PRESENT: LENNY LEUER, BRUCE WORKMAN, JERRY BROST, ELIZABETH
WEIR, TOM SUPEL AND DICK PICARD. ALSO PRESENT: PLANNING
AND ZONING ADMINISTRATOR LOREN KOHNEN, CLERK -
ADMINISTRATOR PAUL ROBINSON, PLANNING CONSULTANT BILL
THIBAULT, PLANNING INTERN TODD LARSON AND PLANNING AND
ZONING ASSISTANT SANDIE LARSON.
ABSENT: SUSIE MACKAY
Chairperson Lenny Leuer called the meeting to order at 7:33 p.m.
1. DERRICK WETTERSTROM/SCHUTROP HOMES - 1495 MEDINA ROAD -
LOT COMBINATION/PLAT OF 3 LOTS TO 1 LOT - PUBLIC HEARING - 7:34
P.M.
Loren Kohnen read his memo to the planning commission and put up an overhead of
the site. He explained the location of the new driveway which had been approved by
the public works director and also noted that it had a better sight line than the current
driveway.
Jim Scherer, 1552 County Road 24, asked where the location of the new home would
be and Loren pointed it out on the overhead.
Tom Supel said that this was a non -conforming lot, that it is not even close and he
wondered what he was missing.
L. Kohnen said that we always like homeowners to combine lots instead of having
existing smaller lots.
T. Supel again said that we have a big chunk of land that is not even close to the 5
acres of good soils.
Paul Robinson said that in this case it is o.k. - that our ordinance says lots of record
when the 5 acres was enacted could be built on if two septic sites could be found even if
the lot is as small as 1 acre.
There was further discussion on why this would be allowed without variances.
Jerry Brost asked about perc tests and Loren explained.
Lenny Leuer asked about the existing well and existing septic sites.

Marty Schutrop, Schutrop Homes representing the property owner, said they will have a
new well for the new house, but would use the existing one for watering. The existing
septic site will be abandoned.
L. Leuer asked about the power line. Loren showed on the overhead where it was.
Lenny then asked where the new home would be placed and if we know the size of the
easement for the power line.
M. Schutrop said that the exact placement of the house was not known, but fairly close
to where they show on the survey. He explained that it was no closer to the front than
the existing house and the existing house was there when the power line went in.
L. Kohnen said he thought it was 80' and that the survey that they submit for the
building permit for the new house will show it exactly.
L. Leuer said he wanted to make sure that the applicant knew that no variances would
be granted to be into the power line easement area.
M. Schutrop said that their surveyor, DeMars-Gabriel, determined that the easement
was 60' and Mr. Reiser (former owner) also said it was 60' and also said that they were
not going any further forward than the existing house.
L. Leuer asked about the property line easements.
L. Kohnen said that he had talked to the city engineer Tom Kellogg. We will have our
typical 5' easement around all property lines, 10' on the front plus more for the
wetlands. This will all be put on the final plat before final approval..
L. Leuer asked about the right-of-way for Medina Road.
L. Kohnen said this was taken care of when we paved Medina Road.
L. Leuer asked of the old driveway will be abandoned and Loren said yes and there will
be landscaping put in. Lenny then asked about the 12x20 shed that was on the
property.
M. Schutrop said it will stay while they are building and then it will come down.
T. Supel asked if there was a question if Medina Road right-of-way was indeed there,
would it be resolved before final plat approval and he was told yes.
MOVED BY ELIZABETH WEIR AND SECONDED BY JERRY BROST TO
RECOMMEND APPROVAL OF THE 3 LOTS BEING PLATTED INTO 1 LOT WITH
THE FOLLOWING CONDITIONS:
1. Power line easement defined before final plat approval

2. All drainage, utility and wetland easements to be defined before final plat approval.
3. New driveway access per city staff.
4. Existing septic site to be abandoned per PCA regulations.
5. Recognize the existing well and when and if abandoned, to be done according to
health department regulations.
6. Recognize that these are existing lots of record and according to 826.25, Subd. 3,
this new lot conforms to the regulations.
MOTION PASSED.
2. DISCUSSION OF BUSINESS PARK (UC1) AND URBAN COMMERCIAL (UC)
ORDINANCES
INITIAL DISCUSSION:
The discussion started with Todd's memo
Todd Larson explained his research - he said he dealt with Urban Commercial - he
contacted businesses that were currently in operation and then complied a table - his
table showed the general use, the specific use and potential narrow and broad
categories.
Lenny Leuer talked about outside storage and the table on page 5 - he said isn't this
getting a bit beyond this commission- -
Paul Robinson said that this is just an inventory - he said if there are a lot of infractions
maybe the city would reconsider their policy.
T. Larson did say that he go around with Loren Kohnen and they took pictures of
outside storage - he put up an overhead and highlighted some examples of outside
storage. He said one question is, is it practical to say no to outside storage - one
possible remedy would be to allow a small fenced (privacy) area - it would make things
look better but not ideal.
L. Leuer said there are 5 places in Todd's memo to consider for discussion one being
broad vs narrow categories.
P. Robinson said he had given a list to the CPIC committee on why to be broad or just
exact uses that we would want. He said Todd's list on page 1 & 2 are categories to add
to what we have to include businesses that we have - if we stick with the narrow
definitions we will have to add Todd's list to the ordinance text.
Bill Thibault said this information is useful to see what we have and broad vs narrow -
he said it would be a simpler ordinance with the broad categories - narrow can be more
specific - he said he would caution the planning commission on some of the broad

categories - a safer way to list them is narrower - if a category is broader, you will not
know what might come in.
Elizabeth Weir asked Lenny if he was leaning toward the broader categories - she said
she knows we opted for the narrower, but it makes sense to add Todd's list of current
businesses that are in the city.
Tom Supel asked where the categories came from - he said we spent a lot of time at the
CPIC meetings using the NAIC codes.
L. Leuer said we do not want to make the existing businesses non -conforming.
T. Supel said we could have gone to the NAIC codes and have the existing businesses
fit - he suggests before going further the existing businesses should fit or we should
identify them to the coding system.
Jerry Brost said if we had more generic classifications we could make existing
businesses fit.
There was further discussion of narrow vs broad categories - poll of planning
commission members:
Bruce: narrow
Liz: narrow
Tom: narrow - this is what CPIC wanted - in favor of bringing existing
businesses in unless we want to exclude them
Jerry: broad - only for discussion
Further discussion - consensus - existing to be listed so they fit in
Discussion of banks - does this exclude check cashing services
Outside storage:
Bruce and Liz - why not as long as it is correctly shielded/screened
Further discussion
P. Robinson said we need a definition - whether to allow and how much.
L. Leuer said he is leaning toward allowing some.
P. Robinson read the existing ordinance regarding outside storage - this is in the
Performance Standards.
There was discussion of same or smaller parcels; outside storage - allow or not

The current UC ordinance allows 20% of building size in outside storage if the lot is 5
acres or more with it properly screened.
Staff to work on and make suggestion for outside storage - maybe outside storage with
a conditional use permit - next to the building and not out in the middle of the lot - similar
provision in UC and Business Park (UC1).
P. Robinson said he would be cautious in the Business Park district - there are more
restrictions in the BP and less restrictive in UC.
Bruce Workman said he is rethinking BP - shouldn't have any outside storage.
P. Robinson said Bill will come back with a definition of `good' and `bad' outside storage
and then rationale for a percentage - remember it has to be protected from residential
with some kind of screening.
BUSINESS PARK - 9:46 P.M.
Paul Robinson said there are some notes in here that he meant to delete - they were
notes to him.

Page 4 - Subd. 9 - Split into two sections
Page 5 - line 22streets shall conform to city engineering standards
Page 6 - (h) does the measuring of coniferous need to be added
Page 9 - (p) - needs to be modified; lines 41-42 - delete and the city's tax base
Page 10- the table should be after (r)
Page 11- (s) needs to be re -worded, driveways are 9 ton, parking areas 5 ton and
loading areas 9 ton - check with Jim and Tom Kellogg; section (t) - does this section
need to be re -located in the ordinance -
Page 12 and 13-(w) - will need to be re -done; entire (cc) section - delete and reference
PCA standards
Page 15- Site Analysis, Building Plan, Utilities and Signage - move to where it applies to
all uses; line 41 change to hazardous, materials and medical waste

URBAN COMMERCIAL - 11:07 P.M.
Page 1 - line 35 add not to exceed 10,000 square feet; to #14 add something like
general service or repair shops, tailoring, dry cleaining, etc.
Page 2 - line 12 add Electronic Shopping and Mail Order Houses exceeding 10,000
square feet
Page 3 - section 832.05 fix so it is like BP
Page 4 - line 15 check to see if 100 feet is correct; line 19 add Parking lot and also add
lot to line 21 after Parking
Page 5 - line 18 change to read restore natural vegetation along the creek - - - , Street
Trees section needs some language change, Tree Preservation section needs to be
changed to be like BP
Page 8 - line 14 - delete 100 percent
Page 10- (r) needs to be re -worked - check with Jim and Tom Kellogg; (s) line 14 -
check with Jim on the 150 feet, should it be 75 feet?
