Upon a motion by Mr. Boucher and second by Mr. Stahl, the minutes were
unanimously approved.

A request by Mr. Peter Rummell for variance to Section X.I.l.e. of the
Town Zoning Ordinance for the reduction of a rear yard setback from 15.0 feet
to 9.0 feet for the construction of a pool at an existing residence at 3311
North Ocean Blvd.
Mr. Caputo stated that surrounding property owners had not been properly
notified. Therefore, any action would be subject to the property owners having
no objection to the request.
Following a brief discussion, it was the consensus of the Board to instruct
staff to notify surrounding property owners of the request stating that any
objections should be received prior to August 31, 1985. If no objections are
received, then the action of the Board would stand.
Upon a motion by Mr. Stahl and second by Mr. Boucher, the Board unanimously
recommended approval to the Board of Adjustment subject to the notification of
surrounding property owners.
4. P.B. 1185 -7.
A request by John Conway, agent for W.D. Adams, for site plan review for a new
/ single family residence on property described as Lot 5, H.V. Pope subdivision
and located on Old School Road.

Mr. Caputo stated that the site plan as submitted does not comply with setback
requirements of the zoning ordinance.
Both Mr. Conway and Mr. Adams stated that they would meet all requirements of the
ordinance and would submit a revised site plan prior to presentation of the request
to the Town Commission.
Mr. Caputo also stated that the drainage plan as shown on the site plan does not
indicate proper on —site retention of storm water.
The applicant stated that prior to submittal of application for building permit,
he would meet with the Town Engineer and obtain his written approval on the drainage
plan for the site.
Upon a motion by Mr. Boucher and second by Mr. Stahl, the Board unanimously recommended
approval of the site plan to the Town Commission subject to the applicant meeting
all zoning and drainage regulations of the Town.
