CITY OF TEMPLE CITY
COUNCIL MINUTES
OCTOBER 2, 1973
INITIATION:
1. Mayor Tyrell called the regular meeting of the City Council to
order at 7:35 p.m. on Tuesday, October 2, 1973, in the Council
Chamber of the City Hall.
2. The invocation was given by Father George Breslin, St. Luke's
Catholic Church, 9451 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell.
4. ROLL CALL:
Present: Councilmen - Briggs, Dennis, Gilbertson, Merritt,
Tyrell
Absent: Councilmen -None
Also Present: Assistant to the City Manager Biel, City
Attorney Martin, Planning Director Dragicevich,
Parks and Recreation Director Kobett
5. APPROVAL OF MINUTES:
Councilman Merritt moved to approve the minutes of the regular
meeting of the City Council held on Tuesday, September 18,1973,
as written, seconded by Councilman Gilbertson and carried,
Councilman Briggs abstaining.
Junior Girl Scout Troop No. 443 was given recognition by Mayor Tyrell
who presented a special certificate to the group. Mimi Segal gave
a short history of the troop consisting of fourth, fifth and sixth
grade girls and their activities, such as camping, earning badges,
and money making projects in calendar and cookie sales. Mimi intro-
duced the girls . in the troop and their leader, Mrs. Lorraine Magner.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 73 -377 - 2nd read. Re: Amend Ordinance to include
living quarters as auxiliary use to mortuaries with conditional
use permit approval.
City Attorney Martin presented Ordinance No. 73 -377, AN ORDINANCE
OF THE CITY OF TEMPLE CITY ADDING NEW PARAGRAPH 23A TO SECTION
9202 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO CONDITIONAL
USES for second reading. Councilman Gilbertson moved to waive
further reading and adopt, seconded by Councilman Merritt and
carried,
7. ORDINANCE NO. 73 -378 - 2nd read. Amend Ordinance imposing a
Sales and Use Tax.
City Attorney Martin presented Ordinance No. 73 -378, AN ORDINANCE
IMPOSING A SALES AND USE TAX TO BE ADMINISTERED BY THE STATE
BOARD OF EQUALIZATION AND PROVIDING PENALTIES FOR VIOLATIONS
for second reading. Councilman Merritt moved to waive further
reading and adopt with a finding that the revenues are needed
for the ordinary and necessary revenues of the City and thus
the Ordinance would become effective immediately, seconded by
Councilman Dennis and carried.
8. EMERGENCY EMPLOYMENT ACT - Section 9, Phase Out Agreement
Assistant to the City Manager Biel presented background material
stating that the Public Employment Program will terminate as of
Council Minutes, October 2, 1973 - Page 2
June 30, 1974 and that all participating jurisdictions are,
therefore, required to phase PEP employees out prior to the
end of the fiscal year, 1974; that staff had drafted and
submitted a phase out plan to County Manpower; that upon
termination of PEP, the City will have received $28,400 under
Section 9.
Councilman Gilbertson moved to approve the agreement and
authorize Mayor and City Clerk to sign, seconded by Councilman
Briggs and carried.
NEW BUSINESS:
9. SET PUBLIC HEARING: Appeal from Planning Commission Denial of
Conditional Use Permit 73 -402, 9415 Las Tunas Drive
Assistant to the City Manager Biel presented background material,
stating the Planning Commission held public hearing at their
regular meeting of September 11, 1973, and denied the conditional
use permit to establish and operate a fun arcade, which is a
commercial recreational use, because of lack of adequate parking
and the use would have a detrimental effect on the surrounding
properties.
Councilman Briggs moved to set public hearing, seconded by
Councilman Merritt.
In response to question by Councilman Gilbertson concerning
whether it is necessary to go through the process of a public
hearing or a decision can be made on the record, City Attorney
Martin advised that the matter may be decided on the record
only if the Councilmen certified they were completely familiar
with the record.
Following brief discussion, Councilmen Briggs and Merritt
withdrew their motion and second. Councilman Briggs moved to
continue the matter until October 16, 1973 and advise the
applicant the matter will be heard on the record, seconded by
Councilman Dennis and carried.
10. RESOLUTION NO. 73 -1307: Employment of Personnel
Assistant to the City Manager Biel presented Resolution
No. 73 -1307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY APPOINTING PERSONNEL. Councilman Gilbertson moved
to adopt, seconded by Councilman Dennis and carried.
11. RESOLUTION NO. 73 -1308: WARRANTS,& DEMANDS, Demand Nos. 8636
through 8725, in the amount of $70,888.69.
Assistant to the City Manager Biel presented Resolution
No. 73 -1308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $70,888.69,
DEMAND NOS. 8636 THRU 8725. Councilman Briggs moved to adopt,
seconded by Councilman Dennis and carried.
12, COMMUNICATIONS:

A. REQUEST FOR PROCLAMATION:
Assistant to the City Manager Biel presented letter from West
San Gabriel Valley Mayor's Committee for Employment of the
Handicapped, requesting proclamation. Council supported the
Mayor proclaiming the first full week of October, 1973 as
NATIONAL EMPLOY THE HANDICAPPED WEEK.

B. CHAMBER OF COMMERCE - Request to conduct Safety Town,
October 6, 1973.
Assistant to the City Manager Biel presented a letter of request
from the Chamber of Commerce to conduct Safety Town, October 6,
in the northerly half of the parking lot south of Las Tunas Drive.
On motion by Councilman Briggs, seconded by Councilman Gilbertson,
Council approved request of the Chamber of Commerce to conduct
a Safety Town Program in the northerly half of the parking lot
south of Las Tunas Drive at Temple City Boulevard, Saturday,
October 6, 1973, 8:00 a.m. to 6:00 p.m.
13. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
None came forward.
14. MATTERS FROM CITY OFFICIALS:
A. Personnel - Secretary Position, Amend Salary Schedule
Assistant to the City Manager Biel advised Council that pursuant
to discussion held at City Council Study Session held on
September 18, 1973, this matter was being brought back for final
approval.
Councilman Briggs moved to approve amending the adopted salary
schedule and pay plan for the position of Secretary to Range 43,
$655 -809, seconded by Councilman Merritt and carried.
B. City Hall Modifications
Assistant to the City Manager Biel advised Council that pursuant
to discussion held at City Council Study Session held on
September 18, 1973, the matter was being brought back for approval
together with agreement for architectural services.
Councilman Gilbertson moved to approve the modification and
amend the budget accordingly, and to authorize the Mayor and
City Clerk to sign agreement for architectural services, to be
brought back to Council for final approval after completion of
the work by the architect, seconded by Councilman Dennis and
carried.
C. Councilman Gilbertson called Council's attention to a
communication from the City Attorney concerning Proposition #1
tax initiative on the November 6, 1973 ballot, in response to
his request for information. Councilman Gilbertson felt the
Council should support Proposition #1.
Following brief discussion, at which time Councilman Dennis
stated he agreed with the concept, but without more under-
standing of the document he would have to abstain, Councilman
Gilbertson moved to write a letter to Governor Reagan and the
City's legislative representatives supporting Proposition #1,
seconded by Councilman Briggs and carried on a roll call vote:

Following the vote of the Council, Penny Graham, President of
Chamber of Commerce, spoke to the matter, advising the Chamber
Legislative Committee had studied the Proposition, had agreed

to support the Proposition; that letters' were prepared to their
legislative representatives and were awaiting action of the
Chamber Board of Directors. Mrs. Graham also advised that at
their October Membership Meeting to be held October 10, Los
Angeles County Supervisor James Hayes would present the pros
and cons of the Proposition and invited Council's attendance.
D. Councilman Dennis referred Council's attention to the fact
that a misunderstanding apparently exists with the Parks and
Recreation Commission as to their role in the development of
Live Oak Park. It is the feeling of some of the Commissioners
that the line drawings being prepared by staff will be submitted
to Council without being reviewed by the Parks and Recreation
Commission. Staff was instructed to communicate with the
Commission, advising them that the line drawings will be sub-
mitted to them for their recommendations as to the location
and activities with the line drawings.
E. Councilman Merritt expressed a desire to hold a personnel
session prior to the regular meeting of October 16, 1973 to
appoint commissioners to the vacancies on the Parking and
Traffic Commissions.
F. Mayor Tyrell advised Council the City had received a
communication advising the Governor had signed AB 2059 into
law which will require county to account for overhead charges
which have little to do with direct cost of contract services.
Mayor Tyrell called Council's attention to a reception being
given by the American Field Service to honor Pepe Correa of
Quito, Equador, Sunday, October 7, 3:00 -5 :00 p.m.
Mayor Tyrell also advised Council of dedication ceremonies of
the Pasadena Center, 11:00 a.m. and luncheon at 12:30 p.m.
October 15, 1973.
Mayor Tyrell advised of the receipt of an invitation to the
first annual Mayor's Leadership Prayer Breakfast to be held
at the Pasadena Center, October 18, 1973, 7:30 a.m.
Mayor Tyrell called Council's attention to a communication
received from Congressman Rousellot concerning a Re- Employment
Action Committee designed to combat unemployment. Mayor Tyrell
will respond to the letter.
Mayor Tyrell presented each Councilman with a list of confirmed
participants to the Community Seminar on October 13, and
requested they review the list and make personal contact with
their nominees who have not as yet confirmed prior to Friday,
October 5.
G. Councilman Gilbertson called Council's attention to the
meeting of the Downtown Revitalization Committee to be held
at the Chamber of Commerce, 06tober 3, 1973, 8:00 a.m.
15. ADJOURNMENT:
On motion of Councilman Briggs, seconded by Councilman Merritt,
the Council adjourned at 8:10 p.m. to the next regular meeting
of the City Council to be held on Tuesday, October 16, 1973,
7:30 p.m. in the Council Chamber of the City Hall.
