The Alpine Village Company is requesting to delete Article V from the First Amended Development Agreement to relieve the Company from any further obligation to construct carports and storage facility due to financial reasons. The storage facility was a condition of approval to ensure toys, bikes, and other personal property is stored in a contained area. Attached is the request letter, the original and First Amended Development Agreement. Approval of the Planning and Zoning Commission to amend a development agreement is not required; however, City Council approval shall be required to enter into all development agreements. (Ord. 822, 2-23-2006, eff. 3- 16-2006.) The complete land use file is not attached but is available for public review during normal working hours in the Community Development Department located at the McCall City Hall, 216 East Park Street, McCall, Idaho 83638. RECOMMENDED ACTION: Consider the request to the 2nd Amendment to the Development Agreement for The Timber (SUB-06-08) and take one of the following actions as appropriate: 1. Approve the request to modify the development agreement and delete Article V from the First Amended Development Agreement and authorize the mayor to sign. 2. Eliminate the requirement for carports but keep the condition to provide the storage facility. 3. Deny the request to modify the development agreement. RECORD OF COUNCIL ACTION Meeting Date ACTION
