RESOLUTION NO. 95 -3443
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY RESCINDING RESOLUTION NO. 95 -3435 AND
REESTABLISHING THE SPECIAL PROVISIONS AND SERVICE FEES
FOR THE RELEASE OF IMPOUNDED AND /OR STORED VEHICLES
WHEREAS, the Los Angeles County Sheriff's Department impounds and stores vehicles from
within the incorporated area of the City of Temple City; and
WHEREAS, all costs related to the impounding of said vehicles is incurred by the City and paid
for through the existing law enforcement contract services; and
WHEREAS, the City Council on the 5th day of July 1995 adopted Resolution No. 95 -3435
increasing the existing vehicle impound cost recovery fee; and
WHEREAS, the City has established a method for determining the reasonable cost associated
with impounding vehicles, which does not exceed the estimated cost for providing such services; and
WHEREAS, the vehicle impound cost recovery fee is adjusted annually in accordance with the
established method for estimating the cost for providing vehicle impound services;
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. The existing vehicle impound cost recovery fee shall be increased from $65.00 to
$66.00 effective July 6, 1995.
SECTION 2. The fee shall be applicable to the release of all vehicles impounded within the
incorporated area of the City of Temple City under the following conditions:
a. Abandoned vehicles
b. Hazardous vehicles
c. Unregistered vehicles
d. Vehicles operated by unlicensed drivers
e. Vehicles being operated by a driver whose driver's license is suspended
f. Vehicles with five or more outstanding parking violation citations
g. Vehicles obstructing public right -of -way or access to private property
h. Subsequent to the operator's arrest, when the vehicle cannot be safety secured.
i. Negligent or illegal operation resulting in impounding or storage (excluding evidence).
SECTION 3. The Sheriff's Department shall be responsible for all vehicle impound reports,
release forms, fee collections, and receipts. Fees shall be collected prior to the release of any vehicle
subject to the service charge, and the Sheriff's Department shall remit all monies collected to the City's
Finance Department on a weekly basis.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution.
