The meeting was called to order at 9:00 A.M. and roll call was taken.
The following matters were considered:
Staley - 2435 North Ocean Boulevard. Introduction of new owners and discussion
of development concept. The representative for the owner appeared and submitted
conceptual plans and photographs of similar designs used elsewhere. He indicated
that a single family design structure comprising six to seven dwelling units would
Cbe built on the site. The Board stated they would favor the single family design
and would work with the developer when plans are submitted for review. No Board
action was required at this time.
Pugliese - 1511 North Ocean Boulevard. Site plan review - Guest house addition.
Plans and elevations, showing uniformity with existing roof line, building line,
and structural design were submitted for review and action. After a brief dis-
cussion the Board unanimously voted to recommend that the Town Commission approve
the request as submitted.
O'Boyle - 19 North Hidden Harbour Drive. Preliminary Site Plan Review. Prelim-
inary plans were submitted to the Board for their review and comment. After
considerable discussion it was determined that the plans as submitted did not
meet required front and side yard setback requirements. No action was necessary
at this time, however, the Board indicated that they would not look favorably
upon the request and suggested that the applicant redesign the proposal prior to
submittal of the plans for formal site plan review.
Rigby - 588 Banyan Road. Request for hedge extension. Mr. Rigby was present to
discuss his request to extend an existing hedge along his north property line.
After considerable discussion it was determined that the proposed extension
would further encroach upon public right -of -way and would reduce his driveway
entrance width to twelve (12') feet. The Board voted to recommend approval of
the request contingent upon a favorable response from the fire department with
regard to the access width, and upon the Town Commission's favorable action
regarding the sale to Mr. Rigby of that portion of the existing right -of -way
which has been incorporated into his overall site and lot design and is currently
being utilized by him as parking and driveway.

Comprehensive Plan and Evaluation and Appraisal Report Update
Mr. Caputo, Town Management Assistant and Planning Consultant reported to the
Board the current status of Evaluation and Appraisal Report and Comprehensive
Plan update. He indicated that he had met with officials of the State Depart-
ment of Community Affairs for a preliminary response on the format and content
of the work done thusfar. The State has questions regarding the Recreation,
Housing, Coastal Zone Management, and Fiscal Sections of the report. Mr.
Caputo informed the board that work is progressing toward the resolution of
these issues.
There being no further business to come before the Planning Board, the meeting
was adjourned at 10:30 A.M.

Dear Mrs. Gwynn:
At your request, I have reviewed the drawing of proposed improvements
at the end of Banyan Road and have made an on -site evaluation of the
property owners request to restrict the access to a portion of the
town's existing cul -de -sac. While the design that is proposed is very
pleasing from the standpoint of aesthetics, there are other considerations
which may have greater merit.
First of all, the private circular driveway should not be considered
for turning purposes for several reasons. A fire vehicle, garbage truck,
some ambulances and any trucks of the larger variety could not use
the driveway due to trees and shrubs that are too low to pass under
and too close to the pavement on both sides of the narrow driveway.
The circle is also too tight to negotiate without leaving the pavement
or having to seesaw back and forth. In addition, the very heavy vehicles
such as the fire trucks and garbage trucks would very likely damage
the surface which could lead to claims against those owning and /or
operating the vehicles. Also worth mentioning is the fact that there
is no assurance that the private drive would always be unobstructed.
It is the property owners right to use his own driveway which goes
without saying.
Next, current planning guidelines discourage dead -end streets but
recommend that when they are necessary, a cul -de -sac with a minimum
radius of 40 feet be provided. While we all realize that it is
impossible to increase existing cul -de -sacs to conform in all instances,
it does not seem reasonable to make existing facilities even less
conforming. Guidelines are formulated by professionals who consider
the health and welfare of the public and the adjacent property owners
as well as the resulting effect on property values. This brings forth
another consideration.

There are 10 dwellings served by this dead -end portion of Banyan
Road and there is a nearly right -angle turn at approximately the
half way point in the road. To restrict turning at the end of the
street would have an impact on all of those residences since those
providing services or making deliveries to all of them should have
the benefit of a safe turning area on public property and not be
required to endanger the safety of others, or themselves, by being
forced to back out of the dead -end street with a right - angle, blind
turn or having to use the private property of others to turn on.
While I was at the site, the garbage truck was servicing the street
and had to back all of the way to the right -angle turn, at which point
the vehicle backed into a private driveway in order to be in a position
to move out of the street in a forward motion. Also while at the site
I observed vehicles are permitted to park at the edge of the pavement
in the existing cul -de -sac which tends to narrow the turning radius.
My recommendation is that the Town not permit any further infringement
of the right -of -way and that the existing encroachment of plantings
on the east side be removed (with the exception of the Banyan Tree).
This would enlarge the area to near it's original size and somewhat
compensate for space utilized by vehicles that may be parked along
the edge of the pavement.
