ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS
AND TO ESTABLISH A CAP BANK
fN.J.S.A. 40A: J,-45.14)
VfHEREAS,the-Local Government Cap Law, NJ.S.A. 40A: 4-45.1 et seq. provides
that in the preparation of its annual budget, a municipality shall limit any increase in
said budget to 2.5% unless authorized by ordinance to increase it, to 3.5% over the
previous year's [mal appr.òpriatioils, subject tO,certain exceptions;. and
WIIEREAS,NJ.S.A. 40A: 4-45.15a provides tbat a municipality may, when
authorized by ordinance, appropriate the difference between the amount of its actual
final appropriation and the 3.5% percentage rate as an exception to its final
appropriations in either of the two succeeding years; and
\VHEREAS, the Mayor and Council of the Borough of Carteret in the County of
Middlesex finds it advisable and necessary to increase its CY 2006 budget by up to
3.5% ovÚ the previous ýear's [mar appropriations, in th~ interest of promoting the
health, safe~y .and welfare of the citizet1S; and
\VI-IEREAS, theMayor and Borough Council hereby dctem1illes that a 3.5% increase
in the budget for said year, amounting to $176,396.90 in excess of the increase in final
appropriations othclwise pemlitted by the Local Govemment Cap Law, is advisable
and necessary.
\VHEREAS, the Mayor and Borough Council hereby detem1ines that any amount
authorized þerein above that is. not appropriated as part of the final budget shall be
retained as an exceptiori to the final appropriations in either of the next two succteding
years.
NOvV THEREFORE BE IT ORDINANED, by the Mayor and BoroughCoul1cil of
the Borough of Caiteret, in the County of Middlesex a majority of the full authorÍzed
membership.. of tIlls governing body affinnatively concurring that" in. tþe CY 2006
budget year, the fÎ.nal appropriations of the Borough of Carteret shall, in accordance
with nus ordinance and NJ.S.A. 40 A: 4-45.14, be increased by 3.5% amounting to
$617,389.15 and that the CY 2006 mU11icipal budget for the Borough of Carieret be
approved and adopted in accordance with this ordinance;' and,
BE IT FURTHER ORDAINED, that any amount authorized 'hereinabove that is not
appropriated as part of the final budget shall be retained as an exception to final

WHEREAS, the Local Government ap aw. .J.SA

by ordinance to increase it to 3.5% over the previ-
ous year's final appropriations, subject to certain
exceptions, and
WHEREAS. N.J,SA. 40A: 4-45.15a provides that a
municipality may. when authorized by ordinance
appropriate the difference between the amount of
its actual final appropriation and the 3.5% percent-
age rate as an exception to its final appropriations
in either of the two succeeding years; and
WHEREAS, the Mayor and Council of the Borough
of Carteret in the County of Middlesex finds it
advisable and necessary to increase its CY 2006
budget by up to 3.5% over the previous year's final
appropriations. in the interest of promoting the
health, safety and welfare of the citIzens; and
WHEREAS, the Mayor and Borough Council hereby
determines that a 3.5% increase In the budget for
said year amounting to $176.396.90 in excess of
the increase In final appropriations otherwise per-
mitted by the Local Government Cap Law. is advis-
able and necessary
WHEREAS, the Mayor and Borough Council hereby
determines that any amount authorized herein

and N.J.S.A. 40A:4-45.14, be increased by 3.5%

municipal budget for the Borough of Carteret be
approved and adopted in accordance with this
ordinance: and,
BE IT FURTHER ORDAINED, that any amount au-
thorized hereinabove that is not appropriated as
part of the '-'nal budget shall be retained as an
exception to fmal appropriation in either of the next

this ordinance as introduced be filed with the
Director of the Division of Local Government Ser-

The foregoing ordinance was introduced at a meet-
Ing of the Council of the Borough of Carteret held
February 9. 2006 when it was adopted on First
Reading. The said ordinance will be further consid-
ered on Second Reading for final adoption at a
meeting of said Council of the Borough of Carteret
on March 2, 2006 at approximately 6:30 P.M.,
Municipal Court/Police Facility, 230 Roosevelt Ave-
nue, Carteret. New Jersey at which time and place
an persons interested will be given an opportunity
to be heard.
