  Please do not impose extra costs on your taxpayers by allowing free and open access to all residents  of California, the US and the world community, without imposing a commensurate offsetting contribution. Any  contemplated access charge for non residents could be structured such that it would go toward paying taxpayers back  for the purchase made of the park, for the ongoing maintenance of the park, and for the risk of further cost being  assumed by permitting wider access.     If you do want to consider imposing extra potential cost on your resident taxpayers by allowing greater access without  commensurate contribution, please allow those who would finance this cost to vote on whether they agree to have their  tax dollars  be used for this purpose, and to assume increased maintenance costs for the park due to a changed policy.     Thank you,    Best,    Kathy Jordan  1 Brettle, Jessica From:Sven Thesen <sventhesen@gmail.com> Sent:Friday, July 19, 2019 5:34 PM To:Council, City Cc:Project Green House Interns; Vanessa Warheit; Elvert, Catherine Subject:Any Council Members Available Saturday, 2-4pm for a Palo Alto Celebration? Be cautious of opening attachments and clicking on links.  Dear Councilmember Kou,      Please find here Preliminary Comments/Suggested Edits to the SCSC Plans ‐ as these develop ‐ for their Mission and  Strategic Plan (attached).     Suggested edits    I urge the City to please have City Attorney Molly Stump review the roundtable Draft and to  consider the following, as  this plan develops.     1) Background ‐ Paragraph 1:    Reflect that Nextgen impacts ensued in 2014 which is when the NorCal OAPM finished (April 2014). SFO has  acknowledged that they were making changes already in 2014. Altitudes were lowered in 2014, and new  instrument flight procedures went into effect and changes in BDEGA were also happening. Eventually data has  also proven this, and can re‐prove it.    The original Draft states that RNAV allows for reduced separation and concentration which sounds a bit like  permission? It would be more accurate to mention that RNAV allows for the precision and control of flight paths  which resulted in reduced separation of aircraft, and concentration. I realize this is nuanced but an important  order of events.   Several of the new procedures utilize area navigation (RNAV) technology, which allows for more precision and control of air traffic  operations. The new flight procedures reduced separation between aircraft in flight and more concentratedion air traffic.  on  variousarrival pathsof aircraft flight paths. Consequently, people living in communities beneath these modified flight paths began  experiencing an increase in aircraft noise.      2) Proactive Approach Paragraph 1:    The Roundtable will serve as "a" forum as opposed to "the" forum because per FAA's own community  engagement documents roundtables are one of many ways that FAA is to engage with the public not "the" way  (or only way).    The Draft mentions "monitoring" Select Committee recommendations which is carte blanche on how FAA  interprets the SC recommendations. God forbid that PIRAT had caused a real accident (as the procedure was  deemed unsafe almost immediately) it would have been blamed on the noise people. Nobod  intended for PIRAT  to be what it is now ‐  to be designed merely with one day's flight track data, or for FAA to take away OTA (which  2 is actually quiet). The Roundtable can't be merely a monitor but must inject perspective and context. There  may be better (stronger) language for this but I suggest adding The Roundtable will proactively engage with the FAA  to maintain regular communication and status updates on the recommendations and to ensure that the intended outcomes  of addressing community concerns are observed.    FAA and its advisors MITRE use the distinction of noise reduction (for things that are done at the source like  reducing engine noise) and noise management (for say procedures which are quieter). Will help if the  roundtable aligns the language to what FAA and industry use as they are very different propositions for them  (reduction versus management). The Roundtable will track the development of aircraft noise reduction technologies  for both noise reduction, and noise management, and encourage compatible land use planning efforts among member  communities.  3) Guiding Principles     Mission: The Draft makes comments about setting policies. A lot of this language seems incorrect because the  SCSC cannot make up policies for airspace actions. Instead they should really focus on protection the public by  having the laws of the land observed and done better.     4) Goals, Action Items, Resources, and Desired Results   Goal 1: Select Committee on South Bay Arrival and the South Flow Ad Hoc Committees while observing and being sensitive to community needs for adequate environmental review and enhanced community engagement. Upon adoption, the Strategic Plan will be used to help guide the Roundtable’s work over the next three years. In support of that work and in keeping with Objective 3 of the Roundtable’s Memorandum of Understanding (MOU), a separate Work Program has been developed to analyze and evaluate the impacts of aircraft noise in affected communities and to make recommendations to appropriate agencies for implementation of effective noise mitigation actions. Both documents will be employed by the Roundtable to guide its efforts in addressing noise impacts to Roundtable member communities. Background The Roundtable was convened beginning on February 27, 2019, to foster collaboration among communities in Santa Clara and Santa Cruz Counties for the purpose of resolving aircraft noise issues. In 2007, the Federal Aviation Administration (FAA) began modernizing the nation’s air transportation system through implementation of the Next Generation Aircraft Transportation System (NextGen). As part of NextGen, the FAA implemented the Northern California Optimization of Airspace and Procedures in the Metroplex (NorCal OAPM or Metroplex) project. Beginning in 2015, the NorCal Metroplex Project introduced new aircraft arrival and departure procedures serving San Francisco International Airport (SFO), Oakland International Airport (OAK), Norman Y. Mineta San Jose International Airport (SJC), and Sacramento International Airport (SMF). Several of the new procedures utilize area navigation (RNAV) technology, which allows for reduced separation between aircraft in flight and more concentration of aircraft flight paths. Consequently, people living in communities beneath these flight paths began experiencing an increase in aircraft noise. In response to complaints from communities in the South Bay and Santa Cruz areas, Congressional Representatives Anna Eshoo, Jackie Speier, and former Congressional Representative Sam Farr, in coordination with the Cities Association of Santa Clara County, convened the Select Committee on South Bay Arrivals (Select Committee) in 2016 to address noise complaints arising from aircraft arrival and departure procedures serving SFO. The Select Committee issued its final report in November 2016, which included several recommendations for addressing aircraft noise in the South Bay Area. Subsequently, the City of San Jose formed the Ad Hoc Advisory Committee on South Flow Arrivals (Ad Hoc Committee) in 2017 to address noise issues associated with aircraft operations at SJC. The Ad Hoc Committee issued its final report in May 2018. Both the Select Committee and Ad Hoc Committee final reports were submitted to the FAA for their consideration in making changes to how aircraft operate in and out of regional commercial service airports. One of the recommendations made in the Select Committee’s final report was the formation of a permanent roundtable to address aircraft noise issues in the South Bay area and Santa Cruz County. In June 2017, Congressional Representatives Anna Eshoo, Jimmy Panetta, and Ro Khanna asked the Cities Association of Santa Clara County (Cities Association) to form a permanent Roundtable. In October 2018, the Cities Association Board of Directors voted to initiate the formation of the Roundtable. The Roundtable will endeavor to monitor and comment on proposed local, state, and federal legislative and regulatory actions associated with aircraft noise and airport land use compatibility. This may include actively tracking proposed aircraft noise legislation/regulations and providing comments to the relevant agency. The Roundtable will track the development of aircraft noise reduction technologies and encourage compatible land use planning efforts among member communities. Guiding Principles The Roundtable will use these guiding principles in conducting business over the next three-year period: 1. The Roundtable as a public forum serves as a focal point of information and discussion between local, state, and federal legislators, federal agencies, and policy makers, regarding airport/aircraft related noise impacts to its member communities. 2. The Roundtable is dedicated to discussion, study, analysis, and evaluation of policies, procedures, and mitigation actions that will minimize aircraft noise impacts to residents of Santa Clara and Santa Cruz Counties. 3. Goal Number 4 – Work Collaboratively with the FAA: While the Roundtable understands that it is contrary to FAA policy to move aircraft from over one community to another in order to alleviate noise impacts, the Roundtable is committed to working collaboratively with the FAA to address aircraft noise concerns and environmental issues through both procedure revision or development and policy revisions. Action Item: The Roundtable will strive to work with the FAA to address aircraft noise and environmental issues through adjustments to aircraft arrival and departure procedures, development of improved procedures that take aircraft noise impacts and environmental issues into account, and policy changes that will help improve the noise environment in member communities. Resources: Roundtable staff time. Desired Results: An overall reduction in objectionable aircraft noise and environmental issues in Roundtable member communities and the region as a whole. Strategic Plan Amendment Process The Strategic Plan is intended to provide guidance to the Roundtable over the next three years. The Work Program, intended to be used in tandem with the Strategic Plan, has an annual focus, allowing for adjustments and changes in the short term while upholding the long-term goals of the Strategic Plan. Because of the long-term nature of the Strategic Plan and the dynamic nature of the environment in which Roundtable communities are situated, there may be need to amend the Strategic Plan before completion of the three-year period of applicability. In this event, The Roundtable will convene a Strategic Plan Subcommittee to discuss any changes that may be needed to the Strategic Plan, and to identify and develop proposed changes to be recommended for full consideration by the entire Roundtable. City of Palo Alto and City Councilmembers: I noticed when a candidate for President was criticized after a police shooting that the policy of the South Bend police department was changed to encourage - but not require - the use of body cameras by police in the field. I then asked for my city's policy and now see online the policy of the Palo Alto police department (Section 446). Each such policy is designed to protect officers from false accusations and to secure evidence of wrongdoing by non-officers. The policies are not designed to moderate police behavior. Officers are not required to turn on the cameras. And so if an incident arises of alleged or possible police error or misconduct, there may well be no video or audio evidence - only perhaps an expensive lawsuit. On a related topic, I see that last October this City Council adopted (on second reading) an ordinance concerning the use of surveillance technology - including cameras at City Hall.
