Approval of Minutes: February 1, 1984 Others Present: The minutes were unanimously approved as submitted. 3. GWYNN Deputy Town Clerk BARBARA GWYNN Chief of Police JAMES GREER Gene Caputo, Assn't Town Mgr Barbara Gwynn, Town Clerk A request by Digby Bridges, agent for Gordon Ripma, for a variance to Section VII, K.I. of the zoning ordinance reducing side yard setbacks from 15 feet to 10 feet on property described by metes and bounds and located at 4225 County Road. Mr. Mayer read the specific sections of the zoning ordinance which applied to this request. Be also stated that action was postponed from last month's meeting pending receipt of an opinion from the Town Attorney. Mr. Caputo read the attorney's letter and explained the various points of issue. Considerable opposition was received from surrounding property owners. The Board determined that the applicant had failed to demonstrate a justifiable hardship and felt that the request should be denied. After further discussion, Mr. Boucher moved that the Board should recommend to the Town Commission, sitting at the Board of Adjustment, that the request for variance be denied. Seconded by Mr. Eaton and passed by the Board with Mr. Stahl abstaining. 4. P.B. # 84 -3 A request by Barry Eavenson for review of landscape plans and discussion of certificate of occupancy issuance for property described as lot 64 Place Au Soleil. Planning and Zoning Board Minutes, March 7, 1984 Page 2 After a brief presentation and discussion, the Board unanimously approved the landscape plan along with the issuance of a temporary certificate of occupancy. 5. P.B. # 84 -4 A request by Anthony Pugliese for location of a spa on property des- cribed by metes and bounds and located at 1511 No. Ocean Blvd. (Former Kenneth Allen residence). This item was postponed due to the absence of the applicant or agent to present the proposed plans. 6. P.B. # 84 -5 A request by George Patterson for site plan review on property described as lots 29 & 30 Gulf Stream Properties and located at 3268 No. Ocean Blvd. Because the applicant /agent was absent and no plans were submitted prior to the meeting, this request was also postponed. Mr. Brandt arrived at this time. 7. P.B. # 84 -6 A request by Tan Brandt, agent for George Von Esson for review of land- scape plans on property described as the N. 100 Ft. of S.E. a of Section 4 TWP 465. R 43 E, and generally located adjacent to and north of Place Au Soleil. Mr. Brandt stepped down from the Board so as to present the request. After a brief presentation and discussion, the Board unanimously approved the landscape plan as submitted. Mr. Brandt resumed his seat on the Board. 8. Board Members Comments. None. 9.
