Dear Mr. Thatcher: As per your request, this letter is being provided certifying that the additional auxiliary drainage system which has been installed for the new two story classroom addition to the site has been correctly installed per the drawings for Gulf Stream School at 3600 Gulf Stream Road in Gulf Stream, FL. Some minor changes were implemented to plan due to a review of the site during construction. Thev are as follows: 1) A duka -drain has been added between the existing covered walkway and the new building walkway at the bottom of the open stairs along the south side of the building due to rainwater flowing inwards towards this area. This drain has been connected to the leader on the south side of the building. 2) A ground inlet has been installed within the grass area just west of the new building in the north courtyard area. This inlet has been connected to the leader on the north side of the building. If you have any questions regarding this letter or require further assistance, please feel free to contact us. It is additionally affirmed that the Premises will not be used for any activity other than for School and community events involving the residents of Gulf Stream, Florida, the students attending the Gulf Stream School, and the families and friends of those students_ NOW, THEREFORE, in consideration of the foregoing and the mutual agreement of the parties, the Developer's Agreement is hereby amended as follows. 1. Paragraph 3: Site Building Envelope is deleted in its entirety and replaced with the following: "3. Site Building Envelope. Exhibit J reflects broken lines around the proposed one (1) story field house, the existing one (1) story chapel and the existing educational facility (Envelope 1). No buildings shall be erected or expanded outside of this Envelope. Site Building Envelope calculations for the existing building footprint area and for the total building footprint area (now construction included) are reflected for Envelope i on Exhibit J. In order to eliminate the need for the School to seek a variance from the Town each time construction (in addition to the fieldhouse and auditorium renovations) is desired in Envelope 1, the parties agree that a variance will not be necessary for such construction provided that the Total Building Area in Envelope t is not increased by more than 10,000 square feet over that on Exhibits B and )- The parties agree that the only variances from which School is being given relief pursuant to this Agreement are those variances concerning: a) setback or locational requirements, b) the size of structures, and c) the expansion of a nonconforming use or the addition of a building which does not replace or substitute an existing structure_ Moreover, the School must comply with the architectural and site plan review processes and other requirements of the Town prevailing at the time of the expansion proposal. Additionally, Envelope 1 contains an inner envelope, identified as Envelope I(A), to depict a possible future second story area. it is agreed that Envelope 1(A) shall not utilize more than 6,000 square feet of the permitted 10,000 square feet for the second story. The parties agree that neither the fieldhouse and/or auditorium renovations shall be constructed, nor shall any other buildings be erected or expanded within the Envelope, unless all of those site improvements described in Exhibits B through G, inclusive, and Exhibit I ( "Site Improvements ") of this Agreement are completed before or simultaneously with said construction. Provided, however, and notwithstanding anything contained in this Agreement to the contrary, the Town agrees that the School may add up to 400 square feet of the permitted 10,000 square feet prior to the construction of the Site Improvements without the requirement of one square foot removed per square foot added being enforced. Furthermore, nothing in this Agreement shall preclude the erection of new buildings or additions within the Envelope prior to the construction or completion of the fieldhouse and/or auditorium renovations if the Site Improvements are completed before or simultaneously with said erections or additions. Part V. Optional Information Gulf Stream School has, for the last 63 years, held true to the mission of its founders — to meet the intellectual, academic, creative and physical needs of our students. Our 1991 Long Range Plan indicated that increased emphasis be placed in the areas of computers, creative arts, physical education and endowment, not a larger enrollment.. Thanks to the Gulf Stream Commissioners, Developer's Agreement and incredible support by parents, friends, alumni and community, GSS successfully — and conservatively — raised all of the money needed to construct the Field House and computer facility — and we increased endowment. We did not increase enrollment, but rather, enhanced the students' offerings. In a survey conducted in 1996, it became clear that the remaining areas of improvement needed centered almost unanimously around fine arts - specifically art and music. We believe that in this age of technology and increasingly more creative avenues in education, the fine arts and media will benefit from a larger area in which to excel. Additionally, smaller class sizes were desired by all constituencies, not to allow a larger student body, but to accommodate smaller sections within specific courses, for example, math and foreign languages. To accomplish this, a second story plan for the Bernet Library has been proposed, with an adjacent 2 story, unobtrusive classroom structure, allowing flexibility within its layout for subdivided rooms. We propose to add a comprehensive space allowing flexible art room space, media, photography, sculpture, drawing, printing, etc.. We will also renovate the existing Souder Art and Music Building to house an expanded and enhanced music department Gulf Stream School's enrollment will never exceed 250, including seasonal students, we will never go beyond grade 9, we will never go beyond the existing footprint known as envelope 1, the number of allowable events will not be exceeded, the style and color of the buildings will always conform to generally accepted codes as set forth by the Town at the time of the request, and we will maintain a drainage system whereby at least the first one inch of rainfall will be retained on site. We are requesting a permanent amendment to the Developer's Agreement, which currently requires the demolition of covered walkways for each additional square foot over 400. Amending the Developer's Agreement now will ease the process for generations to come. Again, always keeping in mind our role in the community and maintaining Planning and Zoning compliance, we request an amendment to the section which requires equal demolition of square footage for each square foot of new construction_ We would like the ability to build out envelopes 1 and IA, already at approximately 95 % buildout, without removing equal numbers of square feet of existing classrooms or covered walkways. We are requesting flexibility so that future building will not require complex variances and future needs can be accommodated The current plans are totally witlun the allowances for second story building and are an implementation of the proposed amendment We have designed the solution specifically to place the least burden on the School and on the Town by not tearing the campus apart We feel strongly that taking down covered walkways will negatively impact the campus and affect the integrity of the architecture. We feel our plan represents a positive change to the School and to the community. The neighbors will have no imposing changes in their views from any direction. We will only make changes to our campus in keeping with the residential atmosphere of our community, always keeping in mind the needs of the students, our most important constituency. Students who add to the life of this town, students who increasingly come as residents of Gulf Stream- Nearly 50 students of our current enrollment of 238 live here, 21 %, up from 38 ten years ago, while our Boca enrollment has decreased to 53 from 67 ten years ago. Dear Ms. Scullen: On July 26th, 2004, an inspection was conducted at Gulf Stream School property at 3600 Gulf Stream Road in Gulf Stream, FL with yourself, Robert from Mouw and Associates and myself. Previously, Robert had brought to my attention that during times of heavy rainfall, the area adjacent to the walkway and the walkway itself tends to flood. Due to large area of coquino rock close to the surface in this area, the rainwater from the gutter and downspout system does not percolate. Additional, with the hard rock layer being located just below the surface, installation of a rainwater leader system would be quite expensive. In an attempt to solve this situation, the following action should be taken. At the north end of the walkway, the existing gutter system should be connected to the new downspout which is located where the existing walkway abuts the new building. The existing downspout located just south of this corner should be eliminated and the gutter repaired as required to prevent further rainwater flow from the roof hitting the ground. Additionally, at the next south downspout, a piece of flexible PVC piping should be installed from the existing downspout to the existing grade drain located just below the end of the outlet for this downspout. In the future, if this problem of flooding still exists during heavy rainfalls, it is being recommended that the roof surface over the walkway be built -up and channeled towards the south end of the building. An existing gutter and downspout system exists at this end of the building which will allow the rainwater to be transfer to the south parking lot area. SCe NUT TING ENGINEERS OF FLORIDA, INC. ESTABLISHED 1967 August 13, 2004 Mr. Robert Poiroier Mouw Associates, Inc. PO Box 2690 Delray Beach, Florida 33447 Phone: 561-276-9640 Fax: 561-265-3886 Subject: Gulfstream School Grass Field Parking Gulfstream, Florida Dear Mr. Poirier: Geotechnical & Construction Materials Engineering & Testing - Inspection Environmental Services Offices throughout the state of Florida www.nuffingengineers.com - info@ nuttingengineers.com This letter is in response to your request that we evaluate the existing grass field which covers an area of approximately one acre on the east side of the school property for use as occasional overflow parking during large school events. In order to evaluate the potential for parking, we collected a sample of the soil just beneath the grass /topsoil layer and returned the sample to our laboratory for Proctor testing using the American Association of State Highway Officials (AASHTO) method T180 for maximum dry density. In addition, the undersigned traveled to the site and performed soil probes at several locations, and drove over the field using a Ford Explorer after the area experienced several days of rain. Nutting Engineers of Florida, Inc. has also performed geotechnical explorations for the school buildings immediately west of the grass field and this information was also used in our analyses. The results of the laboratory testing revealed the soil beneath the grass has a maximum dry density of approximately 116 pounds per cubic foot and consisted of tan to brown fine sand with little to some limestone fragments. The results of the soil probes indicate the near surface soils are dense to very dense within the upper two feet, the maximum depth explored. The field was observed to be well drained and relatively dry even after several daily rain events, including rain during the site visit on the morning of August 10, 2004. Traveling over the field using a Ford Explorer, which we anticipate will be similar to that used during the occasional parking, did not result in rutting of the grass or other indications that unsuitable conditions exist for use as parking. 1310 NEPTUNE DRIVE • BOYNTON BEACH, FLORIDA 33426 - (561) 736 -4900 - Fax (561) 737 -9975 Broward (954) 941 -8700 - Hillsborough (813) 866 -8800 - Miami -Dade (305) 824 -0060 CONCLUSIONS Based on the above laboratory and field testing, field observations, and our knowledge of the soil conditions at this site, it is our professional opinion that the field is suitable for occasional use as parking during major school events. They are as follows: 1) A duka -drain has been added between the existing covered walkway and the new building walkway at the bottom of the open stairs along the south side of the building due to rainwater flowing inwards towards this area. SAbertE. NOW, THEREFORE, in consideration of the foregoing and the mutual agreement of the parties, the Developer's Agreement is hereby amended as follows. 1. Paragraph 3- Site Building Envelope is deleted in its entirety and replaced with the following: "3. Site Building Envelope. Exhibit J reflects broken lines around the proposed one (1) story field house, the existing one (1) story chapel and the existing educational facility (Envelope 1). No buildings shall be erected or expanded outside of this Envelope. Site Building Envelope calculations for the existing building footprint area and for the total building footprint area (now construction included) are reflected for Envelope 1 on Exhibit J. In order to eliminate the need for the School to seek a variance from the Town each time construction (in addition to the fieldhouse and auditorium renovations) is desired in Envelope 1, the parties agree that a variance will not be necessary for such construction provided that the Total Building Area in Envelope 1 is not increased by more than 10,000 square feet over that on Exhibits B and j. The parties agree that the only variances from which School is being given relief pursuant to this Agreement are those variances concerning: a) setback or locational requirements, b) the size of structures, and c) the expansion of a nonconforming use or the addition of a building which does not replace or substitute an existing structure. Moreover, the School must comply with the architectural and site plan review processes and other requirements of the Town prevailing at the time of the expansion proposal. Additionally, Envelope 1 contains an inner envelope, identified as Envelope I(A), to depict a possible future second story area. it is agreed that Envelope 1(A) shall not utilize more than 6,000 square feet of the permitted 10,000 square feet for the second story. In the event a second story is added, it shall not be closer to any lot line than one - hundred twenty (120) feet. The parties agree that neither the fieldhouse and/or auditorium renovations shall be constructed, nor shalt any other buildings be erected or expanded within the Envelope, unless all of those site improvements described in Exhibits B through G, inclusive, and Exhibit I ( "Site Improvements ") of this Agreement are completed before or simultaneously with said construction. Provided, however, and notwithstanding anything contained in this Agreement to the contrary, the Town agrees that the School may add up to 400 square feet of the permitted 10,000 square feet prior to the construction of the Site Improvements without the requirement of one square foot removed per square foot added being enforced. Furthermore, nothing in this Agreement shalt preclude the erection of new buildings or additions within the Envelope prior to the construction or completion of the fieldhouse and/or auditorium renovations if the Site Improvements are completed before or simultaneously with said erections or additions. Finally, the parties agree that the Traffic Control Plan described in Exhibit G shall not go into effect until the Site Improvements are completed. THE TOWN OF GULF STREAM, FLORIDA: By: William F. Iii a survey conducted in 1996, it became clear that the remaining areas of improvement needed centered almost unanimously around fine arts - specifically art and music. We propose to add a comprehensive space allowing flexible art room space, media, photography, sculpture, drawing printing, etc.. We are requesting flexibility so that future building will not require complex variances and future needs can be accommodated- The current plans are totally within the allowances for second story building and are an implementation of the proposed amendment We have designed the solution specifically to place the least burden on the School and on the Town by not tearing the campus apart We feel strongly that taking down covered walkways will negatively impact the campus and affect the integrity of the architecture. We feel our plan represents a positive change to the School and to the community. The neighbors will have no imposing changes in their views from any direction We will only make changes to our campus in keeping with the residential atmosphere of our community, always keeping in mind the needs of the students, our most important constituency. Students who add to the life of this town, students who increasingly come as residents of Gulf Stream_ Nearly 50 students of our current enrollment of 238 live here, 21 %, up from 38 ten years ago, while our Boca enrollment has decreased to 53 from 67 ten years ago. 1310 NEPTUNE DRIVE • BOYNTON BEACH, FLORIDA 33426 • (561) 736 -4900 • Fax (561) 737 -9975 Broward (954) 941 -8700 • Hillsborough (813) 866 -8800 • Miami -Dade (305) 824 -0060 CONCLUSIONS Based on the above laboratory and field testing, field observations, and our knowledge of the soil conditions at this site, it is our professional opinion that the field is suitable for occasional use as parking during major school events. They are as follows: 1) A duka -drain has been added between the existing covered walkway and the new building walkway at the bottom of the open stairs along the south side of the building due to rainwater flowing inwards towards this area.
